all matters that are relevant to the city of Carver's Authority for up to five minutes um on anything that's not listed on tonight's agenda specific requests for information may not be immediately available although we will do our best to follow up with you um sometime after tonight's meeting the city council should not be expected to immediately act on requests however we will follow up accordingly and May schedule items for future consideration come on up welcome you don't mind introducing yourself with is this okay can you hear me yeah is the green light on yeah it's on you're good am I too close no you're good my name is Al Sherwood I live in Chan hasten and uh thank you for this time to be before you tonight sharing some of my thoughts on Election Integrity matters in Minnesota absentee and mailin ballots are documented to have the highest potential for fraud including concerns with identity theft lost ballots and chain of custody issues a certain administrative rule in Minnesota has made absentee voting a major election Integrity issue with regard to Signature matching state state law requires that the voter must sign the absentee ballot the Secretary of State's office along with an okay from the appell judge has in place administrative rule 8210 2450 which now allows for any voter to have to sign an absentee ballot instead of making the common sense determination that the law requires that the same person signed the application and the ballot and the signatures appear to be the same based on good judgment and Common Sense the court essentially held that any person can sign any ballot for anyone without limitation even if there is a signature mismatch according to the rule the ballot must be accepted unless the names are different the majority of votes in 2020 were cast as absentee does does this give you any confidence knowing that any person can sign any ballot for anyone well what could possibly go wrong with that with regard to party balance Simon's rule also subverted the legislator's intent that party balanced election judges from the major parties accept or reject absentee ballots his rule makes election judges which keep the vote honest completely necessary on ballot boards and allows government staff to accept and reject all absentee ballots even if they themselves are candidates on the ballot mail in balloting mail in balloting has increased astronomically since Simon has taken office as he's prioritized convenience over security every step of the way Simon's rules told cities and counties they could ignore the party balance requirements and that they didn't have to put any election judges on ballot boards even when the law says they must ballot boards look like black boxes to me they work is done behind closed doors instead of an open forums as as required by law official Challengers were wrongly denied the right to challenge a meeting at an absentee ballot board if they can challenge a person they should be able to challenge an envelope that represents that person I realize counties and cities are told what they can do and what they cannot do by St Paul but I call on Carver County to make their ballot boards more transparent I call on Minnesota to respect the rule of law that was put in place with due process and not the opinion of one Secretary of State and one appell judge video surveillance of dropboxes does not prevent people from putting in more than one ballot this is a huge chain of custody issue Wisconsin and other states have out lowed them I call in Minnesota to do the same although it was a nationwide survey given all this it's not surprising to see that a recent poll by rasmason alongside the Heartland Institute found that in the 2020 election one in five people who voted by mail committed some type of voter fraud and that is by the way according to these people's own admission lastly I believe that same day registration is fraught with election Integrity issues once again secretary Simon prioritizes convenience over security by turning a blind eye to a same day Reg registration process that allows anyone to register to vote on Election Day and have their vote count immediately without verification of their identity 47 other states have provisional balloting which sets these ballots aside to be counted after they are verified and I I call on Minnesota to do the same thank you thank you all right um let's see we have no present a and reports but we do have a public hearing this evening um can I get a motion to open the public know um is it on your screens no okay that's okay we computer issues no no the screens are on but I don't think we're getting a signal on buttons okay and I'm looking for just there we go okay can crawl around there it is thank you all right mayor and Council the first agenda item for Carl is uh vacation process so it's on is really glamorous and fun but it's not frankly um Carver Place will also be before you further down on the agenda as well for final PL and development agreement so first order of business is just a uh I would say simple vacation but I think Dave would tell me no vacation is probably simple so uh thinking through why we're doing this why this process is required the Carl lot has been ploted previously twice before so it was platted originally with Carver Crossing nope Copper Hills and then Carver Crossing and so this will be the third time this property has gone through the plating process which has led to a lot of legal documents that are tied to this property so if you try to figure out which drainage and utility easements are important you have to figure out which legal document to go to and it's a lot so this would be the third time that it's been replatted so what the process would do tonight is that it would create the Carver Place plat so getting rid of these previous drainage and utility easements and a trail easement to clean up the property so all legal documents would just be for car place which frankly makes our lives easier today and people's lives easier in 10 years depending on who's in the seat to be able to find the legal documents that tied to this plat there was also a trail that was originally platted through the center of the plat for Carl which needs to be removed since there will be Construction in that area and a public hearing is required for this process it was run in the chasa herald twice and posted at City Hall so I have a couple exhibits so you can see Outlaw a this is for Carver Crossing this is the lot that will be uh considered tonight for carb replace you can see the hatch Mark is that there was a trail uh easement in this area that needs to be vacated because the plan has changed and construction needs to take place there you can't do construction over a trail easement so we need to get rid of it so we can move forward with our project so getting rid of that one replacing it with a Carver Place plat that you'll be considering tonight so essentially this is a cleanup process it gets rid of some of the jargon some of the tricky things needing to hunt down different legal docents to be able to just have car replace drainage and utility easements and to get rid of that uh Trail easement so the pl you'll consider tonight is on the screen so it would just be replacing the two previous versions with this one for car replace questions comments I did have one question um will we talk later tonight on the land use about the trails will we see all the trail connections yes they just want to be able to answer if somebody asks what about the trail you got rid of where are you going to replace it but y I felt like it was accounted for just want to make sure we'll see yes and the trail that's in the depiction in the hatch area was never constructed so it's not there we're not removing a trail at this point it's just space that was reserved for a trail um why don't we just before we go any further let's close the public hearing so um are there any public comments looks like they're probably are not in that there isn't anyone from the public here um after all public comments are received if there are any the public hearing will be closed no further comments on this issue will be received at this meeting all right I would entertain a motion to close the public public hearing because we're changing existing platting or I mean this is the first time we've done this so I just maybe a little background sure that's a good question um mayor and Council so um before theity vacates any public easements that it holds whether it's for public Street public Trail like we have here U public drainage and utility easements like we have here um the statute requires that the city um notice and hold a public hearing so not only did we um have to publish notice for this but we also had to send a notice to any affected property owners in this case it was just the the applicant who obviously knew about the the vacation so it wasn't um you know too significant of an under taking for staff um and one other thing too that it's probably worth adding is that all of the vacation that we're contemplating here in the languages in the resolution but it's contingent on the final plat being released for recording and being recorded concurrently with the vacation documents so what effectively we're doing is is wiping the Slate clean that will this vacation will be recorded um immediately before the plat and then the plat will get recorded right after that and that's going to have all the required dedication that development needs to function properly um and so that's I think a good way to think about it is we're we're trying to clean up the title like Aaron mentioned and also um eliminate that trail that runs through the middle of the property that is no longer part of the plans for this for this area sure so so we're basically doing instead of a Choose Your Own Adventure look at this section jump to this section we're kind of starting it over and then replat it with the final one we wanted anyway right it's just a simplification correct okay those uh watching uh in the work session tonight the city council uh discussed a capital Improvement uh plan related to uh Building Maintenance project and a renovation project at the fire station um if you just can zoom in so the project includes a um the fire station addition which is a really a renovation project for uh to segregate and climate control their independently climate control their turnout gear um and then a fullof roof replacement at 801 Jonathan Garver Parkway along with HVAC replacement uh rooftop uh replacement at that same uh location and so as we discussed during the work session um we're planning on using Capital Improvement bonds which uh requires a public hearing and so uh on your consent agenda was a public hearing notice so the estimated cost of the project which also includes uh design and soft cost Etc is 1.3 million in change as you can see uh in the notice we round it up to 1.55 uh not that the council intends to spend that amount but this has an additional contingency uh since this is the uh sole source of financing uh does give the council the opportunity to at least consider if you have uh a larger um bid come in and then uh this evening uh the Al discussed uh looking at developing a concept for solar and uh the the idea of a workshop number of around 250,000 was uh discussed as a additional budget consideration again not as a a definite plan to do it but at least the option to consider it from a budget perspective um so open to suggestions on this but uh I just simply uh added 250,000 to the 1.55 Z and and got to the 1 1.8 million as a a published notice but I defer to the council if you feel more comfortable with another number again this is just uh not just this is the number that you would put in the public hearing notice and then based on bids and based on scope you would determine the amount of uh the bond issuance at that time I'm comfortable with that and that's in line with what we discussed at the work s yeah and again to reiterate what Brent just said that's the ceiling number yes yes don't have to that's the number that we have to let the public know is the absolute highest we can go but wouldn't be necessarily the number that we borrow so i'' be looking for a motion to approve the not notice of public hearing but amending it to 1.8 million all right I'm going to try and get through this here so just say some so you want no I really wanted to say it okay um no I big agenda yes approve a notice of a public hearing with the intention to issue General obligation Capital Improvement plan bonds second by council member Walsh any further discussion all those in favor to say I I oppose same sign motion passes all right business items 8.1 Carver Place land use approval thank you mayor and Council so part two of Carver Place uh we just worked through the vacations now we'll review that final plot that we talked about with those drainage and utility easements so starting off where the project is located we're talking about property at 1591 Heartwell drive so just south of Carver Crossing north of the oak tree development near caror station along Jonathan caror Parkway or County Road 11 talking through the applications that are before the council tonight the first is the final plat so the final plat is the technical planning document it lays out the drainage and utility easements which we just talked about in the vacations uh shows the layout of the property this will be the final review by the city council so once this review is complete you likely won't see another review for Carver Place uh generally what we're looking for at the time of final plat confirmation of what we saw at preliminary plat that holds true there are a couple changes that were made during the planning process that I'll talk through in a couple sides but in general what we saw uh at preliminary plat which the council reviewed on January 16th 2024 is consistent with what you be reviewing tonight um the Planning