rupe here and your city administrator Scott laner president roll call is taken sir thank you make a motion to approve or amend the agenda as presented Mr mayor council M rainville I would move that we table till the January meeting um under city council new business e items one and two agre Mr Mayor in light of the possibility of get of filling a Council seat I do not I think that we should not um suspend those for January why not we've been running for months with four let the new Council handle it Jeff and I have zero say in we should go on there Council so you moved that yes and uh Jason you seconded that I do and U so those in favor so are we going to have discussion on it oh discussion thank you um Mr Mayor um most of the residents aren't even aware that there's a counil vacancy um which leades us at a tie board at 4 to four uh 2 to2 um I believe moving this to January is in the best interest of the residents and allows for residents to be informed of the the vacancy and apply for consideration if they so choose to it allows for the appointment process to be open and transparent and it allows for the new Council to determine how they wish to move forward with the filling the vacancy the documents I provided in my my request for councel Action um spelled out the process used used for councel to to make the appointment the documents also show that in a tie vote of 22 the mayor has the authority to make the appointment um an important thing to understand is that other than adhering to the legal requirements of the person you're appointing that they have to be uh of age and a resident and such there are no limitations whatsoever on a mayor as far as who they can appoint or determining the effective date of that appointment uh we recently had an election and those of us here at the table who were on the ballot ran saying we were for open and respectful government by tabling this matter allows us to F fulfill our promise to the residents and my goal is to keep my promise we had a discussion at our December 12th meeting um which was only posted to talk about the city administrator but we had a motion moved and I seconded it and I should not have um to accept the resolution of council member flatable we later discussed things in that as far as processes and such um until that point of that meeting that resignation was not publicly knowledged it was not known and only the people that rece the the person that sent the resignation and the council members who received it or anyone they forwarded it to were the only ones that had any knowledge of a vacancy um during the discussions it was apparent that the group had conflicting information regarding filling of vcy so I made a motion for staff to continue their research and bring back to us tonight the conditions we are required to follow to fill a vacancy the majority of what comes in front of the council doesn't have a large impact on the residents um but however filling this vacancy is an important step that we must take and given this is our first time doing so we need to be sure to get it right and I will just say if it doesn't pass um I'm advising the body that I will leave before that vote because I'm not going to participate in not allowing the residents to have participation in filling a vacancy any other discussion Mr Mayor I have documentation that I'm going to provide to all council members of residents that have provided their input through email and um sending information to uh staff that they wanted their voice to be heard someone can't be here so they asked if we would make sure that their voices were heard I'm going to just three over here and also have people signed up this evening that want so just wanted you all to have all the information on what we've been receiving as a staff in the last 24 to 48 hours um so as you're looking at what people have say um that weighs into your decision on what we're going to do this evening Mr Mayor I I mean I totally agree with Mary it feels like this is not something that we need to rush through the last meeting of the year it just feels like the new team should come in and figure out what they want to do and what best supports the community and uh I tend to agree with Mary that um we need to uh we need to push this into 2020 and let the new handle it I don't know that there's anything between now and January that's so dire that we need to make a rush decision tonight I looking at the schedule that is in Mary's packet it'd be February or March but Mr Mayor The Proposal I put in is up for discussion and there's any there's a possibility of changing any of those dates in there those were dates just I used to have dates on the on the request um but the the new Council can make the decision on what those rates are yeah and looking at that there's you're asking for Council meetings before the council's actually swor in and uh it's hard to tell are those open meetings or what exactly um that time frame would look like but at a you give uh less than two weeks with Christmas in there to actually make an application so I there's detail to be discussed there but um any other discussion on the the motion that counc rville has made so again Mr Mayor to your comment the dates that are in there are proposed the council the new council at the January 14th meeting can make a decision or we could the date of the swearing in we could change and change the agenda at that time add this to it um it's just for discussion um these were not made uh not in concrete um I just did not want to leave them vacant and to um make a decision not now were um not allowing the new Council to have to make those decisions and I think it puts you in a tough spot because if we clearly Mary and I are over here not sure where you stand on it but it puts you in a tough spot that you get to be the deciding vote which feels like not a spot that you need to be in I mean we should let the new mayor and that team figure that out any other discussion seeing and hearing none all those in favor of the motion to table items uh 11 b 1 and two at one and two yes it just resolution so it's item one and two um all those in favor signify by saying I I I opposed n n motion fails we'll be leaving right after the item prior to that so as I whoa my gosh M mayor if there are no other changes to the agenda I move it as as approved second all those in favor signify by saying I I I I opposed motion carries start with our uh public hearing on the 2025 Levy and budget so there looks like there's no presentation tonight on the levian budget so this is our truth and Taxation hearing um city council adopted PR preliminary levy on September 23rd certifi the amount to County to the county prior to September 30th and we're having our meeting today for public comment city council director staff to bring necessary Levy change to meet needs to operations debt and capital total tax levy is 2,1 129366 2025 Levy is a 99.98% increase over 2024 total increase of 93190 Base Levy was u in 2024 was a mil 72 950 9005 sorry base Levy for 2025 is 1,800 $76,900 total City Levy in 2025 will be 2,129 milon 29366 compared to 1, 93677 99.98% increase total budget for 2025 is 2,465 th000 $80 um includes $692 180 for increased salary and benefits $2,250 for increased shareff contract $20,000 Planning and Zoning increase uh $3,400 in other changes a reduction of $35,000 in the fire contract uh reduction 31,50 and a maintenance decrease that was moved over to Street Improvement fund $224,000 Capital decrease and $1 1,975 material and Supply decrease Residential Properties may see an increase between 9.6 and 10.6 in their city tax liability for 2025 increased taxes for most res Residential Properties will are impacted by the increase in residential property value vales increase in fiscal disparities distribution decrease in the fiscal disparities contribution and an increase in the city Levy the city tax rate is up to 22.2% market value of an average home in now then increased by 2.5% to 492,000 at the new tax rate this home we pay about 1,094 in city taxes an increase about $96 annually for this you get police and fire protection Street Maintenance and plowing Park maintenance planning and inspection of properties Street improvements equipment purchasing Capital Improvements administration of City activities and debt retirement total revenues for recycling are 55320 which are derived from fees for recycling and from Anoka County this is a decrease in revenues 23,6 185 and reflects only the operating Grant from inoka County total expenditures are expected to be 6937 which is decrease of 12,235 city has reduced staff support hours and move newsletter