Consent Agenda Items A, B, C, F, G
Moved by Council Member Bray Johnson [10:04] · Seconded by Council Member Tradewell [10:05]
Items A, B, C, F, and G from the consent agenda were approved without individual discussion. Item C, a variance granting, was later noted to be related to and dependent on Item D, which was separately pulled and tabled.
Consent Agenda Item D: Minor Subdivision & Variance
Dissent: Council Member Wy, Mayor Ralph
Moved by Council Member Bray Johnson [15:20] · Seconded by Council Member Tradewell [15:28]
Council Member Wy expressed strong concerns about the proposed 36-foot frontage, arguing it sets a poor precedent and deviates significantly from city standards. The applicant, Robert Bodnis (Paul), defended the request, citing the Planning Commission's unanimous recommendation, the large acreage, and his health, while stressing it avoids highway access. A vote to approve the item failed 2-2. Subsequently, a motion was made and passed to table the item until Council Member West's return for a full council vote. It was later clarified that Item C, a variance related to the same applicant, had already been approved as part of the initial consent agenda.
Motion to Table Consent Agenda Item D
Moved by Council Member Wy [15:53] · Seconded by Council Member Bray Johnson [16:00]
Following the failed vote, Council Member Wy made a motion to table the item until Council Member West was present to allow for a full council decision. This motion passed unanimously, providing a second chance for the applicant.
Consent Agenda Item E: Home-Based Business (IUP) Permit Conditions
Moved by Council Member Bray Johnson [26:15] · Seconded by Council Member Tradewell [26:22]
The council reviewed conditions for an IUP. Condition 8, limiting employees to two (below code's allowance of three), was removed by consensus to align with city code. Condition 3, allowing city staff to inspect without notice, was debated extensively. Council Member Bray Johnson expressed concern about privacy and government overreach, advocating for prior notice. Despite staff explaining it's standard practice and notice is usually given, the council decided to retain the condition for now but committed to a future discussion with the city attorney to re-evaluate it for all IUPs.
Consent Agenda Items H & I: Election Judge Resignations
Moved by Mayor Ralph [27:54] · Seconded by Council Member Bray Johnson [28:02]
The Mayor expressed gratitude to the resigning election judges for their years of service to the city, acknowledging their contributions despite any potential disagreements. Resolutions formally accepting their resignations were approved.

36 feet seems quite a drastic change and I think that sets a lot of precedent for anybody else in the city that comes afterwards.
I did it purely by the recommendation of the planning and zoning commission. They were the ones that came up with this idea and they passed it unanimously.
I'm all about consistency. How could I say yes to you and no to the next person who maybe has 50 feet?
He could have up to three if he wanted to part of the code. Well, that's what everyone else is allowed. So, why shouldn't he regardless if he needs it or not, right?
I believe in smaller government. If somebody has a business, we can give them even if it's only a 12 or a 24-hour notice, I think that they should have a notice that we are coming to their property.
It's a trade-off though for that IUP... I think these are for the small select few that are really a problem and are not working with the city and those types of things.