Commission reviewed at their most recent meeting again a reminder the city council approved preliminary plat on a 5 to zero vote at that meeting in January once the plat is recorded with that vacation notice as well the developer can move forward with a building permit once all those documents are recorded So a really important step is that we memorialize this package of approvals and having it be recorded So the final plat is on the screen now so again it's really technical planning document it lays out easements project location Etc shape of the lot um here we're creating outlot a which may develop in the future as an additional project which will start the planning process all over again which is Carver Oaks which we can talk about in a couple slides so lot one block one is considered tonight for final plat for Carver Place so the other request by the city council is uh a motion to approve the development agreement with the CDA so a development agreement is a document that's drafted by the City attorney reviewed by City staff reviewed by the developer to make some agreements in what the expectations are so there are agreements throughout on some really big expectations so things that the veler can anticipate the city can anticipate what residents can anticipate there are some really big details so fees what they owe us for Park dedication uh storm water Sirens Etc schedules are another really big one so we can start to tell people that might be calling when is this project going to start when is it going to end we start to see some of those details through the development agreement and it goes down to really small details how is the cement truck going to get on site it's included in the development agreement so it's a catchall for the entire group to come together and say these are expectations this is what we're agreeing to Da again is recorded and referen throughout the construction process and Beyond so if someone calls and says they're hammering outside of construction hours we can go back to the DA and go to the developer and say you signed this you need to meet these expectations so again another really important process so tonight it's a resolution for a final plat and then a motion for the development agreement so again located just south of carber crossing their second apartment site so some details about Carver Place it's a project proposed by the CDA which is the Carver County Community Development agency which will construct own and manage the property so a little bit different than Carver Crossing which is the existing uh apartment complex on site it's 60 units 15 1bedroom 32 bedroom 15 3bedroom some project details it's 95 parking cells with 70 of those being underground which meets the requirement of our parking ordinance a parking lot with 27 25 surface level indoor outdoor B storage and then Ada accessibility throughout the entire project at the January 16th meeting you reviewed a lot of information about the zoning about the comp plan so I'm just going to give a really brief overview since everything does continue to meet the expectations that uh were set at preliminary plot so you'll see that the proposed project meets all setbacks the height requirement the parking improvements as well and then thinking through through the city's comprehensive plan so it's guided medium density I know it can feel a little bit uh funny having an Department going to what we call R2 which is a residential district we use pretty frequently for single family uh this one again at the January 16th meeting I kept saying like think Copper Hills think carver station think all of it together all of those things are important to hit the density that's required for our medium residential district and our comp plan so this project meets the intent of the city's adopted comprehensive plan I'll look at what the building will look like from the north looking South General layout of the parking garage and the first level so first level will have Lobby space mail space garbage Community rooms um some office space for CDA staff members a fitness center for members living in the community and then just a general layout of the different units on each floor two and three are the same so council member s asked about connectivity it also is brought up pretty heavily at the January uh meeting at preliminary plat how is this going to connect into our greater system how does this play in so what we've added from preliminary pla to final PL is the area circled in Red so you'll see throughout there's if you start looking there you can see where the sidewalk transverses the entire East West portion of the building hooks into our trail system along Jonathan Carver Parkway provides a crosswalk over to Carver Oaks which is the cda's proposed future project and then as part of the comments for this project is that we requested with Carver Oaks a North South Trail connection on the farthest Westerly side of that proposed building so we don't know a ton of details about that building yet just because we haven't started the planning process but we'll continue working with the developer to make sure that trail connectivity is a feature for both Carver Place and Carver Oaks so you'll see um it continues North as well to get into our larger trail system so that's one change well you're on that side the um the trail on the East is that the existing connection between parallels JCP yes yep then one that is uh not as glamorous as fun trail connections is that we've gone back and forth on the landscape plan a couple times uh buffering to Oak Tree so the previous version of the landscape plan showed some trees where the red circle is right now the pond requires that space for the uh which high water level is it what's that 100 year high water level so we aren't able to put trees in that location because water might bounce there from that pond which would lead to trees probably not being successful so that one has changed a couple of times but this is the version that works for construction with that pond unfortunately so the final plat is on the screen now we also have uh put the pond on the south portion of the property in a drainage and utility ement which is our typical practice so the pot looks a little bit different from preliminary to final but in general conforms to our typical practice um was reviewed by City staff and Consultants the development team is here if they want to come up join our conversation and discussion I'll pause for now if they want to join us do you mind introducing yourselves before we start welcome good evening mayor and council members thanks for having us back again um I'm Alison strip strike the deputy director with Carver County CDA and Steve Dunbar with ay properties owners rep for the CDA I'll open it up for a discussion either City staff or the development team right any questions good yeah um can you just go back to where you talked about removing the trees from the uh tension Pond how was the I don't remember from January was the tree planting as kind of dense if you will as it is on the Eastern side no there were some groupings between but it wasn't as dense as those okay um I don't know that I have any questions on the project thank you guys for incorporating that trail connection I think that that was important because my question was how are the kids GNA get to the best stop um back in January but I appreciate you accommodating that and making that work um the only other question that I have is for the da and so that might be for you guys um I would like to see language in there about what we casually refer to as our water piracy ordinance in there um just for you guys we've been having an issue with contractors related to or unrelated to construction opening up our fire hydrants and that turns off the water system and the neighbors have issues with discolored water it's been a real problem so much so that we made it a misdemeanor in the city of Carver to um unlawfully access a fire hydrants so um I kind of looked and I don't think I saw anything in the da about that but um I think that that would be a good addition to that we we can certainly add a reference to that if if you'd like us to there's also just a general compliance with laws provision that requires the developer and that includes their contractors and everyone doing work on their behalf to adhere to all laws ordinances regulations directives of the state the city that kind of thing so it's it's a catch all because there's really all kinds of laws that arguably would apply I know that one's really important especially as of late with some of the issues we've been seeing with contract um and so what I can tell you is um it's kind of wrapped into that catchall provision as I would still like to see it called out I I would like called I also understand that the contractors probably aren't going to be going through that with a fine to col but it's been a real issue in the city of Carver so much so that even like in the off season from January until now we've probably seen two or three hydrants illegally access to um when you wouldn't expect it to be happening in the middle of winter although this isn't a traditional winter as we all know um but I would really like to see that we can add reference to it there's also an opportunity for um what's called a preconstruction meeting they have to have that with our engineering team before they start construction um and so I don't know if we talk about it in every meeting too so it's reinforced at that stage as well with the contractor at the okay we we do have some blanks that we have to fill in before we finalize this I don't think that's a controversial provision that anyone will have issue with so we can simply reference that that ordinance in the in the version that we have executed and recorded okay great dollar question it's oh sorry um I think our uh the discussion with Minnesota housing today now is a July 1 is that what our just targeting yeah hopefully it'll happen in January but that's kind of what we're targeting right now July July July 1 okay yeah awesome in welcome July 1 it's a long time outstanding appreciate it thank you um okay 8.2 the Lions Court project authorization for bid Smith thank you mayor and Council so tonight we're talking about a project at Lions Park which is located off Mount H road so um I suspect the mayor will talk a little bit later about a learn to pickle ball event that we had with the parks Advisory Group which was so fun by the way so fun um but we started talking about this project that uh should the council be favorable we'll have some pickle ball courts and people were like where when when can we be there so can I get there tomorrow right so located in lines Park which is off Mount Hope Road so Lions the court that's in Lions Park right now is in a pretty rough shape it was resurfaced in 2011 after it was also in rough shape then the change between the project in 2011 and the proposed project now is that the project is a full reconstruction so instead of just resurfacing we'll do a full reconstruct so it should last a while so the base will be reconstructed as well there's also a few changes to the existing court so we'll transition to a half court basketball with two permanent pickle ball courts which will require some additional fencing and the proposed funding source for the project is the special Capital fund and once the $325,000 are potentially allocated for this project the fund will be dissolved so something Lyn chudy the finance director has been working towards is dis dissolving the special Capital fund so um moving forward with this project we'll dissolve that fund so existing conditions there now so it's a tennis court and a basketball court with some like free space on the Westerly side with a basketball hoop conditions in 2011 when we did the resurfacing so the left is obviously the correct condition in 2011 the one on the right is the AI picture that looks so beautiful and fake it's not AI I took that picture I know it looks so fresh and nice um so potentially hopefully what it will look like with this new reconstruction and back to where we are again so similar conditions to 2011 when that initial project was completed proposed layout so keep the tennis court go to the half court basketball with the two permanent pickle ball courts on the west side east north side that's kind of a strange orientation of it so near the basketball courts and then thinking about the fencing so uh 10-ft fence on the rear of the pickle ball in tennis and then six foot fence throughout the rest of the project so again I'm looking for authorization to go out for bid for the Lions Court sport courts Lions Park sport courts I said too many sports there any questions I have a question about the fencing um so the fencing right now around the tennis court partk at least is got to be 10 ft right because I'm afraid are you saying that this 6ot fence is going to go around the tennis court also so 10 ft on the backside by angles property corre yes yep yep but right now the fence is higher than six feet out there because that doorways yeah that looks sure so what I'm worried about is if we only have six feet around a tennis court I mean those balls can go those go flying right so they're going to be chasing around so why wouldn't we have 10 ft out all the way around like we have now cost is none of this fence savable then to keep some of this because I don't know that this was refenced at that same time when it was resurfaced last I haven't looked at the I guess the condition of the fencing but it's possible to save some of the T of fencing I don't know six feet I don't think is yeah so this is a cost consideration the the cord is going to get larger so like the foundations of the pulse are going to be removed okay uh so theoretically you might be able to save a little bit of the chain link but that's not going to be a significant portion of the cost so you're really looking at uh new