Does anyone have any changes to the minutes? Okay, we will let those stand as they currently are. Uh as far as announcements, I only have one. Is that right? You want to give the announcement? Okay, the only announcement I have is that the next planning commission meeting is scheduled for June 4th, which we I think we already know, so other than that we're in the clear. All right. Um First up for a public hearing uh is agenda item 6A Valvoline Instant Oil public hearing to consider the application of Valvoline Instant Oil for a conditional use permit for minor auto repair in the M2 mixed use Cedar Corridor District in a commercial building to be less than 2,000 square feet of floor area. And I believe we have um I'm going to switch this around. I'm guessing that we have Mr. Duthie and Mr. Wellert to talk about Valvoline and then the pastor will be talking about the church cuz we have them all reversed on our forms. Please join us. Thank you, Mrs. Chair. Um I represent Valvoline oil here. I'm from CSO Incorporated, which is located uh in Akron, Ohio and we represent Valvoline in several of these locations around Minneapolis including a couple of that have been here in Lakeville already. Um so with that, I assume there is some familiarity with the operations of the oil change facility. I know one of the questions typically is the operations and that's most people's concern is the typical functionality of one of these oil change locations. They operate in a very what I would consider low-key manner um and it works well being near residential districts. They stick to typical business hours, which is typically 9:00 to 6:00 or shorter depending on the day of the week. They're a very low volume traffic generator. They don't bring a lot of traffic and if you think about it, when you go to get an oil change, if you see two or three cars parked outside, you typically drive on. It's not an immediate requirement, something that you have to have done that morning. Because [clears throat] of that, it keeps visibility really low at the existing sites. There's never cars queued out. I always like to compare it to Dunkin Donuts or Starbucks location. There's a Dunkin by my house that blocks traffic out into the road all the time. That's not an issue with a typical Valvoline location. They also do not allow cars parked overnight, which is a big item uh especially near residential districts. So if you do see a car in the parking lot, it's worth investigating because Valvoline has not approved that to be there. With that in mind, their lighting is focused on the building and the area immediately adjacent to it during working hours. Uh that's the primary focus of their business is that 9:00 to 6:00 time frame. They also do not allow any exterior storage, which [clears throat] is another big benefit being near residential or adjacent to residential districts. There's nothing stored outside and they recycle everything on site that they can reuse it. Um with all those items in mind is why we think this would be a good location. It's a good business to come into that development. And it fits well with surrounding residential districts. It's a useful item. It doesn't have does not keep, you know, oil drums sticking out. The way the deliveries are handled, they have a truck that pulls up beside the building, pumps in new oil, pumps out the old oil, and they pick up and move on. So, there's no oil drums, there's no above-ground storage tanks parked out in the parking lot. There's not even underground tanks out in the parking lot or driveway. It's very clean site. They try to have as minimal impact on the region as they can. They come in, do their business, and they want to look nice. One of the concerns is always landscaping when you're looking and one of the items I've been impressed with around here is you guys have a lot of mature growth trees everywhere. Everything is landscaped very cleanly and it's very nice driving around. >> [clears throat] >> Valvoline's typical sites work well in those districts because they do keep a very manicured location by limiting what's allowed outside the building. So, if you have any questions, I know this was a full engineering submittal as well. So, if there's any questions or any technical questions, I can speak to those as well. Thank you so much. We'll have staff come up next. Thank you. Appreciate that. Ms. Botten. Good evening, Chair and Commission members. This request is for a property located on the west side of Glacier Avenue. It's south of 175th. It's in the Marketplace at Cedar Plat that you've seen a lot of requests for lately. Uh the zoning of it is M2, which is the mixed-use Cedar Corridor District. The request in front of you tonight is a conditional use permit to allow the minor auto repair use, and then also to allow a commercial building to be less than 2,000 sq ft in area. The building proposed standalone building is 1,871 sq ft in size, and that is including three service bays. And the service bays are on the south side of the building. So, there's one egress point in the southwest corner through the private drive throughout the uh Marketplace Plat, and they would come in and either park in the parking stalls up here on the west, or they would continue in to go to the three service bays. Within those that service bay area, there is room for stacking for about three to four vehicles behind each door. So, the building and the parking lots and parking spaces do comply with our setback requirements for this lot. The storm water design and installation was approved with the plat, so you do not see any of those plans with your packet. Uh so, the final review of those will be reviewed by engineering with the building permit, but all of the