Jody here. >> Hi, Mayor and Council. Um, I'm bringing before you a revision to the second reading. Um, in December, the city adopted a set of housekeeping amendments to chapter 10, the chapter 10 city zoning code. Um, council approved both the first and second readings and the ordinance was published for public comment. Because these amendments affect properties in the Rum River Management Overlay District, they were required to be sent to the Minnesota Department um of Natural Resources for review and reertification and certification. The city received conditional approval from the DNR on December 17th. The DNR is requesting that section 10 be revised to clearly state that accessory buildings under 200 square ft within the Rum River Management Overlay District still require a zoning permit. And with that, staff is requesting council approve the minor clarification requesting uh requested by the DNR so the ordinance can receive final certification. >> Joel, >> I have nothing. I I'm a little I'm just a little bit concerned because I I get I'm not I'm not opposed to what they're asking here, but what quickly becomes the rule of land is everybody says, "Oh, you can build a 200 square foot with with no problems." And how many people are going to know they're within the Rum River overlay? I I mean, so the the urban myth, so to speak, becomes anybody can build anything under 200. And they're not going to read the fine print that says unless you're living in the Rum River. And then they're going to say, "I don't know if I live in the Rum River." They're not going to have any clue. >> Then they'll do it until somebody calls on them, they'll have it. That's usually, unfortunately, the way it goes. >> Yeah. I mean, we do get a we do get a lot of zoning calls for do I need a shed? Don't I need a shed? Um, and so if they were to go to code and look it up, I mean, they would question if they're in the Rum River. They know they live on the Rum River, but that was Yeah, we were removing it and it was approved, but then the DNR came back and said, you know, we want we want permits for these these buildings in the Rum River Overlay district. So, they felt that that would be fair and it would be enough to for somebody to who who does want to go check code. If they don't check code, they a lot of times they'll call us. If they don't call us, their neighbor calls us, [laughter] you know, sometimes sometimes they don't. Yeah. And so, >> um, >> so when it's when it's, how do I want to say this? when it's put out there to the public either on our website or whatever else. Is there a way of making that more prominent other than, you know, a footnote at the bottom down there saying unless you live in the Rum River wershed, which most people aren't going to read it that far. They're just going to say, "I don't I don't need a permit. I'm under 200." >> Yeah. >> Is there a way of highlighting that somehow? But >> well, we do have a spring newsletter coming up. Um, there's all sorts of ways that they do get involved. So, we know that there are a couple properties that live along the Rum River right now that have put up sheds that didn't ask even though we had a zoning permit for everybody. So, there's the people that call, there's people that are going to do it whether there's a permit or not and not ask. And there's the people that'll find it. Some of the argument was is when we took this out of this section of code, it was still under the Rum River Management Code, but because that was so buried, this is kind of the step to bring it a little bit more noticeable. Um, it's our codes are great, but I could tell you that I can find a property where every one of them is broken. >> For the most part, I think we'll have pretty good compliance with it. people on the river seem to be more sensitive to what they can and cannot build. Um, but it's if the DNR receives a phone call or um, you know, if we see something that is beyond our control is when we would call the DNR. So, we do have that relationship, but a lot of times if they put it up on a weekend and their neighbors don't care, it it could be there for years and nobody we wouldn't even know it. So, >> yeah. So I again I don't know how we advertising it was good like that but I just I just think it would start out best if if the if the way the code was written if you live in the Rome River wershed you still need a permit then it continues on saying you don't kind of a thing rather than somebody saying it rather it being a footnote at the bottom of it. We are picking back some items that um kind of got set back with a lot of the work on the fire department the last month that became a very high priority. So a few other things had to be put down. So dusting off with the new year and and picking things up kind of where where we were and then also I was notified today that we should hear this week or next uh in regards to the $2 million on the federal appropriations. So hopefully we get that phone call within the next two weeks that we have $2 million secured for our utility project along Highway. Other than that, just getting back into the new year and getting going. So >> question for Kate. Anybody? >> I have one question. Kate, as Highway 47 chugs along this year, will there be an opportunity, anything on either an agenda or to keep the public apprised of what's going on other than just a newsletter, this or that, like offer an opportunity for people to come and ask questions. I know it sometimes getting cluttered. People say, "Well, why don't we do this or why don't we do that?" Well, we're past that all that. We know where we are that that regard. Is there an opportunity for the public to at least uh have an ear to the tracks and hear what's going on? >> Yep. Mayor Council. So, we we did lay out the design at at night to unite, hoping for some of that conversation. I have asked MindOT to write an article for our spring newsletter. So, I'm hoping that >> good. >> They have sent somebody to us to help with communications. So, I'm hoping between their website, our website, and a newsletter that we can get some updates to them. I think there's a real gap there as far as what's being said out of mind. Um, so we are working on that. We can definitely add, you know, those pieces to our some of our events, add some more of that table communication, tabletop, roll out that design and let them ask questions. Wasn't there some other monies that last year or year before you were Can you give us recap as far as monies gathered or potentially gathered so far? >> Absolutely. So, um, in regards to the project, the pavement the pavement project between our $7 million regional solicitation grant from Met Council, NDOT has filled that gap, so we now have the funding to completely do the highway pro project. >> That's fantastic. >> Um, the $2 million is for the utilities underground. uh the $2 million will be a great assistance and that is also what we are asking the state for another $4 million on um you know we'll see if we end up testifying or