Uh Mr. Mayor and council members, that is an interesting question. One that we do not have an answer for, but happens uh every every time uh for some reason. And um I do know that they pay a little bit more up there to offset some of those costs associated with putting that system in, but not a significant amount more than anyone else. And um and it's just for whatever reason. Uh the lion share of them come from that area. >> Yeah. I'm just curious because you got Wiking Preserve. There's only four and 16 from Whispering Aspen. is like same thing every year, right? >> Well, and I don't understand how they continue to develop buildings, yet the prices never decrease because we keep being told build more, it'll spread the wealth, but the prices continue to increase if nothing else. And I don't understand that because apparently developing isn't working and decreasing the cost for our residents. And the other thing these some of these people are one thou over a,0002,000 $4,000 for a year. That's 10 years. That's 10 to $40,000. They could have multiple septic systems and wells with that kind of money. It's ridiculous. I don't I I'm just baffled. I'm baffled that this room is not full of people complaining about their water bills. [clears throat] >> Uh Mr. Mayor and Council, what I will say in response to that is it is based on usage. So if you leave, for example, a toilet running uh and don't fix that, you would be amazed at the amount of water that gets wasted. [clears throat] Um, and I would say that our water rates are probably not out of line of other communities in terms of in terms of the cost to operate the system. You're operating in cost and then also in terms of your replacement cost eventually uh for these systems. I mean it's uh utilities are not inexpensive. Um, and even if you have your own well or um an septic system, you are well aware of the costs associated with that too. I mean, you can't pump a system without hundreds of dollars these days. Um, if you have to replace a well pump, it's thousands of dollars. If you have to replace a system, u you're into the 20s to $40,000. I mean, it's it utilities are expensive. Um, replacing them even more expensive. Could you explain to me one thing? I have heard that uh kind of what um Councilman Urkl has said. [clears throat] When you have a development, as the houses go in and you fill it up, that decreases the cost to the residents who have already bought houses in that development. Is that how that works? I can maybe have Nate speak to that, but I would I would say that in a given development when you are running the numbers to determine how many houses are going to be built and how much your system costs, you're kind of anticipating a buildout. In this particular uh development or the lion share of these in this development we're speaking about in Whispering Aspen, uh it has taken 20ome years to build this out or to get to where we're at today. So I would say from a um from the standpoint of [clears throat] you know when you're doing your analysis of putting a system in cost X amount and so many people are going to help pay in and 50 years from now you're going to have to replace all these lines. You're you're not assuming that it's going to take 20 to 30 years to build up that account. Um so uh but you still have you are still going to be ultimately responsible for that shall we call it a continuity cost of replacing that system. So again I I don't know that these prices would reflect that delay. Um but uh but it's probably uh established based on the initial estimates and followed through on what people were told initially when they when it first went in. My hope is that there will be enough dollars in there to replace a system when when you have to replace it. >> Any further discussion? Need a motion on the resolution. Item 4B. >> Uh Mr. Mayor and Council, on the advice of our U city engineer, we have a storm water pollution prevention program annual meeting that we need to conduct here. Uh, and this is essentially uh a storm water uh how we handle storm water in our city. We have various different strategies here to include street sweeping inspection approximately 20% of the city storm water basins annually hosting city programs such as cleanup days uh conducting this annual meeting and developing educational materials and anytime we find uh discharges that are not appropriate, we try and follow up on those. Um, but we need to conduct this public hearing to get the public's input uh as to what ideas they may have for a city storm water pollution prevention program. And um and to conduct this public hearing would meet [clears throat] that requirement annually. And uh and then once once approved, we can we can submit this um program u to to the state and uh and go from there. >> [clears throat and cough] >> So, we just this is anformational item right now, right? >> Just open up another public hearing and if there's anyone that wants to speak to it. >> Okay. Um, my my uh family has been uh living on Lake um for uh for 30 years. We my grandfather bought the property we live in in 1950. We love living here, made it our home, take a lot of pride in uh uh taking care of our property and uh and and living where we do. Um [clears throat] over the reason we're here is over over the last