Dissent: None

The public hearing introduced the 2026 Southwest Street Improvement Project, detailing the assessment policy, calculation methodology for various components (water main, sanitary sewer, curb/gutter, streets/surfacing), and assessment payback terms. The engineer highlighted a recommendation to remove a water main loop from assessable costs. Several residents and organizations presented formal objections to their assessments, citing disproportionate costs, lack of direct benefit, financial hardship, or prior investments in infrastructure. Specific properties mentioned for review included two corner lots on Willow Circle, Michael Cobb's property (112 3rd Street Southwest), the American Legion Post 184, and Anne and Barrett Swanson's property (1st Avenue Southwest). Staff provided responses and potential options for amending assessments.
Resolution 2647, Approving the Street Assessments
Dissent: None. However, the approval included specific directives for future amendments to individual property assessments: reduce two Willow Circle properties to align with other 70-foot frontages; discuss sanitary sewer costs with the American Legion; reduce the sanitary service cost for the Swansons' property; and discuss with Michael Cobb regarding his concerns and documentation for payment deferral.

The council discussed the procedural approach for approving the assessments given the objections raised. It was decided to approve Resolution 2647 to initiate the 30-day period for property owners to file with District Court, with a commitment that staff would bring forward a separate resolution at the next meeting to amend specific assessments based on the discussions and council's directives. Directives included reducing assessments for two Willow Circle properties, further discussion with the American Legion regarding sanitary sewer costs, reducing the sanitary service cost for the Swansons' property, and discussions with Michael Cobb regarding his concerns and deferral options.
Notable Quotes (8)
The special assessments I'll talk about tonight follow the Minnesota statutes chapter 429. Using this process and the established assessment policy, a portion of the project costs can be assessed um against benefiting properties.
I've recommended that the city pull that portion of water mane out of the accessible cost and that is paid 100% by the city. what that would have done was arbitrarily um increase the water main linear foot cost disproportionate to other projects.
First, I believe this assessment is inequitable and disproportionate. uh on the grounds inequitable. The city uh or the overall assessment of this has failed to recognize the completeness of the construction project by the very virtue that you've expanded this the road which is great. At the same time you've taken property from me.
First, we're concerned that portions of the assessment do not do not appear to reflect the work that directly benefited the property. Specifically, our assessment includes sanitary sewer costs, even though the project documents indicate no sanitary sewer service was performed on Legion property.
U, we sent a letter uh to Elizabeth and I hope that you all have received copies of that. Um we have asked for consideration on our assessment because very recently and that was August of 2019 uh we had already paid to cook excavating to replace our sanitary sewer line on our property but also they extended the line all the way out to the main sewer.
So, I believe what we've done in the past um is you'll you'd have a discussion and decide what you would like to do um in the instances that's been brought up um the resolution that's before you would be approved um because that's what starts those timelines and whatnot.
I absolutely uh Stephen, in the past what we've done is we will approve the the assessment role tonight. Um and then at the next meeting, I will bring forward a resolution amending the assessments that you ask or require us to amend.
Make a motion to approve the 2647 street assessments giving the provisions of the information that we talked about with the revisions that were stated here tonight.
