through it quick nobody knows what the public hearing is about background information in accordance with Minnesota State Statute 42911 City staff prepared a proposed assessment role for unpa special charges incurred prior to September 15 2023 as required by Statute the city council will hold a public hearing which is being held today October 10 2023 at 7:05 p.m the historic town hall City staff must notify the property owners by the following statutory notice requirements publish notice of the proposed assessment in the city official newspap paper and we do have a copy of that in our packet uh is the September 29th Edition this meeting and mailed notice of the proposed assessment purpose of the assessment hearing is not for the city council to determine if a violation has occurred the ability to appeal a citation is provided for as an administrative process under applicable sections of the city code property owners were previously notified of the citation penalty amount and any cost incurred by the city for abatement of the violation the ability to appeal the fines and charges that are now do lapses today as of this meeting the deadline for payment of the assessed amount without interest being charged that should say is November 10th 2023 a month from now once Del delinquent unpaid special charges plus administrative charges are approved via the attached resolution property owners have until November 15 2023 to made their assessment on the to the city the payment is not received by that date thein of balance plus interest of 6% per year will be asset we are being asked tonight to discuss the property owners uh the property that unpaid charges and formula an assessment list to be submitted to the NOA County pending assessment amounts may be eliminated or reduced as may be authorized after discussion by the council and then uh after our discussion there would be a motion to approve the resolution outlining miscellaneous special sent and has made the amended when pack the public notice we're not on yours yet so your SS and then we have the resolution in your package you will see the the list that was discussed in September and then the individual properties with the letters that were sent out and notations and photos from each Bo oh property number [Music] one is going to be you guys want to rearrange the books what I did is I just s the letter and then the property so we you're going through the list follow along property number one is p2- 33-25 43-3 5833 noris the letter that was sent out plus the administrative fee of 6% for a certified and so we don't didn't know that whether they had gotten this or not um we drove by a number of times didn't see anybody out knocked on the door one time and after the after the assessment notice was sent subsequent to that notice going out and the daughter-in-law went through the mail found the notice and as indicated that property would be cleaned up by October 30th I getting that right correct okay so the the assessment on that because it's been quite a while there's going to be [Music] 1,200 yeah this says 809 here that's says 651 there's a discrep be the 651 okay I'm sorry m what was that told that so on our on our spreadsheet it says $1,651 on our letter it says $1,289 which is the accurate the table is more accurate okay so the total being discussed here is $1,651 Liz having made contact fin what is your recommendation at this point Mr Mayor I would recommend that we keep it on the assessment list we have an opportunity later to remove it upon me seeing the property on the 30th and then we can remove that before the list is certified to Ana count and that would be the 15th we have another meeting before that's right certified to the it okay that sound good to the council Mr Mayor counc bri can we just get an update on the results of that not right after that make sure it's on the agenda t again so I just want to clarify that R say proper have until October 10th 2023 to pay the balance and full prior to interest charges being added so so does that mean that they still have till then and then you're checking the property in the 30th or is that um so I guess this start out um February 22nd letter 2023 says that I have number one was that I had no building permit $200 F I have a building per right here that falls within those days like to see that so it's from 9922 to 3823 so that is that one um undeveloped property was the second fine shall be illegal to store par permit or permit to be any stored vehicles of on undeveloped residential property um I had already uh everything was cleared out of there I did have two work trailers that Liz um gave me the thumbs up on and there was a tank in the back of the property I was thinking about using first sewer tank that I had forgotten about actually was back in the woods didn't think it was an issue so I guess that was uh sitting on a trailer that wasn't mine but uh that had been there since for a long time before all this happening so that one is questionable uh the third one is um uh living in a recreational vehicle prohibited that's ceased back in way back in August of last year that's all been good nobody's been verified by this um she I had her out to my house today I still have the same two trailers there today actually I'm getting rid of one of those um we do have a tolder I had home Bill trailer all behind the house or actually behind the garage it's there existing garage and that has the foam insulation for my heated floors under the concrete so um I don't know if anybody wants to see this building permit that was was valid than me and had a nice talk out there and I just feel like U I don't want you know I don't want to get Liz or anybody in hot water not here to argue anything I just I don't want to pay the $600 I feel that it's appropriate guess that's really all I can say about [Music] it I did comply and here we are I thought this was all cleared up because I had Liz actually out I made a note right here um well not that one this one on Three of 36 of 23 this year I had Li come out to the house she followed me from the city hall actually she came over um after meeting with her actually we had some issues with the easement to crop my property um that started that day right there I found out about these easements that were supposedly across my property and I had the documentation said termination of easement I did a lot of homework spent a couple weeks on it actually because I was nervous about it and the way it had been looking from different documents was have been pulling from County and registered AB directors in NOA well I followed suit and been doing to the county spent a lot of time I spent actually I spent a couple weeks on on a lot looking at different documents and she spent quite a bit of time on it too that all came about right at this time that um so the city thought they had a EAS went over my property for some roads a road um and through around the edge of my property back to my back neighbors and my back neighbors was the one that originally wanted to know about all that so and I I guess I could see why you want to know what the story is with that so um at that point obviously I quit working on the house uh I I actually let the permits expire after that because I didn't know what what the deal was with the season it took quite a while to find and I was right there was no using the cross property it was terminated and so that's another little twist on of all to but um yeah um that's it I just I just want to be clear to this I just like to be be stricken from the record the $600 and that's it Mr and Liz can also vouch for me for not living in the recreational trailers right we discussed that earlier right after you receive that letter yes that the RV was not there well that was it wasn't there back last year that's that's it I guess right so Liz will will'll have you bring us up because you you put this together you made the recommendation a year ago we went through this for a similar 5 so 3590 m Council CH the wave at that time progress was being made building building permit was applied for and things are getting cleaned out the current assessment amount is for single citation dated 22223 issued for storage vehicle parking and expired building permit no progress in the FR structure this has been exposed for years Mak St hours were spent working with property owner during the past year do three site visits phone calls meetings at the city offices Research into access issues and complaints from other property owners um building permit was extended through 62523 and hopes keeping the build permit active the property owner called in for framing inspection in June of 23 uh property wasn't ready for a framing inpe inspection had been told previously walls used bracing uh last inspection prior to that was October 22 there still no measurable progress on structure make it habitable meaning the in outdoor storage is limited and shall not include Vehicles had the been permitted to work he had been made two work trailers when he had an open building permit the 831 23 AR photo appears to show an RV has been brought back onto the site there was also a request for the owner to combine two lots into one uh after the termination the right away dedicated previous have been vacated as public access without doing the combination smaller lot has no access so what are we issuing a fine for so after the fine last year was RA um Mr weld still wasn't making progress we were starting to get complaints again about the property potential RV on site so he was right he had a building permit issued on 99 22 so it was close to expiring on 3823 so this was the time when Frank was still in the office and Frank and I based on the um new complaint um and excuse me what was the time the the expiration in 23 yeah expiration of March 8 23 well Frank was on in September 22 or okay I'm sorry so yeah he was G prev so um but we had talked about um these new complaints and uh lack of progress so with that building permit set to expire he hadn't done anything and so the rule is he's got to have limited to no storage out there if he does not have a habitable structure so we issued that permit I did go out like he said on the 6th of March or so thereabouts and verified there was no RV um but I believe I don't remember if that was the time that Scot with or that was another time but um so it wasn't the fact that there was just no building permit but no progress on the building permit since that time um um lots of back and forth um for the most part he's been in compliance I did verify he's in compliance as of today he was pulling one big trailer out of there this afternoon um so basically the agreement right now is as long as he doesn't bring anything back we don't care if he has a billing permit or not I mean we're done kind of fighting that battle I mean that's the recommendation that kind of Scott and I talked about um and so as long as he holds to that I guess it's really up to you how you want to proceed with this but is there an RV on the property right now no so I there's two trailers one of them the big one's leaving well he had windows and two tools and things supplies I had permission to keep those two trailers there before even I knew this was going down and Liz was coming out today I was want to sell one of the trailers anyway so Rach and I Beyonce were cleaning it out because we got some storage at our house now so we're cleaning out because I didn't want to sell the trailer it's a sow bu trailer actually and sell it but anyway I did make progress on the house actually and I did have quite a few inspections um they made me do a a whole bunch of required bracing and because of my Pro portal framing because of the windows I had I DET teral headers it's it's a nightmare um Can can I ask you Mr did you say something about joining properties what was that says here that the owner um has not combined his two lots into one as requested after determining once the right of way dedicated previously had been vacated as a public access thus making the smaller parcel no access gotta I wasn't for that came from Lizard was a neighbor complaining mentioned that this this afternoon about combining the line you mentioned this afternoon again yeah yeah I I don't have to do that but I may do that when I get a chance or I go sell it or yeah right now there's no access to it so right and I think that must have come around your research on that that easement I'm guessing well that was yeah it has no so once once you figured out the easement then then there's there's no access small okay um anything else this um so what's your recommendation was my recommendation would be to wave $200 for the RV that was on the letter um and you know that the other just s because he was violation at the time and that's when the citation was issued you know he was confused between his citation and citation from 2022 but it was at at you know honor about March that he finally started working with us and we had multiple meetings at the city office multiple phone calls um you know the city covered the expense for that research on the access these men so which is not my burden no not necessarily but we were helping you out as well as helping out people around I got we to here that has nothing to do with this thing nothing anyway um that's my recommendation Mr say on this yeah Mr a couple things so we did try to work with uh Mr W Shel here uh myself and SC from inspect we did try to extend his billing permit in uh the middle of 2023 um just to give him some more time to be able to get some of the work done here I think the framing he's referring to on Miss Stockman honor Stockman is referring to me being out there that was fall of 22 that's the only time I recall being on Mr weld's property and that we were talking that when Scott was out there also and we were talking about the the brackets and all that the one thing I'd just like to add uh to the conversation is is I understand that sometimes we don't we think okay we're in an office for working we have put a lot of time and effort and and hours into working with Brian trying to determine exactly what he has out there I know Liz has time into it I have time into it Brian certainly has time into it um at some point I think the time that we put into some of these things to be accounted for and not just written out um so um you know when I took a look at the aial total that dated August 31st 2023 the first thing I thought about when I seen that white trailer behind is dwelling there was did you bring in an RV or something of that sort so I was really happy to hear that the two of them connected today and Liz was able to go out and take a look and to verify it's not but it's it's it's it's a concern for me as the administrator that Mr wot continues to follow the the rules that we have in place when you don't have a permit there's a certain different set of rules that we need to abide by it sounds like today he has an agreement with Liz and we can move forward but I just don't want to lose the fact that we have hours into this over the course of an extended amount of time and if Council so sees fit maybe we should recoup some of our time that way that's all I have to say can I speak anymore yes you may great so the permit that I did send for I paid for that this one trailer here that in this picture is the same trailer just moved around the back of the house to keep it out of the sun because it's a $40,000 trailer I'm not even sure what this is It's supp to be my truck camper that's on the back of my truck my truck must be parked there but does doesn't even make sense that was back in 22 but but yeah here's a 23 pict everything's in compliance there so but here's the bottom line it says no building permit I did have a building permit undeveloped property storage of vehicles I was in compliance there and uh the third one not living in a recreational vehicle so I got to pay $600 because of circumstances that are Beyond me I mean I I guess I I I want to be I don't want to be a bad citizen here or anything like that circumstances come up I've actually been sick with something I think it's long Co since January actually that's here and there but uh there's other circumstances I got engaged we thinking about selling the property I have been in compliance and I guess I'm wrap it up with that you guys going have to make a decision on Ms both I mean the one is a little questionable of the that tank stored out back of the $200 but the the whole $600 I'm I guess I just fight that to that's just not right are you permit