Um the reason for the plat is that this property was previously platted quite some time ago as part of Wood Duck Haven, but it was an outlot and an outlot cannot be built upon. Um, in looking through the historical records that existed at the time, it appears that that um there was an old preliminary platter or sketch plan that showed how this area could potentially be developed with several lots coming down a new road to be extended in. Um, but for whatever reason, that wasn't pursued back then. So, Mr. Knox is applying now to plat this into one lot only. So, it would be one lot with direct access on the 229th Avenue Northwest. We do have some comments that are in our comment memos in the packet. So, this isn't um fully ready for final approval by say the city council yet, but we do think that these items can be resolved um hopefully before the council meeting and that we would still be able to get them on hopefully that July agenda if everything comes in in time. them on July agenda. Looking at the comment memos, the items that today are missing, if you will, or need a little more attention, they need to provide new soil borings for the septic sites. The reason for that is that the um original soil borings were taken in a location that ended up being in the shorland septic. So, they had to Um the surveyor had had to show that stroll and setback area on here and they're having to move the septic sites. So they're out there taking those soil borings now. Um we're going to have them dedicate drainage and utility easements over all of those wetlands and water features. That's common when we're doing a plat. They haven't yet depicted the buildable area. That's a requirement on section 10-3-5 of your ordinance. And that's that one that shows the the area with at least one acre of one foot separation and at least 23,000 square feet with 3 ft of separation in this many acres of separation. We think it's unlikely that they won't be able to demonstrate that somewhere for that limited amount despite how much water there is there. Um amount despite how much water but they will have to do that before we would put that on a city council agenda. But they will have to do that and then some things kind of associated with that. They have to show the subex from the wetlands. And then we do note that the um proposed driveway as it's shown right now does appear to cross a wetland. So they'll have to move right in this location. So they would need to move that to the west a bit to get around that. So they would need to move that to the west. I am she's sharing it. There's a delay. Yeah. So, now you're seeing moving. Um, so now you're seeing moving around that projector is having some issues. So, it's going back tomorrow and tested. Um and so there's an issue that you can't fill the wetland. Um, you also can't um grade it up in any locations in a way that would hold back water and potentially cause water issues for neighboring properties. So, that's also an issue to be wary or concerned with or to watch. Um, and then there's the potential that if it's too low, you could also have water covering your driveway during storm events. You could also have water. So, it's a balancing act. Um, he's got a he's got it. He's got an app that shows the wetlands and on his app it is the driveway is not on that part, but I know on the uh surveyor survey it looked like it was. Um so I don't know, but I do know that it's it's awfully dry. There's no wet. It could be a seasonal wetland. So it could be dry at some points in time and wet at other points. So um and I don't believe there's been a wetland delineation done for this property. So, we don't know exactly for sure where it is. Um, we just know right now that the surveyor try to do this even though it's going to show 30 seconds. Oh, is it? Okay. And you guys have we have something. Yeah. So the the um surveyor called out at the time that he was out there and remembering that these water levels can fluctuate, right? So at the time he surveyed the water level was at 924 which is in that area and then DNR said that the ordinary house and my water level be at about 925. High water level be at about 925. We have bought in the property rains. And again, it could be seasonally wet or in flood conditions, it could be wet. And like I said, and like I said, uh Perkins Cross Street is doing the driveway for us. And according to his whether his map is whether his app on his phone is is correct or not, well, his app on his phone shows that the driver is not crossing. I don't know what what what app he'd be looking at. I'm assuming it's pulling from a national wetlands inventory. I'm assuming it's from a national wetlands inventory. Yeah. What I was going to say is those are wrong frequently. They're an estimation of where the wetlands might be, but without having somebody actually go and check for the wetlands, but without having go and check for the wetland, we're thinking this could be going potentially through wetland in that location. And it might be better to veer it around to the west a bit and it might normally the driveway would be looked at at the time the building permit comes in and then the city engineer will be looking at this. The building permit comes in and then the city, how much work is he doing? Okay. He has they have cleared the trees. Uh he has uh they they have cleared the trees all the way back and we've got a we've got about a little over an acre and a half of cleared land back there. Um and for for where we'd like to put our house and uh and then he's brought in some dirt and uh and he scraped the land back there. He's got two big piles of dirt on the sides at the end because he scraped all the all the grease off because we had someone else come in uh before him and they they had this machine that with the trees. So there's all these tree tree uh chips all over the place. So they scraped all those off into a couple piles. They got a they got a like a like a area where we could put our house. Uh I forget what he called it. Uh whatever. He's got that area there and uh he's got he's got dirt from there going from the road all the way back there. Uh and he's got a covert right on top. Do you know when they took down the trees and cleared out the area to construct the home on what they used to figure that out? And I asked because one of the things that had to happen was you're in the Shorland area. So that setback for both the home and the septic sites has to be 150 ft from the ordinary high water level. So if they did it too early. Yeah. So if they did it too early I thought that Ashley had measured that and it was 150 ft back. Yeah. It's definitely not put it but well not not based upon where the surveyor showed. Well then based upon where that can be easily moved. That's that's not a not a problem at all. that did the trees. The uh it wasn't Perkins that did the trees. It was JB Sod landscape in Elk River that did the trees. Um we hired him and he gave us told us the price and we getting at is that she's concerned that if you move too much dirt, take down too many trees, you could be in an uphill battle. too many wet. So be careful and with shorland alterations too where things need to be. Yeah, he uh he had that uh he also had that app that Perkins has. He assured me that this is not a way. This is actually the highest ground of the 44 acres that uh that there is. That's why we picked that area. This is the highest ground. It's a good um I would say it's at least uh 15. So that does make me I mean looking at the topo um where they were originally showing it just because I remember where it was. It's not on the one that's in your packet. It was to the east of where it is now and that was the highest point. But then it drops off to the east towards the towards the public water body. But you need to have 150 horizontal feet from that which puts you in a lower area to the west. Instead of being up on that high spot. Oh, okay. Okay. instead of being up on that high. Okay. And that's something that And that's something that I know we're going to have to probably have a lot of dirt brought in uh to cover because right now it's all clay um if we want to have grass or anything like that.
