So, we're we're meeting planning zoning tonight, but further notice uh that everybody saw and read. Oh, before I go any further, if you have your phone, please turn them off. with fire keep the noise down if possible. Um [clears throat] per the notice of the meeting that sent out this is the workshop for the planning commission and this is the first set such meeting this planning commission has had with uh uh this whole this whole issue of uh the uh skyway project Skyway development fund. Yeah. And um so tonight's meeting is going to be solely conversation between the commission and the parties that are here. There will be no public input at this meeting. So don't raise your hand because I'm not going to call anyone. And I also uh want to give instruction to the Ryan people. There is no going to be no involvement between you and the public. Okay? Your involvement is here and Craig will be uh man that. So um that's that's the instructions and there will be other meetings in the future you can ask questions and have public input from not tonight. All right. So with that, let's go with with the review and discussion of the skyway development application and Craig, that's you. All right. Good evening, planning commission. Um I think what we'll do here is we do have a PowerPoint presentation that we'll uh we'll run through. Um again, the purpose of the meeting tonight is to run through the submittals that we received um on October 27th and uh staff is here, Elizabeth and Stephen. So they'll also run through a little bit of the timeline and let you know, you know, how we got to where we are today and then just be here to answer any questions that you have. Um like you mentioned, this is the first um time that the planning commission has had a workshop like this to go over a large scale project that uh um you know that may need a little bit more time to uh to gather the information and to explain it. So um so that's what we're here for tonight as well. Um so with that, Stephen has the uh power pulled up and I guess we'll go through that. And Melissa, do you want me to run through the first portion or do you want to take with that. So, um, just since we have a lot of new faces in the room, um, I'm hoping some people join us online, I just kind of wanted you to go through, um, how the plan zoning commission came to be, what it's governed by, um, and kind of what it goal is, it business. So, um, kind of the the dry stuff up front, Minnesota State statute 462.354 gives cities the ability to establish planning commissions. Um a lot of smaller towns the city council serves as the planning commission. Um as kind of on the throne we split it off as a separate um bound to um the planning commission is um the actual pine island planning commission established in section 2.31 of city code and the planning commission is governed by a slew of Minnesota statutes as well as chapter 11 of the city code. Chapter 11 of the city code is what we know as the zone code has to do with zone and land use regulations. So if you hear staff and the engineer commission reference um the city zone code that will be chap of the city's code. Um the planning commission gentlemen we have up front here this is an all volunteer board. I want to thank them for their service on the board. It's not always easy getting volunteers to this board. Um so I appreciate um their willingness to step up. Uh this board is an advisory board of the city council. Um they issue recommendations either for or against projects. Um they do not approve or deny projects. Um some of the duties of the planning commission include um reviewing comprehensive plan. Uh the city recently approved the new conference plan a year or two ago um to play for role in that seeing it through the end as well as capital improvement programs. And then kind of the meat and potatoes of what we do here um are any zoning ordinance, any change to zoning regulations, any reszoning, that all comes to planning commission or this council. Um and then any zoning or subdivision applications. uh with applications would be things like the additional use permits um cds interim use permits variances um things like that that the city rules on always comes through planning and zoning first um many of those applications that I just referenced these various things like that are subject to what the state calls the 60-day rule I believe statute 15.99 um lays out that variances conditional uses The city has 60 days to issue a decision on those applications from the date that we receive it. Um there are a few options. Obviously the city can approve with usually with conditions on these applications. The city can deny these applications. When doing so they have to issue findings. There has to be legal backing to why you're denying these applications. Um or the city could choose to not um issue any finding on an application and at the end of 60 days when that runs out the application is just automatically approved without any city. So as far as I know we haven't done that and we always have something to say about it. Um so like Craig said we received complete applications off the reign companies on October 27th. We received two applications at this time. Um which should be the preliminary plat application. Um and that was in the packet along with that is the actual legal plat document. Um it is industrial is the name of both. Um and then the second document is the conditional use application. Um this initial use application approves the use of a planned unit development which creates development. So like I said earlier the conditional use application um was received by the city on October 27th. That application is subject to that 60-day rule. So in theory uh the city would receive that in October. you have to have a planning and zoning public hearing in November and council will have to approve that in December. That timeline was far too short, far too fast. Um