storm water for the Marketplace development was done at the plat time uh time of plat approval. So, when looking at the landscaping, most of the plantings were done um along the right-of-way, which is required. So, the south, north, and east side. The easterly side is kind of beefed up and additional landscaping along that side because of the townhome development across the street. So, adding more buffer from the townhomes. The lighting plan, the code requires you cannot exceed one foot candle at the right of way line. So, there are some spaces currently that that does exceed minimally but that one foot candle. So, the photometric plan will have to be revised prior to city council review of the request. And that is a stipulation added at the end of the report. But when looking at building elevations, the proposed building is just a one-story structure. The maximum height would be about 24 feet and that is measured from the pillars that are shown the decorative pillars. Uh, the main height of the building on average is probably 22 feet. The exterior building materials must have at least 65% grade A materials and not more than 35% grade B or C. So, the building is proposed of grade A brick on 66 to 72% depending on what side you're looking at and then also uh, six and then 28 to 34% grade C with an EIFS material. So, those numbers are in compliance with our code requirements. The signs shown on this plan are just for illustrative purposes. They're not approved with the CUP and those would be they would have to just comply with the M2 um, zoning district requirements. So, staff is recommending approval of the conditional use permit request with the seven stipulations listed in your packet. We have not heard from any of the surrounding neighbors and this is anticipated to go to the June 1st city council meeting. So, I'll stand for questions. Thank you. Um, so got the other one coming in, um which is great. Happy to see business expanding here and all that, but with that, I think pretty familiar with what the the business is, what it looks like. Um, and from that standpoint, I'm comfortable with the plans that have been provided to us for review here today, and I will be voting in support. Thank you very much. I think with the growth in population, there's growth in cars, and we need all need oil changes, so. With that, I'm ready to make a motion. Please go ahead. All right. The next item on the list is a public hearing for Restoration Covenant Church. It's a public hearing to consider the application of Restoration Covenant Church for a conditional use permit for a building expansion, sanctuary [clears throat] space, and to exceed 125% of the minimum parking stalls required by the zoning ordinance. And I believe we have Pastor Rob Jacobson to come on up and uh introduce the project for us. Good evening. Thank you, Mr. Chair and Commission. My name is Rob Jacobson. I'm the lead pastor of Restoration Covenant Church and have been since its founding uh for the last 15 years. We started about 5 to 7 minutes from the location that we are at now at 16880 Cedar Avenue. We were able to um just thankfully and graciously purchase this from the good people of Faith Lutheran Church that um started as a church plant like we did in 1975 actually in the old Piper building. And 5 years later, they uh brought forth uh architectural plans to the city in 1980 and they built that building that you see now in 1980. In October of 2022, we were able to purchase that building and when we did, we actually found not only their original blueprints, but uh blueprints that they sent for an expansion in the late '80s or early '90s uh that they had designed um and brought forth. So, it is with just a fun joy in the tradition of churches continuing to expand that we would take that legacy forward. Um they cheer us on and our hope in this space is to not only grow in numbers, but also grow in depth of character with Jesus Christ, and then also to be a blessing to the community. We want to be a place where we are noticed and missed by the community if we weren't here. So, our hope is to then turn our current space, expand our classrooms, have greater room for seating, and with potentially two more services coming, which is the reason for the expanded parking over the amount stated. I also have my family ministry director and communications here and our architect and our engineer if you have any questions, but I'll keep it brief, which is hard for pastors, and turn it over. Thank you so much. >> You're welcome. Come on up again, Ms. Botton, give us the scoop. Okay, thank you, Chair, commission members. So, this request is for the property located at 16880 Cedar Avenue. It's on the east side of Cedar. It is zoned RS3, which is a single-family residential district. So, now this residential district does allow for religious uses uh by a conditional use permit. So, the request in front of you tonight is for the conditional use permit to allow the building expansion and a conditional use permit to exceed that 125% of the maximum parking spaces allowed by our zoning code. So, the current congregation in church area is about 5,700 square feet. That's the existing building in this area, and the proposal is for a 7,555 square foot addition that would include a sanctuary and lobby spaces. The parking spaces that would be allowed for the site would be 100 spaces at the minimum, and then a maximum of 125. So, currently they have 72 parking spaces. And then with the addition to the east, they they be at a total of 153 parking spaces. So, what is unique about this is that um parking is not allowed on Cedar Avenue. So, a lot of a lot of times when you see churches, especially in residential neighborhoods, you can