The Triple Crown is a prestigious award recognizing governments that achieve the highest standards in financial reporting and budgeting and have received GFOA’s Certificate of Achievement for Excellence in Financial Reporting, Popular Annual Financial Reporting Award and Distinguished Budget Presentation Award. This is a first for the City and is a significant achievement. The City is one of just 14 cities/counties throughout the state that received the designation and just 441 governments throughout the nation. Each award recognizes governments that produce reports which communicate their financial stories in a transparent, accountable and easily understandable manner. The designation exemplifies the City’s intentional commitment to the community to maintain transparent communication and preserve public confidence. Please extend a big thank you to current and past City staff for their involvement in achieving this prestigious designation. Resolution No. 2026-79, Appointing Election Judges for the 2026 Election Year. Melissa Moore, Assistant City Manager, presented a resolution to appoint Election Judges for this year’s election activities in August and November. She provided background information and recommended approval as presented. She noted that Mayor Ostwald will be volunteering as an Election Judge and therefore should recuse himself from this item. Mayor Ostwald recused himself from this vote. Motion made by Councilmember Evanson to adopt Resolution No. 2026-79, Appointing Election Judges for the 2026 Election Year. Seconded by Councilmember Cardona. Upon a voice vote, all voting aye, Mayor Ostwald declared the motion carried unanimously. 7. Resolution No. 2026-81, Affirming the Hearing Examiner’s Declaring the Dog Known as Astra as a Potentially Dangerous Dog (Fridley Police Division Case No. 26-113965). Nick Steiger, Police Lieutenant, explained the narrow role of the Council tonight to determine if the process worked and whether the record supports the decision. He stated that the decision to declare the dog as a potentially dangerous dog was already made by an independent Hearing Examiner. He stated that the Council may affirm, repeal, or modify the Hearing Examiner’s decision based on the existing record. He provided background information on the May 21 st incident, the Hearing Examiner’s determination, and due process. Page 10 of 52 ## City Council Meeting 7/13/2026 Minutes Page 3 Councilmember Bolkcom asked for more information about the actions that would deem the dog to be dangerous. Lieutenant Steiger provided examples of those actions. Councilmember Cardona asked about the experience of the Hearing Examiner. Lieutenant Steiger reviewed his experience in the position and as a contractor for the City. Ms. Moore provided additional information on the appeal submitted by the dog owner and the purpose of the hearing. Mayor Ostwald asked legal counsel for additional input. Sarah Sonsolla, City Attorney, stated that the City did follow the process identified through City Code. She stated that the Hearing Examiner is well- regarded in this field, and he has provided his findings of fact. She stated that the dog owner could continue to appeal to the District Court, if desired, or could come back after six months to request another determination if the situation has changed. Susan Churchill commented that she and her dog were the victims of the incident. She commented on the lack of connection or mediation from the City, noting that she connected with the other dog owner on her own. She stated that dog one was the sole perpetrator in the incident and dog two was not involved. Mayor Ostwald clarified that a bite is not needed to declare the dog, and running along is enough to receive that classification. Lieutenant Steiger stated that a reclassification can be requested in the future and described that process. Ashley Wrath, dog owner, stated that Astra was not charging but was running after her sister as they were codependent dogs. She commented that Astra has been attacked and has not bitten back. She commented on the other experiences the dog has had with no issues. She did not believe her case was appropriately reviewed. Councilmember Bolkcom asked if there were any other witnesses. Lieutenant Steiger replied that there were no other witnesses. He explained that in the review of body-worn camera footage, Ms. Wrath did state that her dogs are reactive, reactive to other dogs, and that Nova had attacked twice before. He stated that there has been a pattern of behavior, and the classification of potentially dangerous is an incentive for the owner to assist in changing the behavior of the dog. Ms. Wrath commented that because the dogs had jumped a four-foot fence, they built a six-foot fence, but the gate was ajar that day. She noted that even though the dogs were sisters, they were raised in different homes before she got them. She did not believe her dog should be deemed dangerous when she was not trying to attack or run at the other resident or her dog, but was chasing after her sister. Lieutenant Steiger explained the classification of a potentially dangerous dog. Councilmember Evanson explained the role of the Council in this process and did not believe there were grounds to say that something was wrong with the process. Page 11 of 52 ## City Council Meeting 7/13/2026 Minutes Page 4 Ms. Wrath commented that when she was served the potentially dangerous dog paperwork, it had both dogs’ names on it, and Nova had already been euthanized at that time. She commented that the incident occurred on May 21 st, and she was served the paperwork on June 6 th . She attempted to clarify the facts, but no one from the City would speak with her. She commented that she was only in contact with Ms. Moore and did not speak with Lieutenant Steiger or the Hearing Examiner prior to the hearing. Councilmember Evanson asked if that is the typical process. Lieutenant Steiger commented that the resident was served the designation on June 9 th, and Nova was included as she was also being deemed with that designation, which is the normal process. He stated that a quarantine notice was served on the date of the incident. Councilmember Evanson asked about the primary concern with the designation being placed on