[2:57] meeting and the April 17th planning

[3:12] planning manager Jensen if we have any
[3:14] announcements for tonight uh no handouts
[3:16] for this evening and uh the only
[3:19] announcement is that if tonight's items
[3:21] are not tabled they should move forward
[3:22] to the May 19th city council meeting

[3:32] and Vault interim use permit this is a
[3:35] public hearing to uh consider the
[3:37] application of South Metro Safe and
[3:40] Vault for interim use permit and IUP to
[3:42] allow the outdoor sale and display of a
[3:44] safe as an accessory use in the C3
[3:47] General Commercial District uh first up
[3:52] um is he on teams mr

[5:47] yellow safe out there or do you want a
[5:49] little history on our company
[5:52] i think what we're looking for is uh
[5:53] what your request is regarding uh for
[5:55] the IUP
[5:59] oh okay uh my request is is that we have
[6:02] a a large yellow safe on a trailer it's
[6:07] an item that is for sale um it's a very
[6:11] large safe and I was informed uh months
[6:16] ago by the city that I needed to get a
[6:19] $1,500
[6:21] permit to have that out for customers to
[6:24] see and I paid the $1,500 and then I was
[6:28] notified of this meeting
[6:32] okay excellent thank you so much i guess
[6:36] we'll move on to uh Ms botton to present
[6:38] the staff report good evening chair
[6:41] commission members so this request is
[6:44] for property located at 16350 Kenrich
[6:48] Loop it is located east of I35 and on
[6:52] the corner of Kendrick Avenue and
[6:54] Kenrich Loop the property is zoned C3
[6:58] which is our general commercial district
[7:00] as are the properties surrounding this
[7:02] parcel
[7:05] so as mentioned the applicant is asking
[7:07] for an interim use permit to allow the
[7:09] outside sales and display of a safe so
[7:12] outside sales are allowed in the C3
[7:14] district but not to exceed 30% of the
[7:17] gross floor area of the leased space and
[7:19] it's subject to approval of the interim
[7:21] use permit so an interim use permit
[7:24] allows flexibility of a use on the
[7:26] property for a temporary amount of time
[7:28] so this is unlike the conditional use
[7:30] permits that you may be a little bit
[7:31] more familiar with where a conditional
[7:33] use permit runs with the land the
[7:35] interim use permit will terminate on the
[7:37] happening of any of the following events
[7:40] whichever may occur first so it may at
[7:43] the date or event that's stated in the
[7:44] permit uh violations of any of the
[7:47] conditions in the permit or changes in
[7:50] the city's zoning regulations which
[7:51] renders the use non-conforming
[7:54] so the South Metro Safe and Vault their
[7:56] business specializes in the sale of fire
[7:59] and gun safes so the proposed outside
[8:02] sale of this area for the safe is
[8:04] located in the southwest corner of the
[8:06] um parcel and it takes up one parking
[8:09] space so there's no actual physical
[8:11] changes to the parking lot or the
[8:13] building the site would still comply
[8:15] with the minimum parking requirements
[8:17] and the proposed outdoor display area
[8:19] does not exceed 30% of that lease area
[8:23] so staff believes that the interim use
[8:26] permit uh conforms with the performance
[8:28] standards in the zoning ordinance and is
[8:30] consistent with the goals and policies
[8:32] of the city's comprehensive plan so
[8:34] staff is recommending approval of the
[8:35] request with the four stipulations that
[8:37] are listed in your
[8:39] report thank you thank you very much uh
[8:43] I doubt that there's anybody here but
[8:45] maybe uh if you'd like to speak at this
[8:48] public
[8:49] hearing for this particular
[8:53] item doesn't appear and there's nobody
[8:55] on the phone in addition to Mr orchard
[8:58] madam Chair Commissioner seeing no one

[9:41] purchase that physical safe if you
[9:42] wanted so it's more of a display and
[9:44] sale of a product

[9:57] um I assume that there's not going to be
[10:00] any change following an approval of
[10:03] what's there now the stay the safe stays

[10:08] just like it looks now well it wouldn't
[10:10] be able to be moved off the hard surface
[10:13] if they would move it to a different
[10:14] parking space on this property i guess I
[10:16] wouldn't see any issue with that as long
[10:19] as it doesn't take up more than one
[10:20] parking space um but it wouldn't be able
[10:22] to go onto the grass or in the corner
[10:24] off the hard surface