we got a recommendation right now to make it to 4 20 well that's that's up to you guys to make that decision I'm not going to pay it would be okay with possibly $200 actually I feel like I should be third of all it that's it have a question for you stated stated that you had kind of given up on paying some things um you had stated earlier that you had kind of given up when you thought that um the lines are running for your property so he had given so that's so that part of the thing that happened in the last years is what you were happened in March and started lasted for way longer than I wanted to it was very painful actually because not only you want to take my driveway which is an E8 mile long they wanted to go around the whole perimeter my my Lots out of bulldoze the house and sold the land at that point so yeah I had to get a when did you get the answers as far as when that came through that that was not well between March and probably early May so what he was saying before was that he stopped working on the house during that time yeah just just just for clarification though Mr Rell you've been on on before this Council for a number of years I mean last year we forgave it but but this property could have been three years at least so back through 2020 is when it started I've only been here one time I mean the property has been an issue for the city you came here last year when it forgave that because you were reinstating the building permit you cleaning up the property and so we forgave the the fine last year but had already had been cleaned up that's why they decided to forgive it but this is a whole different thing this is allegations accurate that's all I got to say it just it just isn't accurate you to add something binding that was right and I guess P I don't want to I'm I hate to take all your time and I appreciate you guys' time everyone here so I'm just going to step down let you guys deide thank you questions for Council so Liz the remaining $420 what is that what citation would that be against that would be the lack of progress on the building permit so it wasn't necessarily the fact that he did not have a permit he did have a permit but in order to keep it current you have to make progress with your inspections and then um so see the letter was sent the end of February was coming you're coming up on the March 8th deadline um and then with the you know couple other trailers or the one trailer he had a tank on and then like it was assumed at the time the letter was sent that he had an RV based on a neighbor's complaint but what I got up there he did not so I think that would be a fair action so there's a $200 Citation for lack of progress and a $200 citation fora tank on it yeah not being so we had a little bit more out there than just the two work trailers we had agreed upon $200 one for a is right I can't speak you much yes you can motor home there is a motor home there's never motor home on the property first of all whatever um there was progress on the building I've been working on it no I didn't hire anybody I'm doing it myself I had to re tear out all the headers had to re had to buy go by Braes that special straps figure it all out completely tear the whole anal on wall down all the big huge Windows big Windows big door in the middle big picture window up above I had to redo that so the lack of progress on the house nobody verified that that's just that's just there's no way of measuring that it's just not accurate and not that was in the middle of winter February you know January February was nice so I didn't have Su in where I could get and then the tank on was going to be a sewer tank so Mr Mayor I might add that there was there were expired building permits prior to this one being acquired has been going on significant period of time the building is currently sitting exposed to the elements and that's his choice I mean like I said as long as he not violating the storage requirements you know they have having the occupiable structures what changes your what you can store on a site but as long as he doesn't bring anything back but it's been a battle haven't brought anything back ever since the last meeting of year ago haven't brought one thing matter of fact since day one all I've done is clean this property up literally thousands hours of the cleaning this property up so is the intention to actually build a house on it or is this a retirement project that's going we don't really know at this point because I that mean you understand the Gap right it's to get the Gap but if there's no lot says like got to build it it's got a roof on it it's it's got windows in it it's not hurt it's not being hurt it's wrapped partially wrapped i' like to WRA the rest it isn't hurt me it's not an eye Shore to anybody it's in the middle you can't see it from any house anywhere even in winter time so it's it's it's Mr lard so one additional thing I just like and just see if you recall the conversation with me you I felt but your permit was become beginning to to expire and then myself and Scott from menp do when we extended your per you first wanted an extension for six months and we extended it to you for 90 days the other thing I want so we've been trying to work with you and the other thing I want to say is I don't think anybody here is trying to say that you haven't been working on the property all those things you saying you're doing but when we're talking about progress we're talking about having inspections and and mpec being out there and you making steps in the right direction when I when we went to extend your permit for you when Scott and I were talking about that and Liz and I I brought Liz up to speed with our conversation um that was extended for another 90 days as a courtesy to give you some more time to be able to work on when I contacted Scott from mpect there was never a call back to mpec to come out and inspect anything to show that there's been any progress or that any more work has been done now you may have physically been working on it but according to us here in mpec there were no more inspections that were called in there was no more site visits or anything done and that's the conversation that's quite accurate I did have quite a few instructions out there actually and I probably have the insruction card here no incorrect between the time of that was I'm not sure I'm not 100% sorry I don't think I had anybody else in midd wi you're right probably right PA I certainly did that's for sure quite a few times but because it's Problem Child up so I just want we we we've tried to work with you we' tried to be fair we've tried to extend things for you and and all those efforts and and time spent on that and working with you I mean how many times do you figure you've been in my office and we've been having conversations about all this kind of stuff at some point at some point we have to recoup some of our cost for all the time and effort that's going and I think we've been more than fair with you extending that the 90 days we didn't even have to do that did you um do you guys get part of the building permit fees because I got a lot of money and building permits that I just threw away and I mean a lot and I I got buy two three four grand Whatever It Is Well there's another point so I guess you did recoup some money actually most of the building per goes to the inspection pass through so like I said I'm not here it's just circumstance I'm sorry the bottom line is these allegations which just aren't correct and that's it if you want to make me some more citations or whatever I guess we'll go from there to me this just not good Council we've heard from the planner we've heard from the administrator recommendation is drop one of the fines 200 and and stick with 42050 other questions or comments Council looking at the with the permits is is because he was having a issue with the road I'm not saying it's right but I can understand as a homeowner that and you're kind of frustrated hug building it I get that I understand I'm not saying that's right though okay um because that would have been a time I believe that you could have you know I know you were talking somewhat to Liz but I think it would have been a time that you have said I'm not happy with paying this and doing this it's frustrating and I don't want to do it I can't I so communication um so that's something that I I I I understand so as an as a good effort I'd like to take 200 more off for that I am I did have Liz after I had come up I was good to go I got thumbs up do you recall the what we waved last year what things plans were buil same exact same exact been going on for years just during that time question maybe your point on working through this with Frank prior to Scott getting here it was the same issue which I well lot of Life circumstances couple daughters getting married this that ran so uh just a little bit of background about the feasibility report this is the first step in a uh 429 procedure so any project that results in special assessment this is one of the required steps to prepare this was kind of called a preliminary report uh Shane just just real real quickly though this is Shan's first through this um make sure you give us plenty of details so in the report obviously you saw there's a schedule meetings two of those are required first one is is two public hearings are required so the residents can get this so as as you walk me through it um walk us through that but the first one is is their chance to hear what we're proposing okay and they get the weigh in on it we'll have a public hearing these numbers this report will be be part of that uh then you can see the various steps in between then and at the end of that before we actually commit ourselves to non-refundable monies we have to have another public hearing when we have solid numbers we have bids we have those things and if a resident chooses to challenge that or what they call 429 rule statute that says um the impact on the property value um and its relation to the cost of the assessment they can challenge in at that point and be real much or we could say no it just doesn't make sense and we don't want to but there's two public hearings that have to be had the first one that we proceed tonight will be in November and that's when the residents get to know what we're thinking which is what you see here tonight okay so if you have any questions as we go along feel free kind of walk through the report uh so starting on page one we just have a little bit of background uh the roads were paved in you think in 1990 so they've been in service for about 33 years they they've served their useful life generally uh roads are designed to last 20 years uh try to do overlay the Strategic times to get closer to a 30-year life or more um just just clarification that that neighbor went in in probably 1970 and and back then the township wouldn't have had the road standards we have today correct and what we realized when we did the rest of that neighborhood last year they literally buried keys in the road and and so we had to dig those out and put in new base and we were down 18 20 ft on some of them correct even though they were redone probably in 90 they weren't good Lo to begin right yeah and the practice of using trees for like a subr stabilization they called it a cord R mod it was actually a common practice uh back in the 50s 60s 7s we have different methods that we we utilize now because over time the the trees will rot and they they don't no longer serve so um yeah so again the the roads uh were paved have been paved since 1990 uh they're experiencing some payement failure in the form of elevator crashing uh City actually done quite a bit of patching out there uh in the past years uh the current existing width of the road is 28 ft back to back it varies a little bit but in general that's what we believe it is say back to back this cly has vinous curbing on it where we haven't plowed into the ditch um and so back to back is the outside edges of that Cur so it's not the actual width of the road but the Cur included that correct and and a lot of our roads or most of most of the roads within the city uh utilize ditches and driveway culs to convey storm water where in this particular neighborhood the binus Cur was inas a storm Walker so any run out from the street it's kind of channelized in the Tous curb then it it runs at various uh discharge points and discharges either into a culvert a cross cver that goes underneath the tree or into the adjacent lows so I'll kind of flip in on page two uh that's just the map of the project area so uh again at the southern part of the the project that's the city of Ramsey they also uh have their segment scheduled for reconstruction in 2024 so from the municipal Border South uh will be constructed by the city of Ramsey uh and the properties that we've identified that would benefit from this project are highlighted in yellow and we've identified 18 properties uh this is always a a point where I encourage the council to take a look at the map and sometimes you know most of you have Liv in the community for a lot longer than or know it a lot better than than I do and sometimes you might know a property and say well that property is not buildable or something like that if the property is not buildable or if there's some extenuating circumstance it's always good to discuss that uh at these meetings as far as I know all these properties have uh structures on them so I believe they are buildable uh there's one driveway or one property that shares a driveway with the adjacent property so property uh number 16 share the driveway with property number 14 and property number 14 is some kind of a that has a sign off that's AED sign um so they separate P okay so right now they're separate PS but if they are owned by the same if if people have 14 they appear to live on 16 and have a business on 14 should they see an assessment of $8,700 they could decide to combine that property into one which we can check this number High okay then 17 benefiting properties that's always a risk in neighborhoods where people own multiple lots and they they combine them like we did old Viking Mach sorry CH okay uh so moving on to page three where we talk about the proposed roadway just one thing on that because of the way that that Ramsey has decided to U fund their roads these people down here south of this will not be charged on their property taxes Ramsey decided to just put it all in their Levy and I think they've got tens of millions of dollars road so this project for them this next summer is going to be a $3 million project but our residents will be B than the neighbors will getting pay nothing for what we'll be charging approximately $9,000 yeah that's correct Mr Mayor we we will literally have properties that are directly adjacent to each other and the properties that live in the city of Ramsey will not be assessed uh based on on what we've been told and then the properties and now then if what is presented in the feedability report is accepted would be assessed so that's something to be aware of there's always reasons for that you know different tax rates just different uh and and should should the council discussed not doing that know that the adjacent property s North two years ago that just assessed for their their project so and they're all Prett tight lot of those people been down there 40 50 years together so they know each other pretty well and the same trucks are likely going to be doing the work if if we pull with Ramsey on this to try and control cost you're probably going to have the same people putting in the gutters the curbing the Cs and corre that so they'll see this same truck working right down the road and they're going to pay this and they're not pay directly they pay taxes so Shane let's say that does happen let's say Ramsey does add curb and gutter and it is going right into our roads and we don't H can that happen or will we then add curbing gutter at the same time because it will continue well we are in this report we recommend adding curbing gutter you do because there's no ditches there's nowhere to ladder to run if you don't direct it to specific than right currently there's binus curb and binus curb was pretty popular uh you know during the time train in which these these roadways were constructed uh I've been doing uh my current job as a civil engineer for 24 years now and I think for the past 20 I have not seen pinous curve on a resid IAL neighborhood like this anywhere it is still utilized uh maybe on County roads