expenditures to general fund total revenues are not projected to cover all costs in 2025 City's projected to use $4,050 of other funds to pay for recycling Park Capital fund the city is holding off on planning Park improvements in 2025 turn out gear the city is funding future turnout gear for the fire department replacements for its firefighters right now transfer $7,500 a year into the fund for turnout gear building fund the city is also holding off any building improvements in 2025 funding for building improvements exist in the building Capital fund city has budgeted to spend Road Improvement funds as follows $100,000 in Street Maintenance $50,000 for calcium chloride and $380,500 for Street improvements City will most likely issue debt in 2025 to pay its share of the 2024 and 2025 Road Improvement projects equipment replacement fund the expenditures and the equipment fund 2025 are the only final payment on the fire tanker of $6,950 and in the packet in the back is the actual breakdown of the budget by areas of the budget anybody would like to see that as this is a public hearing does anybody have any comments on the tax Lev open yeah we can open the U public hearing any comments any challenges all right again the the information that was just presented in that packet is's a single copy in the back of the room and there is a imagine it's all on the city website all right seeing that are here I what I'd like to do is especially thank these individual served our community and I'm thinking about Jason here he was on a few years of planning zoning with us and he's also served here the last four years and I want to thank you Jason for that and also uh our Minister Scott I want to thank him too for the his Services here for the last three years uh uh it's a blessing just to have him here uh most you probably don't know how he got came here and what what had happened but it was the answer to prayer uh and so we appreciate what Scott's been able to do here in our city the last 3 years and then last of all well I want to thank our mayor pein for what he's done in our city here probably most of you don't realize some of the things that he's done how he served us here in our community he uh was on the Planning and Zoning I don't know how many years and now he's the uh uh city council representative on the Planning and Zoning but anyway uh I I've had the privilege to serve with him in the Planning and Zoning I've been the privilege also to be on the working with him in the Heritage day and the things going on here Community uh you won't believe the work that he he put in and put has put in uh and doing the things that need to be done around here not only he he went down the state legislation and uh did some work against the Met Cil which is an asset to to our city here because they want to take some more controls away from us but anyway I appreciate all the years that Jeff has served here in our community I believe it's close to 20 years I'm not sure what it is but uh it's been a privilege and honor for me to serve with him and I thank God for that privilege because I think if it hadn't been for God we wouldn't have had the results we've seen happen here in our community because right now I think I think our our staff and stuff we have here at the city are doing a tremendous job I've never seen the U cooperation people working together as much as what they are now so it it's it's it's a privilege for me to stand here and and represent our part of the city and I thank you for that privilege thank you D thanks D thanks D Ken Glazer Mr Mayor city council my name is Ken Glazer I live at 18735 Clear Road North West and now then and I am a council member elect I'm here to share some thoughts facts and assumption and an assumption pertaining to what has occurred since November 29th 2024 related to council member flat Abo's resignation first I feel it's important to eliminate any question of bias by telling you that I did not vote for either mayor Pon or council member rainville now for those residents demanding transparency that seem to be pointing fingers at the mayor and council member Brian I would ask that you question how it came to be that staff were so prepared to discuss how vacant Council seats are appointed when council member Flat's resignation was sent out after the close of business Friday November 29th and staff were not included in that email I would like to ask administrator laner and Deputy clerk johnon to share with us which council member disclosed this information and did they direct staff to research the process of filling the seat as for comments made at last week's work session by Deputy clerk Johnson pertaining to best practices and prescribed period of time for public posting of vacancy nowhere have I found this in writing within statute or League of Minnesota City Publications so I can only assume that this is someone's opinion and not based on fact as for council member revil's request for Council action pertaining to a process F filling Council vacancies upon close examination of the proposed procedure it simply remove statutory rights from the current mayor and transfers those rights VI via City policy to the mayor elect as an example I would prefer that our current pres president not be allowed to appoint over a 100 new judges to the federal bench just before leaving office but he's not breaking any laws but it angers that council member rainville may be trying to change the rules because Miss rainville and the staff might not like the outcome of tonight's meeting based on my own investigation state election officials verified that no laws are being broken by the current Council voting to replace council member fatabo as for concerns expressed by staff that mayor Pon might be able to run for Council if if there were to be a special election and there may be one because of law he has the legal right as a resident of now then to do just that lastly I would like all those concerned to consider that if the timing of council member flat Abo's resignation be different based on the outcome of our recent election Cheryl M Olsen would may already be council member elect I know Cheryl to be an objective and fair person that loves a city of now then thank you next is Trish I'm pass okay next is Matt wesling good evening I'm Matt wesling I live at 19441 Burns Parkway and uh the reason I wanted to come up here and talk to you guys tonight is exactly about the process that they're talking about tonight to Simply put somebody in place um talking with a number of different administrators in different cities the process is laid out exactly as Mary has laid it out it gives open transparent uh information to the community it allows the community have input once again into who would be the next council member the council member right it's one of four spots and then the mayor it's a very important spot it's a very important position to have it's a lot of work uh and we need to have the right person in there I do not believe that just simply choosing somebody just because they had uh votes throughout the uh the last election um Minnesota statute is very clear that that does not have to be the option it's not an autom IC that that is the way that it goes um every every administrator I spoke to points to Mary's Direction points to having it a fair process allowing the the ships to fall as they may that way um I do not believe that uh it should be the outgoing parties availability to affect major change they're not going to be here they're not going to be the ones running stuff that's all I got for you thank you and Steve Schmidt uh good evening Mr Mayor and City Council Members my name is Steve Schmidt I live at 6232 191st Lane Northwest um first of all Sue would like me to apologize on her behalf for not being here she's got some severe medical problems and today was not a good day um however Sue and I want to thank you Mr Mayor for your uh 18 years of dedication and service to now then and uh thank you to those who have come out to support you and thank you um and we also want to thank the others that are have served and are moving on it's not an easy job being a mayor or a city council person we know that um Mr Mayor how much do you get paid monthly to be mayor $500 $500 and how many hours do you think you devote to this job and you're volunteering most months 20 hours okay and I presume that's taxable income and um so for the amount of effort and time dedication you put in you're obviously not doing it for the money so we appreciate your many years dedication and what you've done for the city uh getting the cable in here and fighting the Met Council so