[10:34] happen to sell that safe and they put
[10:36] out a new safe they can do that as

[12:07] Heritage Commons 9th edition and the
[12:10] vacation of public drainage and utility
[12:12] easements uh here to speak on behalf of
[12:16] the project is uh Matt

[12:49] essentially we're uh planning to split
[12:52] the lot into two separate parcels one
[12:54] will have the Chase Bank with a 247 ATM
[12:59] and um drive-through lane and bypass
[13:02] lane um and then east of that is
[13:05] undetermined right now a what east the
[13:08] east parcel is undetermined right now

[13:34] evening is a preliminary plat and
[13:36] easement vacation for Heritage Commons
[13:38] 9th edition uh as Connor said it is um a
[13:43] a two lot subdivision of a parcel uh for
[13:46] a Chase Bank and a a future user to be
[13:49] determined uh the property is north of
[13:52] 202nd Street just down the street here
[13:54] from city hall and between Ideelic and
[13:57] Iberia Avenues in the Heritage Commons
[14:00] uh
[14:01] development it is zoned to PUD uh
[14:04] because it is part of that Heritage
[14:06] Commons PUB but it does have the C3
[14:08] district which is our general commercial
[14:10] district as its underlying zoning uh
[14:13] this is the preliminary plat it is
[14:15] currently uh the parcel is currently an
[14:17] outlot uh from the tires plus uh
[14:21] development to the to the east so they
[14:23] are proposing to split this into uh two
[14:27] parcels each parcel uh is in excess of
[14:29] the minimum lot size required for that
[14:32] C3
[14:33] district uh and then this is the
[14:36] proposed site plan for Chase Bank uh the
[14:39] the structure itself is about 3,400
[14:41] square ft it is oriented to Ideelic
[14:44] Avenue uh it does have a drive-thru ATM
[14:48] on the south side including a bypass
[14:50] lane uh to allow other vehicles past
[14:52] that uh there is parking um on the site
[14:56] and it will have a stub for the uh east
[15:00] parcel and you will have access from
[15:02] Idealic and from Heritage
[15:04] Drive uh and then there will be storm
[15:07] water ponding on the site this pretty
[15:10] pond
[15:10] here uh this is the landscape plan uh
[15:14] there are overstory trees uh around the
[15:17] site there are additional plantings on
[15:19] the south side here with the drivethru
[15:21] area to help block those headlights the
[15:24] landscape plan has been uh reviewed and
[15:26] approved by the city forester
[15:30] um this is just kind of a a ghost or a
[15:35] concept layout for that vacant parcel uh
[15:38] to show how you know potentially it
[15:40] could be developed again we do not have
[15:43] an identified user for that um but they
[15:45] will have a a connection at this point
[15:48] and then with the tires plus side a
[15:50] connection both uh on the north and on
[15:53] the south side for give them flexibility
[15:56] in how that site were to lay
[15:59] out uh the building is a onestory
[16:02] building uh as you can see it uses
[16:05] nearly 98% grade A materials they have
[16:08] three colors of brick uh cast stone and
[16:11] glass materials um the design element
[16:16] that you see right here it's a kind of a
[16:18] stripe across the building here that is
[16:21] consistent with all of the other
[16:23] Heritage Commons buildings in that
[16:25] development if you go look and see uh
[16:29] you will see that design element so we
[16:31] asked them to incorporate that to help
[16:33] carry that through and and they were
[16:35] happy to add that uh to that building uh
[16:39] the also the trash enclosure will be
[16:41] made up of the same uh materials as the
[16:43] building uh consistent with that
[16:47] uh that is all I have for you uh staff
[16:49] does recommend approval of the Heritage
[16:51] Commons 9th edition preliminary platin
[16:53] Eastman vacation subject to the 11
[16:55] stipulations that were included in your
[16:57] planning report

[18:05] maybe help me out in understanding what
[18:06] might be at that location on the parcel
[18:08] yeah that's uh
[18:20] that there you go that's uh currently
[18:23] underground storm water storage for the
[18:25] improvements for Heritage Drive so that
[18:29] everything collected off there gets put
[18:31] there right now and that's where we tie
[18:32] in our above ground storm water too
[18:35] gotcha so that kind of helps explain as
[18:38] I'm looking at the site I was kind of
[18:39] wondering why nothing was happening in
[18:41] that portion of the site or why that
[18:42] wasn't part of the development here so
[18:44] that that makes sense i appreciate you