the city did not feel we would have had ample time to review a project of this scale within that timeline. Um obviously the community has made every voice heard that they would like more time to do this. So, we took that input and we are requesting um additional time to stretch out this project by project to conduct additional work sessions like this. Um I didn't find it fair to spring on planning and zoning and have them review the applications to have a planning uh public hearing and make a decision all in one evening. That would be far too much to ask um of any board especially volunteers. So the city is requesting um extending a timeline an additional 60 days. Um so instead of having 60 days for the needation is our position or our plan to request from the developer extension up to 120 days to do that. So give us ample time to look through the development have work sessions like this have additional public hearings in the months to come and really get into this project. Um so like I mentioned the preliminary plaque that we received that document requires a public hearing. Um the public hearing is planned intentionally at least to be held in December but the December 8th believe that is December 9th. So that's why they're not having a public hearing this evening information is their introduction that will be done from the night review these documents have all these documents get additional information over the next month or so and then be well versed when we come through that hearing in December. So in the event that council the pine zoning and council approves the preliminary plat there would then be additional submissions that would be to come that would be final application development plan application development agreement and an exitation. So this project is far from complete. Um this is truly an introduction to it. Um like I said this is the first time the the board here seeing the documents. Um so really ourselves into a long process that will have multiple periods and then multiple planners council meetings in the future. So as we get into this um the city's building website all these application documents as well as all the information that the city receives and issues over the coming months um about these applications will all kind of uh updated in there as we go. So that's kind of the paper trail and paperwork of how things um go on the planning zoning board and then we'll jump into the the timeline of the project so far and what got us here. Um, I won't read out every single box to everybody, but um, this was initiated originally at a council meeting in March of 2005 or 25 um, where council issued the beginning of the AAR process. Um, that that triggered a public comment period in March. Um, we houseed in April. um has got public comment period to an end. The city adopted um another order to continue. Um all of these are submitted to the committee for public review and Minnesota agency review. There was another 38 public comment period that began in June. Another one of July. Um again final A submissions to ETB in August. the city council adopted the AY in September. Um we held another open house listening session in October and then for those of us who exceeding November 10th um workshop um we have on the tentative dates for the next planning as well as the council meeting of December 16th and that is again just for preliminary class um and the preliminary development plan for so we've had a lot of meetings and a lot of steps to get where we are. Um again this is also just the beginning of the official process for the development plans as you have received. So now we will kind of get into the submissions as well. Okay. So as part of the preliminary plan process the uh developer is required to submit to the sexual plans. So uh as the project pres progresses here as they're getting final documents fin and those sort of things we'll see more detail on these in these plans. Um so again these are conceptual level just showing the um proposed alignments of sanitary uh sewer water um extensions and also the uh roadway improvements in that. So on this first exhibit uh this is what we would call the um offsite improvements and as you can see the the overall project is divided into two project areas. We have the north project area and south project area and this totals around 482 acres and the first phase of development was proposed that the south project area. So with the preliminary flat the blue area as shown that blue shaded area that is lot one block one finally industrial and the shaded area is showing the concept and we'll get into concept but that shows uh some future buildout of that of that portion of the property. The north project area extends all the way up to 490th um street and that's on the far right hand side. So north is to the right here we can see highway 52 and then on the east side that is 195th 195th Avenue. So it goes it extends all the way up on the north side of that dry creek and all the way up to 490th street. So the plan will be to annex the entire entirety of this property all the way up to 490th street. uh that's uh the petition for annexation will will be part of a later um application. Um but u at this time with the plan, I just want you to point out the overall project area and what's what's being proposed here. So as far as infrastructure improvements in order to serve the development with sewer and water, uh we're looking at expanding the sanitary sewer from Ridgeway Lane. That's over on the west side. And you can see that red line was showing a a proposed sanitary well I believe. Yeah. Sanitary sewer extension from the existing infrastructure um on the west side of the uh frontage road all the way up to serve the development. The water main uh will be picked up above in that location as well. Um that's where the connection would be made to the public watering extended on the west side of 185th um all