thank you um also like to thank all of you for whittling that budget down to uh what roughly 10% from 20% I think it was thank you for that um then also I understand there's a RCA on the agenda tonight asking for the appointment of an interim city council member to finish out Shan's term um in my opinion and Sue's opinion if it's legally possible we think it should be done tonight um why wait um Cheryl came in third in the election and seems to us would be the most logical person to put her in there with the least time and effort in money um we believe she has the desire from my understanding the qualifications to fulfill this position so thank you very much all right that concludes the public forum have a presentation by Eagle Scout Lucius lucky milman good evening City Council of now then my name is Lucius millerman I live up in 19643 B Street Northwest and I I am part of elk River's troop 90 of scouting BSA I'm here today to discuss a very important part of my next step towards my journey to Eagle and that is my Eagle Scout project and what I want to do is to build bird houses and bad houses for my local twin nights Park I mainly want to do this because I've been going to the park since I was a since I was a wolf in CB Scouts it's been a part of my childhood for a long time and I just want to give back to a place that has given me so many memories and I also want to do this just for the ecosystem the bird houses are mostly meant to protect many species of birds here that we have at the park and the bat houses for the same reason gives the gives the bat some protection during the day it allows them to be around the park at night especially for their food of mosquitoes in the summertime and these are some of the areas that we took pictures of for the park like right around in this Western right around this Western area and some and some are near the lake as well for the birds that hang around that are around there and here are some better pictures of those areas these are the designs of the bird houses and the bad houses is that I want to build how many you going to build uh we plan to build five bird houses and three bat houses are there any other questions so so when uh what is the time frame for your project I plan to do this around the uh Springtime maybe around like May so I can so it's a little lesser time for like school and stuff and I'll be able to do it at a warm time and I'll be doing it with my troop and my family so did you say three bad houses three bad houses correct and so they'll be located in different areas Y and how many bats in in a colony in a house the size You're Building approximately 32 so so will there be any need for uh assistance from our public works department uh no because I sell fund raised using current and past prices from popcorn wreath and gift card sales for my troop Council any other questions no Mr Mayor Scott how will you select the location for the bird houses and the bat houses how do you go about selecting the proper location for that twin lak that's a big area to be able so how would you do that so we may so for the bird hous is we selected some of the taller trees in the area like here I am pointing at a couple of them here and near the park and for the bird house and for the bird houses we also like to keep them in the trees but we also might have to put like posts in in certain areas for ground level Birds okay any other questions angel I move that the council commends and supports Lucius and his efforts to build the bird house and B bird and bat houses for the betterment of Twin Lakes Park um I had initially said this support would include Public Works staff assistance and any financial assistance not to exceed a certain dollar amount but Lucas has said he has the costs covered but I would think that if we need to provide on what we've done here yes ma Natalie uh about a year and a half ago I believe that we voted that we are going to increase um the alcohol licenses due to the uh surrounding cities uh being significantly higher than now then um we had since been noticed by ATT Ruby that we had to hold a public Hearing in order to do so on that particular price increase um we had talked about moving it up to 2500 to be the same as Oak roove to get a little bit closer to where we should be as far as um the pricing it's up $1,000 and what it had been for the two or three locations that we have in now all right so that is the proposal at this time to go up to 20 2500 anybody in the audience wish to speak on this right anything from the council Mr Mayor counc Brian so um question just to um for Miss Johnson if I remember right we were Chang we changed the on sale to 2500 where we um it's not here where we adjusting the off sale and the Sunday at all I just don't recall from the last time we're not okay all right we'll close the public hearing and we'll accept a motion on the U increase Mr Mayor May Brian make a motion to increase the uh intoxicating on sale liquor license Fe from $1,500 to $2,500 second and that becomes effective when um on publication or actually I can't remember exactly did we put it at the end of the year yeah you put it in effect of January 1 January 1st right but the yeah most ordinances they're effective upon publication unless the council puts an effective date on there and I believe this was effective January 1st and the renewals are in June so all right I and then we'll talk about the opportunity for public input on the Swift good y okay yes so the this is part of your annual ms4 permit as a requirement you need to have an opportunity for the public to comment on the storm water pollution prevention program so Mr Mayor may I ask her to introduce sorry yeah I'm Erica I'm from Hockinson Anderson thank you so if um I'd like to ask if we could open it to public comment if anyone has any we open up we'll open up the public hearing to uh comment from the audience um this is the storm water pollution prevention plan part of our ms4 requirements uh for storm water management in the city and that is being managed by hackinson Anderson under contract with us and so this is an opportunity for questions uh or comments regarding the storm water pollution prevention I know it's pretty exciting [Laughter] stuff what exactly is it so it's a complete program there's a bunch of different parts of it some are ordinances some are pollution prevention housekeeping um methods like inspections and for construction sites and outfalls and things like that so there's a whole big program with all these different things that just meant to prevent things that aren't storm water from going into the storm water system and this is for handling rain water off of pav surfaces mostly y that's the main source of storm water it's a program that monitors our our Retention Ponds so all the impervious surfaces you see that there's construction that's required to uh build Retention Ponds so that sediment goes into the pond and the water flows out to the river system to the water sh and uh and it's a a multi- tiered program I said there's there's looking at pollution prevention there's also monitoring of all those every uh storm water pond in the community has to be monitored and if they have do have to be remediated that's something the city would have to pay for it's an unfunded requirement of the government so we would have to actually clean that up in that there's a lot of educational components to prevent pollution to make sure our staff all knows uh what an illicit discharge is um so that we can do whatever we can to keep pollutants from running into our our water shed into our our streams and uh Rivers so it's it's mandated program started back we first became a city and it's gotten more complex each year and that's why we turn it over to a contracted situation with Hawkinson Henderson I recer I am I'm and I here chy can you come up so we can get you on the microphone I think there's a lot of people that don't know what went on with the oil so again my name is Christy wall and I lived out here since I was a kid so so um one of the things I was really wanting to see is to get that big oil tank out of the recycle center first of all because of the danger of slippage it's it's a disaster it's dirty one of the issues that we struggled with is what she's just talking about is the only location that we could put that that's logical is the fact so it was denied so you'll see it staying in the recycle center because any runoff from that anybody spilling any of the oil if we put it too close to our drains outside the runoff so I was thinking of the farmers because some of them do 50 F 55 gallon drums and they literally