The discussion centered on an applicant's request to reduce a standard 2-foot fence setback to 6 inches, primarily because of an existing irrigation system and the inability to secure a common boundary agreement with a specific adjacent property owner (Lot A of Cold Water Crossing ETH edition). Council members expressed reservations about approving the variance due to concerns about precedent, fairness to other residents who adhered to the 2-foot rule, and practical issues with maintaining a 6-inch strip of land. The Planning Commission had recommended approval. Ultimately, the council decided to table the motion to allow the homeowner to be present for a direct conversation.

Alison Stretch, Executive Director of the Carver County CDA, provided a comprehensive overview of the agency's operations. The presentation covered its mission to provide affordable housing and foster economic development, management of 846 (soon to be 900) affordable rental units, and specific projects including senior and general occupancy housing developments (e.g., Carver Oak Senior Residence, Carver Place). She detailed funding mechanisms like low-income housing tax credits and specialized programs for veterans, teen parents, and domestic violence survivors. New initiatives, such as administering Local Affordable Housing Aid funds for first-time and first-gen homebuyers, a senior rehab program, and supporting community development grants, were also highlighted. The CDA's role in the 2050 Comprehensive Plans and providing housing needs analyses for cities was also discussed.

The city staff requested approval to repair two existing wastewater treatment facility mixing pumps and purchase a new spare submersible mixer. The existing pumps operate 24/7, and annual inspections identified the need for repairs. The recommendation to acquire a spare was driven by a 12-14 week lead time for new units, ensuring continuity of service. Discussions also included the possibility of Public Works picking up parts from New Prague to save on freight costs.

The council needed to schedule a special meeting to canvass election results because Carver County would not provide the necessary early voting and absentee numbers until after November 12th, significantly narrowing the city's statutory window (9th-17th). A regular meeting on the 9th was too early. The proposed special meeting was set for November 16th at 5:30 p.m. The Mayor expressed frustration with Carver County's timeline, feeling it placed an undue burden on the cities.

The council introduced Ordinance 255 to adjust the annual salaries for the Mayor and City Council. Following previous discussions, the Mayor's salary would increase from $3,000 to $4,000, and City Council members' salaries would increase from $2,400 to $3,400. As per state law, these adjustments are slated to take effect on January 1, 2027, following the next election.

So typically fences require a twoft setback. This applicant is requesting a reduction to one uh half a half a foot. So 6 in. Um the drawing up here shows the location of the fence in red. So, he is proposing to place the fence on the east property line um with a common boundary agreement which he's obtained from that property owner. From the rear yard or the north, it would be 10 ft off of the um property line. And then on the the west side, he is requesting the 6 in variance.

I'm struggling a little bit with it just I know that of who it is the property owner that's not present, but I don't know. I'm just struggling with approving a variance just because they weren't able to reach an agreement with that property owner. And I understand the um uh irrigation line, but like that's not anybody else's fault.

I'm worried about the six inches on how it gets maintained. It's still his property. Um, that was my biggest concern. You know, we have the two feet mainly, so we get a lawnmower in there and you can still access on the other side of it, but it was 6 in. Now, I did talk to the homeowner. He said, 'Well, I could reach over with a weed whip.' And he could reach over and do it, which he probably can and would, but what if he moves in two years and the next person doesn't?

I'd like to table it. I don't want to make a decision today. We can I I'm okay tableing to get the homeowner in here. I would hate to, you know, if it go to vote and it doesn't pass, then what is that? You know, then what? We don't have that opportunity to have that discussion unless it came back again. But I think overall it's probably best to table it for two weeks.

Our mission is to provide affordable housing opportunities and foster community and economic development. Uh, we currently own and manage 846 affordable and subsidized rental units scattered throughout the county. Um, we will be breaking ground on another property in Waconia in a couple of months and that'll bring us to just under 900.

It's um so Carver Oaks and Carver Place um are funded through lowinccome housing tax credits through Minnesota housing. And so it's basically like backing into the points. So unfortunately, a lot of developers are kind of we had a discussion with Minnesota Housing today on their qualified allocation plan. It's called pointchasing. So you get certain points for certain things and everybody just kind of backs into however they can get the most points. Um and that's what sort of determines the different levels of area median income.

Every county in the uh state gets SAHA. And then every county in the twin cities in the seven county metro area and any any city with a population of 10,000 or more gets la. Um and how they determine the number of cost burden households in your county andor city. Uh so Carver County gets la and then Chesa, Chanhassen, Victoria and Wakonia also get LAA. Uh, so we have an agreement with the county to administer 70% of their LAAHA money, which for us this year was just over 3.1 million.

We have two mixing pumps at the wastewater treatment facility that run 24/7 and those are up for some repairs. So we got a quote from quality control to do those repairs. Uh the two mixing pumps at 2016 varieties and like I said they run 24/7. ...his recommendation is that we do the repairs to the two uh mixers that we have and then uh he was requesting that uh one of the uh spare submersible because we don't have a spare on hand. So, in case we're one reason, it would be nice to have one on hand.

Seems logical to have a spare. Yeah. With a 12 to 14 week lead time, it I think it seems reasonable. Um we're not tying up 50 grand sitting there. It's fairly reasonable. We'll use it eventually.

That window falls from the 9th until the 17th. However, we have been informed by Carver County that we won't be getting their their canvasing meeting won't be until the 12th of November and that after they do their canvasing, then they get the final numbers to us so we can canvas. We do have the the numbers from day of. However, what we need from them is that early voting and absentee numbers, which they won't get us until after the 12th. So, really that narrows our window from the 13th to the 17th.

It's, you know, all the years of doing this, Carver County has never put us in this situation. I don't I don't think they should. I think I don't feel they're doing the right thing. And I'd like to push back a little bit on them. And I'll probably talk to our city, our county commissioner. I just don't think it's fair. They know this has to get done. They know cities, 11 cities have to have their meetings. We have 14 days after they're using up 10 of them, you know, and leaves us four days and we got to bend over backwards. I just I'm a little put off by it um from the county side.

Historically, we've closed uh requested council close city hall the day after Thanksgiving to make it a weekend of that. Generally, staff will then use comp PTO or a floating holiday to cover those hours as we've done as as long as I've been here every year.

At the last workshop, we had brought this uh up for discussion discussionary purposes about adjusting the salaries of the mayor and city council. Uh as state law says that cannot take effect until after the next meeting uh or next meeting, next election, allow me to clarify. And so we have this scheduled even though we're looking at adoption now. It would not take effect until January 1st, 2027. And per our discussions, uh, we still have the history there and it's looking to adjust the mayor position, uh, from 3,000 to 4,000 and then city council from 2400 to 3,400 and that would be annual amounts for reiteration.
