Zoning Violation Enforcement
Short-Term Rental Ordinance (Chapter 5051)
Votes (2)
Zoning Violation Enforcement at 18505 Highway 65 Northeast
Dissent: None
City staff presented a history of non-compliance at 18505 Highway 65 Northeast since June 2026, including storing damaged vehicles, deteriorated signage, and improper hazardous waste disposal. The property's B3 zoning permits repair but not storage or dismantling. Enforcement letters and attempts to schedule meetings were unsuccessful, and the owner's attorney disputed the city's position. Staff requested council direction to escalate the matter to the city attorney for potential prosecution. Council members expressed frustration with the ongoing violations and the public nuisance aspect, particularly concerning hazardous waste and odors. There was discussion about the property owner's previous interactions with the city.
Short-Term Rental Ordinance (Chapter 5051) Review and Amendments
Dissent: None
The council reviewed the proposed short-term rental ordinance, which has undergone public hearings and planning commission review. Key distinctions were highlighted between administrative permits for standard rentals and interim use permits for higher-impact scenarios (e.g., more bedrooms, lakefront properties, multiple rentals in one neighborhood). Council members expressed strong concern over large event venues causing neighborhood disturbances and the need for stricter regulations. They discussed the current limitations on police enforcement and the desire for clear, 'black and white' rules to facilitate prosecution. Several amendments were proposed, including clarifying definitions (21-day vs. 30-day rental periods), ensuring enforcement relies on 'verified violations' rather than just 'repeated complaints,' addressing existing lawful short-term rentals, and requiring renters to sign an acknowledgment of city rules and consequences.
Notable Quotes (9)
At that address, city staff began addressing zoning and site compliance concerns at that address in June 2026 after observing numerous damaged, inoperable, inoperable, and partially dismantled vehicles stored outdoors along deteriorated signage.
For lack of a better word, the matter should be forwarded to the city attorney for review and potential direction about appropriate next steps.
I'll just comment as you guys know um it's the next step and and it doesn't make things happen automatically either. So, you know, just know that if you want to wait longer, so be it. But if you want to turn over for my office and start to handle, we'll start working on it right away.
I think we should let our attorney attorney. Try to approach that attorney that first sent us that letter and see what that comes out from that correspondence.
East Bethl is not alone in trying to get his hands around short-term rentals. There's goods and bads. Nothing in your ordinance proposed would preclude anybody from getting it.
My feelings on this particular residence is it is not your typical Airbnb. It is a large event venue and that's what they're using it as with they're getting thousands of dollars every weekend every single weekend and really disturbing their neighbors.
This ordinance would essentially take care of the large venue gatherings. What clearly defines it for people? So that again, if it needs to come to prosecution, it's there's no if ends or buts. It's black and white.
I think we should go forward with this with uh some of the changes that we've discussed.
I would just ask you to jot your changes down and then when we discuss it this evening, we can bring that up and vote on it. Make that part of the motion.