then bring them in five gallon pales at a time um again that's her choice to do that where you're talking a farmer who's got umin equipment and that's a lot of oil and a lot of lot of oil changes so it would be easy if it was outside they could back up their pickup truck take their drum spout turn it on and it goes into the drum it's not just from the drum I've done I did all the research and stuff for the city it's if the drum inside the tank would break it's not just that the runoff of anything that somebody does we're adding more stuff for pollutants because then that would go directly into the runoff as much as I wanted to get that dang thing out of there it's it's not going to happen um for that reason unless we can come up with a different location that it's not not going to affect what these folks are trying to do for us so it's again it's a safety issue in other ways and it's about the environment so I just wanted people that were here at the meeting and so that people understand because we really wanted that out as much as we could last year but it's not going to happen until we can come up with another solution but it's been researched and researched and I've talked and talked and talked to the people even that put it in there and right now there's just not a position in our property where we can put it right now so didn't happen but I just wanted to add that because it was a big struggle and something that we did want to do but it's not going to happen anytime soon doesn't I always say things can still happen but you just right now it ain't gonna so thank you you CH thank you Chris anything else in I'm pollution I'm Kelly pero my address is 7500 205th Avenue and now then here um a question I guess is going to be addressing everything for this um do you guys discuss this every year or is this the first time it's had to come up do you guys know more about this you do discuss this every year okay so you guys don't have any concerns other than what she's proposing that she has to open up this up for for public hearing to be spoken of today so what uh Christie had just spoke of for the oil moving that canister which I understand why um you guys have no concerns for it and you guys don't desire to move it either or look into a new way of moving it having it something externally um available from the outside for for it's the door the access panel it has a door on the outside of the building nothing like that can be done Mr Mayor CC rainbow I would address that as the as the re recycling lays on um christe did bring that forward um we we was determined that we could not place it outside there's can always be discussion as to can there be um change to the our existing recycle center to make it easier but we have to make sure that the product that's going in there stays in there doesn't uh run off into the to the drains so we can always look at something um but at this point it's stays that was my direction I was asking about is moving it and having it closer to an exterior wall not on the back wall where it would be easier accessible for those reasons yeah and that and that that's something we can have a conversation with st with our recycling center staff and administrator and such so okay good thank you anybody else right we'll close the public hearing on that no actions needed at this time that will be noted as educational opportunity for the public input and that'll be part of our ms4 records thank you for coming and doing that tonight thank you the um fire department's next we have monthly report response time you know year-over-year is improved 2023 response time in November was 13 and 13 minutes 50 seconds and 2024 is 12 minutes 12 seconds calls for service 2023 21 2024 22 uh equally divided between Medicals and and fire and the number of firefighters responding has gone from 4 to 4.8 that's the year-over-year comparison anything else on the monthly report all right next up is the interim part-time fire chief recommendation um I don't know if this got out I I sent in a note this afternoon regarding this RCA um my recommendation is we table it because this this process started back at the end of September early October uh was delayed till recently until this week um we originally had um a start date in October ending six months later and that's completely off now because we're not be starting this until first of the year if then um also at the time we had decided what we were paying because we wanted this to be an examp position there was a a uh a new minimum salary that qualified for exempt position uh that increased from $684 a week in July it went to $844 a week and it's January 1st it went to $150 a week federal courts have since ruled that that is nullified that is not legal and so the exempt Baseline drops back to $684 I think it's worth discussing um this position are we going because we thought we had to because of federal law go to the numbers that we had originally presented or because that's what was posted that's what we I think that's merits discussion on the part of the council and then the RCA here says that it was a unanimous decision to recommend Robert Miller for the position I don't know that we actually ever took a vote I don't know that how that could be stated as unanimous as we never I've never even seen the um psychological profile on either the the final two candidates it's also been policy that if the the two voting members which are the council members council member rainville and myself didn't agree on a finalist that they would come before the council and the council would would select that person so I think the length of term on the contract the pay and the review by councel the final interviews by counil uh necessitates this being pushed out and table and that would be my motion Mr Mayor C rain have second for discussion right um we did start this process a while ago but it took time to get interviews done and then we did our first initial round of weeding through applications and then we did interviews the candidate that was selected was to go to Martin mallister for the the assessment it has just taken this long to get that back um it wasn't delayed um on it by in purpose or on purpose it was we were waiting for information to get back um as far as the dollar amount uh we advertised it as a dollar amount I guess I would ask our attorney to um provide guidance on that but we advertised it as a certain dollar amount um the contract time yeah we had a time when we originally spoke that time is passed we're looking at a six-month contract so it would be what it would start from whatever date we were able to get a contract signed it'll be six months from then as far as uh unanimous we had conversations between the interviewing uh panel but as in the past practice the interviewing panel does not have a vote on it um Thursday we were in Mr layer's office and we had a conversation on it and I believe the conversation ended at this was who Martin mallister recommended and was there any reason not to bring them to council and I said I'd like to bring them to council I don't remember a negative on that I could be wrong but I don't remember a negative on on saying bring this to council and that that's just not at all the same thing of in passing saying oh by the way we got we finally got the candidate in they finally were able to get into Martin McAllister we finally got something back the the hiring committee has not seen to my knowledge either of the psychological profiles um and in passing when it was oh by the way we're having multiple discussions on other things we did get the response from Martin McAllister and they recommend one over the other uh that to me is not a unanimous decision to recommend one over the other that was never actually put to a a vote or a firm discussion by saying I didn't hear a negative is not the same as I treat that as unanimous and and I'm saying it wasn't to in my opinion it wasn't unanimous and I think it should go before the council the two finalists with the profiles for the council to make that decision Mr Mayor counc that's that's a fair assessment I would then move it uh table it till January and let the new Council deal with it I I and personally I don't need to see a psychiat the assessment I I'm going to put my faith into Martin McAllister that they provided documentation Scott is telling us that they said this candidate came out on top I'm going to put my faith in the experts I don't know what to look for in that evaluation I so I we I did anyone see the other ones I don't know I don't I wasn't part of that interview committee um but but I would say no they W they weren't back