Andrew and Heidi Knight sought a CUP for their 3-acre vacant property to build a single-family home with an attached garage (1,026 sq ft) and a detached accessory building (1,500 sq ft) for a boat and camper. The project required two CUPs: one for exceeding 1,500 sq ft combined accessory space (totaling 2,526 sq ft) and another for exceeding 15 feet in height (reaching 21 feet due to camper door height). Staff confirmed the project's compliance with setbacks and recommended approval with six stipulations, noting no public opposition.

The Alhadi Association applied for a CUP to construct a 3,600 sq ft mosque in an RS2 single-family residential district and to exceed the maximum allowed parking spaces (proposing 59 spaces where 49 is the maximum allowed, based on a 118-person occupancy). The project includes stormwater management, tree preservation, and architectural standards. A lengthy public hearing involved strong community support emphasizing interfaith dialogue, youth development, and community connection. Nearby residents expressed significant concerns regarding increased traffic, noise, light pollution, infrastructure strain, environmental impact (including demolition of an old house with potential asbestos/lead), and the suitability of a dead-end street. Staff clarified that the project complies with city standards, including setback requirements and a plan for traffic management and stormwater maintenance. The city attorney confirmed the Planning Commission's limited discretion for CUPs, focusing on compliance with ordinance criteria.

what we're applying for on our conditional use permit is to add um essentially a third stall to our garage. um uh right now the current garage will get absorbed into the house and then build a new threecar garage on the end of the house. um personal use.

Conditional Use Permit for Michael Mo: Accessory Building Square Footage Exceedance

The attached threecar garage is a typical garage size for an attached um for an attached garage. uh the applicant has stated that the additional space is for his own personal use and it would not be used for a home occupation. So staff is recommending approval of the conditional use permit with the four stipulations that are listed in your staff report.

this is one of those items that uh we we see fairly routinely. um some of these over I'll say larger square footage accessory use type of pieces and in this case we've got a property owner who's looking to improve the property bring it up to current standards it's kind of a no-brainer in my book makes it very easy to vote and recommend approval of this one

Commissioner Swanson [00:10:04]

We are asking for addition, excuse me, additional accessory space to be able to build a um out building to house um our boat and our camper um for personal use and to be able to kind of live back where I grew up.

Heidi Knight [00:14:52]
Conditional Use Permit for Andrew and Heidi Knight: Accessory Building Square Footage and Height Exceedance

The applicant is asking for two conditional use permits here. one to exceed the gross square footage of accessory building space to exceed that 1500 square feet of combined accessory buildings and then also to exceed the 15 foot high maximum that is the requirement for the detached accessory building.

the request for the height is not unusual. We've been seeing that one more and more recently with say folks with larger campers, that type of thing. So, that seems to make perfect sense on the height requirement. I also like um the layout of the buildings on on the site just given potential for any kind of future options down the road, but not anytime real soon.

Conditional Use Permit for Alhadi Association: Religious Institution Use and Exceeding Maximum Parking

The action requested is for uh the construction of a religious institution and to exceed 125% of the maximum parking spaces as allowed by the zoning ordinance. Um to put those in numbers the the structure requires 39 spaces. Uh 125% of that would be 49 spaces. They are proposing 59 for the site.

We're concerned, highly concerned about um increased vehicle and pedestrian traffic and the noise and light pollution. I heard earlier from somebody from the city said that, you know, there's going to be no parking lights in the the parking lots. I don't believe that's ADA compliant. ... It's It's we just feel that it's in the wrong spot. It's in a dead end street and the increase of traffic.

Dean Johnson [00:39:13]

I I think that we have to to look at the amount of traffic that the that the new facility would bring. So it will change what I call our community as a micro community... this facility is going to be much more active than has been proposed. ... it's kind of the idea that it changes our community um in a very dramatic way because there will be a lot more traffic that and with traffic and with people come noise.

So a conditional use permit is essentially a permitted use subject to meeting the conditions identified in the ordinance. The council has or the planning commission and then the council has very limited authority, very limited discretion. Um when it comes to conditional use permits, you're acting like a judge and looking at the facts and then just making sure that they meet those criteria.

Conditional Use Permit for Alhadi Association: Religious Institution Use and Exceeding Maximum Parking

And again, it's an allowed use within our residential districts in the city of Lakeville. It's no different than any other religious institution that is located in these types of places. So, with that, we're basically bound to try to um evaluate, does this meet our rules and standards? And as city staff has reviewed and put in front of us, they believe it does.