the dog. Ms. Wrath did not believe her dog should be included on that list. She commented that they have enrolled the dog in training and did not believe that she requires being muzzled. Mayor Ostwald asked and received confirmation that Ms. Wrath did not witness the incident herself. Councilmember Cardona asked if the Hearing Examiner meets with the dog himself. Lieutenant Steiger replied that the Hearing Examiner does not meet with the dog and described the hearing process. Councilmember Cardona was glad to see the residents had made amends. He commented that although he does completely agree with the process, as he believes the dog should be involved in the review at some point, that would not be the typical process, and therefore, the correct process was followed. He commented that it seems that the owner is taking the right steps to lift the classification in the future, and hopefully, that can be done after six months. Councilmember Vescio asked if the classification could be removed after six months if the owner and the dog followed all the instructions and recommendations. Lieutenant Steiger confirmed that the classification could be reviewed, and perhaps removed, after that review. Wally Wyspopal, City Manager, asked about the number of potentially dangerous dogs in Fridley currently. Lieutenant Steiger replied that there are five declared dogs at this time. Motion made by Councilmember Evanson to adopt Resolution No. 2026-81, Affirming the Hearing Examiner’s Declaring the Dog Known as Astra as a Potentially Dangerous Dog (Fridley Police Division Case No. 26-113965). Seconded by Councilmember Bolkcom. IT Division Update Mike Grundman, Information Technology Manager, provided a review of the IT Division and its employees, projects and future projects. A special emphasis was made regarding cybersecurity. ## 2. Finance Update – June 2026 Year-To-Date Joe Starks, Finance Director, provided a regular update to the City Council regarding the City’s financial condition. All budgets are on target and no concerns were identified. Page 15 of 52 ## AGENDA REPORT ## Meeting Date: July 27, 2026 ## Meeting Type: City Council ## Submitted By: James Kosluchar, Public Works Director ## Brandon Brodhag, Assistant City Engineer Title: Resolution No. 2026-84, Receiving a Petition for Traffic Calming Improvements on 60th Avenue from 4th Street to 7th Street ## Background Late last year, staff were contacted by Miranda Josephs of 6020 6th Street regarding traffic speeds along 60th Avenue between The Cielo Apartments and 7th Street. Ms. Josephs and her neighbors were requesting traffic calming modifications along 60th Avenue from 4th Street to 7th Street. Ms. Josephs expressed concern that the 60th Avenue entrance to The Cielo Apartments generates an influx of cut-through traffic, introducing volumes and safety issues that have altered the historical residential character of the neighborhood. Staff advised that this segment was currently slated to be a part of the 2029 Street Rehabilitation Project. Staff performed a speed analysis which determined the 80th percentile speed below but near 30 mph. This analysis was provided to Ms. Josephs, who requested a petition form to appeal for speed control nonetheless. Staff provided the standard petition formwork. On June 16, the attached petition was presented to the City of Fridley (City) by Ms. Josephs. The property owners that signed the petition are shown in the attached map prepared by staff. Since the petition received referenced MN Statutes Chapter 429 and was signed by over 35% of adjacent property owners (not necessarily 35% of benefiting property owners), a resolution to receive and refer the petition is appropriate to direct a feasibility analysis and report by staff. The report would further develop the basis of benefit for any potential special assessments. If approved by the City Council (Council), staff will prepare a feasibility report to be presented to the Council. This report would likely be completed in late 2026 or early 2027. ## Financial Impact ## None ## Recommendation Staff recommends the approval of Resolution No. 2026-84, Receiving and Referring a Petition for Traffic Calming Improvements on 60th Avenue from 4th Street to 7th Street. Page 17 of 52 ## Resolution No. 2026-84 Receiving a Petition and Ordering Preparation of a Preliminary Report for Traffic Calming Improvements on 60th Avenue from 4th Street to 7th Street Whereas, a petition was submitted to the City of Fridley (City) by residents of the neighborhood adjacent to 60th Avenue, requesting that the City implement traffic calming improvements along 60th Avenue from 4th Street to 7th Street; and Whereas, the petition cites localized safety concerns, residential pedestrian risks, and increased cut-through traffic volumes associated with the 60th Avenue access point to nearby multi-family developments; and Whereas, the City Clerk has received said petition and staff has verified that it contains the requisite signatures from property owners within the affected residential area. Now therefore be it resolved, that the City Council hereby: 1. A petition requesting that the City implement traffic improvements along 60th Avenue is hereby received by the City Council on July 27, 2026, and is hereby declared to be signed by the required percentage of owners of property affected thereby to authorize referral and further action. This declaration is made in conformity to Minn. Stat. § 429.035. 2. That the aforementioned petition for proposed improvement is hereby referred to the Public Works Director, James Kosluchar, PE, and that person is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is necessary, cost-effective, and feasible; whether it should best be made as proposed or in connection with some other improvement; the estimated cost of the improvement as recommended; and a description of the methodology used to calculate individual assessments for affected parcels. 