If you'd like to attend in person, we encourage you to contact our City Clerk in advance. In other announcements, the state primary election is tomorrow, August 11th. Polls are open from 7:00 a.m. till 8:00 p.m. across our five city precincts. The We're moving on to our regular agenda and the first item on that agenda this evening is item 6.1, which is to consider a temporary noise permit for Floyd's Bar. This does This item does contain a public hearing, but before we do that, I'll ask our community and economic development director Jen Brewington to present her agenda report. Ms. Brewington, welcome this evening. >> Thank you, Mayor and members of the council. Some just background information before we begin here. At the June 8th, 2060 2026 council meeting, uh the council approved amendments to chapter 12, article 2, establishing a temporary noise permit process. The amendments provide a clear process for those requesting outdoor amplified music beyond 10:00 p.m. while balancing economic activity with the quality of life by nearby residents. The temporary noise permit process establishes 10:00 p.m. as a standard ending time for outdoor amplified music within the central business district. Businesses or organizations seeking to extend amplified music beyond that time must apply for a temporary noise permit. Each request is reviewed individually through a public hearing and requires city council approval, providing the flexibility for special events while ensuring transparency and consideration of potential impacts on nearby residents and businesses. Floyd's Bar has submitted a temporary noise permit application requesting approval to extend outdoor amplified music until 11:00 p.m. on the eight dates listed on the screen. And with that, I have a sample motion on the screen. I can answer any questions. >> This item contains a public hearing uh for a a temporary noise permit for Floyd's Bar at 1758 Arboretum Boulevard. I will now open the public hearing and anyone who wishes to speak to this item, please step forward. Anyone wishing to speak to this item can step forward. And last call. There's no one um who has opted to step forward, so I will I close the public hearing and open the floor for discussion among the council members. Council, any further discussion on this motion? >> I'm assuming we have not we did not receive any complaints or anything with the previous temporary noise permits permits. >> Councilmember Robert, that's correct. Thank you. >> I guess I would just say most of the time this is intended for special events and basically letting them do this every weekend night of the summer is more than a special event, I think. It's just regular and like listen, I want them to succeed. I want them to do well. But, um I also think it's a bit of a an annoyance to the people around them every weekend of the summer to have to deal with it. So, um I'm a like I'm sure it's going to get approved again, but if it does, I think we should still put in the same restrictions that we did the last time that if if they have one instance of going over 11, it's the rest are gone. So, that would just be my two cents. >> Okay. Council, any other comments, questions on this item? >> I would agree with Council Member Roberts on that. I think putting that same stipulation in makes a lot of sense due to some of the history here and um uh I think it just we owe it to the residents in that city. >> Very good. >> Well, I'm supportive of Council Member Roberts and Council Member Rice's proposed amendment to the the city of Victoria with respect to this temporary noise permit as as a zero tolerance policy on going past 11:00 in any given night. And then any given violation that is duly noticed and has the the complaint process that we've previously laid out that you know, that we've uh cuz we have to give the applicant due process. Uh it has to be um met to the standard that we've set before. And then if if the standard if the if there's a violation and it meets the standard of uh compliant non-compliance uh determination, then we would go and we would revoke those further down the schedule from that point forward. >> Yeah, Miss Hardy, please. >> Uh Mayor, and of the council, I just want to clarify that um that for the I don't remember the exact wording, but um you had empowered the city manager for the last round of temporary noise permits um for Floyd's that if they were to be in violation of that temporary noise permit, either observed by a city official, a city council member, or the deputies that the city manager could revoke any subsequent um times. So, that um if we're talking due process generally um that I um I just want to make sure that if you're that you're if if you're going to go down that path, if you want to do what you did before um that that language would be similar language would be incorporated into this motion, but if you wanted a different process or due process for them where they would hold another public hearing and have an opportunity um to come before council, that that process that motion might look different than what you did before. So, I just wanted to um note that as you're discussing. >> Madam city manager, thank you for making that clarification. I it wasn't clear to that specific point that uh but that is the spirit of what I was trying to go to with saying that to adopt that what we had adopt previously um empowering the city managers to engage in the um enforcement action. I I think that that's certainly where my mind is at. Um and you bring up an excellent point that that source can come in from a a number of different um avenues as to where that um infraction notification comes.