have that overflow parking on the streets. In this case, that is not allowed. So, the applicants did submit in their narrative kind of their their need and their demand. And so, what we need to do is to make sure that all their parking can be accommodated within the site. They do have a shared access. There's one egress in the southwest portion of the property, and it is shared with the commercial building to the south, but there's no actual parking agreement with that site. So, we can't just count on those spaces to be available or even for them to use that. So, looking at the grading plan on the site with the proposed improvements, uh there is a one storm water management basin that's proposed in the northwest corner of the property. This is a private system. And before this goes to council or with council review, there will need to be a storm water maintenance agreement and also a site plan improvement agreement. So, those agreements would cover um well, one with landscaping would be the SIPA and any kind of landscaping requirements that would need to be submitted, but then also the maintenance and future maintenance with that storm water improvements with the the basin. So, tree preservation did kick in with the site with the addition. So, in a residential district, they are allowed to have up to 40% removal. The proposal does state that they are removing 73.6% of trees. So, tree replacement is required on this property. The forester did review the plans and has approved the plans that were submitted. Uh so, they are complying with the replacement requirements. Uh in addition, they are including landscaping that is around the perimeter of the site and the parking lot. They are not proposing any landscaping in the other future addition areas. Um which that just doesn't really make sense to put landscaping in there and that would have to be located or possibly move it in the future. Uh but otherwise the plantings would be around along Cedar and on the northern property and then along the parking lot. So the building elevations would be what is proposed of some stone, brick, and glass. Uh mainly the grade A materials uh that is in compliance with our code requirements. Uh in addition to the the addition the existing structure too will also be seen a I believe a facelift. Um so overall then there will be a cohesive um like everything will look cohesive with the proposed addition and the existing structure. So staff is recommending approval of the request with the seven stipulations in the planning report and then also the requirements and the stipulations listed within the engineering report. So those stipulations will in the engineering report will have to be met prior to the request going to city council. So I stand for questions. Thank you. This is a public hearing. So, a future expansion, I noticed the two additional expansions. Uh, any any thoughts on the the timeline for that and some of the milestones that Yeah, trigger those expansions? So, um, the first expansion is because we're out of both kid space and sanctuary space, but seeing looking at the um, kind of whole vision of the plan, um, wanting to have a central entrance for all people, um, that would also promote safety. And so, currently, um, the existing building would be our new family ministries area and dedicated for that. Um, but in the future plan, uh, we would build a dedicated children's wing and our current wing would then become a student and adult area. And then the third addition is uh, potentially, um, some kind of activity space or something that could benefit the um, community as a whole. Does that answer your question? It does. Thank you. Yeah. Any other questions? Madam Chair, Commissioner Swenson, maybe a question for your architect, perhaps. We'll see it if not then it will go to city engineer. So, if we're we're talking about multiple phases with the building, um, and potential for for doing that, um, I'm I'm assuming the original plans that had an expansion on it did not anticipate there was going to be a storm water pond and that on the site. Um, so I'm just kind of curious with the sizing of the parking lot and the um, expansions proposed, is the storm water facility sized to handle all those future expansions or is it just for the current expansion? Uh, the answer to that is yes, it is sized to handle the whole thing. They're just it wouldn't make sense to piecemeal it, you know, because most of the work is in in the grade, you know, is in the regrading of the site. Right. No, I'm grateful to hear that that's that's the plan and um was was anticipated with us. I also appreciated Ms. Botten bringing up the um the parking um since there is no parking on Cedar Avenue or overflow parking and so the city has ordinances related to parking where we're looking to make sure we have enough parking but not too much parking. You know, trying to strike a balance um with that. So, that's part of what we're talking about here with the um 125 exceeding 125% of the required parking here. Um given the situation and scenario with Cedar Avenue here, it certainly makes sense that the parking lot is a little larger um than we than we might anticipate um otherwise. So. And uh so I I don't I don't feel based on my experience that this is unreasonable at all as far as the amount of parking. You know, they may not use every single parking space on day one. We >> [clears throat] >> we just finished another church where they did. But uh I eventually this this parking lot's not going to be big enough, I don't think. So. But I'm I'm glad to hear you're flexible about that kind of thing. So. Thank you so much. Other questions? I envision that large parking lot with a hopscotch and chalk for part of the time.