before I'm sorry what those those um evaluations weren't back before the council transition so counc Brian to say something well there's a motion on the floor right now Mr Mayor yeah was that was that for discussion do I get to discuss it hang on no there okay so there there's a motion there's a motion to table to table then there there so we have to my motion was a table okay and she's seconding it and so now it's up for discussion okay so that you're seconding the table all right yes Mr may I don't we need to get this this position filled it seems like as per our policy where we said if there was if there was not a unanimous decision that it would go to council there was a preliminary date set up to to have things go to council but then because of the um evaluations those got delayed um I would I don't I I would agree that if that that's our procedure that's our process that we need to address it we won't be able to address it tonight and and um that in my it's my opinion that this shouldn't can't wait until the next council meeting and if there's any opportunity to get this set up with a special meeting so that we can address it uh in yet in December that we should be able to get it taken care of all right any other comments mayor so I I I guess I'm thoroughly confused um for the simple fact that I first of all I did send your email out before the meeting so the council and the incoming Council saw what you had to say uh second well these topics that you have on here we talked about in my office with council member uh rainville present on Thursday I asked for Clear Direction on which we were going to go you had no opposition and I said we are going to move forward then with one we're not going to end up doing interviews and front of the council this is what the recommendation for art mallister was are are we okay then as a team moving forward and your comment was yes the only reason it's on the agenda for tonight is because we walked out of that meeting with the two votes which was you and council member rainville saying move forward our else staff want to put it together so now to throw this out there and have these questions and say we're going to stall this one out I'm just confused on how we walked out of that meeting with clear Direction on what you wanted us to do and now sitting here tonight completely on the opposite side of what we talked about in that meeting I was very clear and asked very pointed questions make sure that I was accurately doing what was asked me to do and at 2:15 today these things these questions came out completely undermining what our conversation last week was about we talked about the new Council extending the six month so that was addressed we talked about Mr rupe's recommendation to the staff was is that we stay with while we posted it for consistency stake sake so that was ran through our City attorney and point three that I'm looking at right here was thoroughly discussed in my office on Thursday so I am confused on why we're looking to table it and kick it down the road further so we have a different recollection um I don't recall I remember council member rainville saying in her opinion the contract started in October which is why I brought that up when do we think this starts but it wasn't this is six months from when we have a contract signed I don't recall that we had any discussion on on uh the posted price versus what the the federal judges have said was nullified the reason we we based our our uh our offer on that was based on federal Texas law I understand and uh so again that was not the point of the meeting in your office we' had a long discussion about other things and again it was kind of oh by the way we we got the thing back from Martin McAllister and it's very clear who they recommend I don't recall saying um again because it's it's ancillary to the other meeting that had taken place for very extensive conversation and and very challenging conversation between you and and councilman rainville and me sitting in the middle of it and it was like oh yeah by the way and I just don't think that's the way to handle it and if if the the council's happy with that go for it but but I think that the council should interview the two and make the decision and have the uh psychological profile as part of that packet but that'll be up to the new Council so Mr Mr mayor council r a question to Mr rupe this evaluation is that this something that is publicly available to all of us so we wouldn't see that it could be available to you as a council members as you're making your decisions it would not be available to the public if it parts of your packet it would not be part of the public packet that's in the back but you would have a right as the quote employer to review that okay so Mr I'm not quite sure why we PID thousands of dollars and then say we're not going to use it so Mr Mayor if we're concerned about the dollar amount it's a six-month contract and it's $400 a month different from the high end to the low end so we're talking $2400 to push this thing down the road and I find the irony of this kicking the fire chief down the road a couple months crazy and we have to vote on a city council member tonight that's been gone for two weeks so this is is a little insane to me especially when we look at what we think from a a resident standpoint and trying to we talked about this at length on getting somebody in there to help the team and now we're saying well let's let the new let's let the new Council handle it I think that's great but then let's be consistent on both of them and if we can't make this decision tonight because you don't agree that Mr Miller is the best candidate you want to move Mo it to the new Council great but then you need to be consistent both ways amen y amen I think councilman Brian would like to get resolve yet this year yeah I would then deny the motion and vote this person in and let's move forward I have a motion to second any other discussion seeing and hearing none all those in favor of the motion to table signify by saying I I I opposed n motion fails so Mr Mayor counc Ang I would move that we direct staff to offer the interm part-time fire chief position to Robert Miller I ask a couple questions on this yeah we have a motion a second so yes part of this do you have the contract negotiated already with him or is this something that you're planning you're you're voting to hire him would be subject to his approval of the contract because I don't have it written yet and I'm not even sure because I wasn't part of any of your hiring policy I'm not sure what the contract terms are I mean I I can I know I have contracts for Fire Chiefs on my computer but I don't know exactly what it is that you negotiated with uh U Mr Miller with regard to the position and would that be just posting that you approved is all we have okay well that's the question I guess is is if it if it's subject to a contract and I haven't drafted he hasn't accepted it yet that would be a cause of concern because once you approve it what's the terms what am I supposed to have in there so is it just the normal job duties of a fire chief and I mean is there anything that was discussed about any kind of uh PTO any sort of information about hours anything about response time any sort of information I I've heard different numbers I know the M money was probably whatever you posted would there be any what is what were you expecting to see in the contract because this is the first time hearing about it Mr Mayor Scott so I think a lot of the questions you're asking there Mr rupe were part of when we were looking for when we switched to the interim part-time fire chief those were the things that you and I were working on that we're going into the job description that we're stating it's this much there's no PTO there's no benefits we we should have a lot of that already and that's what I'm asking yeah that's what I'm asking because I wasn't part of any discussions that you might have had with any of these potential candidates not additionally to what they are but you were part of the discussions on the overall dollar amounts and all that so that would be the place to start and then we would work from there would it is it the anticipation of the council that you're hiring based on the posted job description and information and you just would like to see it reflected in a written contract Mr Mayor that would be my preference and I can get that done I just need to know what you're proving I would have the the approval of Mr Miller subject to him signing the contract to the satisfaction with the terms and conditions uh satisfactory to