fencing at least um if you want to go 10 ft okay so we can do it we just we'd have to amend and um adjust to find a source of funds for that other questions I'm just Ming this I'll come back I have a question on this slide um or actually two questions is there anything in the um plan for shrubbery or landscape because I'm wondering if there would be the option to add just a tree line or start with some really small strawberry to give a little more of a aesthetically pleasing look there's not plan for it now again it would be a cost consideration that we don't that we didn't account for at this time just you know one piece from um when we started looking at this so uh as an additional cost saving measure um Public Services is doing 100% of the um what's the word removals of this so of the surface and the fencing so because we were uh uh up near what6 700,000 and so we've um you know we're going to be having Public Services participate in some of the back filling so um this is um getting this getting the project in in the ground if you will um but again we can you know we have we can be dynamic if the counil says hey we really want this to occur whether it's fence or Landscaping Etc but this is going to get you the courts the striping and the fence as shown I mean we've built in a contingency obviously so if we get favorable bids we'll have um a um more I guess and I um you know I I did uh make a request to the Carver Lions to see if they wanted to participate in the project I haven't heard back from them uh so that's also an opportunity where the budget could expanded uh but we have 325,000 in the special capital and so uh we worked within the confines of that budget to try to make this work any other questions comments motions could we add um some landscape or just like a I guess so you're asking us to approve the plans to go and advertise the the plans don't include any landscape is there a way to do it and just say like what could we get for $2,000 knowing that I'm worried that I'm hearing that this plan is the top of our budget yeah I don't know that we have $2,000 Lori are you talking about a buffer between England's property and that just on the northwest like there probably isn't right room but that's something we don't have to do with this project you know if it's something we could look at later later or maybe you know who knows what I just think this org this park will get more visibility getting more use out of it the one thing say that it's right on the property line I'm sorry yeah I was just going to say mayor that it is very close to the property line so we'd have to try to shift things a little bit more closer to the trail to try to save a buffer space for landscap in the future if you were to consider doing that at some point so it would we'd have to make some changes now to facility that later if you ever wanted to do that I I would like I would support that I just feel like we're telling people we're putting $300,000 into you know redoing this and adding the pickle ball parks I think they expect more for amenities and maybe there's something in I'm not the horiculture expert but maybe there's something where there's like an ivy can you know some type of Vine can grow or maybe it's not where that 126 feet is but it's to the left of it so it would actually be on the northwest um just kind a buffer so for me I mean this is a chain link chain link background that you're looking at anyways I guess to add additional cost I mean we know that could be moved we could do that we could Shi it it doesn't seem to be a big priority to have a chain link fence now to hide you know to put Landscaping behind it also as a person who knows a little for I would not I would not do a climbing vine it'll tear the fence down okay um I guess Lori I I mean I appreciate the Aesthetics part but for me I just if we're looking at a chain link fence anyways I don't it's not on a highlight list for me okay I'm also a little worried about what the cost impact of moving it there's not a base to if we'd move it four feet or whatever so just uh mayor Cel is from a sports poll oh thank you uh perspective um you don't traditionally see like you wouldn't want trees or like leaves blowing into like the tennis and pickle pickle ball court areas it would add a level of Maintenance and disrupt the play um so if we would plant trees you'd want them uh in a perfect scenario to be a little bit further away from the actual plane surface so there isn't and coniss are going to get 40 feet wide 30 ft wide so then were really yeah I'm going to make a motion to approve plans and Order advertisement for bids for the Lions Park Court reconstruction project a second got a motion by Mayor Johnson a second by council talk bad news all right Third Street uh Bridge Project authorization for bid Mr good evening mayor and Council so this is topic that we um looked at at our last work session and this is the formal step of bringing this to you now for approving the plans and authorizing us to go ahead and advertise for bids um we have state aid plan approval so the plans are ready to go and um this would be to reconstruct the Third Street West Bridge which was originally built in 1912 and um we have State bridge bond funds to replace that structure um the the funding plan is is attached in the memo um mot state aid Bridge office would be responsible for about $1.4 million in costs uh the city's local match on that would be $20,000 and then nonparticipating items in the amount of 75,000 for a total of 95,000 for city of Carver and 1.4 for state of Minnesota that number will be adjusted after we get bids um so they'll re reassess based on the actual bid results so that number will be adjusted accordingly and we'll get a formal encumbrance letter from the state of Minnesota for that grant program um so um I'm looking for a recommendation to move forward with um advertising for bids when we come back um with the bid award I'll also have the grant agreement with the state of Minnesota so we can see that entire package and what that looks like um and I'm anticipating that for first meeting in May at this point any questions questions I do go ahead Chris um so when we're looking at the lby the stop log system um are we we don't have the the some of the other pictures here of when and if the levy gets completely done when when yes um so is this bridge going to be raised up high to match or is it going to stay exact at the grade it's at right now um as far as like the roadway elevation or the railing or the roadway the roadway elevation is staying within inches like it's basically the same profile as it is today so the the water will will go through Third Street when it when it floods and the stop logs will basically keep it from going outside of of the channel area yeah I just want to make sure when the flood walls are up that that is an actual point where the the water can't escape so that's it's necessary for that so okay that's all IE all right um I think this is a great project getting a $1.5 million bridge for even if we pay $100,000 although I know you're optimistic that we'll get reimbursed with some of the levy funds that's 7% so it's like Pennies on the dollar don't check me now I just I think that our engineering team was so smart to great job get their foot in the door when we were at below that 5,000 threshold so good work good work to you eron good work to Dan appreciate all your hard work um I will make a motion to approve plans and in favor say I I I oppose same sign motion passes all right 8.4 filter media acquisition for the water treatment facility Mr Schmid all right thank you mayor uh this is a change order that is um for the water treatment plant project uh this this somehow or this relates to the filter underd drain work that Council had previously authorized late last fall uh filters number one and two um the under drain system so basically there's a a sand media that filters the water and underneath that um there's a screen system that um prohibits the sand from falling through and going out with the water into the clear well um those existing under drains which were from the original plant they had failed um so Council had previously authorized the basically the replacement of those underd drains um at the time we had thought that we'd be able to retain much more of that media that was essentially lost when those drains failed and that turned out not to be the case um the contractors went in there and done the removals and they're prepped for actually putting those new drains in they're going to start working on that this week um but what happened when they did the removals we found that we really weren't able to save much of that media because it was basically comingled in with the underdrain system underneath it was hard to separate and with the composition of the media but with the two materials it was hard to really tell what we had left between the anite and the green sand so really the cleanest way to make sure you have an un engineered filtration system um is to put new media in after the underd drain work is completed this spring so that is the recommendation by staff and uh the change order is in the amount of about $156,000 so any questions questions um yes um so um like you said we we didn't we thought we' be able to reuse it but after they actually got in there and looked at it just the amount of loss and uh was was too much and then what was the co mingled so you're you're saying that for the drain to work effectively you need to have a isolation between the two different materials and once they got mixed together even if you had enough couldn't put it back in because it wouldn't be the proper it would be incorrectly mixed or not stratified right is what I'm hearing yeah and they have different specific gravities so one weighs more than the other so it it wasn't necessarily that it's not possible but just physically the underd drains themselves were literally full of media and there's no way like the the concrete under drains had to physically be like broken out and removed so it would be full of debris and it just wasn't suitable to put back into your filtration system so between that and what was removed from the clear well itself um that was basically vacuumed out and it's not really salvageable Sal so what so this is an additional 150,000 because we already had approved a what would you have the total now I believe the previous change order for the underd drain work was like 300 43,000 does that sound right Brent it was three it was three something um so yes this is an addition to that so I acknowledge it is it's a it's a big cost but it's we we need to get these filters put back together otherwise we're going to be in a you know coming up to Summer and we don't want to get into that position so we recommend moving on this and continuing to move forward um so I guess was more for Brent so the enterprise time we have that money in cash already available yes so the you know the strategy that the city council um preliminary kind of adopted is to do a bond issuance on the W controls and so that in essence um leaves that cash in the fund to to pay for this out of pocket or with cash if you will okay thanks any other questions I have um go question and a comment if I remember right we came in under budget with the water treatment plant I was trying to go back through some notes in hindsight I wish we would have like held on to some of that money which that's not how budgeting works but it's too bad we didn't foresee this sooner and no well we we more or like we like that money wasn't given back it still stays within the account it's just moved into the general account so we're um and this is being a change order with that same project so I would um I wouldn't look at it as that money was lost or used for something else it would we be able to get a account for like how much we were under budget and what we've used and what we've used it for and I realize that those answers wouldn't be you you'll get a um you'll get a lot of that in the audit if you want a um we could have make arrangements for Lyn to just do kind of a a project recap at an upcoming work session too I think that would be helpful yeah no rush but that would be helpful um and then um I wanted to comment I appreciate having the line item on Wow how much the media really cost yeah it's a large cost and then is there anything on like guarantee or like warranty or could we be looking at this again and one year 30 years as it relates to the media itself yeah so that was the media loss was due to the failure of that underd drained system that was originally installed okay so this this will have a completely new system now you know that that failed after 20 you know 20 plus years um we we feel that the design of of the new underd drain is something we've been using for a long time and we we think it's a good design so it actually doesn't use a stainless steel screen anymore it uses a gravel layer to kind of separate um the sand from getting through so we we think it's a a more robust system than using mechanical anchors and such to to retain the media itself so all right think that answers my question um mayor and Council just and I I don't know if you mentioned this Aon but the we have a good relationship with our insurance providers since we're kind of uh involved with the our partner with the league of Minnesota City's Insurance trust so we've been reviewing this and investigating whether or not this uh Rises to the level of a claim since you know the underdrain system failed um and then the media was a result media loss was a result of that um I don't have enough uh background in insurance and our policy to determine if that'll be a go or not but just as a sign that we're exhausting kind of all available resources as it relates to this and then um you know Aon has mentioned it in his memo but uh filters one and two have been offline and so none of this is uh connected