out state but where you have uh closer residents just I think a lot of the the cities in the metro area figured out concrete St better and last longer uh we have less damage with our P trucks and it is a better product for concentrated water flow um and so a lot of City when they reconstruct grow uh remove the binous curve and put concrete curve back in so the the other thing along that because it is hilly and and pretty wet down there take a look at one through nine those properties there you to put a ditch in there to run the water off and take about 15 ft out of the front of their property and they don't have a lot of property there to take it out um some of the people actually have septics in their front yard just because the it's a it's a [Music] challenging um so as I mentioned the existing roads are 28 ft wide back curve to back of curve and that's what this report discusses replacing so a roadway with 20 ft uh back to back with the exception that instead of a tmin CS it will be a concrete curent uh we're assuming 3 and A2 in of a Tas which is our city standard and we're uh We've included in the quantities two in of additional aggregate base uh just which is just an assumption at this point so at this point we haven't done any soil boardings we haven't had a geotechnical evaluation if this project proceeds and mve to The Next Step our next step would be to get to obtain quotes from uh the geotechnical firms such that we can either confirm that assumption or revise it and that's typically done with preparation of the final construction plans generally we would not go back and revise the feasibility report based on the soing shame did we determine that's part of the engineering legal and administrative correct is that it's not additional it's not additional and the neighborhood we did just north of this as you can see where ventry goes up in the middle of your top third so ventry where the yellow line is everything North on ventry there we did in the previous project two years ago okay that's 22 feet wide no curve because it's fa flat up there so that neighborhood's pretty much pretty consistent 22 feet on those roadways correct and so roadway with the curving here 28 ft is about 24 ft that is correct the the concrete curbing gutter is 28 in wide uh on both sides so it's about four and a half people so so the uh the actual payement in between per face occur to face occur would be roughly 23 and a half slightly wider than the the payment section um to the norm like it is not uh yeah actually yeah yeah if you drive there yeah on Entry Street you see the binous curve and then there's a a pretty sharp taper of where we tapered into the the roadway that was reconstructed two years ago then for easements we don't obtain uh we don't anticipate obtaining any new easements at this point we have't ordered owners and encumbrance reports for these properties uh but generally we're keeping the rad the same as it is now so therefore we don't think that any e will need to be obain as far as the drainage system in general that we think the drainage system is is uh functioning okay uh you know again there's the dra exess of the tus curves and the calverts and it appears to be conveying the water away from the road into the low area so when I say that it's functioning okay what I need is uh in conjunction with this project we're not recommending some other really large ra Improvement projects an example of that would be right here in iguana Street where we have some water and and some water that's backing up because of a ditch that hasn't clean them pain for several years and in that instance maybe we would recommend some drainage improvements in this this location doesn't seem that would be a factor uh so then also on page four we get the section five the estimated cost so the total estimated cost for this project is 75200 uh of that 7 152,000 uh we estimate that $313,200 will be for the payment replacement the concrete curb gutter in the driveing matching and that's an important number because of uh when we get to the section we talk about kind of the cost for uh remaining 438,000 will be for the subgrade corrections the base construction storm sewer restoration or brand cost so now we flip to page five these are just that last last paragraph second last paragraph there on that page four assume that this project will be bid concurrently with other similar projects R which is anticipated to result in lower bid prices that caveat is um and lately we're seeing inflationary effects on cinus and labor and things like that of about %. so we may see a reduction but it's very likely going to be at least this expensive even that the Shar cost it's so if that's that's fair I mean we we have no idea what teaming with Ramsey could bring it down but we also idea what other crost going to be next year right yeah in general I think uh you know the advantages of of entering into a joint project the city of Ramsey will be uh it's going to be a larger project we're going to attract larger more professional contractors uh the contractors have mobilization costs you with the cost of of delivering the equipment to projects and uh if we're combined they only have to deliver those pieces of equipment once and they can do both projects opposed to if we had separate projects you we have different contractors mobilizing and I I think another really big factor is convenience to the residents uh if we don't uh do a joint project with the city of Ramsey it is very possible that two different contractors could be awarded the projects in the respective cities so in city of Ramsey they might have one contractor city of now then we might have a different contractor they're going to be on different schedules uh you know you might have one contractor trying to pour curb while the other ones driving semi trucks trying to haul in material and there be a constant conflict uh not to mention there would just be uh there would be uh less work occurring together so in other words you might see concrete curve and gutter uh in Ramsey or the driveways being Bo and then on the now side our residents will start calling say hey I see they were just here how come the curbs in front of our house aren't done yet how come our driveway has been for yet and then we have that explaining the do well it's a different contractor we think they're going to be there in three weeks or six weeks or whenever that sched I the other thing to know to this neighborhood is you cannot get to it from now then you have to over to get into it so if Ramsey's on a different schedule than we are those residents have to drive through that Ramsey project to get to this area from Dr res recently down there and they didn't know what downtown downtown one of them said they didn't realize they came the city for four months uh so moving on to to page five uh this is just our estimated big quantities so these are individual items that we anticipate could be part of the project but at this point they they are just what we call a good they're not actual quantities we would not be able to bid the project off of this because we don't have an actual set of construction plans we don't have the geotechnical data this is just based on our experience with other similar projects what we think uh may be included uh one thing I would note is we we do have some quantities in here for subr exavation and bringing in a bill or a good clean sand so we have some money in in the estimate already for that it's probably uh it's 33,000 it accounts for about $660,000 of the estimate um and that's for things that just from me looking at it where I think it might be necessary there are two kind of areas that are are low that I think would should be uh look at being raised with the project the one of those is will be on wo Drive kind of uh just west of wo street so there's a wet land a big wet land to the north and there's an area that's slow and right now the water is draining across the pavement I think we could do something U that would be an improvement there and probably provide a safer roadway one thing that or the reason that we don't like it when the road sheets across is because during the winter time we generally snow snow pile the roads and we pile snow on both sides so we pile snow on the on the downstream side and the Upstream side while those warm days those snow piles melt they start melting across the pavement and then when it cools down at night again it freezes and it creates icing problems so sometimes you know I think we've done a a pretty large patch in that area and sometimes you see the expert da day just because of the water flow and other times because maybe you have to Salt it a little bit more because you have an icing problem so we want to look at correcting that and then it's also uh low right at the corner of where wle Street uh takes a 90° turn to the west and it turn into 1802 l so those are the two areas that I've kind of identified that I think and that's what my the the quantities in here are based off of um and then in addition we also have a $30,000 construction contingency in the S now now again we will we hope to find out later on in the process if we're going to need that item and generally as we have a geotechnical data and actual set of construction plans we can remove or reduce that construction contingency but right now the does include those two items um so when get to section six of the financing and assessments portion the first thing I want to state is that the council does have some discretion here uh we have a past practice of assessing 50% of the project cost on overlay projects and we also have a past practice of the city funding subgrade improvements or subgrade repairs and drainage improvements for projects but we do not have a hard and fast assessment policy uh and the reason that we we don't have a hard and fast assessment policy is so we can look at these project on any legal basis and the council can kind of determine what's fair so what I did for this project is I applied we've done in the past in which the uh the city pays the uh subr Improvement costs the drainage cost uh and then assesses just the street replacement cost uh and in this scenario will be the concrete curving gutter uh as well as the driving so those items our estimate is 33,200 and what we've done in that past project is we' assess 50% of those items uh so so using that methodology $156,600 will be assessed to the benefit of properties and dividing that by the 18 properties would yield an assessment of $8,700 per unit and again that number is it stays at 18 and fitting properties people ony board them trying to get annexed into um and then there of State EV so generally uh when assessments are LED against the property they have uh the property owners have two options they can either pay that assessment op and full before we certify them to the county kind of like uh you discussed in a assessment list tonight uh generally that deadline is November 15th uh and if they take no action then uh that amount would automatically be certified for the taxes and then will be payable over 10 years at an interest rate set by the council and interest rates by by law be one and a half to 2% above what we borrow if we borrow on this that is correct if if the city borrows money to finance the project uh you're required by law to charge a slightly higher interest rate than what you borrow the money at and the reason for that is because not everybody pays their taxes not everybody pays their assessments and in the situation where not everybody pays their assessment the city still has to make good on that Bond payment so uh there is a requirement statute uh I believe that's the purpose that it has to be one and a half to two points higher than the the rate that put much money was B at and last time we borrowed money we about 2.8 million was at 8% uh rates a little bit higher yeah they are so we're at 6% we might have to we'll be looking at 8% and that's over 8% a year for 10 years I think that the other part of that charging over the interest is because some people pay it off and so there is no prepayment doesn't cover what we would anticipate we're going getting interest that is correct so uh yeah because of the uh at the time of bond is sold generally you have to decide how much you have to your Bond's going to be for and the city pays interest on that full amount well if and you have to do that based on kind of educated guess of prepayments and if you get way more prepayments you're still going to have uh I mean you have the principle but you don't have the principle plus the interest that approv well then just to skip the second last paragraph there total estimated cost the citywood fund in addition to the 1566 would be 5954 um ultimately the city funds the whole thing and then we get it back in the assessment in payments so ultimately we have to we have to have $752,000 that is correct because the contractors get paid on delivery and we get paid on time right now I'm actually have 72,000 Cas I'm woring about it anyway that's if we move on to page seven and section seven which discusses the project scheduled this highlights a couple of the the major steps that are involved in the 429 assessment project so we're here tonight uh discussing the feasibility report uh you also have a resolution tonight approving the feasibility report and calling for a public hearing so assuming that's done uh there's certain noticing requirements and advertising requirements that would have to be followed um so we would assume that the earliest we would have a public hearing is in November of 2023 so again that's where we invite the residents in we inform them of a proposed project we give them an estimate of the assessment at that time but really the purpose of that public improvment hearing is to talk more about the project elements um one thing is you know right now the road's 28 ft wide uh and we might want us to lookit input on uh do the resident feel that's the right with uh know a 26t wide road we would probably uh serve the purpose in this residential area just fine but if you're parking or you have a lot of you know people parking on the roadway well maybe they'd rather stick to the wider roadway so uh we also talk about drainage and you know the the the uh proposal to replace binus curb with concrete curb together uh so those things are discussed at the public Improvement hearing and then from there the council takes that input and then decides whether or not to to order the project and Order preparation construction plan uh specifications in which case uh the project or some of the project elements might be slightly different than the assumption that we in this report U and that would be uh so that would be a something that occurs over the winter design months certainly that's what we do in our on during the winter months is do the plan respects for the project that we buil in the summer um so if we ordered plans ins specs in November uh we would uh present those to the city council in February uh for review and approval of plans insect and at that same time we would also authorize the ads that's when we advertise for bids that's another monthlong process uh and at the same time we call for the assessment hearing so normally we call for the assessment hearing uh and when at such time that we invite the residents in we actually have the contractor vids in hand so at that point we know if the project is going to cost uh and that's when we really talk about the number with the resident that's when we tell on this is your proposed assessment and they been speak to the number that proposed be uh if we follow that schedule the bid opening would occur in March that's when the assessment hearing would occur in uh we could then uh award the contract in April of 2024 uh and then we' have uh you know a month or two to to get contracts in order have a preconstruction conference and then construction could start as early as June of 2024 normally what we do when we make the projects is we give the contractor a window if we specify a really tight construction time frame generally what we're going to see is DS so we we specify a window usually it's you we don't want to see you starting until after school gets out we'd like to have you done by the time school starts that's when we try to do most of these residential type projects and then the contractor based on their other schedules and their other projects when it fits best for them can complete the work uh kind of at their discretion with the only Clause that we