3. That said preliminary report of the Public Works Director shall be furnished to the City Council. Pursuant to Minnesota Statute § 465.03, the City may accept these donations and gifts for the benefit of residents. For specific donations or gifts, the donor may prescribe certain requirements, such as for a specific activity or department. Consistent with the above-mentioned statute, staff prepared Schedule No. 1 (Exhibit A), which outlines the various donations, gifts and/or sponsorships received by the City between June 18, and July, 2026. To accept the same, the Council must adopt the attached resolution by a two– third majority vote. Generally, special assessments are a form of tax levied by a local government against a property that benefits from the improvement(s). This process is governed by the Assessments Chapter of the Fridley City Code and the City’s Roadway Major Maintenance Financing Policy. Consistent with these regulations, the Council followed the below process for the use of special assessments regarding the 2026 Street Rehabilitation Project (Project) No. ST-2026-01: • Ordered the preliminary report, plans and specifications (Resolution No. 2025-18); • Received the preliminary report, called for a public hearing (Resolution No 2025-134); • Conducted the public hearing (Monday, November 10, 2025); • Ordered final plans and specifications, called for bids (Resolution No. 2025-150); and • Received bids and awarded contract to Park Construction Company (April 13, 2026). • Declared cost to be assessed, ordered the preparation of proposed assessment and scheduled a public hearing (Resolution No. 2026-86); • Mailed notices of this public hearing to affected households on June 24th, 2026 (Exhibit A); and Published the notice for the public hearing in the July 17th, 2026, edition of the City’s Official Publication (Exhibit B). Based on the construction costs, the proposed special assessment for Project No. ST–2026-01 will include 170 properties totaling approximately $743,981. Benefiting property owners will be permitted to repay the applicable amount over at ten year period at an interest rate of 4.25%. ## Financial Impact The Adopted 2026 Budgets included and anticipated the use of the above-mentioned special assessments to support Project No. ST-2026-01. Page 32 of 52 ## Resolution No. 2026-86 ## Adopting the Assessment for 2026 Street Rehabilitation Project No. ST-2026-01 Whereas, pursuant to proper notice duly given as required by State law, the City Council has met and heard and passed upon all objections to the proposed assessment for the 2026 Street Rehabilitation Project No. ST-2026-01. Now, therefore be it resolved, by the City Council of the City of Fridley hereby approves: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be certified to property taxes in 2026 and shall bear interest at the rate of 4.25% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2026. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County, make one payment of at least one hundred dollars ($100), to the City of Fridley; no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. A property owner may pay to the City of Fridley the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Please note, no payments will be accepted between November 13 and December 31 of any year. 4. Upon receipt of any such prepayment, the City Clerk, with the assistance of the City Treasurer, shall note the same upon the records of the City, credit the payee therefore, and reduce the assessment as originally made in the amount of the prepayment received. The balance remaining shall then be noted as the amount due and may then be certified to the county together with and as a part of the assessment roll in which the original amount due was contained. 5. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. Background Pursuant to Chapter 700 (Liquor) of the Fridley City Code (Code), On-Sale Liquor license applications require approval of the Fridley City Council (Council) to operate in the City of Fridley (City). The purpose of this review is to ensure that all standards for liquor-related establishments are met and that regulations are in place to ensure responsible service of alcohol, protect public safety and maintain orderly business operations. The City Clerk’s Office has received an application for an On-Sale Liquor License from Enuye Faneta, to operate Central Bar and Grill at 1040 Osborne Road. These steps included a criminal background check with the County and State of Minnesota and building and fire code inspections of the site plan and proposed space to ensure compliance with the Code. Staff have signed off on each of these verification steps as shown above. 1040 Osborne Road is a unique property. Two businesses have attempted to operate as a liquor establishment at this location in 2020 and 2024 and have ended up having their licenses revoked. Staff met with Ms. Faneta and discussed these past issues and concerns about the property as a liquor establishment. Ms. Faneta has stated she is committed to running a safe and proper business and fully understands the rules and regulations required. She is aware of Page 49 of 52 past issues with this property and knows that the City will not hesitate to take appropriate actions for compliance as it has done previously. This license will only cover the restaurant area of the property (Exhibit A). Ms. Faneta is also aware of and committed to complying with the City’s 60:40 liquor to food ratio. Page 50 of 52 ## Resolution No. 2026-85 Approving On-Sale Liquor License for Enuye Faneta, Central Bar and Grill, ## Located at 1040 Osborne Road Whereas, the Fridley City Code (Code) and various sections of Minnesota Statute (M.S.) direct licensing requirements for certain business activities within the City of Fridley (City); and Whereas, pursuant to Chapter 700 of Code, the City Council must approve On-Sale Liquor Licenses; and Whereas, an On-Sale Liquor License application was submitted by Enuye Faneta to operate ## Central Bar and Grill at 1040 Osborne Road; and Whereas, applicable City staff have reviewed the applications and conditions of the on-sale liquor license application including criminal background checks, building and fire inspections; and Whereas, applicable City staff found no reason to deny the on-sale liquor license application for Enuye Faneta to operate Central Bar and Grill. Now, therefore be it resolved, that the City Council of the City of Fridley hereby approves the on-sale liquor license application for Enuye Faneta to operate Central Bar and Grill Located at 1040 Osborne Road.