to any reports that we had throughout the winter related to discoloration in the system you anticipated one of my questions about the insurance claim thank you um let's see Erin is there any cost the Ria that we were trying to save is there any cost removing that do we still have that same removing what mayor the original uh media so yes um that the original um under drain work assumed that they were going to salvage and reinstall that media um so this this uh change order or uh proposal request that the contractor wrote up was it it credited that piece of it um in this so those that is accounted for in this cost no cost to remove get the media from the water treat the old media from the water treatment plant and dispose of it so that um I believe those costs the the city was going to take care of that the the removal of whatever was still remaining okay so we're not having to pay the contractor to do that okay is that correct um and then you had mentioned that some of this purchase of filter media is for filters three and four of the new ones are those doing I assume we're monitoring those pretty close because we be losing a ton this early yep so um there's been a couple inches of media that have lost um in those filters in that section and that's not something that's uncommon when you're starting up a plant and kind of working the bugs out per se when you're getting the backwashing sequencing optimized and that sort of stuff so we're getting a little bit extra anite which is the top layer of media just to top off those the new filters three and four since we're getting the getting that delivery anyway so and I assume that's part of our procedures we always check on that to make sure we're not losing yep so staff measures the depth of the media on on some sort of cycle I don't know what it is but okay um it's something that they're watching very closely as well to make sure that there isn't something happening that we need to adjust some sequencing on the plant operations itself for those filters okay super thank you except for my questions any others a motion I'll make a motion to approve change order number six in the amount of $156,600 [Music] discuss uh proposed equipment acquisition for the Public Services Department uh we're proposing to finance this through a Capital Equipment certificate as a part of a l larger Bond issuance uh for your consideration later this spring uh this is an item that the council's reviewed on several occasions related to our long-term financial plan and then in a in several work sessions um the four purchases are replacement of the 1989 payloader uh we do uh plan to keep the existing payloader and um uh through some uh I would call minor uh cost sensitive upgrades we want to kind of keep that as long as we can to provide uh as much uh life and use out of that uh machine uh single axle plow truck so that's the traditional large large City plow truck uh utilities truck so that's uh especially um outfitted from a box perspective truck with a crane uh used to pull lift station use to to pull and service lift stations um has a lot of utilities related equipment and tools within it and then a heavy duty truck and I really want to give Paul and uh Eric and the whole public service team a lot of credit for some creativity uh with this um the uh we're purchasing chassis which from a non-public Services perspective isn't some a term that I'm really used to using a lot but basically the truck and then it's outfitted with different boxes depending upon the use and instead of having a truck for garbage for the garbage compactor on another truck for um when we do brush removal Etc they've uh found a device called The Switch Eng goal which basically allows them to put different tools so think of your vacuum cleaner with different um pieces that you can put on there for a brush and vacuuming out your car and so on and so I think this is a real ingenious way to look at a vehicle purchasing rather than buying individual trucks that might be used once or twice a week uh you can use the same truck and use it for different uh types of services that we provide throughout the week um so uh series of motions we're we're asking the council to approve the purchases uh of these items um because in some cases we have anywhere from six months to a Year's worth of of wait time um some of the things will come in different pieces if you will like we might get the chassis but not the box or vice versa and so we really want to get these in the queue and ordered uh and we'll we'll have the cash on hand then to uh complete the purchase at the time of delivery so uh happy to answer any questions that you may have have questions I have one about the payloader I'm not sure why I had this impression in my head but that we were going to sell it or get rid of it um we would recoup I mean in my mind then obviously we would recoup some cost not that it's um a 1989 1989 payloader is going to bring in millions of dollars for us um is there a reason to keep both payloaders I mean yeah I mean I would offer like it's the one of the primary um pieces of equipment that we use to clean cacs and so um just anecdotally that's you know we tend to get uh a lot of Resident feedback on like culdesac cleaning and if we can do it in half the time with two culde saacs at minimal cost um sold thank you yeah less emails all right any other questions are there any other vehicles that we were replacing or is all additions uh there is a um the utility the addition is the uh the Switch and Go addition says addition of a large truck yeah I I would have to I don't know if we're keeping I'd have to check back in with you stuff kind of goes to Christie's question is there anything that will be kind a surplus that the city can realize say so we have to I think I know but I don't want to speculate I would say that anything that we sell we have will'll bring back to the council in the form of a resolution a surplus so I want to be 100% sure on that I I know for certain that uh we're keeping the payloader I can get confused a little bit between like utilities and heavy duty I know there's uh one that we just replaced a transmission on um but we also know that it's going to take some time to get get the replacement so we didn't want to be that down so we did invest in money to get that transition repaired transmission repaired um but I'd want I'll I'll get information back to the Council on that any other questions or do we want to start doing motions okay I have one more question so when we're looking at the financial part so it says that we initially estimated the 970,000 and it did not include any of the tax title or licenses obviously seen it coming in at 972 is not huge difference because we had some savings otherwhere did was it an oversight that we didn't include the tax title or did we just we had no idea what it was going to be well those are estimates that we had and so actually we're the 970 didn't include that but the N the 970 didn't include that but we're actually considering that we're only 2,000 more we had 63,000 worth of tax title and license cost so we're is that what it was it's the last item in that t in that table there the last so we're I would offer we're considerably under budget based on that 97 yep and I have no problem with where this is coming in but if we're going to make purchases in the future if we didn't if we don't include that tax title that could have been $63,000 above this right correct but we we don't know that until we actually like get the quotes on the vehicle so a lot of that would be we can speculate on that in the future if it might be good to just have an idea of that before going Council uh this is a continuation of a discussion we're having at work session so someone's tuning in now and looking for some additional Conta text uh the work session that took place tonight has a lot more additional information with the slides darn it okay so during the work session we gave an overview of our current sign ordinance Dave the City attorney gave a quick overview of uh the legal implications that come with signage throughout the community we talked through specific zoning districts the type of signs that are allowed gave some examples throughout the community so we could start to picture what they look like prohibited signs is the thing that staff is looking for the most feedback on so thinking through signs that are placed in the right of way what does it look like to be a good friend and neighbor to local businesses local community groups Etc but also having Fair rules for things like City sponsored events the Lions steambot days Etc so thinking through uh specifically temporary signs in the right of way and then some feedback about signage on uh city parks City facilities Etc so again lots of information at the work session but going into discussion about the signed ordinance so I can yeah can I just jump in just for some clarity of purpose here the so I think it's inevitable that we'll the council will get into um a revision to the sign ordinance and I think anytime you start talking about s ordinances there'll be a community and business owner component and so selfishly what we're looking for as the staff is like what guiding principles do you want within that so you wouldn't necessarily have to decide you're going to allow this and not allow that but on some of these bigger ones like Signs and rways some guiding principles as it relates to how you see that and what your perspectives are will be helpful in uh creating a revision uh so that we don't deliver something to you that that is not in keeping with you know what you support you have anything to add there Dave yeah I think those are great points the only thing I was going to add to is um just procedurally you know we'll take feedback and incorporate those guiding principles into any Amendment if we need to do an amendment um and then just I wanted the council to be aware of um you know the zoning ordinance is where the sign ordinance is contained and so that means we would have to bring any proposed amendments through planning commission there' be public hearings so it would be a very public process with opportunities for people who might have um comments or questions about any potential revision to make make those comments or ask those questions um but just procedurally I wanted to make sure that everyone knows too that it it'll take some steps and so we'll have to work through those steps regardless of where we end up all right thank you um I was going to start the discussion was saying that um I don't know some of you might know I'm not a big fan of these temporary signs in the the right of way um I think they have a tendency to look junky they get a skew in our kilter after the wind comes through and um they're just never maintained I'm quite certain there is still one up off of Monroe Drive that says Christmas tree lights come and we'll hang them for you um and that is probably been there for three months um so I also think that there is potentially some dangers not only for the folks who are placing them but for our folks who have to to remove them after some amount of time when they're along Jonathan Carver Parkway and I just I don't think they look too sharp when you're coming to Carver and you're going down and you see all these temporary signs so you know we had a a lengthy conversation about this in our City attorney pointed out that we had a better than average uh city ordinance related to signs that it was uh fairly well encompassing and well written has somebody else cracked the code of this are there other communities that have some Provisions or structured leeway in the ordinance that says these are the rules uh but understand your sign may be removed uh if you're if you're in violation of that code and come pick them up at City Hall so are we looking to make an ordinance change or a statement uh to say be aware uh and you know we under we recognize uh we may see these from time to time uh and understand that they may be pulled and and this is the reason why I'm worried there's a a slippery slip of making an ordinance change that allows everybody to to put their temporary signs that will and have a policy that backs them so that we have uh an explosion in uh in in advertising in Green Space so that's the concern and the question is again is has anybody else the coda in this or is our ordinance does it sufficiently protect us and give us the ability to pull them and we need so if we're going to talk about other cities ordinances I'd like to see what they do for the community organizations because there is something about some of these signs that really lend itself to you know cohesiveness in our community right so things that the Lions do things that the ccbsa does you know there's you know sign your kids up for softball the field well they were not allowed to have the sign in the city park so yes you can put it on social media but again these are some of our city organizations that you know create some of these binding ties between families and neighborhoods and friends so I think I think there is I think I personally would like to see something and what that looks like how we would address that I can't get to so like you said has someone crack the code for this I wanted to mention a couple a little bit more specific obviously I am the coordinator for steemo days which is a big event which takes much signage that um sometimes Aon was zip tied to a stop sign um and here's why because we do have these bump outs now there's no place to put things that say this road is closed you can't put a banner in there because it's concrete so you come to certain corners and have to say okay now where I going to put this now this is just an example there's been I will just there was a corner and I asked a certain person you know would you mind if I did this and they said no and I said okay then now what do I do so you have to look at alternatives to