generally have a a continuous progress Clause so it's fine if you don't want to start this project until August but once you start this project in August we want you to make you continuous progress on it so that it's done within say six weeks of construction or eight weeks whatever we determined is an appropriate conu time frame based on the actual fond so on this schedule the April the city council approves bids and contracts that's the point of no return that would be the point of up until that point we can we can drop this project once once we award contracts for yes sir sh remind myself in the council the feasibility study is included in the engineering fees that we s in here is that correct that is correct and if this project doesn't go forward is there a estimate or an idea you can give us what the cost for this feasibility schedule will be if the project didn't go forward you know that uh generally preparing the P Bill reports is right around $4,000 so that's where we're at tonight if you move forward you're going to incur more costs so uh you know if you move forward with uh the geotechnical work you know a lot of times that's right around $10,000 if we have to order owners encumbrance reports so they're like $700 per parcel there 18 of them um the surveys the preparation of plans specs so as as we continue to move forward you do incur costs but really the big cost is that um you know Contra I appreciate that I know we talked a little bit this week about I just want to make sure the council is kind of disp that so thank you so uh uh with that I think I'll stand for any other questions that there are uh we already talked a little bit about uh you know the possibility of entering into a a joint Powers agreement with the city of Randy I don't be a joint Powers agreement or cooperative agreement but some kind of an agreement uh uh Joel ran the assistant city engineer just gave me a call on that last week uh he's asking a few questions where does that fit on this schedule we're going to be looking at um bids Council plans and specs um advertising for bids how does that work in a joint agreement like that coopertive yeah there I don't think there's a you know there's a a hard and fast rule or requirement and maybe we could consult attorney rupy if this this moves forward but I would think a good time to consider this consider that agreement would be at the November meeting so yeah because we we would have to we're if we're advertising the bids in conjunction with them we have to be in sync that is correct and we are already uh schedule wise we are already behind the city Ramsey uh so uh my office is also doing the the work for the city of Ramsey and we've already done the field surveying for their projects TR out yeah and there you know they don't have to go through this extra step so they didn't have to start with the feasibility report they don't have to do the 30-day notice uh and and have the the residents in so they just can Will great uh preparation construction is this time uh I think if we follow this timeline I think we can catch up and uh we'll be just fine but that would be one thing that I would discuss with Joe I when I talk to Joe i' let him know that's coming here tonight uh so I told him I give him an update after I could do that Improvement hearing like the Wednesday before Thanksgiving get it over with quick Brian questions this off the top of your head if we did go to 26 instead of 28 ft is spit ball how much that would save it I think it's 10,000 10,000 toal say $10,000 to make a 26t road instead of 28 wow and there's here's some other chunks if you look through that SCH the curving alone is34 we've seen concrete Rices over the past few years you know they're one of the things that have had double digit increases year after year part of that is you know there's a some kind of a concrete shortage not all contractors can get concrete St can only get uh you know they have allocation so um and then we also exceed on like uh pipe material so concrete pipe uh plastic pipe have had some pretty dramatic price increases year after year and and the pipe in this area you're talking kind of correct yeah whenever we do so uh so this road uh if we were to use the concrete curbing gutters and the payment uh we would expect the concrete curbing gutters to last somewhere between 50 and 100 years and the pavement to last somewhere between 20 and in 30 years so uh at year 20 we would recommend that the payment's evaluated and uh if you know the the pavment needs it or if it's showing signs of distress then the city could do an edge maill and an overlay uh so that's where you you Mill the edges you actually uh instead of a e/ inch lip at the curved facee you increase that to like a quarter or a half inch um and then you kind of end up with this uh a little bit different shape of a crown in the road but you can increase strength and a lot of times when that's done on these Urban section roadways you're seeing lives of say 35 or 40 years uh you can potentially do that EDG Mill in overlay a second time or do some other payment preservation practices to make it even last longer and the reason that we don't want to replace our CS with metal covers or leave the metal CS in place because generally they have a service Ty of 20 years so the rest of the roadway is still good we don't want to dig the roadway I'll dig that part of the road up I just replace the Cs at the head you here here okay other questions question do we need to pick a public hearing date tonight um well the staff in October here has to mail publish notice and leave 30 days uh Mr Mayor I did speak with attorney Ry today uh and asked about his availability he would be available on the November your regular November meeting so the second Tuesday November we're having a a regular yeah we're having a Improvement here pretty much I was look at this next the following Tuesday the 17 no I did not go into the following week at all I as I did ask attorney rupy about his availability uh the the remainder of that second week M uh P to be available Wednesday or Thursday if that's something that the council wanted to do generally I think Bob's pretty busy on Mondays most Mondays and Tuesdays uh if he attend a lot of meetings more than I certainly want to um and so I think if we generally we do have the attorney available at the public approvement hearing and the hearing that is a legal proceed by one day if you go that next we Tuesday before 16 and one thing to keep in mind is there's only 18 Property Owners so uh in past projects we've had projects with a lot more Property Owners uh but I've had public Improvement hearings that have lasted 15 minutes which is just basically the presenting the project uh and other ones that have lasted a couple hours so y me too the 9th the the 16th or the 2th the n9th I already got a work session plan let it's jeck with Bob on the 21st otherwise you're saying the 16th how do that work with the rest of the council early if I can set you're it depends there are some put on the agenda about s cor's discussing that tonight and there were some things that he had said that he reached out to people that's a shame he did not but there's some we're going to have a discussion about it there was something that he had spoken with me about with the DNR and who approves certain things or who I think we can just get okay yeah I don't think Shane would Char than yeah we'll find out sure okay we'll let you know all right R along X will be fire department and chief Schmid couldn't be with us here so I'll give his report quick [Music] all right September response plan comparing 2023 to 2022 response times a year ago was 11 minutes and 7 Seconds this year 13 minutes and 3 seconds and we're taking a little longer in response calls for service had 15 last year and 16 this year the charts a little Dy because we're going up in2 increments but it's only one more call for service this year than last year number of firefighters last year at 4.8 responding to the fires this year we're averaging September 4 firefighters and fire runs versus EMS pretty close to last year seven fire and 9 EMS versus 8 last year on September 2 3 fire department responded to 16 incidents on more than the previous month of August an average response time of 13 minutes and 3 seconds which is a 16 second improvement from August so we're down slower than last year but up from August average number of fire fighters attending calls for service was four fire department reports no dollar loss from the fires during the month of September the fire department assisted other agencies two times in the month St Francis once and Ramsey once and received assistance from St Francis once in the month September 3rd fire department was dispatched 6300 block of 218 Avenue Northwest or reported allergic reaction after a beain to arrival the patient self administered in EpiPen as the patient had known a known allergy with anaphylaxis to beast thingss on arrival of patients condition began to decline again the fire department successfully administered second dose of eanon this incident is an excellent representation of the importance of carrying critical medic ations that even though this patient had a prescription was aware enough to be able to self-medicate the duration of the ethine very short approximately minutes and had in capacity to further interventions made a difference in the outcome to this patient that pen I believe is $1,200 so she's bringing that up because it's a very expensive thing to have on board but it was very important in this Cas so September 4th mil County Sheriff St Francis PB and nowland fire responded to the report of cardiac arrest the CPR in progress at the bar none facil AR arrival of law enforcement staff was providing chest compressions to one of the residents at bar nun law enforcement established the patient did have a pulse or return of a pulse but noted the patient was not ging law enforcement provided life-saving interventions until the arrival of now then fire who assisted law enforcement with critical activities including use of the powered suction device an advanced Airway known as an iel Naran was also provided inasal patient was transported to the hospital by a light EMS in serious condition that was I think they did the N Canon and then they also had to do I remember right I had to do an IV on that patient as well with the N 5th fire department Hope County sheriff and theine ANS were dispatched to pick Lake for the water rescue you saw pictures of this initial reports were that a boat had capsized stranding a victim on top of the boat and the victim was swimming for an island along with a stranded hunting do now the fire arrived initially deployed their rescue boat they were able to recover both victims and the dog the area of rescue was a significant distance from the shore and the launch assistance was utilized by the county sheriff with their boat out to cover floating items and ultimately tow the boat and recover victims to shore no injuries were reported on the positive side these were also able to assist recovery of hunting equipment including guns a portable gas can in a pollutant decoys and recovered the game that was quite a team effort we appreciate that on September 30th fire department along with no County deputies the line responded to a report of an accident with injuries on the 20 22400 block of St Francis Boulevard initial reports were two vehicles collided headon fire department and the deputies were already responding to the bar facility at that time when the accident occurred our Personnel provided traffic assistance on St Francis Boulevard as the patients were attended to by align EMS and all of the new recruits have started their training the recruits are currently enrolled in an EMT course being delivered through a line of EMS and they in class every Tuesday and Thursday evening Fire Department open house during Heritage days went very well unfortunately the weather in the latter part of the day did not cooperate for up fire Loop explor anything else you want to know about fire out thank you Mr Mayor members of the city council I have the report for the county sheriff's office for the month of September 2023 you know under my written report under call for service there's a typo there it reads August 2023 call for service that should say September um the numbers are correct I just uh didn't change the month and they should have there so just a note for you uh in the month of September we responded to 129 calls for service and a total for 20123 is a total of 1,171 calls here to date we're about 106 calls over last year's year to-day total again those calls uh in September included four to the barland facility Five Alarm calls eight Medicals and six animal complaint reports a couple calls of notes animals with quick complaining couple calls to the bar none facility on the 4th uh at 11:14 p.m. deputies responded to the bar campus on a report of the juvenile female not I'm sorry that's a male even a male not breathing arriving deputies found the victim had a pulse but was not breathing adequately First Responders recognized a possible overdose situation something we're seeing a lot of in all settings including our jail and most of our communities um deputies administered Naran which we are carrying all of our squads as well now then fire arrives shortly after and and placed in advanced Airway the victim that is critical because we carry in our squad cars limited Airway management tools because we're not trained at the same level as the the no fire department is they arrived and I saw the chief puted in his report that igel Airway allows us to get fully oxygenated oxygenated air into the victim a lot faster and a lot more efficiently that type of equipment coming to scenes like that is critical for us especially when response times for at in M can be a little bit longer and some of our more Metro Southern communities the victim began to recover on the scene was transported to a nearby hospital fore addition care uh on the 30th uh at 2:14 p.m. sheriff's deputies responded again with now then fire to the barn and facility on a report of a juvenal female that had self-inflicted injuries to her uh wrists upon arrival they found the deputies found that there were just minor cuts and uh as mentioned in the in the fire report fire diverted from that call to the crash so we handled that one that uh that young victim was transferred to the hospital for a crisis care again another thing we're seeing across our communities there more and more need for crisis care and many times both us and fire our First Responders to those situations to provide that first initial care um some other not with the incidents from around the city can can I ask is the sheriff doing any social work you brought in social work those types of things so that we don't have an eded social worker right now but in our long-term development plan where so the County Board received Public Safety Aid money that we can use potentially to implement some of those projects wellness and some of our social Outreach programs so that's actually a discussion we had just this week about how we can better integrate our our social workers who are experts and get them into the field to where they can provide uh sort of critical expertise that props have it but we're not as good at it because we don't have the training that um some of these folks do so it is in our long-term plan bla P has been very successful with their program one of the Premier programs in no County um so we uh are working with them and talking with other police departments to see if there is a there sort of a co-responder model we can share costs to try to get someone because as with any there's a shortage of these type of experts and um we asked a lot of those folks who would go into the field with us so short answer is yes it's on our radar we're working towards that New Hope got quite a program going to and it's proven it's proven pretty effective on the road so um other noteworthy incidents from around the city on the 5th uh at 2:29 p.m. we responded to the area please not at time 2:29 229 not 2:30 no just it's it's not late in the evening it's not this is somebody coming from lunch apparently long lunch yeah we responded to the Area bking Boulevard in near Highway 47 on a report of a UNC Sierra caller reported that the vehicle was driving recklessly passing on the shoulder a deputy responded to the area as this vehicle was completing a very unsafe pass on the shoulders through slower traffic um