two years. Um the quality of our life has has changed drastically, specifically due to the short-term parental property next door to us. The amount of people and activity that uh can uh congregate uh each week has made us feel unsafe and it's uncomfortable even for us to have our own family and friends over to our to our property uh for visitors. The home is uh being marketed and used as a commercial event center, weddings, bachelor parties, bachelorette parties, reunions, golf outings, all types of gatherings that usually involve music, drinking, gathering are happening every week. Strange people show up. At least a dozen cars and 15 to 25 people show up next to us. Um, and it's it's it's getting it's getting worse for us and it's just really uncomfortable and difficult to live next door to. I don't think anybody here would want to live next door to that. Um, I I contacted the city in 2024 regarding if there was any ordinance or regulations regarding rentals. I found out if there wasn't. Uh I filed a complaint in October of this year um after uh my wife and I were out of town and our daughter called us and said, "I don't know what's going on here, but there was about 50 cars and 100 people in our backyard." Um and there was a wedding going on. Um she felt unsafe, so we told her to lock lock the doors and and just wait it out. If anything happens or somebody stumbles over to our property, call the police. Um we did uh construct a fence um this year to minimize the spillover activity and so we didn't see the activity. I worked with Grace and some of the people here to apply for the fence permit. Um and during that process uh I learned that when you put up things like a fence or apply for a variance, you have to do things that are reasonable. Don't change the character um of the of the neighborhood. um and you know protect the integrity of of the neighbors. This is a PUD final plan, final plat, and development agreement for Cliffs Anderson Acres. Sherico Construction has applied for the approval of these three items for a three lot subdivision called Cliffs Anderson Acres. The subdivision is located north of 217th Avenue. This is currently one property. It is 20.35 acres. It is zoned and guided rural residential. The properties to the south and west are zoned and guided the same. The property to the north is part of the Gordy Mickelson wildlife management area and the properties to the east are part of a subdivision within Lynwood Township. This property is within the significant natural environmental area overlay. This is an overlay district applied to properties that the Met Council Inoka Conservation District and the DNR have identified as containing significant natural resources that contribute to the health, welfare, and quality of life of East Bethl's residents. This application was brought before you as a PUD preliminary plan and preliminary plat at the September 8th city council meeting. This request is for the approval of three items. The first being the approval of a planned unit development final plan. This is required by section 59 of our zoning ordinance for properties within that environmental area overlay. The purpose of a PUD is to allow flexibility and variation from the code in exchange for higher levels of design, environmental protection, pedestrian access, landscaping, and things like that. Um, the city has a relatively high level of discretion when evaluating a PUD. The PUD must meet the standards in the comp plan and the standards within our zoning ordinance in section 56, which is the section pertaining to PUDS. The packet contains an analysis of each of these standards. Notably, in previous reviews, no conditions pertaining to environmental protection have been recommended for this PUD. The second approval is for the approval of a final plat. Uh there are no significant changes between the preliminary plat approved by you all in uh September and the final plat before you tonight. The city has less discretion when approving a final plat. If it meets the standards established within the subdivision and zoning ordinance and is consistent with the preliminary plat approval, the city must approve the request. Review of these standards has also been included in your packet. The third item up for review tonight is the approval of a development agreement. This is a standard part of a PUD and final PLA approval. Um, pretty standard. Nothing of surprise in there. This is a quick look at the final plat up for approval tonight. Nothing super surprising, super complex in here. It's three lots. Each lot is approximately 6.5 acres. There are no internal streets, no wetlands. You may notice the drainage and utility easements are a bit interesting. Uh, this is just what's required for the storm water uh in this in this area. And these have been approved by the city engineer. staff has found that the proposed PUD and final plat meet the standards established within the zoning ordinance and are consistent with the preliminary approvals. Uh, one thing to note is that this project is not requiring any PUD flexibility. So, um, we're not seeing higher levels of design in exchange for flexibility. Um, everything in here complies with the standards that are within our zoning code and our subdivision ordinance. Um, one thing to