putting it in someone's technically in their yard right and so then up Sixth Street and I realized that in here there is some Lori had pointed out there's some Provisions for Traffic Control signs or maybe Brent had said that too um you know I have to put those in the right way going up Sixth Street for seot days they have to say seot days no parking and things like that but once you get down here it's a little bit more difficult to find spaces in the downtown to to put some of these things I also want to be very proactive in the downtown um when it comes to our businesses down here we have a new Trail coming in I would love to see them really flourish when that happens now do I want to see signs that are left over from Christmas tree lighting anywhere I don't um but what is again what's the result we have and we have I think it's okay to look at some of our unique features of Carver too it doesn't have to cookie cutter to every I mean if we decide that gazebo Park if you pull a permit and we say you can have the sign here on Saturdays in October maybe that's okay maybe that's okay for the Lions what are we going to do for those clubs like that so the Lions who are very Community Centric in the money that we raise and the people that we support now we're technically out of we're out of line with the sign ordinance so we couldn't put that up for the meat raffle on Saturday or down when we have um you know whatever event is happening we put it in the park that says you botom things thank you how do we how do we figure that out like how what does that look like for us I don't think that that I don't think squashing some of that in our town is a great idea but that's really the conundrum right the delineation between what's a benefit to the community and everything else and we can't say yes Lions right no right I mean I I mean I'm leaning more towards Christy's kind of I think we have to find a way where we we allow some of it but right I mean just logistically right there's going to be signs that the Public Services can't take down right so they're going to be up right so the question is is it is I guess is it e easier legally to have a ban and then just whenever we see it we pull it but then does that get the city and how fast does it have to pull it do pull signs relative to the other ones as soon as it see it versus if there's you know a temporary sign for a week but I also see we don't want sign sting around for remodeling for three months right so I think there's got to be some balance and I'll lean towards our our Le of like like how you know like did we did someone already crack code of what is a reasonable restriction for safety you know the maintenance of trying to mow the yard right obviously if it's on a on you know I think the other trick is getting you know as with this side of the sidewalk right is that actually the right it's the easement but that's part of the property owners too right um depending on where it is right along along the sidewalk or the front of your yard right right so um I I don't think I have a genius solution but but I think we need to find a way to to have some allow right temporary or some sort of way you know to get in there without a blanket ban are we talking strictly mayor and Council are we talking strictly about signs in the right of way at this point I mean is that I mean I'm guess we are but I don't think I just want to make sure I understand what's leading the discuss we put I'm just example Lions go in the park so we put them in the park right so they're in Depot Park you'll see signs they're also they end up in the RightWay they end up on sidewalks in front of business you know we don't own the post office right but we put the meat raffle sign in the post office Corner okay just just to because I think Aaron did a really good job of trying to direct us and guide us can we go back to scenario one okay and discuss very specifically temporary signs in the right of way okay I would support not allowing any temporary signs in the RightWay it's it's unfortunate that we can't have some flexibility in gray area but I just feel like what we've been educated on from a legal aspect and to not put oursel in a situation where we have to make a decision or we find out afterwards we made the wrong decision I would just like to say no temporary signs in right of ways and can I also just clarify too does that include in the central business district where currently they are allowed in the right of way as long as okay I I mean I don't like that um but hopefully they maybe have um partnership or with the community engagement that they could put the sign on somebody's personal property and so I think there's probably going to be work done on the education piece of where is the right away Lori there's zero lot lines on most of these these buildings come up to the to put them I realiz that than poster on the door y the sandwich signs that we see on the corner for the creary or we'll see you know here and there those don't I don't have a problem with those in the downtown and I think to expect that there's room for to to get that on someone's personal property that there's almost no green space downtown that is owned by a business there's very very little I do support the signs in the central business district downtown for that re and there's and that's where our businesses are and I think the signs that we see and I know we can't legislate this but I think that's the signs that we see down there tend to be for more of our businesses it isn't the hang your Christmas lights finish your basement buy a puppy pay my house yeah um so I for me okay to continue in the central business district but I don't like them like this example I don't like this example either but this isn't the only example so I think narrowing it down right and I'm I'm not I can't I can't get on board with this because that then again takes away from any of our community groups I get it that this is would be like a personal business but just because we're looking at the example here it it also will include all of our community organizations that can't put anything there yeah and I can't get on board with that one thing that's interesting to I don't know if anyone picked up on this um this temporary sign language we didn't talk about it in too much detail earlier but it only allows temporary signs from 6:00 a.m. Wednesday through 9:00 P p.m on Sunday meaning even temporary signs in the central business district there should be none of them up on Monday or Tuesday which I assume it's probably not in practice how it it they usually take them down a lot of them are occasional shops I shouldn't say sure a good majority of them are are gone by the and I just raised that because it right now on its face that would if you had anything up on Monday or Tuesday which I assume these businesses are all open on Monday and Tuesday um Sandwich Board signs for example wouldn't be okay um I don't know if if there's any anecdotal evidence about that so like yeah I guess Caro creary being open that they theirs out Monday and tues and Harvey's occasionally has a sandwich board too and I'll just add what you're talking about now allowing them in the central business district but not throughout town in the right of way that's what our ordinance currently says so it wouldn't be an ordinance change I think we would get if we if your direction is to be more aggressive about the city right of way I'm happy to have my team go out and pull more signs and be more active in that but I think we're going to get some feedback that will likely yeah come to you as well so just establishing the boundary to say you're right we are pulling more signs the city council had this discussion so I think we'll get some more feedback but I think you will too so it wouldn't be a change to our ordinance right now but just something that might trickle to you as well and Eric you I mean you had asked has somebody already cracked this code right so I for me to you know we're looking at this now and trying to make choice I would almost rather see some examples from other cities if they have cracked this code what's the code we're trying to crack I'm sorry if I how they balance between like Community organization and like like the sign behind you I want to push back on that I think if we look at our Pure SE cities and call eight cities we're going to have eight different examples and I think we're sitting in these seats to get this figured out because I I truly think there are going to be different examples to kind of to what Eric said or Dave we're doing this right I think and for us I think it's just a matter of enforcing perhaps what we have right now and I want to also clarify too that my comments about how good shape the sign or is is really from a legal perspective I don't want I don't want it to right just policy wise I mean you you have some discretion obviously there are legal parameters around that discretion which I'm here to talk through and um I just think it it is a it's a pretty soundly written ordinance from the standpoint of First Amendment law and I think there's it's very um very well done um so policy wise I don't know there's maybe room to go one way or another I you know it probably depends on what direction you want to go but you just have to keep in mind that um you know and we start talking about how do we how do we thread a needle to to allow signage for organizations that we as a city want to see thrive in our community and their local businesses it's just a very very slippery slope because you can't favor one type of sign over another when it comes to content and I know you all understand that maybe that's the legal question right um it's all or nothing and the wish to support Community organizations understand that wish and we I think we all want to see our community organizations do well but it's All or Nothing correct when it comes to content yes because if you allow a sign or a community organization to go in this location or that location you are also because of the substitution Clause allowing any sign that has a message on it that isn't necessarily for that organization but for something that you may totally disagree with to also be placed in that same area and you can't tell them not so not just content but where it's placed yeah correct that's what I'm asking size where it is all or nothing there is no um structured leeway because then you're defining you're delineating what you want and what you don't and you're regulating based on content whiches the issue question yeah I would like to suggest that we enforce I'm looking at um from the work session slide 18 that we would enforce what we have and maybe Tuesday becomes the day that Aaron directs her team to pull signs with the idea that it should have been pulled Sunday night but let's give Monday as a day for whoever put them up to take them down and if not Tuesday they get pulled and then knowing that Wednesday they can put them back up outside of the RightWay oh yes outside the RightWay thank you so then if it's outside of the RightWay you're on personal property pulling signs no no I know but what tell me how this works then where where are we going to be pulling these at the par so signs shall be located out outside of the public right of way except in the central bus District where signs can be within public right of way provided signs are not placed within the street or parking spaces so anecdotally after some situations this past year we allowed signage in gazebo Park so if someone wanted to have event signage for a business downtown they could do gazebo Park they could use outside of City Hall we allowed signage there too so a couple of options downtown that our city owned that you wouldn't have to get joeo who lives next door that would give you permission but so what on the public right of way maybe so wait I'm sorry can we just have Dave follow up on that thought think I just want to make sure I heard that correctly so was there a direction to actually go on to public property and pull signs um did I catch that correctly no I should have said that are in the right sorry and we our team wouldn't do that we wouldn't go on private property and take signs okay thanks sorry Bren just so so like I guess I'm trying to think is the difference between like in a neighborhood that the public right away is that like do your your property line technically come up to the street so any sign and like a residential neighborhood would theoretically need the property owner's permission and then that sign is then on their property right right or is it that what I'm thinking like just on a neighborhood just like my Red Oak Bridge if I stick a sign in my front yard is that in the RightWay or that's on my yard it's typically within 10 feet of the curb I think 10 feet of the curb okay um like if you're living mid block sure seemed ridiculous for someone to put open house for you know a huster trying to sell in your yard right but home on Corners we would routinely get in like the RightWay adjacent so I I can speak a little bit to this temporary sign piece in this carve v um the landscape was a little bit different and we were really at the time the city was really um trying to work with the occasional shop owners so this the outside of the intent even though it's it seems clunky now looking at it probably at least 10 years later was to allow uh Sandwich Board types of signs in the downtown because there isn't um any private property where you could put it aside from the building it wasn't intended to um allow signs to be like in the right of way like Jonathan Carver Parkway wasn't like a consideration um and then I do think that there's a period of like um clarification because you know the the enforcement of the S ordinances can be a little bit halfhazard and so if I I would um unsolicited like advice is like recommend like if we were going to do like change the enforcement strategy that we provide