of course the deputy stopped the vehicle and made contact with the driver an adult female who immediately showed signs of alcohol impairment again this is 2:29 in the afternoon we did our normal on-seam testing and evidence Gathering and that drive they arrested for DWI tested at Double the legal limit legal limit in Minnesota is 8 double the Le limit is16 and that uh generally results in a driver's license and a license plate rication even for a firsttime offender so that's a very intoxicated driver in the middle of the afternoon so good person to get off the road and we thank that 911 caller for calling we do get those calls pretty regularly about reckless drivers sometimes we can get there quickly and uh and locate these vehicles and make stops and sometimes we can't but we prefer people call in because there are there are frankly there are gr drivers on the roads in the middle of days so um so uh good arrest there on the 20th 8:25 p.m. we responded to the 6100 block of bking Boulevard on a report of a vehicle that had rolled over into the ditch um the person arriving Deputy located a 1996 F350 which is a very big truck by the way rolled over on top on top uh onto its cab deputies arrived and found the vehicle appear to be unoccupied our first concern I know we've talked about this before that soon had have been ejected from vehicle or was underneath the vehicle that prompted a rather large response from area public safety personnel including the Nan fire department um total of 12 police squads we had K Rapids Police Department came out and assisted us with their drone to try to search for victims and then Northstar to was also called to the scene to expedite to try to get the vehicle moved to see if there was someone under the vehicle ultim never located one in the area we checked extensively and didn't find anyone that vehicle was towed from the scene and help for proof of ownership and that case is ending did you ever find the owner no we have not yet on the 27th at 10:47 p.m. we responded again to the 6100 block of Viking Boulevard on another R crash with injuries the reporting party indicated she had been West on Viking when a 2007 for F150 pass her and a high rated of speed she observed the vehicle lose control slide sideways and then it left the roadway and rolled into the South ditch deputies responded and located an adult male driver who had minor injuries but showed significant signs of impairment at the scene he again went through our standard onfield testing and ultimately was arrested for DWI his test result was almost three times the legal limit at. 23 uh he was booked at the ORD County chil on charges of these going till 10 yeah couple other updates from around the office we had our open house last month we had a total uh over a thousand people came to see us they came to see our canines and had some of our Public Safety Partners including um the state patrol helicopter and um our local Air angle and service came so highly successful I love open house night because I just get to walk around on top of people and see helicopters come in and that's always fun but the problem is is usually when the helicopter com into a scene uh we don't have time to like check it out because there's some unfolding emergency we're dealing with so nice to have those Partners come out and had a lot of folks come out and see us which was great we also attended the now then Heritage Festival we had our K9 diesel came out um his Handler Deputy Cutler was there as well did two demos this year we got a lot of people that came out on watch I thought it was very very engaging very interesting people I got to come up and get pictures with diesel and so it was very cool um one of our rookie dogs was there um um but that dog Joo is still in train and uh wasn't really wasn't really up for some of the demos Diesel's an old veteran he's been doing it many years but U so some some keeni now the residents may have seen our new rookie dog too but um yeah was a ton of fun got to see the fire department cut a car in a little pieces which was cool and got to see some giant pumpkins and uh yeah was a ton of fun the mini Donuts were great so by the way our local grower just set the world record yeah really yeah alltime World Records 28 2856 or something like that that's fantastic it might as well be an all right adding $55,000 too holy cow really that's not a bad that's not a bad day at the office um we actually had uh we had a sort of a a run of some cool awards that have come in in the last few months for us Detective Jesse stal who came to us from the Minneapolis Police Department um he joined our criminal investigations Division and actually received a Statewide award um the organization is called minia they're an organization of sex crimes investigators that um they meet annually and he was awarded uh for the state for his work on a child sexual assault investigation where it came in as a single victim single suspect and as he worked through that investigation he was identified he was able to identify uh three other adult males who had been with this underage victim and this was clearly a sexual exploitation trafficking situation he could have easily said oh I got my suspect I got my confession I got my Victim we're going to move on but he pushed ah head and took three more people off the street and um those cases are still active but that only one investigator in the state gets that award and it was pretty cool how long has Jesse been with he's been with USX you um he's one of a small handful of folks that we've been able to recruit out of penan County to join the our Sheriff's Office U we've recruited folks from Minneapolis Police Department uh Brooklyn Center Police Department Brooklyn Park Police Department great cops they come up and they do great work for us he grew up in now then I don't know if you knew that I did not know that he that the Kid Next Door okay um his his folks were both his his mom was and yeah actually got them both at the award for first time so um our lab um which is called the Midwest Regional forensic lab basically our crime lab they Reed a project oright Maximus award you may have seen this at the County board meeting last month U this award goes to 15 labs in the world there are 15 labs in the world that get this award based on their proficiency their testing and basically their accuracy of doing their job which is critical to us because that's how we put people in prison who should be in prison so phenomenal job for them uh one of our newer deputies Deputy Cole Brownfield who has just gone to what we call drug recognition expert School ER school now that we're moving across the state towards legalized marijuana we're adding drug recognition experts to our staff because it helps us recognize impairment outside of alcohol so he's been one of our top performers when it comes to pulling impaired drivers off the road and he was awarded an All-Star mention from the DLC Department I'm sorry DPS Department of Public Safety for his work last year and this year I expect him to be among one of the top enforcers in the state and he's really good at what he does and um in fact this is not an nowman call but he was at Quick Trip in the middle of the night on break with our other drug recognition expert and an impaired driver literally walked in grabbed a snack and walked out and they both are they're both experts they both could tell she was impaired and of course she end up being invested but both Mark cars are in the lot so that's that's a clear sign of impairment yes and that's you know that's part of it right I mean two marked cars quick Trip's the only place open to sell the bunker you know after two in the morning any that was a good driver to get off the road anyway and then our acso SWAT team a that we U we have Team highly highly decorated professionals that do some of the work we uh um we love to have them um we hope to never need them but the reality is we do need them from time to time they participate in an annual training where they compete against um train with and compete against uh approximately a dozen other Metro swap teams and um in this case we um our team received two Awards the top Iron Man team which is what it sounds like it's like an Iron Man competition ition I'm not a SWAT guy but um it's pretty cool and they also uh they also received the award for the top team cly which is also a three award so they're high performing team and um was excited to see that I'm getting long here but one last thing the patches um you see me wearing are these patches here these are the NOA County these are charity patches for this year um this is for breast cancer awareness month we uh you see deputies wearing pink on their patol uniforms um and the goal is to raise money in support of breast cancer causes in the past we have donated to some more National organizations this year we're donating all of our funds to the Firefly Sisterhood which is a local Minnesota organization and they provide mentors for folks going through a breast cancer diagnosis and so if you'd like to acquire one of these beautiful patches they are for sale at the Sheriff's Office uh it's $10 for patch you get you get this patch here the same one we wear on a uniform and uh it uh all the proceeds go to that charity and have any questions I can answer today Council you know going to have a couple questions sir can you give us an update I'll just give them both you real quick uh can you give us an update on where we are with theales in the schools can and uh Deputy Barrett possibly I here maybe leave at the end of the year replacement so I have to get back to on Deputy Barett because I don't have the big sheet with me but I'll get back to on that okay um as far as the sros I can't comment on that as you know uh we've been working very hard we have we have a number of sros across our office in an open County there are quite a few sros across a number of different agencies the law changed over the summer the legislative change um restricted uh a number of things uh regarding how our s's can work in schools um unfortunately there wasn't a lot of discussion ahead of time with law enforcement professionals um to try to get on the same page um the Attorney General's office came out and told us there is one standard for use of force it's the standard we've always used and there's no different standard in schools well the confusion on be on behalf of the law enforcement professionals is the new statute says there is a different standard in schools and here's the standard that standard appears to read that we can't intervene in um anything happening in a school until there's an imminent threat of of violence or injury well the problem is is Sr are designed to intervene well before that um and they're we don't want to these Works in schools we never do we rarely do but we have to have that tool to effectively police in schools and um the A's office came out with a ruling they said no there's only one standard the new law doesn't apply in that situation and then if you saw Miss morard um office out in henin County she came out with a different um understanding of the law and she said well there is a Curr standard in the schools based on the statute and that those who offices not not being uh not being on the same page with what the law means is very indicative of the confusion over the law so as it sits right now our SRO are working in modified shift they're in the city of Handover primarily they are responding into the schools for emergencies they're in the area of the schools on a regular basis and they're they're doing walkthroughs basically um as much as possible but um that not sustainable forever because the school is not paying anymore um city of vover P's deputies so ultimately there'll have to be a resolution and at this point um it's unlikely there'll be a change until after the Law changes there's just too much confusing thank you follow up with that I did have a conversation with representative Noy on Sunday and there's actually listening s that's um tomorrow down at the capital tomorrow morning um to to talk about the eso issues and um there was that correct me I don't don't know the acronym there was a mppoa Gaya last Friday and that was um basically a lot of a lot of the attendees were saying there that that the bill needs to be clarified the law needs to be clarified and um that there is a bill that is already being drafted to amend the law that's at least what I got from him on Sunday so right anything else I do want to thank you for the sincere summary report there it's nice to see the trends and more encouraging because you see the trends are actually pretty good in 2023 for that thank you sir now what everybody's been waiting for siging and Zoning all right first up consider an iup follow the leasing of outdoor storage space at 7411 181st Avenue North Jason you got a note from M that your name to our discussion here it says I object to number 14 and number four letter to at the beginning of the meeting condition 14 and four you want remove regarding date of November 15 um well there were two dates in the [Music] finding one being coming into compliance by November 15 and the second being having everything removed by May 1st 2024 he's asking that due to um du to Winter approaching I don't believe this amount of time is enough to complete the task um and then I walked out there to speak with her and she was yeah objecting to the fence being constructed and I said Mr Vin agreed to the fence and the timelines at the PV meeting and she said oh he did and um that that that's fine but she can't personally afford to construct the family um I said do you want us to wait she felt ill I asked her if she wanted us to wait until next month and she said no she wants a decision and I said okay um and then he wanted to leave and I said you need help give me your car said no thank you so that was all I able to get uh but as we may have gleaned from the discussion at planning and Z me let me ask did did council members get to see the Planning and Zoning video we were able to read through the packet and get the gist the packet went online council member rville on she did watch the video of the planning and zoning and um is not interested in backing off any of the condition condition I would wholeheartedly agree with that um the the impression if you watched the video was that there was really probably no intention to do what they agreed to or he agreed to um unfortunately M Pon is the applicant and the responsible party for the cost um but the fact that some of these things have been in litigation for years and some of them are still going to be in litigation um it was the Planning and Zoning recommendation that you see here there would be a certain amount that could be there on the property if it's properly uh screened in the back of the property no more than a quarter of an acre and the uh equipment is properly licensed currently licensed and oper which is as as you see in your packet that is required by our ordinance um and the concern was if you sawall long enough it's going to sow on I guess think it was which is why the November 15th date hopefully we're not very s by that time the November 15th date was get these things cleaned up or the iup is not going to effect the other obviously question was in that um who's going to verify that these conditions are in compliance and that the timelines are being met right and during the discussion at planning and zoning the uh location of the storage area and the size the size was decreased to quarter and then it was pushed to the north and west to be farther from the power property line think the idea get back behind the house as much as possible so any neighbors that aren't looking at the limited amount these eight items that are eight nine items that are allow part Le covered and and there was discussion about the fence put in a fence that he could take with him this would be his responsibility um if he wants to keep the storage there and that was discussed in planning and zing and my understanding was agreed yeah I think he didn't seem to object too strongly I mean he doesn't he would meet the 100 foot requirement if he you know moves the things like he's supposed to um there's some concern over any of this happening but uh understanding nothing touched since so attorney R did have a couple minor changes to the findings the conditions if you uh move forward here so he wanted in number three on page five he just wanted it reworded a little to say the use of the property