the City attorney so that if Mr Miller needs to it says for some reason he's not willing to sign the contract that I believe is reflective of what uh City administrator larner had said this doesn't automatically get him the position then we move on right yeah so Mr Lena won't be here after Thursday and so we're going to offer this guy contract based on your best guess of what the council put in a posting well I think Mr lard could email me the posting to make sure that I have exactly what that you guys as a council posted and then I can use take that and draft a contract Mr Mayor I'm um in the consent agenda we appointed Natalie um acting our interm administ TR so she would be Mr R's contact in regards to this with conversations with Mr ler if necessary right other discussion seeing and hearing none those in favor of offering a contract to Mr Miller signify by saying I I all opposed n Nate Mr Mayor Brian I would make a motion to to schedule a special meeting in within the next two weeks so that we can properly per our process see the two candidates and and discuss which one is the best fit for now then and then um go forward with that candidate I'll second after discussion Mr Mayor back in October we had a process that if a during the interviews and if there was any any any there if there was not a unanimous decision that they would come to council and that doesn't appear to be the with whatever Communications has been going on or not going on it's it's apparent there is not a unanimous unanimous decision and we should be able to address that in the next two weeks so Mr Mayor so if we were adding a meeting right now I would vote in favor as a person on the hiring committee I would vote in favor of Mr Miller based on what we received of Martin McAllister based on the interview process based on the grading that we did of the people that we interviewed uh the feedback from the interview committees um I would vote for him am I understanding that you would not vote for him so we would not be unanimous or could we be unanimous unanimous and we could be done with this it's putting you on the spot but either way either we come back because we weren't or we decide no so if we go with council member Brian's proposal we come back have this discussion and that Point determine that Mr Miller's the choice would be want option if there's two candidates one of them would be the choice Mr Mayor or we could go back to the my motion that was seconded by council member Alders it failed but can be brought back is that we come to an agreement right now if if we can and that we approve uh Mr Miller again based on the assessment from Martin mallister based on the interviews that we did based on the ranking that we did and the input of the of the interviewing the entire interviewing committee we're not going to go back and ask the interviewing committee because they don't have a vote so it's you and I that have to make that decision I'm I'm in favor of Mr Miller I think he's the best candidate he has uh battalion chief um experience um um the other gentleman is looking for experience um doesn't have that this is an intern position I'd rather have somebody be able to walk in the door and hit the ground running well again this is one of those process breakdowns but to move this forward I could be persuaded I'm sorry what I could be persuaded to keep this thing moving forward all right telling by Body Language nobody's looking for another meeting from the theft suspect was booked in Clay County Jail miscellaneous there were 15 vehicle crashes in November and now then highest monthly total for 2024 many of these crashes involve deer drivers are especially at risk in crashes with deer in the fall and early winter deer are most aced between 600 p.m. and 900 p.m. drivers should watch their speed and be on the lookout for deer and since Chief deput is not here anything uh from the reports that you would like followed up [Applause] on and hearing none we'll accept the report and move on L Nash cannabis thank you Mr Mayor as I think you're all aware excuse me the um in 2023 the legislature adopted statute that pertains to cannabis making it legal in Minnesota um to grow and buy and sell um so we have two things to talk with you about this evening one is an ordinance amending the zoning ordinance pertaining to where various types of cannabis activities could be allowed within the community you are required to have this in your ordinance um you're not able to exclude it from your ordinance So the plan we worked with the Planning Commission and came up with the following recommendations so the ordinance that's in your packet defines a number of terms that we need to have defined because of course they're new um and then we would be placing both cannabis retail as well as the lower potency hemp edible retail businesses as an interim use in your commercial district and then putting all of the um manufacturing testing extraction cultivation and all of those items as an interim use within your industrial district both of those similarly have a number of conditions that they would um if you adopt this ordinance that they would be required to adhere to including buffers from um schools dayc carees Residential Treatment Centers and attractions within a public park so that's item number one that we'll ask you to consider adopting this evening that way we will have something in place when the moratorium that you have lifts off in um January that's not to say that over time you may very well want to Chang some some of these things we're all drafting these for the first time we're all still trying to learn what these statutes are and the state hasn't come up with all of their rules yet right there is very likely that a lot of the guidance that we have received and that Cindy and I have been working on your planner and I have been working on on your ordinance and other communities ordinances may all change and so it's a work in progress and it's also a very poorly drafted statute so a lot of this I already know that there's lawsuits you know that are working their way through the court system which are also will give guidance eventually to this but this is our best estimate of what we think you should do given the current state of what we understand the law to be and the regulations to be and we recommend approval and and that's of the zoning piece so there's a secondary piece to this which is the all the non- zoning stuff so every community um ultimately can either choose to retain or delegate to the county What's called the retail registration Authority that um process similarly is actually even further behind in most counties um than the zoning pieces are because everybody's trying to negotiate between the counties and the cities and the townships just how that'll work who wants to place limits on things who doesn't want to place limits on the number um and a number of features like that and again that pesky set of rules that hasn't been adopted yet at the state level factors into this as well um it did come to our knowledge very late about two weeks ago that Anoka County has hired somebody in the position of a can't remember the title but it's something some senior cannabis person um they are looking at being able to offer that service of delegating those retail registrations to you um assuming that you um would have otherwise chosen to limit those to the one license per 12,500 that you can under the statute um I will say a lot of communities your size are choosing to delegate that authority to the county for those retail registrations there is a lot involved in the compliance and having knowledge of those um regulations again that aren't even adopted yet and for One retail registration it's just more convenient to have some one person at the county doing it for everybody rather than everybody's individual staffs so we have not drafted that part for you yet um and would like some discussion from you and we'll look at um working with the county and seeing what we can come up with now that they are starting to think about that themselves and try to do that in the first quarter of next year it does appear that because of some lawsuits that are going through the system right now along with the fact that those rules aren't adopted yet we don't think that the state's going to be in a position to be issuing licenses on January 1 at this point that seems to be the prevalent wisdom on the City attorney list serve and in the various discussions that I've had with other city and Township attorneys it's just they're behind and so this is something that if you did take the time to allow the county to put