some communication because we haven't been doing it consistently and frankly you know if compelled like Aon and her team could drive around town and find zoning ordinance violations probably on every street and so um it's it's not a like a priority piece it's getting the inspections done and like we'll respond to whether it's signs or tall grass or an unshoveled walk we respond to those by uh complaint but I do think this am ambiguity like first surface many years ago but um essentially as an organization we kind of Kick the Can down the road and it worked at the time but we are reaching like a point where um Aon and her team are taking on too much as a relates to decid deciding who the winners and losers are of who can put a sign in the RightWay and who can't and so um it doesn't need to be resolved tonight and maybe we can push pause on this and circle back after we've had some time to kind of experience the community maybe from a different line of sight but I do think it'd be in our Collective best interest to to to provide some more clarity I can't remember who made the comment at the work session but um might have been Dave but taking the gray area out of this I've I've been through at least a half a dozen and I know aon's been through again as much if not double conversations with Nick jensson about should I pull this sign or is this one okay and I just think that's where the public says you know um well that one's getting they can do it but why can't I and that is a really tough spot to be in that said like um it's a very the same vein as pulling them it's a very challenging conversation to have I know I've had it Aon and Nick have had it too of the saying like I have this sale and I want to promote the community and I want to have this event um I just don't know what that answer is and I think we're all kind of trying to find what that is um but there are certain constraints here that are challenging that have set us up to where our current situation is probably a little bit untenable because eventually we'll have somebody in here that you know was doing the right thing and they'll has to put up those signs and then a and her team will say no because they can't advocate for someone to break the ordinance and so I think we're doing good work to get ahead of it but it doesn't mean it's necessarily going to be easy well and I don't want to I'll speak for myself I kind of feel like the rest of council is probably this we don't want this to be hard on you there is we want the gray out and it to be black and white what that black and white may look like is not what we may agree on it's not the process that you shouldn't be having to to try and Weedle through this and pick and choose so again I think once we get past that can I just ask a couple questions is there any kind of carve out for SEO days weekend for signs so I haven't thought this thought before so it might stress a lot of people in this room out but I was thinking about the large event permitting could we add a clause to that permit that temporary signage is allowed two days before the event and two days after just to allow so if someone needs to close streets or do no parking that maybe under the large event permitting that would be possible in if they gave us a signage plan that we could look at and follow up on yes and I think that's even already implied because a lot of large events a lot of large events require street closures and as this road authority it's our job as the city to make sure that we communicate what closures are where and so I think signs can be used certainly for traffic control and other things so um I think it's a good point we can kind of bootstrap a lot of the sign stuff into our large event permitting if we look at Steamboat Days as a part partnership event so traditionally and I think we're allowed to buy go like that's kind of part the city's event so like putting signs on city property like should they be in the RightWay no I mean there are um there are cities in Carver County that go through a pretty significant efforts to um alert candidates for office if their signs are in the right away and so like that's a whole another you know pedal of fish when you talk about like um people running for office and having their signs outside of that right away cuz it is you know that's it's a universal but on the events for uh that are connected with the city and Steamboat Days would be the only one that's tangentially not ours um we allow events it's just folks will see that and then say well why can't I do that for my event and so some that we recognize that we're going to have to explain through a conversation I was going to say that's great I support that I support even more than two days I was more referring to the like temporary signs rumage sale this blog 12 family rumage sales so more of the temporary ones and part of it no matter I would say what the council adopts like I think people are going to be prone to do that and on Steamboat Days you know we typically just don't have the resources to enforce that so it's um even if we wanted to we'd have to reorganize some priorities and by the time the event over the signs are I would say 90% gone we're certainly don't um promote them being there but you know there are literally hundreds of signs uh throughout the community if not more and so I would say Steamboat Days is like a an outline there's probably any number of things or I'm like that's probably a code violation but you just unless it's a health and safety thing yeah you know you don't address it because you know there are you know how many garbage or Garbage not garbage garage Sands garage sale garage sale signs up in the community and so like not it's not just the actual physical act of pulling the signs it's think of the dozens of calls that Aon and her team would take on where's my G garage sale sign yeah well if it does make it I mean we also for SEO days we do advertise as part of our joint event citywide garage sales yeah because you're maybe that weekend that weekend is just the outlier we what was that that weekend's the outlier different um can I ask on the feedback side you have a bullet that says enforcement was that folks saying I'm mad you took my sign or we why AR why don't we enforce this what are you looking at both I think there we go got it got it it's a little bit of you took my sign but you didn't take expers sign talk me through that process also I think signs are personal preference like some people want to see the business signs and so the other ones don't bother them so much or some people say I don't want to see any of them they bug me all the time so um it's that's the tricky part of it too is that we try our best to strike that balance where we allow it to happen a little bit so people don't get really mad at us but we understand it's a slippery slope that can snowball pretty quickly so I think we're getting nowhere with this discussion um because it's hard yeah I guess I would ask what if we enforce the ordinances that we have for like a two Monon period which is silly because I would argue that we should be enforcing it forever and always um but then kind of see what kind of feedback we get and move forward from there I think we have trouble with that though with the if we by letter of the law because of the downtown businesses like Caro crey can't have their their sign out on Mondays or Tuesdays um what can't they because they it's a eight frame temp as long as it doesn't interfere with traffic it doesn't take up a parking spot um it's the C it's C1 yeah C1 sh yeah but this isn't picking and shoot this is supposed to be all them so yeah the first one says 6 a.m. on Wednesday to 9:00 p.m. on Sunday maybe then that should have the carve out but I think I'm ready to to kind of digest this more and maybe even talked to some of my neighbors but maybe then something like number one includes a car vote for the central business district we would then just have to just thinking loud a little bit we'd then have to probably decide what makes those signs temporary in nature I think the point that this implies is that these signs are only up at Ma at maximum for 5 days so they're temporary because they're coming down for at least a couple days so if we exempt Central business district signs from the Wednesday to Sunday thing then what makes those signs temporary I mean wouldn't they be arguably permanent bring them in we can think through that another shade of gray yeah another shade of gray we'll we'll follow whatever Direction the council gives us I I would ask that while you're thinking about this that Ain and her team just enforce it as they have been and then um the impetus is to like make the the change because if the ordinance language hasn't change I think we owe and then we enforce it in a different way I think we owe the community an explanation of why that is and we don't frankly have the ordinance language to back up like why we were allowing it two weeks ago and not today and so I just I think it creates a lot of like messy conversations for Aaron and her and team and selfishly like me to have with folks where um we do our regular I don't know if it's monthly or every other week we'll go through and it's primarily Jonathan Carver Parkway and if there are signs on city property like carver station is usually a big one or I noticed on the way in on deot Park something related to like storage or something like that I mean we'll pull those but I um just my two cents we'll follow whatever Direction the council wants and I you know we do have a pretty robust group of like uh neighboring cities we can just ask them anecdotally what they do for Community signs and maybe that tells them tells us that they they do nothing they treat them all the same or maybe they have something with their legal team that they figured out as a carve out but I don't think that effort would be too significant for us to to at least report back to you and then it gives you a little bit of space to think about this issue I mean I I think for sure we need to fix uh the number one figure out the timing and if that still makes sense and then and then get uh get the central business district figured out um I guess I'm more on Christy's side of trying to find a way to keep those smaller temporary signs some some at least clear Direction at least in the code of what where they're maybe not by intersections or not something like that but I don't know just my thoughts yeah I think um can I just can we do that anywhere in the community just not at intersections we can't be that prescriptive can we I I'm not ripping on you I'm truly like get get a well is a safety hazard right maybe I I think we could I mean as long as we can tie it back to some sort of Public Safety thing I mean the issue with public RightWay is we as a city cannot give permission for people that don't own the underlying property to put signs in right of way because part of the scope of what the city can do in right of way is not allow signs for private Endeavors private businesses but if the property owner is okay with it then yes we could allow it and we could create like a dist from intersections I think I mean that's something that could something that you there you go but in the CBD yes but you know you'd want to probably have to be really be very careful about how you drafted that language because be careful what you wish for all of a sudden you've got Boulevard that's full of signs if you don't limit it in certain ways I mean I think there's many different ways to to look at this and um again I think we're just looking for I know it's hard to come up with a consensus as a group um and we don't need to do that tonight it's just we're looking for a little more directional policy um I feel like Eric has something to say well just the more we talk about it the fewer flaws I think I see in our Zon I understand what we wish for I really do but to start making changes puts us in check so the decision is is are we making an a zoning ordinance change I don't think we are are we going to make a change in the level of enforcement maybe maybe we do that uh I think what we do today is based on the resources we have do we want to spend more money removing signs I don't know that the the town is going to be supportive of having a signed duty officer that goes you're hired yeah somebody to do it for free well but so so we two different things we're talking about here are we changing the ordinance I don't think so not unless somebody has a revolutionary ordinance that that uh addressed this in a way that uh uh keeps us out of Jeopardy if you find that that's great tell us about it we'll we'll deliberate uh do we want to make a change to enforcement and U you know how often we do that or step it up or step it down no change in enforcement is going to make everybody happy so we're just we're going to have to accept not everybody's going to be happy I don't know that there's a recommended action to I kind of don't feel like there is that's my I'd like to you bright talked about just a couple of our neighborhood communities seeing if they have anything any language in there that talks about what they do for Community organizations um and if it's you know you said it's won't be too much few phone calls see what they have yeah that'll be very easy we can report back on that for sure I'd like to know that and for me again the the temporary sign things in the CBD district is a little bit hard because of the that Monday Tuesday so again well I don't know what that looks like like not sure how to fix that but I mean telling the creary sorry you can't have your sign out Monday and Tuesday on Monday and Tuesday seems really arbitrary yeah thank you that's yes that's the word I'm looking for you can all the other nights but not not Monday I don't disagree with that maybe it's a different temporary signs in the central business district different category it it could be as easy as um