shall be limited to the parking of vehicles and Equipment outlined below any other uses shall be prohibited and then in number six he just added um after any existing inoperable or unlicensed Vehicles just clarifying I had it just any existing at the present time must be move removed than but he just clarified that again repeating inoperable or unlicensed and then he said item 17 condition 17 is not necessary he said it's just adding confusion because up in number 13 we already have the date the deadline date of May 1st so with those changes the findings would be as uh you received in your package on November 15th or 16th gosh B will be out um what do we do I think we move forward as it's written and um yeah he's got a tight timeline but that was partly the intent um because even if we initiated Code Enforcement Act right now would probably take us for to get him out we can give them a chance I don't know because once it's smelled yeah he's probably not going to get anything so you know obviously the neighbors looking out at the containers is a big deal um is there anything we can do to obvious this says the containers out 15 and the inoperable Vehicles anything except for the eight items there so if he doesn't comply by the 15 then we can start our code enforcement process now we could go straight to an administrative notice um since all this discussion is basically his warning letter and then he's got two weeks to comply and you know you could initiate a batement but again it takes a while to get that paper work done you're going to be in the winter but I I would say that yes this has been discussed for many months yeah I think we go right to that the max it's unfortunate too I mean you've got three adult people and not one of them called and asked you know not not one nobody called and asked and I worked with um Miss Pon before and she has my number and her son as well but but you know I think he just needed a spot to move his items quickly and they offered took her up on it and you know she misunderstood he thought you could do whatever you wanted if you were agriculture I explained that you're well you're really not agriculture you know you're not hang you have no animals Etc so it's too bad according to the attorney and that will come up later in this section here we got to amend our ordinance to clarify our ordinance and right now we're stuck correct yeah but the conditions are what the conditions are and so by November 15th these things will be cleaned up the remaining eight items or eight things on the list maybe behind the fence right I start building that fence now and he can yeah I mean he can take the fence with them when move but it wouldn't have to require fence but you know if you assume the worst that the stuff might be there if he chooses not to comply you know it may be helpful to have it there for the neighbor well even if he keeps the stuff there he's being allowed until May want against that stuff I just I just want to know what enforcement we we have available to us because if nothing's happened since planning and Zing he hasn't started anything right as she indicated tonight he's anticipating snow and everything down that that stuff will stand out in the sow right yeah but ne's been putting up with it for months already yeah um but I think yeah we do need to try to get a code enforcement meeting scheduled too I know you have lots of meetings um probably the bottom another one is cool but um we uh we do need to chat about yeah what next steps are when you know citations don't work and there were a couple good examples of those tonight to on assessment list yeah it doesn't help things you clean Baptist assessment on next year's taxes we saw that up Norris all right so with this one here with the Amendments that Liz indicated there from the attorney that the aggressive enforcement November 15th Brian I make a motion to approve the p to the conditions outlined in the findings of fact as well as amended by attorney rupe and the compliance by November 15 with an end date of May 1st 24 by which all the line property is removed from the property second motion Council M Brian second Council mayor Alders any unanimous recommendation from planning of zoning this is basically just a technicality of front yard def Birds side yard usage and neighbor across the had a building just like it well it's not as nice well no but it's in the side yard for the front so um yeah variance for location of the accessory building in the front yard uh of a shed that exceeds 300 Square ft and and they not be required to comp of the identical exterior materials although they will be incorporated colors and from textures there will B sighting as well our office does recommend approval need findings mayor to approve the Vari subject to the conditions out okay second discussion all those in sign saying I po carries thank you w thank you guys consider approval of variance to allow addition of a front porch 8766 North Lake Road here I told need to take the night off chose again Planning and Zoning recommended dynamically that this move forward it's a six foot addition on the front of the house closer to North Lake Road and given the existing circumstances The house's age is almost 100 years old uh our office does recommend to improve the drainage issues on site as well as the architectural appearance of the home there are four conditions as listed in your finding I move that we consider approval VAR to allow right motion to approve the Tas and variance subject to the conditions of outline counc second council member all any other discussion not all those in favor certifi by saying I I I post Mo carries okay next we have the recommendation to place morum uh on these things like the buildings land is part of the extent of home if you've read through our our ordinance it's really confusing as to home occupation stand home occupation has to be by a family member and it references buildings but it doesn't require them and so that's what made this first issue so muddy because it's not somebody who lives there it's not somebody it's not a family member it's somebody being leased from property and they weren't required to put anything in a building but we want to clean that up so we want to put a moror on this so we don't face this again while the Planning and Zoning gets a chance to look at this and and clarify the language that's the intent of this moratorium may I just add that it's just strictly related to the leasing of land or buildings all other home home occupations could move forward as typical and and in the in the motion you have section 11-4 d3b and just if there are any other related sections that the Planning and Zoning PL I would just like to that as well just um Mr so when it says um I'm just having a question so any leasing of buildings or land is part of extended home occupations for period so are these land you're saying this is land one is living on no this is this is the pon property we just went through that's that's the claws they slipped underneath in because home occupation extend home occupation is supposed to be the homeowner or somebody in a family that lives there and at some point in our history somebody put in a closet and said you could lease out a building but they didn't include building and so so a homeowner is leasing out to somebody else for an extended home business it conflicts with everything that feeds up to that in the ordinance and now you're you're not only leasing uh your property with the understanding was in the building they took it and said no it's just she's leasing her property so there's no building there's no other requirements there and yet the whole point of Home occupation is it's you and therefore if there's a problem with it we come to you the homeowner this is this is the guy who left his stuff there and trying to get a hold of him and and force anything is very get and this Pon is the one subject to incling their very percussions from this and so because it's unclear as to why you would ever lease if you're running a home occupation to somebody other than b inventor and if you did it has to be inside building that one langage so it really has to do with mations for people that which isct of the but because it's there we got start and she had a leas so we realized that we were doing mental gymnastics trying to figure out how to get around our own ordinance and the attorney said clean it up and what put a moratorium on it so somebody else hasn't come and start leasing out land before you get this done you have stor Vehicles so this is the purpose of this gives the the Planning and Zoning an opportunity to clean up the document get back us and rep Mr Mayor most approve the moratorium prohibiting any leasing of buildings or land as extended home occupation for a period of one year and also directing the Planning and Zoning commission to study the need for ref clarification of our ordin said more right motion from council member Brian second second council member Al any other discussion you have any question no all right all those in favor please signify Idaho stop which means if nobody's coming at a stop sign they can roll through so legally if they're running that route that's even more impressive than I thought it was but you still don't want to get behind them because it'll be longer I'll move on to be there then the Marine County Sheriff's Office Marine unit training is at Twin l park that's CED for October 19th uh this will be a sage train this is a keep dep I don't know if you want to add anything to that or he that but um it's uh and I know Natalie you've been talking to him too this is going to be a big ordeal going on yeah this one they're taking the platform and like going to SN it and then retrieve it I do you know more I mean that's kind of what I got out of it is and we're probably going to send mine down to take a few pictures again I write a little story to put it up on the website it pretty interesting I like that they're using our link and people go watch it's one of the clearest around clearest and deepest Mr Mayor yes sir uh I'll be there as well I'm going to take some photos of the action and get some uh try to get some updated photos of our of our di in action in their gear so yeah it'll be it'll be a process and this is just in regards to when we schedule work sessions so typically in the past we tried to get on all your calendar schedule a work session we got a deadline we got to get something but done by whatever that may be and we're going to change the process a little bit just uh so everybody's a little bit in the know here so we just use the ATV ordinance for example um in the past we've scheduled the date get on your calendar like I said and then we' work on making that what we're going to do is we're going to take a step back here a little bit we're going to make sure that we have an RCA we know what the ask is we know exactly what we want to do if there's documents on there that need to be provided the red line documents with suggestions will get out to the council and then uh coun will have an opportunity to take a look at it and then we will be asking for dates that we can do it the reason we do that is we seem to be really especially with our current Staffing model that we have right now we we we we want to get things out there we know your guys' schedule are tight we set a date and then sometimes we struggle to make that deadline if you will right and one of the things that staff hears me preach about all the time in the offices is a paper we're not putting anything out we're not bringing anything to council we're not sending anything out on the website unless it's a paper and I'm starting to get a little concerned that a paper wobbles a little bit when we are up against a deadline and we know we got to have something up to but so what we're going to do is we're going to make sure that we get that a paper put out there at least our version of a paper get it out to all you it gives you an opportunity to be able to take ask questions Red Line whatever get back to me on it and then when we're comfortable this thing's ready to go then we're going to skip the date so that might feel a little different than how we've been doing things so we just wanted to call it out tonight so all of you aware of that or have the opportunity to push back if you think I've lost my marbl at this point so Scott I have a question then as far as that goes I think it's a great idea however one of the things that will since we have since we you know like we we can't talk to everybody unless it's at a council meeting so I understand redlining um will if we Redline something and we send it back to you let's say the ATD thing you send something up I find something in there that I want changed or don't like I write on there send it back to you will then that be sent to council so Council can see that as well my question is based on when something comes up here and we have a discussion on work session or in a council meeting sometimes another council member will ask something and answer something something will come up or the mayor will point something out and it clarifies something it makes me think of something else it it's just easier when we're all here so I'm not concerned more questioning that will we be able to see it as a whole then as a discussion rather than as things get taken out or put and there's no discussion there um so just it's just wondering if what the what part will everybody play in that and how is that going to go out so in let me oh sorry I understood what you were saying okay you're really saying to draft so the the understanding is what's being asked because I I think the point of the work session is to work the details out as a group but if somebody's bringing it up whether it's staff or us and and I would think of an example I don't know if this is what caus this but um last month we were doing the budget we we scheduled another budget meeting and there was an understanding that all these things had to be done for the budget instead of being proposed and saying here's here's the draft that you guys can discuss which we decided to do in November rather than that when I was in signing checks it was very he in there because they're trying to meet this deadline and everything else is get put aside to try and meet all those budget questions instead of saying here's a draft for the council to consider in November it was we have to get a final thing right now so I think on ATV an example probably would be what is the draft what's the what's the request so they can put together a draft for us then to discuss the details whether that's working with Sheriff's Department working with other cities or but it would be a you know something that they could collect information and when they've got it I hear you right rather than saying we're going to meet next Wednesday get it done because that's what it seems to be in the office is the urgencies that keep coming up to stop people from getting things done thoroughly okay is that what you were it is and that example you gave was the one that kind of pushed us to considering this yeah it's not to take away any discussions that you're having uh or to have the ability to be able to discuss it after the work session but what we don't want to is try to put together something and then meet the deadline and then we get here and forgive me for lack of better terms but then we have a group thinking everybody kind of has their ideas and then we go back and we're reworking it again we'd like to be able to have an opportunity people speaking it now for example the ATV I have you earmarked as kind of the spokesperson or the people leading so then my expectation would be is that you would work with us whatever you might have and then we start putting together an RCA way of what is the ask with the RT do we just want to look at the Ordinance do we what's the ask I want to make sure that I'm bringing it to all of you that this is kind of what has been presented to staff this is the work we put into it now let's discuss it further um but give us the time to do that before we just schedle a date for whenever that Mak sense no sort of yeah sort of makes sense to me because otherwise it seems come in half paked and we we kick it around and we have all these questions and then you guys are right back to where you were and like I said that budget one was that was a stressful time for in the office Mr Mary maybe I can explain it Shan probably this came from me because at the last meeting that we had with the