members zuzic here kza here [1:23] Tinsley here morovic here Zimmer here a [1:27] here Swenson here all right agenda item [1:30] number three approval of minutes um any [1:34] changes to the minutes all right then [1:37] they will [1:39] stand and Miss goodroad announcements [1:42] for tonight thank you chair members of [1:44] the commission there's a hand out with [1:46] um the revised stipulations for the [1:48] conditional use permit for the [1:50] application this evening and then if [1:53] this item is not tabled it will move [1:54] forward on November 4th to the city [1:56] council meeting and the next Planning [1:58] Commission meeting is November 7th [2:02] all right thank you agenda item number [2:04] five Nicholas Borman this is a public [2:06] hearing to consider the application of [2:08] Nicholas Borman for a conditional use [2:10] permit to allow a detached accessory [2:12] building with a combined accessory [2:14] building area exceeding 1,100 square ft [2:18] on a single family lot in the rst2 [2:21] single and two family residential [2:23] district and to allow more than one [2:25] detached accessory [2:27] building and Nicholas if you want to [2:29] give us yeah a brief overview of your [2:32] project so I'm Nick Borman um yeah so [2:36] just asking for permission for the [2:38] conditional use permit for a 40x 60 pull [2:40] shed just to to house my personal items [2:43] I do have a small business and after [2:45] talking with Chris I have a small [2:46] roofing business so I've got a couple of [2:48] trailers related to that I know now that [2:51] that has to be offsite and I'm taking [2:53] action right now to to get those moved [2:54] off site permanently uh so it's strictly [2:57] for my own personal property [3:00] prop snow stuff you know like skid [3:03] loader and Ice House just large items I [3:06] know there's a new development that's [3:07] going to be going in around us we've [3:08] been kind of out in the middle of [3:09] nowhere for a long time and didn't have [3:10] to worry about any of that so I just [3:12] want to have a place to to put [3:15] things okay thank you [3:23] yeah all right thank you chair members [3:25] of the commission um as Mr Borman stated [3:29] um he is requesting that conditional use [3:31] permit for an an accessory structure um [3:35] the property is Zone rst2 here's the [3:37] location map and then there is the [3:39] zoning map it is Zone rst2 it was a [3:42] while back um Zone ra rural agricultural [3:45] District so as he said he has been kind [3:48] of out there in the middle of nowhere um [3:51] there is a development Cedar Hills North [3:53] that will be reviewing in um next month [3:56] that will surround His property so he's [3:59] asking for now so the conditional use [4:01] permit is really necessary for two [4:03] things one for overall size and one for [4:06] having that second accessory building [4:08] and so on the property today um the [4:11] proposed structure is 2400 Square F feet [4:14] and there is the survey so the proposed [4:16] building is 2400 square fet there's an [4:19] existing attached garage that's 1,8 [4:21] Square F feet and then there's an ad a [4:24] detached accessory structure on the site [4:26] already at 308 Square ft and that was um [4:29] um constructed prior to Mr Borman owning [4:32] the property and so he is asking for [4:35] that addition um building which will be [4:37] a total of [4:39] 3,726 square ft for the overall property [4:42] and the property itself is over 3 acres [4:44] so it's a very reasonable ask um one of [4:48] the things that we look at um of course [4:49] are setbacks um all of the setbacks meet [4:53] requirements um he is as he stated using [4:56] the building for personal reasons he [4:58] understands what the rules are he [4:59] understands with the stipulations that [5:00] have been added to the conditional use [5:02] permit um the property um is currently [5:05] well screened um the structure as you [5:07] can see in red is on the North End of [5:09] the property um he's got Evergreens [5:12] along the west property line and he's [5:14] intending to add Evergreens along the [5:15] entire North property line so that'll [5:18] not only provide him added screening as [5:20] a new denser development than what he is [5:23] currently living on um is built but will [5:25] also help kind of struct um screen that [5:28] new structure so all in all um this [5:31] meets all of the zoning requirements [5:32] it's very similar to some of these um [5:34] kinds of requests that we've been [5:36] receiving lately and staff recommends [5:39] approval and this is a public [5:41] hearing thank [5:43] you anyone would like to speak on the [5:46] public [5:48] hearing seeing no one coming forward uh [5:51] Madam chair I would move to close the [5:53] public hearing second I have a motion [5:55] and a second to close the public hearing [5:57] all those in you for [6:12] your acknowledgement of the stipulations [6:14] that are in here and everything else um [6:17] I'm I'm one of the Lakeville residents [6:19] who's you've done the roof on my house [6:22] in the [6:23] past so some questions did pop up in our [6:26] brains as we started thinking about this [6:27] proposal and everything else so I do [6:28] appreciate your understanding of of [6:30] what's going on here and the world is a [6:32] changing out there in that uh part of [6:34] Lakeville for sure so again appreciate [6:36] your understanding of that thank [6:40] you madam chair Mr Borman I just want to [6:43] say thank you as well I was going to [6:45] State the exact same thing however I [6:47] also want to State thank you for having [6:49] your property so well cared for as well [6:52] it really does look nice and I don't see [6:54] a lot of junk ever laying around there [6:56] and I drive by multiple times a week so [6:59] thank you so much for being a great [7:01] residence [7:05] there looks like we're ready for a [7:07] motion Madam [7:10] chair yes you have something you all [7:13] right just [7:15] check if you're ready for a motion yes [7:17] all right I move to recommend approval [7:19] of the Nicholas Borman conditional use [7:20] permit to allow the construction of a [7:22] second detached accessory building [7:24] greater than 1,100 ft in the rst2 [7:27] district and located at 75 592 200th [7:30] Street subject to the 12 stipulations [7:32] listed in the October 10th 2024 planning [7:35] report as amend second I have a motion [7:38] and a