during your operating hours because you're taking them in then when you're done whoever goes out Tak the sign BRS it inside yeah and I think that would be to me that's a temporary sign because it's not staying up okay um a lot of cities allow um in Central Business main streety type areas um you know sidewalk um you can put like clothes racks where if you're selling if you're selling merchandise you can put it on the sidewalk only during business hour I think it's a very similar from had fun before how does that keep us though from the Christmas tree light hangers and they want to say or the basement remodelers who say they're open 247 or something well I think we'd have to come up with a way to to word it I mean we'd probably tie it to businesses that are um you know open on the main there are physical businesses that are open on Broadway and or in the district and then also it has to come in at 9:00 at night we can look at what hours typically are in that area when people are walking around and frequenting those businesses and saying that you know yeah but they have a physical address there too I mean if if rodler decides to throw it in gazebo Park he's out of compliance anyways he doesn't own business there so right no this will only be out here right right so say that might they' still have to get the underlying Property Owners consent they sure would yeah but the language itself is to make it temporary right yes if there otherwise it's not it's permanent if we make this change to during business hours you can be sure that you're going to have folks in business owners say that it is owner is to go out and pull these every day so yeah we could do that and maybe it makes sense but it has to be temporary that's what this is I don't think it was arbitrary to pick Wednesday through Sunday I think it was done to make it tempor sure right I actually you know living in the downtown and seeing the signs coming in and out most people don't want to they blow away eventually or they walk away right so a lot of times once that business is closed they want that sign inside anyways I don't see I don't see many that stick around overnight yeah I've seen setting them up taking down yeah yeah so we can say that we can say that in the central business district you have to be a me have a storefront no no well I'm I want to think through it a little bit more but the direction is that we want to allow those signs in that District to be all seven days a week as long as they're temporary in some way shape or form coming in at night I think we can make that happen Okay um and to Brent's point I mean they'd still need the property owner's consent so I don't think you're going to get a lot of signs from un yeah unrelated to their businesses maybe that the owner allows tenants to use space for things okay so we're all going to give some thought to the side calls we're going to save ourselves from talking about this for another four hours yeah sounds good okay thanks at the risk of like going back to here we go it is like I do think it's critical to talk about like the when Dave mentions like underlying property own that is connected especially in the downtown the way that downtown was planted to the adjacent proper property owner so if yes if this was a private business that we collectively owned you know Harvey's couldn't put a Sandwich Board in front of our in front of our business without if we wanted to be jks without our consent yeah um and so I know that was an issue that occurred in the downtown and so I think that's something that we can add some clarification to when we get back into that you're talking about the city hall property I'm talking about another business business a advertising in front of business B like the right away is still part of considered part of the property and so they need that property owners consent City Hall is probably a bad example let say if you had an ice cream shop at an art store and the art store wanted to advertising front of the ice cream shop because it's a corner and there's more space there right so like that will need to be like I think some clar clarity on that would help uh avoid um miscommunications and hard feelings or at least attempt to we can work through that yep so I'm just I'm just GNA am I okay to yeah yes please do so a lot of these items or all these items we covered in the work session but I wanted to Circle back to monthly Water Report so in the department reports you'll notice the February Water Report um and I know I've talked to council member pman about you know maybe concepts related to maintenance household maintenance and uh different types of filtration systems and I just wanted to um connect with the Council on what you wanted those monthly water reports um to look like um because there are pros and cons to each but we'll facilitate it however you want so I don't if I could maybe defer to you council member pman on like you know you mentioned some uh items you wanted in like as an educational resource for residents within that report I think that might provide a line of sight to the council and let's we won't debate this for an hour but uh careful but you know I I do uh We've certainly all heard a lot about uh discolored water concerns and where that's coming from and I think we probably have a lot of homeowners new homeowners that don't have familiarity with what happens to the water when it comes in to the house what a whole house filter does what a water softener does what a reverse osmosis system does what those filters look like what the maintenance schedule is the settings all of the things that go with inhouse systems and it unfortunately adds to the narrative that they're getting a poor quality product from the city uh it isn't really our job to educate folks on how to run their in-house appliances but with all of the attention this has maybe it's worth putting uh some uh some kind of information educational link or did you know that Carver's water sits about here and your water softer they work best at a setting of 37 uh something like that and here's why did you know that your resent tank has a 20-year lifespan on average and if your home is older than 20 years it isn't functioning the way that it needs to whatever might help uh a resident who has those concerns or looks at a gunky filter and thinks this is a result of poor quality water coming from the city versus this is exactly what that filter is designed to do and it needs to be replaced every 3 months not every three years um I guess we need to decide how much we want to step into The Fray or not or just provide a link or a a small section in the in the newsletter about that but that was the the conversation that I've had with Brent in the newsletter or on our website or either either okay do we we have some of that information on our website don't we yeah we have the like the basics on what to sit your water softener at um you know depending upon like what you'd want to discuss you know some of this I'd have to like defer to erand or you know I um when it gets into like specific water filtration systems you know I'd want to I don't want to guess or have unintended consequences on that but I do think like resources you know available on the website it's just a matter of like how intricate do you want it and what do you want um and there you know normally on something that's maybe this kind of dayto day I wouldn't check in but I think the sensitivity in the community is kind of is really high related to water so I want to make sure that there's cons from the Council on like what you want to say and how you want it said right so so I think that kind of hits it right there too so we do have that sensitivity right now and we did just come off of hearing um that there were time that they thought that this that the city all of us were a little bit too much like as a homeowner you should be you know take care of this take care of this um and kind of turn it back on them so I I think it's I think it's a good idea to have some of that information again as a city we're not going to endorse any specific you know company or product but um I think that would be very good information to have on the website I'm not sure what how we get that out without I want to be careful on the messaging right now that we're not somehow turning it back um that hey take another look you know your your side which it's both sides right we've done our work and we're still doing our work and then homeowners also have some of their own work to do so I don't know how I don't know how that comes across whether the rest of the council yeah thinks that's a good idea I don't mind having that information on the website for sure I think it would be great I would probably go look through it again myself to make sure that I'm set correctly in all the things so I say the following as a homeowner who didn't know you needed to flush your water heater every once in a while until literally December maybe not so coincidentally my water heater died after that I discovered this um but with that caveat I worry like where we draw the line and I don't think it's the city's job to tell folks what options are available to them to be the salesman for Contico or BR or whatever I think with as many of us in the room we probably treat our own water at home different ways maybe Aaron doesn't have a water softener maybe Dave uses a better filter maybe you do Contico you do home home housee filtering reverse osmosis you know like there are a lot of different options out there and where do we draw the line but if I have an issue with my air conditioner or my furnace are we going to ask the city to then share tips for that I just I worry that it's a slippery slope um and kind of to what you were saying we did get the feedback that initially we weren't acknowledging the issues and said well and when we truly were trying to be helpful and you know said could be the resident from the water softener or you know and I think the Optics of that was that we were saying oh not it it's got to be on you resident so I do really want to be careful about that but I feel pretty strongly that it's not the city's job to tell you what your options are for the water that's inside your home or how to maintain any of the appliances that you have within it I think the information is great I'm looking at the website and we have that res resident guide eight pages already I think added to that um and that definitely just kind of just being good stewards but yes it is you know because they're paying for the water service if this is a way that can optimize the service that we're giving them by educating them and then maybe there's something different I know it's not a water quality but just the water um cost you know new owners new new home probably needs a different education fee about adjust your sprinkler system new Resident but in a 20-year-old house needs education on something like the water heater or filtration system so I would support it and I think the resident guide would be a good place to start think that's the city's job and I don't think that we have experts on staff who know as part of their role how you run your mod sophomore I just and to what you said I worry about the messaging of our water in the city of Carver is safe period end of sentence but if you want to filter it and if you want to do this and if you want to do that here's from the city how you do that I worry that that's so I think that's an absolutely valid concern you know what is the line and I started with who are we to tell them what to do with the water in their home however we have a lot of folks that uh are quick to post a picture of a dirty filter and where did that come from and I think there is there's really a a breakdown in understanding of what gets delivered by the city and what a final product is uh that isn't blame that is U I think just kind of a the basics of of homeownership and uh some people know that some people don't there's a a wide range do we want to have that on the website as a resource I think it could be helpful I don't think we uh you know the intent isn't to put Blame it is to help people understand what those systems do not by brand there are probably four different types of main of systems that process the water in your house and what their functions are we can choose to uh educate or we can answer uh one by one well this is this is why you have a dirty filter this is um why your water Sofer isn't working because we we've done that uh on a caseby casee basis we are doing that we're going in we're testing we're saying well uh you know this this valve broke and it caused this and it caused this leak or uh these filters don't function anymore and that's that's why you've got this product or when you turn on the faucets to your hot tub the water is coming out so fast that your in-house systems can't keep up with it so even though you've got them you're going to have discoloration and that isn't a a fault that's how those systems work and that's the limitation of those systems so we can do it Case by case we can continue to do that we can we're going to continue to make improvements in city water infrastructure talked about filters tonight um do we want to provide some education online I don't think it hurts us to to put some links on our City website uh so but I understand the reason not too I so I am I'm bored with putting it on the website I don't think that we need to call it out in the newsletter we've talked a lot about about water in our newsletter and that like again as Courtney said our water here is safe to drink um I don't think to me it doesn't seem like a slippery slope it says this is sort of the hot topic of the day so why not put a little bit more information out there for homeowners if they want to view it I am I don't know what the correct spot on the website might be wherever that lands I think it would be with me it's absolutely fine to put some more of that