budget there was all of these questions so I was scribbling them all down and I thought at the meeting that we were doing for the levy was I was supposed to have all those answers oh before we could do that I wasn't really directed that that's what we were supposed to do but both Scot and I had that same understanding and then we got here after doing all of that work it was just like no we're just doing lety and then we're going to do another final in November which is why we sent the meeting in November then to go back to the budget and have some of those things finalized okay so what I should have had asked for was okay here's an RCA you want me to check on all of these items and research it so like as as far as the ATV what do your residents want changed what are you thinking we need to get changed I've got some information from Chief Deputy I've got some information from other cities but am I looking at the right things because I don't know what the residents are talking to you about so if I can get an RCA from you that says this is what residents are asking me for we can do the research put together the packet and then I can go around and try to find everybody and we could see it before we all show up at a meeting going look up this ordinance on your T right just to have some time to practice make sure that I'm getting the right information is that a better explanation it does it does I just don't want to take away from something being able to get more information bounce more like when you say you take things back from a meeting and now we've heard more I want to be able to serve our residents by actually having that ability to have some more ideas and there might be and that's where we would table something or we ask something be brought out so I'm okay with that I just needed more and the work session will definitely be that it won't necessarily be the end of discussion maybe once we have something in front of us like the existing ordinance and some other samples to look at and then we can say yeah this is what we like and and we still can go back and tweak it I mean there's a lot of times we Redline things three times three or four times it's like okay we got this close you we'll see that in some of the other things that come but but you have something to start with because last time we did this it was Dan's looking up whatever the current ordinance is here and chief deput is looking up something else over there and rest was sitting there going I'm not even sure where we are and so we come into the work session now at least we have some documents to working with and say okay I got a chance to look at this ahead of time ask some questions ahead of time we have a much more fruitful discussion that may not be the end of the ordinance change at that point but at least we've got something to have a fruitful discussion and they're not under artificial timeline that says good or not next week we have to have this WR absolutely I don't want to take that away from you guys are busy nothing as it is so you don't need more and I just don't want to take something and we'll take the ATV um thing here if a resident wants wants us to do something as a council and present something I think we still have to be able to bring something forward as new business even even if we don't have all the inform information right away and it can be well this can go later we can't I in my opinion I don't think that we can it it pushes our residents back by saying well you can't you know how do I how do I talk to council why can't I present this what happens and people need to understand certain things that this is our business meeting so I get all that but I I don't want to push us so much into we have to do it this way and this way and this way because then we lose our residents at the same time from being able to come to us and say hey this is and that's what happened with the ATV thing it was one of those things that was just presented called us the night before it wasn't something we could come and talk to about right away um that was Jason and I both got that phone call and even though yes more discussion needed to be done on it it was showing our residents that we were able to be able be contacted and we just presented it as new business and it didn't mean everything had to be done now and granted yes we didn't you happen to have your thing we might not have been able to look it up but that that was a part of a discussion that we'll have to table it till later till we get some more information at least it was brought up and so our residents had a voice and and as a council member that's something that I am concerned with all the time that we don't become so bureaucratic that our residents do not feel that they can come to us and just talk to us we have to be approachable and and as council members I think that's our responsibility so I'm concerned but I'm willing to go with it because I can understand what you're saying and your heart in it Mr Mayor I think you're misunderstanding no I'm not no I think it is nobody said we couldn't bring up new business at a meeting like this right what we said is we're not going to set a work session until I have all of that right and I think that's that's that's great so yeah so Mr I think it's really important too especially with an ordinance you know label it draft and date it you can have 10 drafts if it comes to that right I mean just so we can talk about it and I think the second thing we should be doing is using the comment mode so that we know who made this suggestion and why this certain part was changed right was this a resident concern was this you know um maybe a statute that changed and then it's just so easy to follow that way too why why we're doing what we're doing and it documents everything Mr I think as long as we still have like it's basically a it's a item that comes in front of the council once it's a four item what is the right what is the right Next Step because we'll we will table the action or we will take a recommendation from the Flor item and review it and it's like what is that next process so if it comes out of a floor item that's essentially what it was it goes to Scott's team on okay we've got a floor item that you want us to look into who's on point that's gonna drive it to some packet so this is the packet that we want after it on find so if you guys aren't exactly if you guys aren't well alers wants to drive golf cart wants to drive fourwh front so it's like you know it's like what is the so it's a floor item that comes in front of the counil yes what is the right next step right so this is the process for the right Next Step and we can explain to the residents that okay we got a Flor item we're going to look at it so the next step is someone's going to have to volunteer to help the team Define what we think a red line is or what we think the packet is that we want to look at that's exactly it yeah that's you what what is somebody asking because my snow will be with the wheels one whe but gets on the road so yeah because otherwise you get one guy another ask something I mean but we just got to make sure just from transparency standpoint from approachability standpoint if someone's going to take the time to stand up there get their address it's not like well you didn't like an RCA so it's Inver conduct paper Minnesota Pollution Control agency Aaron Patrick no return phone call I don't know what that means look like his notes yeah so let me give a little bit of background first um so um it came up that he wanted to have he did a floor item thing with us it was sent out to Natalie Natalie sent it out to the council um and I don't I responded to him I you responded to him I don't know if other people and C responded to them Dan and I talked to Scott Scott asked us to deal with um s discuss things with him we both have had ongoing conversations with him he was asked to provide um bullet points by you and then asked again to give bullet points of what he wanted to discuss um in speaking with him on the phone on my side uh over a week ago he said he would provide that um because in that discussion I had written some things down and when I went over it with him he said no I because I'm like do you want me to just throw this together and the reason I said that is because I wanted to get these bullet points down and he said nope I'll get it done then I had a conversation with him I talk to you about it but then I had a conversation with him last night and he basically said or yesterday that those were my bullet points I said what were your bullet points and he said what was sent to the council that's basically what I want to talk about um and then and then I spoke with Dan last night and we went over some things which you had said number two you were going we were going through each of them to say no it's not a bullet point we need more information um so I sent that back to Sam and had some discussions with them I talked to Natalie this morning over all that which was you had stated and correct me if I'm wrong you you had stated basically I can't really put this into bullet points because there really wasn't the who what where did you do your research kind of thing so is this the things is starting to read this his handwritten that so what that is then I had specifically asked him excuse me so what you were just referring to though the it wasn't bullet points wasn't email that was the email that was the email is that sent to all the council yes and that's what he thinks is bullet points because he was he went back and forth and some things so then what I did is I sent him a letter and I said um I'm just going to read what I said um sorry we've been going through everything [Music] um so I'm asking you for clarification on what you wrote which was that email um documentation of who you talk to and what they they sent if they sent you anything um from the company and what they told you this way the city can address it if the city is in the wrong meaning you know anyone like Liz or Scott or the city council um did something that you think was wrong that we need to look into then let's get clarification on that and what you found out um how to get this completed if you are getting a different story than what we are getting then we need to see what that is um I asked him to write up again bullet points and clarification on this then what he had asked is he said if I'm doing this then I want I want that from the city as well which I and I asked him what information do you want um and he so and then I said so you want who the city is spoken to the information they have um do I have this right this is mine um and then he said um he wants to know who Liz and Scott have spoken with and he went into all the that and then I just said if you pull your information together and send it to Natalie or myself um then we can gather Scotts and Liz information and everybody will have it together for the meeting so we need all this for the meeting um [Music] then oh and that's what we were I was clarifying with Natalie what exactly it was going to be and it was an agenda so I sent that to him said it will basically be an agenda that states things so then that's when he sent us this information of who he did work with because in the conversations that I was having with him he was discussing how he has been doing the research he's talked to the DNR he's talked to um he talked to a pollution conservation officer who basically turned it around and said that we needed to that small cities it doesn't get handled by the DNR it gets handled by small cities and it actually goes with um Watershed like Shane for instance that that's when I was pointing out that Shane might be doing that so he had all this information where he just sent with these people that um he had looked out with and what they said on all these topics so that's basically what I have at this point what you guys have been texted not by me so texted all these all these topics when you say all these topics it all seems to to center around pollution control or DNR or um Watershed or um and his his claim here I'm looking back yeah I have to go back to the email I don't but it's very difficult I'm sorry Mr Mayor well so it says why is the city of nowan allowing the illegal pumping of the SE septic system DN protected Wetlands why is not been tring investigated so everything I just heard you say about whatever was written on what did you say some kind of he just quickly he when I asked him him what his information because the thing is is the question came up of are we going to have this meeting are we not he needed to provide bullet points I was trying to get that information across to him of what was needed and everything you just read there had to do with the water and we're talking about Watershed we're talking about ms4 which would be sh talking about DNR talking about was Act was those all have to do with this claim that the city of now then is allowing illegal pumping of a septic system and I've never seen any evidence of that the the the statement he's made to me was they don't have a record supposedly of pumping that system for a period of years and therefore they must be pumping it into the wetlands right because he heard a pump going right and and is that enough to substantiate all these other because that's an accusation the city of now is allowing illegal pumping in setic system absolutely and we haven't properly investigated right so now if he wants to come and say I know it for a fact I have pictures and and I was told with him investigate it wasn't that that you can follow that trail but to just to to you know to say uh we're allowing illegal pumping and we know it and we're not doing anything about it is's an accusation and I think why that's come about is he has stated that he's called the DNR and he's called the en environmental pollution control and that we are supposed to be doing things and yet we needed proof and that DNR needed proof and the guy that he talked to on the DNR said no we don't need proof that the city should be taking um steps to um investigate that by talking to M back by talking to um uh the conservation officer right by pointing out who does it in our city like you said a building inspector or or someone like the that deals with the wi shed so and that's what his accusation is is that we didn't go further with that and he wants a conversation his biggest thing I I found was that he just said I can't seem to have a conversation I have to go to each individual council member when I would like to get into a room and talk to you about all these questions so I can so you can all discuss it at once with me and it seems that we're not willing to have a conversation with him I did expressed to him in our last conversation that he had with me um we have 4,600 residents here and it does seem like his particular concerns should occupy all of our time and and my question is can we do the same thing for all 4600 residents or however many of those people are adults should they have a concern do we have a conversation as a whole with every one of them as opposed to ideally what you do is is we're all available our numbers are in the newsletter we can all be called if if there's something that somebody thinks all of us should know but that's again why we have staff to do investigation now the the imputing here is all the city power resides in the hands of the city administrator and the city administrator is arguing on behalf of the contractors not representing the residents does that mean city council as a whole does not actually represent the residents again those are are accusations um I think we do a pretty good job representing most of the residents here um how long are we willing to spend on those kind of statements it's it's you know have you quit beating your dog yet kind of argument how do you how do you defend yourself against that no I haven't beat my dog I never beat my dog but at that time it's too late oh qu beat your dog there and and that could be night of this because what I asked him is what are you asking us to do can you tell us what what you and you said what would make me happy I said I'm not even trying to make you happy I just want to know what you want because you're imputing staff you're imputing Council because we don't listen and yet I know many council members have given hours I've given days to this the past year um so I'm I'm quite willing there but just be aware that if if every resident comes up and says I want a private meeting with the the council it's