in place its own ordinances Rel relating to the registration and compliance and then you delegated that authority to the county I don't think You' be prejudiced at this point in time but I do think you need to consider putting the zoning component in there because that's relating back to you as a community so the question on the if if we delegate to the county um can they be imposing things on us that may may we wouldn't want because we delegated this authority to them so in that case it would be delegated for whatever process and rules they establish but our understanding is it has to follow our zoning it's got to follow your zoning it it seems to be that one thing that I have seen in some of the various counties like Sherburn and stuff and we are working with them Sherburn County for example put together this whole it it doesn't track the law so we have to go back back unfortunately there a county attorney's office allowed this to go forward without actually kind of really reviewing and understanding it so we're trying to change it on that situation but the one thing that appears that a lot of counties are putting into this registration component is if they do the compliance checks and enforcement for you they want the enforcement the fine money course which I I didn't have a problem with because it seems fair if you are managing the program and you're incurring cost for us that you should be compensated in some way and that's how that's the one thing I have seen and I I guess that's I'm raising that with you now so that you know that this may be something in NOA County asked for but they haven't indicated to anything like that to us to my knowledge they're looking at something just basically setting up a policy and procedure for how they're going to do this registration and compliance component which they hadn't thought of before because I think they were thinking Cindy you talked about I think they were thinking Well everybody's a city they'll just do it but then they realize they're still lywood Township and and I think that some of the cities have communicated with their various County Commissioners I know Lynwood did so that therefore now they are looking at doing this component we're bringing this to your attention so that you can take advantage of it if you wish if you don't want to do that and you want us to draft a registration component you just need to let us know and we will do so and the devil is in the details as with anything um the on the face of it the big negative I suppose of having the county do this would be that even if there is a limit set in that case it would be set by the County's population and any given jurisdiction could end up with say more than their allocated share of these types of businesses at the same time we've both experienced other counties who are writing in special rules to address that situation as well so we do have to just see how how they go in their process yeah we haven't seen it yet but once we do see what they are proposing because they have to adopt it like an ordinance we'll see it and then if that is not something that you guys are interested in then of course we can proceed to draft our own regulations you have the ability to choose right now we're we haven't done the registration component of it because it may be a waste of of of City time and money because the county may do something that is perfectly acceptable to us then it would be the County's issue yeah that would be not something I don't think the city would want to have more than we were required to have out here dumped because we were I think there's enough cities fighting to have it that it wouldn't be a problem but if they were looking to fulfill their mandate stick three of them out here that but we have that because they don't have their documentation prepared yet we go with the zoning we've done our minimal the state saw has and figured out what they're doing so the enforcement of it is not real probable for any immediate future the registration and component and and enforcement component so if we pass the zoning portion of it which can be modified once we know more information you always have the right to modify your zoning ordinance you cannot Zone this out I know kind of like adult uses you still have to have a component for it it's something similar I tried to explain to another client is they were vly opposed to this it's preempted by state law they recognize that people may not be happy with this and they thought that we would try to Zone it out and they basically took that ability away but they do have restrictions on it and we may be able to take advantage of that restrictions like I think mayor and you said if there's other communities that want it and they are as one County put it taking it for the team you know then it may be that there is no uh cannabis business in now that because the County's already met the statutory minimum requirements and so there is a benefit from the registration with the county to be able to go in and be part of their Global area all right right so at this point the action you're looking for is is a motion on the zoning portion of this yes Mr Mayor Mr Mayor mayor Brian I'll make a motion to adopt the ordinance amending the city of nland zon ordinance related to cannabis which would take effect upon publication second I have a motion council member Brian second council member rainville any other discussion seeing and hearing none all yes sir um my for whatever reason what you have in your agenda packet is the same as I have in my notes but it's in a different sequence so bear with me that we'll be able to get through everything uh in the right way first thing I have just up update regarding new staff um I know some of you that have been in the in the uh office and all that kind of stuff have seen what's going on there but I got to tell you I am thoroughly impressed and uh these two new recent hires uh with dilia and Shelly have been a great asset to the team um moving Lexi to fulltime giving Natalie a little help when it comes to that and of course you guys all know what what a superstar Natalie is and what she's been able to accomplish um and I'm glad to see that you all are looking at putting it as an interim administrator to be able to pick up uh some of the things that uh will be happening here before we talk about an interim administrator and so on and so forth so uh I just wanted to give you an update that uh if you didn't know it and you haven't been in the office that office is uh humming along um and I I think we're in good hands going forward and and and the two new hires are just uh picking up on things very very quickly so things are in good shape there uh you guys know this but the number two on here that the uh new now then uh m.net emails are all ready for 2025 get some uh you've all pretty much got your new emails for 2025 um but that uh that is in place and there's um people that keep reminding me that please use my now then email because I was using all emails so I I thank you for the the reminder from time to time to make sure I'm sending emails the correct way but uh we we will we will get there I think I did it the right way today so I that was my first one so um so a couple things that I put in here just an update on you know I promised all of you when I gave my notice that I would do everything I had to make sure we leave things in good standing and all that and and we've been working really hard and I've been trying to get things cleaned up but there were a couple of things that were out there that I've had questions on uh the the Danny ortell property that is uh that is uh moving forward we did end up noticing uh Danny uh Danny had a repres reprentative has contact us back and that representative is telling us that they were going to work with the local contractor to be able to get that uh basement yeah Foundation knocked out and all that so that should be that should be in place so that uh doesn't sound like we may have to do anything from a city standpoint so that should hopefully resolve itself if anything if everything continues on to trajectory that uh it's on right now Scott did he give you a time frame of when they might do that work no I I talked with the individuals today specifically Renee and uh he's working on a timeline within so I don't have a timeline as a t property owner or the contractor uh the contractors who I talked to who recently just as of this morning talk to the the resident that's representing Danny and they were going to utilize the estimate we got from the contractor to be able to continue to do it um but what we're being told is the homeowner