additional information on there with again the the message that our water is perfectly safe you want to heighten your system or you having some issues here's the things you can check and do whatever that wording kind of flushes out flushes out that was actually an accient that was really an accident but no so for me I'm I'm happy to see it on the website um in including the things that you've talked about again with the messaging that we're not telling you to do this because the water isn't isn't safe so yeah I think I'm yeah support like a five quick tips check your filter doesn't need replace that kind of thing but I mean I don't think we need a detailed guide like you know maybe those three or four examples we've had multiple calls of the same thing right that seems something that we may want to highlight but I don't think we need to go over for it there is mod did that give you any direction yeah that's what yeah what I'm hearing and I can work with Aon and um Eric menth and the other utility Texs I'm hearing kind of just like a little call out section on the website this is some uh Water Resource links you know so like best practices like there are I know the state has one for um water softeners I think there's one for hot water heaters there's probably some other like we'd probably focus more on like agency and like government entity resources let's do that so that it's not the city says to do this um but it's more like you know you know if you people want to get more information we can have kind of a little online library on our water page for it sounds [Music] good and then the last thing I mentioned this is uh if anyone who's watching or if anyone knows any of anybody who wants to get on a lawnmower um and be in our Park system this year we're uh looking for applicants to work uh throughout the summer in our Public Services Department maintaining our Park system um what was number four related to I don't remember seeing four uh yeah so that's um that's probably close to a year ago now uh the city uh Council approved a kind of a bridge railing update to the to Jonathan Carver Parkway uh there's a decorative railing oh okay over the over the bridge and if you look at like Points East like in chasa I think Eden Prairie actually just did a new one that's nice won't be as nice as glass and colors but uh it's basically the city it will say the city of Carver arched I can send a another photo up to the Council on our logo but it'll be on the the bridge railing over there okay and that took a long time to get done so we had to go through a lot of jump a lot of Hoops negotiate away something big I think okay all right uh Council updates you ever start with me Christie kidding don't go you said good let's go okay uh we had HPC meeting um on March 12th we talked about the third straight Bridge Project so Aaron was here to talk about that also the certified Levy project overview very good response from the HPC they were very happy to uh see the the product I guess and they had a few comments here and there and and Aon I'm sure will take those into consideration with the plans as we see them Courtney also uh came to that meeting to observe um Brent did a nice job of the HPC commission overview uh obviously we have some new folks on the commission so that was nice to give an overview of that uh and then we talked about the HPC letter that we send out so during construction season starting up and people are starting to do home projects we have over the last number of years sent out a letter to Residents who are in the historic district saying don't forget your permits don't forget you're going to have to come to the HPC for this um and then just some other information for them so we reviewed that and got that ready to go out to homes in downtown um the Carver Lian Club is having its Easter egg hunt at community park on March 30th starts at 10:00 a.m. it's fast yeah not yeah yep so um and then the next event is the ways out so that's all I have is the next event the pork chop feed uh I don't have that one on here right now okay but it should be but then the only other one on the website is not soon okay who wants to go next I'll go go um we have a uh Planning Commission meeting coming up this Thursday with the new members so that'll be exciting and then uh we had a park commission County Park commission meeting on the 13th and uh one of the interesting things we talked about was the county is going to try and be more proactive in managing the unstructured area so just like the woods trying to get specific native plants and more be more intentional in the kind of trees they're planning to avoid uh uh emerald ashor and try to reforest it with more native Oak and maple so I thought that was an interesting thing the County's trying to do so that's all I have all right who wants to go next I'll go I'll go last second um I uh I missed the March 4th meeting I was on vacation so in the future I'll do a better job of communicating that with when I know I'm not going to be available and if I do think I'd have comments for what's on the agenda I'll find a way to get those shared so that I don't have any update because I was on vacation all right so I do have an update but I'm going to keep it brief because I don't want to take any thunder away from anything um so I had the privilege of attending uh the capitol city Capitol Hill day okay March 7th where we all go to the state capital and for me he was with our mayor and city manager uh we had an opportunity to talk to uh Jim Nash and Len grunhagen among a couple of other folks and I'll I keep my comments short but the mission really was to make sure that Carver is uh front and center in everyone's mind and specifically as we're talking about the uh Levy project we need another 3.35 million to complete it uh we didn't get that money in the last bonding session we needed in the next one so the mission was get in front of folks and get their commitment to move it forward and from that standpoint we had a commitment to move it forward to uh Tom Emer from Jim Nash uh L grunhagen also agreed to move it forward so that was mission success from your mayor and city manager and I just wanted to communicate that U and that's it I'll let you tell the rest of the story thank you um I left my phone at home so all my notes I tried to replicate um but we'll see what I remembered and what I didn't um let's see in no particular order um last Friday I met with Shane from Hometown Bank he wanted to meet with um us because they're getting really close to starting to think about what opening looks like he's interested in getting some um pictures from historic pictures from the city of Carver um to put kind of behind the wall where their tellers sit so it's really cool that they're trying to incorporate these touches literally into this building um he also is interested in doing kind of a grand opening event which he thinks looks like a 5k or something some fun RunWalk um so to be determined more details on that um I also met with uh Ryan finy from Carver Elementary last Friday this is his last year at car Elementary he is going to be leaving and he has accepted a news job as a principal at an international school in the Dominican Republic so not only did I wanted to like say goodbye to him but I was just so curious about how that happened um and he has a really great story about that last Friday we also had um the business Alliance um saw a couple of new faces that hadn't been there in a while um and it continues to be a group that fills the conference table um and so strong participation good feedback from folks um eron alluded to it learned to pick a ball was last week we probably had about eight folks including Aaron and I I did not fall Aaron and I wanted Brent to know that we were sporty we enjoyed ourselves and we had fun Sports balling um but it it really was fun um we were at the chasa community center where we spent an hour learning how to play Pickleball and then we went upstairs and probably had a 30 minute meeting um just really casually with the folks who were able to stay um and we talked about things like the Miriam Junction trail um the ly who did you take with you over who went this was the parks group oh the parks okay yeah so yeah we also Ed that opportunity to get feedback from that group about um the removal and of the skate park in community park and what should happen with that um there was one individual who um thr own guy enjoyed writing the BMX bikes on there and said that um he really enjoyed that but was also like yeah it was time to take that down that was in pretty bad shape so um no clear One Direction from that group but just kind of good to bounce ideas off of them um let's see we had a re Regional Council of Mayors last week um we heard from folks um from um the airport we also heard from um the legislative Folks at uh Minnesota cities um and um or I'm sorry League of Minnesota cities um talking about one issue that I'm going to bring up a little bit later and then League of City's day in St Paul um was great they always have programming and then um we meet with our legislator so as Eric had mentioned um we met with representative Nash who no longer represents us but has kind of been a friend of the levy project traditionally um he didn't feel very strong that there was going to be a bonding bill this year of any significance although it's still early and I think there's a lot a lot a lot that's going to happen between now and the end of May at the end of the session um met with Senator grunhagen he was great he literally chased us throughout the Senate Office Building because we kind of had our has uh crossed a little bit um and then our last uh visit was with representative harder and the last thing after we kind of talked about the levy she said hey I'm hearing a lot about and I have been asked to sign on to house file 409 which is this missing middle housing legislation what do you think about this and I was like I can't believe that you're asking but boy do I have a lot of thoughts on this and so um we all kind of shared why this is just an absolutely terrible um bill for cities this again something that we talked about at the Regional Council of Mayor meeting last week and I truly have yet to find a mayor anybody representing local government who's like no I think it's okay you know even Jacob fry said you know I understand where they're heading what they want to accomplish with this but I certainly get that it would not work for some of your cities it's not a one- siiz fits all we can't accomplish this with one siiz fit all do you know who's authoring that like from where in the state um I don't know off the top of my head I think that Jim Nash is the author of something and there are still a bunch of bills that are kind of bouncing around and they'll eventually get Consolidated into something that's contains parts of each bill um Jim Nash I think is the author of some of them um I can't think of his first name craft from St Louis par Larry craft Larry um he has authored some of this it's boggles my mind because a lot of these folks started in local government and now they want to preempt the authority of local government so um to that end Bren sent out an email ma today um so a few things on that um hopefully appearing in this week's um chasa Harald and Chan Hassen villager will be a letter to the editor that is co-authored by the four mayors of Eastern Carver County so myself Elise Ryan from Chan Hassen Mar win from chasa and Deb McMullan from um Victoria so um we got that written in like 24 hours and got it submitted to the papers today um Brent sent out an email today from the league of Minnesota cities that um has a link to a City Zoning um authorization what is it um City Zoning Authority model resolution which um I would like for the city of Carver to sign on to all of our peers and that peer group that I mentioned of the Eastern cver County um communities have all written formal letters formal letters to their elected offic offal saying we oppose this here's why it concerns us um and I would like for Carver to join that group so I just wanted to bounce it off of you all and see if there was support for that absolutely yes and I haven't had a chance to read the email yet so is it is it for all the things that we're just talking about right now or what this um what are we signing off on because I haven't had a chance to look at that email today let me see if I can find the model resolution um yeah this is it it's it it's local zoning preemption it's just everything that's kind of bouncing around that's so concerning so um that's part of it so this is one thing the resolution and then I think another option and I was going to try to write something today in my afternoon got away from me but come up with a draft to share and I don't know if it's too late I can probably have something I I hope it's not too late by April 1st but I can absolutely have something by then to share well we can prepare it and present it so you can look at it you're not you wouldn't have to agree to it tonight yeah yeah no I'm I'm fine with it with I just would like to view it so I know yeah beforehand so okay that's what my ask is is generally are we in favor of really letting Senator gr grun Heen and representative harder know that don't think that this would be a good idea for the community yes yes okay reaching the end over here I've given I've asked Erin to help me on some tough ones today so she gave me kind of the side eye for like can you get that resolution together while I'm gone and I said I would love to yeah I would like I think that yeah after reviewing it and seeing what the content is that there's certainly what just happened just started this is what happens at meting at 9:15 anyways to see um that I think it it would be nice if we all sent yeah as a as a as a council as a whole just now the giggles started okay all a long meeting thank you I'm sorry I was pay attention