anything this year with it shorter session. So um we continue to ask for those funds and look for ways to to help with that but our biggest challenge now is that utilities underground. As of today the the pavement and the work at the intersections has been fully funded. >> Wow that's fantastic. Kudos to you and your staff for staying on top of it. And again, I hope the public appreciates what I know it's seems gone on for four and a half years, but five, well, seven almost seven years, eight years now, >> but uh you've done a yman's job. It's awesome. Uh then one of one other thing I just like to suggest a new year. You said we had seven work sessions last year. I'm all for more as especially for the budget standpoint so we don't get into this quagmire that we did at the end of this year which was it's inevitable but at least we can show some earnest that we're talking about stuff and our expenses and and whatnot. I just threw these two things on there. It didn't have to be under mayor report, but it's I I returning to the 1957 Minnesota state flag. And I've got personal reasons for it and I've got general reasons for it. And I I I don't know that my personal reasons really matter so much as the general reasons. And one, so I'm just going to lay it out there. My two reasons for return. Number one is I'm sickened. Absolutely. Sickened is the right word by what's going on in this state. And I I and I I I don't think we've got their attention yet. It's just a big fingerpointing game and it's it's it's going nowhere. And so I I look at this as a statement. And number two, my big other biggest reason is I think changing the state flag and I know there was I know I did a little research on this and I know there was people who were asking for it including legisl legislators. I think something like changing the state flag should go to the people. I really do. And just running an online survey isn't going to the people. It it it this is this is in my opinion is paramount to changing the name of Minnesota. Can our legislature just say, "Oh, we're not going to be the state of Minnesota anymore. We're going to be some other some other name." And and by and probably correct. And I but just because they can do it doesn't mean it's correct. >> So for those two reasons, I I I would like to return to the to the gold flag. I understand that they're still they're still in storage. We we have them. So, it's not going to be another expense. So, I don't know. I I brought to the table tonight. Um I I think it would make the citizens happy. Um, I hear a a lot um about it on social media and I feel like I feel like it would make our citizens happy. Um, for whatever reason, um, I personally didn't agree with changing in the first place as you seem to. Um, also, um, I I think I didn't see anything wrong with the original flag and I and I liked it and I agree with you that it it's a pretty major thing and they should have it should have either been to a vote or it should have had had a better vetting system. And I I personally like the old flag and I would be on board with switching back. I just going to piggyback on that for one second too because that's a that there was a third reason. Thank you for reminding me. There was a third reason and and it simply is we're here to represent the citizens. Now my phone hasn't been ringing off the hook with people asking for the old flag, but I have gotten a handful of calls but it's not like it's been over. But I I think the sentiment it's our job to kind of represent our citizenry. I know some people won't be thrilled with it. I [cough and clears throat] think the majority are in favor of it. So it's based on population and per state statute we are required Anoka County is required to review four precincts at random. So they pull election judges from each of those precincts and they go down to the county where they handc count ballots from the precincts that were randomly selected and they match them with what was printed out on the tape registration at the end of the night. There's language out there on some suggested resolutions from ASET and I know a handful of cities in ANOA county have passed this part the poll pad part. I don't understand why we'd take the time to go take C staff time and all this other stuff when we're trying to save money on something that is nothing but a telling them we're not happy. We're making progress. On uh December 17th, I attended the chamber meeting. Again, I encourage people to be as much as you can with the chamber. I think they're the I think they're the pulse of the city. Uh had the audit call with Abdo, just the routine 12 questions or whatever it is that do I suspect or see any fraud, that kind of stuff with the audit report. So, I had that form conversation with them. Was there more to it that I should say, Darcy? Uh, had a good sit down with public works again, talking primarily about MS4 and, uh, Smart Salt kind of discussions. Just a good sit down with Paul and the parish. So, I appreciate that. And then lastly, on December 23rd, Kevin and I requested part of be being part of the fire board, we wanted a tour of the Bethl Fire Station. So, Chief Schmidt took us on a tour. It was very it was a very good discussion, a very good >> walkthrough. I found it really helpful to see see it firsthand and know what we're talking about >> as we move forward with that. It it was it kind of relieved some of my fears. I was worried that it would be a knockdown situation in the near future. That's not the case. I think we can make make things work. The only other thing I want to highlight is that there is a Pioneer Days planning meeting on Wednesday, January 21st at 6 PM at the Legion. Um, just to repeat, I also went to the uh I was at the Remember Fire District meeting on the 16th. I tooured the fire station with the mayor. Again, got a better eye view what was three people over there that covered Bethl's fire department is now they have lockers for well, they have enough space for I think there's 12 individuals over there now currently. But there's some again work to be done, but it was neat to see it firsthand and and talk about the future. Um, also I encourage people to go to the hardware store. I've met Cassie a couple weeks back, the wife's one of the owners and then her husband Danny. Um, you walk in there, it's a whole different place there. Uh, it's bright and cheery and not that it wasn't before, but go in there and support those guys. You know, I had a couple keys made. I'm going to I need to get some Victor mousetraps here tomorrow. I'm going to stop in there, but um they're willing to uh listen to some ideas if you you're thinking that they need something or they don't, you know, fill in the blanks. If they need to add to their inventory with something that you want, um by all means, they're willing to listen. Um I wish them all the best and that I I think it's pretty exciting that they're they took it on and >> it'll make a difference. So, support your local vendors as it were. So, that's all I have.