consider, um, I've mentioned this during previous meetings, is if you wish to apply conditions because it is a PUD, you you may, um, something that you could consider is environmental protection, things like um, requiring a more stringent uh, tree preservation plan or requiring a certain number of native plantings, but again, these are things that have not been recommended previously. And staff also finds that there's a very limited environmental impact associated with this development. Um, the homes are being built on land that's currently bare. There's a small number of trees being removed for driveways, but really that's a very small number and overall there's a very limited site disturbance. Um, anything else that needs to be resolved um before this plaque gets filed has been added as a condition of approval within the resolutions. Again, these are very standard things, some minor engineering comments, some things that just need to get filed when the plaque gets filed. So, nothing surprising in there. Uh, this was reviewed by the planning commission on October 28th with a public hearing for that PUB final plan. No public comments were received and the planning commission voted unanimously to approve or to recommend approval of the PUD. Uh final plats are not reviewed by the planning commission. So that's why there is no recommendation on that item. Uh the city council is directed to move to adopt the resolution approving the PUD final plan as recommended by the planning commission and move to adopt the resolution approving the final platin development agreement for this development. The appraisal uh being the primary one. Um, and you're reading that correct. It is Guggenberger Appraisal Services, which is uh a relative of Alex Guggenberger, our um our county assessor. Evidently, there's a family um desire to be in property. Uh but at any rate, he um he's offered us an incredible deal. Most appraisal services are around $3,500. He's um agreed to do it for $1,000. Um there was a title commitment and um Council Member Mundle stepped out uh during this part, but that was pulled uh this evening because our um u our attorney has already um gotten a title commitment back in June. So, we don't want to duplicate that. The environmental uh site assessment uh proposal is in there as well for a phase one. Determine if there's any sort of contaminants or or issues on that property. the purchase agreement is there as well and um and then we've included yeah we've included the title commitment but that's uh that's going to be not approved this evening. So um I'm bringing this forward um just in terms of full disclosure of what the costs are associated with uh with some of these contracts. they would they can be approved by myself given their dollar figure but I think given the the nature of this uh of this acquisition that we wanted to bring this forward in case there were any questions make sure everyone's comfortable with it. Um, I I would like to propose that for any federal employees that are being affected by the government shutdown that if they can provide ID that they are govern employee that the city would forgive any late fees on their water and sewer bills. um and relate to that uh almost every evening that I've been watching the news in the evening, it talks about uh [clears throat] the the federal workers going to food shelters that food food shelters are being hit really hard right now. Um, I would like to help support our local food shelter, NACE, and if it would be possible, if the city has the power to do it legally, I would like to donate at least $1,000 to our food shelf to help our residents. So, if there's any other ways that any other members would have ideas of how to help these federal workers that are being affected by no fault of their own, I would be open to discussion on that and the items that I presented. >> The government is open now, so they're getting their checks. >> No, it's still being shut down. I know we had way more kids come through here than I get at my house. So, it was great. I love seeing the costumes. I took some pictures. Um, I won't post any of the pictures because without parents permission, but it was great. Um, we do have the town hall this week and I'm hoping that we have a good turnout from the planning commission and the road I always want to say roads commission, the planning commission and the parks commission. And I'm hoping for more information. The [snorts] community has been asking me, well, are there going to be any information on all the developments? So, if we can get any information on developments that are going on, that's one of the things they've asked for. Um, and I wanted to mention the East Bethl Bulletin. I just got it this last weekend and I don't understand how it would take so long. It everything was due September, the first week of September the 5th or 6th, but we not getting it till the end of November. How is that possible? Well, do we need to get a new printer? Because I can tell you two good printers who could have that stuff out in a week and probably not much difference in cost. So, uh, and the print was a lot smaller than usual, so there must have been a lot more information. I would just I'd like to see him like the the one that St. Francis puts out with a little bit of color.