or the representative of the homeowner is going to be taking care of paying that bill to the contractor to get it done to our standards yep so then hopefully we don't have to be the middle person there so um we've been working on and and and this probably will take past when I'm here but um McKenzie Hills and and the the gusterson uh estate out there um our city attorney's been working diligently trying to uh hammer out a developers agreement with them I recently was asked to be able to go out and talk about some standards on the driveway and so on and so forth um those I think I emailed you all that those were all resolved in the certificate of occupancy uh was issued by Rum River so there's nothing left there other than trying to massage this developers agreement bobin I don't know if you have I have ever I sent him that email that everyone received regarding the one outstanding Improvement that he was was was the uh Wetland buffer signs asking if that had been done and giving him an clean and Redline version of the developers agreement that I do and I will tell the council I do even though he believes that he has completed all of the various improvements that the he he the original developers agreement required of him that agreement was not only an agreement that was that went to successors and ass signs there were other terms in there including uh deed restriction on the property so we are going to need a developers agreement but I have heard back from Mr gson uh since I sent that email out which was last week probably last week I think yeah it was early last week and so I don't know if you know just holidays and stuff but he seemed like he was impatient to get it he's gotten it and I haven't heard from him yeah so I will keep the council and uh Natalie informed if I or Scott if he's still here if I hear from him yeah appreciate that thank you um the other one some of you council members have heard from a resident here um it's the ongoing dog issue um the on burns Parkway I have brought Natalie up to speed on all my notes and and the lengthy file that I have there um Natalie has recently had a conversation with this individual um but she's been brought up to speed on kind of where we are with that so this will be one that will not be resolved before I leave and may never be resolved before Natalie leav but it'll be one that we will continue to take care of as as it comes up so uh I've also had meetings with uh Mr rupe and Cindy and Rum River consultant just try to sit down and strategic look like what what things could be popping up on the radar the next 60 and 90 days just so we're kind of all on the same page so we did that uh just to make sure that we were all uh and Natalie I'm sorry and Natalie was part of that so when we moving forward uh everybody kind of understands which way uh we're heading uh as I'm getting ready to exit here so uh and then there's a lot of just day-to-day stuff that I've been sitting down with Natalie just trying to download information on provider documentation on um just certain things that normally I was taken care of that now I'm sharing with Natalie to to make sure that she's up to speed and she knows that I'm only a phone call away if she needs anything uh at that point uh next topic oh one thing I did want to add to that I'm sorry on the on number three that I had there um reviews for all staff have been completed uh so I got the reviews done I promised staff that I would get those done so reviews for 2024 performance evaluations that they are are completed so with the new Council coming in those will all be taken care of and and some recommendations uh for incoming councel of just some of my thoughts when it comes to staff and all that kind of stuff going forward but that's all done and we have started and I know that Mr Greenberg is not here but uh we have started started a week and a half ago uh flooding the ice rink so with the weather being conducive you'll see us out there putting water down so hopefully we'll have that rink ready for for action for the winter here uh shortly so next topic uh turning in my keys and equipment so I'll be Thursday is my last day um so I will be uh on Thursday turning in all my e city issued equipment to include keys and everything else and fobs and computers and everything that goes along with it so Natalie will be in possession of that uh by the end of the day on Thursday I also asked I put a request out to um outgoing council members to be able to turn in any keys or key fobs or any of those things that they they have in their possession or basically any other um city property at that point so I will be doing that on Thursday and I've asked council member outgoing council members to do the same binder um Beyond a binder do I have anything no I I think you're good I think you're good yes yeah um and and lastly and I'm just going to try to get through this the best I can on the last one um I have thoroughly enjoyed my time here I really have there's been some bumps there's been some this or that um obviously it wasn't perfect or else I went to did what I had to do 30 days ago but the relationships that I've built and and you know and I'm just going to name a few folks and if I miss some folks I am sorry um but I got to tell you in the last few days I have gotten a lot of emails and personal phone calls where people have called me and um it warmed my heart to hear some of the things that people had to say meaning that I must have been heading down the right direction somewhat what I what I was doing when I got here um the relationships I've built with the the guys and gals on the fire department certainly my staff man I'm so proud of this staff I hope you guys are as proud of them as I am the staff is phenomenal and it's getting better and better every day um the contractors that I get to work with on a regular basis um residents and business owners um it it's it's been a hell of a ride and I've enjoyed it um I've enjoyed the friendships that I've built over time I'm proud of what we've been able to accomplish as a team um and I could go on and on but I'm not going to I I'm just very proud and and I'm honored that the city council took a risk with me when they brought me in right I wasn't a well-known commodity I came out of the private sector right Council took a took a shot with me and uh I hopefully when they look back at the time I was here that they will they will look at that time as is productive and beneficial to the city and uh I just wanted to thank you guys all and the prior Council that was part of bringing me in here um thank you for the opportunity to be your city administrator now that um I'm very proud of what we were able to accomplish and thank you for giving me an opportunity and thank you for all the friendships and and uh and all that going forward and this place will always have a special place in my heart but my last day is Thursday and uh I just wanted to get that out there tonight that thank you for for all of you supporting me along the way and uh until I see you next time Scott's out on Thursday thank you thank you you're welcome that concludes my administrator update Mr Mayor all right we have a uh erns bottle sh St liquor license violation a compliance check from no County Sheriff's Department cashier working the counter sold alcohol to a minor with a vertical license after reviewing the license see an ordinance regarding alcohol violations are as follows um first violation within a three-year period Le one day suspension in addition to any criminal or civil penalties penalties are 500 $1 fine for first violation in a three-year period this will be Burns bottle Shop's first violation in the past three years they're requesting the day of suspension be either 12242 24 or 11125 or a different day of the council's choosing so the motion here is to provide a due date for the $500 fine and a specify a day for the suspension of the liquor license so Mr mayor council member rville I would move um that the fine uh move to provide a date of uh 11525 for the fine to be due and for the suspension of the liquor license the 1 day 1224 second okay we have a motion council member rainville second council member ran any other discussion see in hearing none all those in favor signify by saying I I I I opposed motion carried all right now we come to the um resolutions not going to move this till next year uh it's still on the on the new business for this year I'm out you guys year the mayor new mayor and Council want to do it in January and appoint somebody I think that's great those guys can figure out you're get what you want may we no longer have a corn no