going to get old pretty quick especially if we don't know what he wants so what I'm hearing you say is it's all about Watership and here in the thing you sent to the council is it's about um that that our our staff doesn't properly represent the council to the residents and I think that that is what he is talking about too I think it's I think it's a few pronged approach here that he is seing things whether um so he is seing something and he wants to present it but I think when he he gets a different answer from different people or he I don't know because the problem is is I can talk to Dan about this but then I can't go and talk to other members of the council unless what here so therefore it's hard when I have a conversation with him I can't pick up the phone if he says well the mayor said this well I can't pick up the phone and say hey can we talk about this because I think he's getting a different point of view when he talks to each one of us in a way that is not brought together as a whole that's the only thing I can understand I'm not quite sure so meeting with him at least would make it so we could make it a whole come together because I think there's something that is slipped between council members and I don't know why Dan and I I I mean Dan and I talked about one of his questions on there um that he had answered uh asked I don't if it was two or not you and I talked about I don't have it in front of me Natalie could you read number two that he has on there I think it's two you about the the email that came out after counseling that recent uh how is a resident of the city of now than able to have an actual conversation with city council if a resident is having an issue with the city how can we actually speak in quotes with the uh Council will help having to use floor items uh during the city council meeting during the floor items period the city council does not address the residents and the residents only has three minutes to respond what it's not that one what is the one that talks about with representing the residents there's one on there the current administrator is arguing on behalf of the contractors not representing the resident or acting in their best interest that mean the city council as a whole does not actually represent the resident's best okay this is something that I found out when I was talking to him last night is Dan had said in his you had stated no I would represent the city correct and I had said the same thing but I said it in a different way where I'm like no you are we do represent the residents and we do need them to come to us and talk um as as an individual I do want to hear a resident speak to me but I'm also representing the best of the city as well but the way that he worded it and the way that I worded it meant the same thing however because it was worded different and this is the only thing I can grasp is that because we're not all in a room he's not hearing all of us say what needs to be said accordingly to what we're all representing the city I'm lost as far as what to do in regards to a complaint for this neighbor it's not just a complaint for the neighbor it's it's how how are we being are we being told everything yes I mean yes I can say yes you know are we being told that you are sending the information to us I told him you get a you tell us everything on your administrative notes I get that from you each week um we discussed that I've discussed had many discussions on every part of the things which I'm sure all of us have um it's like I just don't know that if we don't have this meeting then what also does it say yes could we could end up with 4,000 residents in here absolutely but if we don't have res this meeting could we also have something where the residents are basically saying you know what there it is again we're not we're not being listened to we're not being heard um Can can I ask one thing because I I know we want to get going here and we're GNA have next week to do this for hours yes but do you have any idea how many complaints staff receives oh I'm sure it doesn't I mean how many how many complaints and if somebody's complaining they have disagreement with somebody somebody blamed and and therefore right so this actually happens a lot but he did come to a counil meeting and aor it them and that's what makes the difference to me is that he stood there and came to the council meeting and talked to us about it didn't just go through St didn't just complain that actually showed up because he didn't like Fast Response right he didn't like what I said he didn't like SC said he didn't like what Jeff said and then he moved on to the so he's open at some three council members decide to do something with staff or but but I would say 99% of the time staff's doing a great job absolutely resolving those conflicts which are typically between neighbors because if someone's complaining they're complaining about a neighbor this one has gotten out of hand for VAR reasons this it should have been shut down a year ago July absolutely just properly say no no nothing wrong here and it's done but it got out of hand but now it's coming to the point where it's it's becoming accusations against the city against the neighbor without substantiation so I just want to be careful as a council that then and that's why I'm willing to have this in public and willing to have it on camera because if you have something substantiated we as a council will will deal with that accordingly if there's a misunderstanding or misrepresentation or whatever it is then we can sit down and I'm guessing that's what he's hoping he's proving some something a Miss with how we're running the city but what we have here and what we have whatever Liz was reading um that's what we have to go on we have to stick to that because it I've been on the phone for hours and it can get pretty wide rang I know and we have to say what are we what are we trying to inclusive so with that said if we're going to go ahead I still think we need to know what we're walking into ahead of time rather than sitting here saying what are we up to right so we should have something whether it's the email that came out or this new thing that came out something has to be saying here's the boundaries and and we get beyond that we're done and I I just want it to be hitting the council against each other against staff oh absolutely not to trying to not do we think he really represents the residents or do we have you know you have the belur and you have both EV and is this you're never going to please everyone at 100% of the time no and based on the discussions I've had with them I mean I don't believe there's a place where you can come out where you believe that he's going to be satisfied with any answer agree so my opinion is why do we keep entertaining the accusations do do you do you believe we let it go public on on video and and be done with it I would I mean if it's me I wouldn't uh I wouldn't put ourselves in a spot to be in another situation where we're getting the if we say what's the agenda we all know it's going to go from here to here and we're not going to have some of the answers because it's going to be well here's this what about this what about this I'm this state I would say if you're really not happy and we're not going to make you happy then you have ton choices don't vote for us figure out someplace else that makes you happy run try to change it but we don't think we're in a space where you're ever going to be satisfied with an answer that's where I'm at because he has a choice run try to change the system don't vote for us or figure out place that he things he can be happier well right we have an established process for these things it wasn't moving fast enough he stood right in front of Scott I and said indicated his dislike for his neighbor pull out a piece of paper and wrote a complaint and there had been two others in previous years one was for sure from him and the other was Anonymous so I he had no proof absolutely no if we entertain this it's gonna it can turn into just ja comment we entertain at this time are we going to entertain at the next 10 times right so I think that's the are we going to open ourselves up to that amount of fun Mr Mayor Bri I'm going back again to I don't have there's there's no information that be provided other than here's what's done if we have these if we have the going back to the original questions from September 12 If he if he's saying we're not doing these things where's the backing information I haven't seen whatever he sent today yet I think that's what he's asking well we need to get that information from him if he's if he's if he's if he's has a complaint what is it if if he has since thing well I HT a pump well what is it and where's where's the where's the information that he has that says we're not doing whatever we're saying we're not doing and he is saying that he has sent that in well in the text that he just sent the one that we just got okay so I haven't he he is basically saying these are the people that I talked to these are the people and what they have said about the situation okay so what's the ask what's next step the ask is he wants to meet with the council he basically he said to me today was it today um yesterday in talking with him he basically said I think this has gotten bigger than it needed to be and I just want to know how do how can't I just have a conversation with the Cil Mr said I needed that stuff you know to to come before the council our ordinance says it's a $500 fee is that correct to special meeting to call a special meeting to have that conversation and he had that conversation I think Mr did you you tell him that I'm just wondering if we if we wave it for him and 10 more people come next week do we have to wave it for that he's been told that that there's a fee to have a special meeting that he doesn't want to B he does not does not yeah and and some of the other things just to just to get it out you know he he's made comments that he thinks the administrator is still ining that I protect staff and I'm not sharing information with the council I don't think you understand that report to the council how much I'm updating you and and I mean all of you just sat around here and just talked about you've had an interaction with Sam and all that kind of stuff so you know then he makes a comment that the mayor says about the DNR and then in today's text message he says this is the guy he called it the DNR DNR they have they've never heard from anybody from now then on this okay so when I have conversation with him and I shared with him that this is the process that we use and this is what we did and this is how we verify we used the license subject it's not good it's not good enough why didn't you use so and so why did you call off Min well we have to be trusted at some point that we go through our process and we do that if we were doing that and we found that there was something running out there was something wrong going on we would investigate it further but it it it's constantly poking that these are the things that you guys didn't do and you know how I know that because I've made all these phone calls myself and I think C member ald is right I think people gets in here and he has the ability just go where he wants to go we're all going to I'll just speak for me I I think he I think it has a potential of get personal and and I think it's when you make accusations you're stonewalling and you're protecting people and you're not doing your job I kind of take that personally for the fact that um I do have an ethic standard here and I didn't treat him any differently I've given him more time than most people have but if you don't tell him what he wants or he doesn't think you're doing it the way he would do it then you're wrong and I just think that Monday could be just a whole lot of that but I'm looking at the email that he sent to the whole Council how do you answer that because the supposition there if all the city power all of the city power resides in the administrator since the administrator argue on behal and he's already made the accusation you're not answer a question he's not saying does all the city follow rest with the administrator the administrator answers do do we know every complaint that comes in no you know there there's a spreadsheet somewhere that we can if there's a pattern we should know about it and he tells us but the one offs no do we know everything he does every day no but he does answer us and we're responsible and we're responsible who responds residence okay we're talking talk about resonance as a whole you know we're not going to do an ATV ordinance for one person it's going to apply to everybody right and so whatever we do here has to apply to everybody and when you come in with statement saying you already incriminating people here the argument is going to be as Jason said it's going to be this big because you're going to end up defending well no this no this no that oh then you're disagreeing and it's all my problem and and that's exactly what I got and I said you do know we do a lot of stuff during the days and these these people working 50 hour weeks and they're doing lot oh so you're saying it's not all about me I knew one of you guys would be over there I did I said it's not we have a whole city to run and you're you're part of it you're part of our city we want to treat you well like there's a lot going on in this city I think that's part of it I don't think our residents know everything that goes on and I wish that they did because I think that I think as a resident careful what you ask a lot but what I'm saying is there were things that I didn't understand before I became a council member and I'm like wow this is a really tough job there's a lot to read there's a lot to research I've worked in the offices with these guys there's a lot that they do and it's exhausting I've seen what every one of you do and you have a lot of work and you do it well and I appreciate that and most complaints are resolved amicably and relatively quickly 100% is an 100% so I agree with you most people want to be left alone to raise their family and amen so amen you do we approve that it's pretty easy when they come in with a big Cube box full those the pluming company those are but but you have home businesses here that are residents and have be running a authorized business no most of the boxes have a business return address on it well anyway I I think because right now we're going to ask recycling staff to polias that and I think we should have some discussion what that looks like because is it limited to cardboard yes so ties are okay tires are okay because all the costs are covered with that or board the costs are not oh it says municip Val's recycling program shall be limited to residential programming for funding reimbursement doesn't say card it says recycling no but we don't get reimbursement on that because we cover the cost on that action on uh assessment notice find out what cities R Us are doing now that need to process any violations plan St to present explanation the next meeting so we take a look at these things um I'm not going to go through them all tonight but please take a look at your your meeting minutes and then we can talk with staff how do we close the loop on these things um and we F to be dealing with lights for the hockey rink an action item apparently only two lights work I disagree with that I may be wrong what are the specifics for the lights bring it up for next meeting uh style verify style size and how they're going be installed so it's not to fear move this item to October meeting it's understanding staff bring lightting information and confirm meet city ordinances so when we have action items we have to figure out without bearing staff how we're going to make sure that what we vote on actually it's into somebody's to-do list that that's but I will I will sit down with staff on the the action items here just to make sure that we understand that but I'm asking counsel I appreciate that Natalie gets the the minutes out um we used to wait months for minutes and she gets them out right away so it's fresh in our minds please take time to look through them for accuracy and action items that' be my request and then we have to work with staff to say how do we do that so it's just not another thing that's piled on that any other questions on that right are we then approving those minutes or are we tbling them to next month I would table them just because there's question one right