the way up to 500th Street. It would then extend um past 500th Street all the way to the west side of Highway 52 and then down on the west side of Highway 52 all the way down to Colony Road. So that um that property over on the on the west side of highway 52 that's city own property that is named the welter property over there just to give you an idea of approximately where that is. Um so those those would be the two utilities that will be extended to serve the property and for provide the appropriate volume of water uh that's required for the development. um the the water main is um is planned not only for the volume of water but also for redundancy. So if there was ever a water main break it would be u be able to be served from one uh from one location or the other and um that infrastructure is proposed to be uh public. So everything in the red and the blue for the water mean that would be um a public infrastructure. Uh we're also proposing uh some improvements to 195th. So the uh roadway from below where the pavement ends on the south side of the property up to 500th Street would be widened and paved. and uh and then it would also be paid out to 490th Street and then 490th Street would be paid from L5th for Highway 52. Um as far as access on to Highway 52, we're we've had uh many meetings with Mind to work out the exact um work about the specifics of that access. Right now it's like an extension of that existing right turn lane that is there right now. Uh when we nested behind the larger vehicles so we could slow down before making the um entry into the into the project area. And then also um along with that would be an acceleration lane. So any uh truck traffic that was leaving the site uh would utilize that acceleration lane before merging in this traffic. So there's there are still specifics that that again we're working with end up but that was um we had a meeting with them last week was discussed yeah >> on the water um I was trying to listen you maybe said this but so when that water comes in the west and then it comes under the highway >> so there's a constant circulation of water same thing you did around the school >> y that's Yeah. Yeah, that's right. The the main goal with any any development extension is to was to drive ahead for water quality reasons. So um and the main the main uh purpose or the main goal of providing that access point on Highway 52 at 490th um is to minimize the truck traffic past um the entry valuation. We want to keep truck traffic away from the residential subdivisions and um as much as possible and that would that a location for that um We're still exploring other options to provide um a pave service to highways um such as 195th all the way up to Highway 60. So that's a couple miles to the north or heading east and pave some roads that way. But again, the main main goal is to keep traffic away from the residential. Um as you know there there's a lot of escalating traffic on White Pines Road and There's a an on street path right now that's on the say west side of the front road there and um it's being proposed that we uh that a sidewalk be provided on the east side of the front road to accommodate the pedestrians coming out of that subdivision and heading to the roundabout and they be able to use utilize that crosswalk senator coming across the street to those um I How far north would that size? >> Um that still a detail that we'd have to determine but up to um I would propose you go to at least say the north edge originally. So that would pick up the residential resist that that Yeah. Right. So, the street improvements, um the sidewalk, there's also a um over on the the west side of Highway 52 11, there is a bypass lane um that would uh that would be there for traffic that is entering one on the on the on 52 there that is planning as well. Um and so that would just help the the traffic flow during construction. So again, we're working with the various agencies county township. So any any questions on the Austrian Queens? Yeah. That was Virginia Street. Um there's a potential for a path there um eventually. So it may be green for that. Um but there's an it would include an alternate formula which is critical that will parallel and I can I can touch on I can catch on that correct. So um the city has been working with other cities in southeastern Minnesota on Pioneer Trail which would connect like Pine Island and Zroa which would connect to Falls and Redwing. Um that's not part of this project, but we want to ensure that we aren't impeding that project. And so um that's just on the maps to show that we're leaving adequate right of way space for that um should that path happen in future. We're making sure that we're planning for future um future development there as well for that path. And then I'd also like to add so all these improvements that we've discussed thus far um would be solely on the developer and not the question. >> That's correct. [clears throat] Paid for by the developer. The only the only other thing I like to mention your team is on 500 street. Um so um again the developer has um has a focus of the the the future vacation 500 street as well. Um so that will be part of the property. Um and um so if that was then um you know that that'll be area for future development for that 192 Yeah, perfect. Anything else? So, the next um slide here show us the conceptual layout of of the property. And what that shows we'll just start on the top of the screen there. So that's a proposed building, but that would be approximately 3,000 square feet. And then the uh building to the left of that um is a was a post office building that's about 300,000 in um on the both on the you know above that building area and below that and in some gray areas. of equipment areas that are planned and then we have parking parking lots um on the north side of the 300,000 foot building and then parking around the house. So that is the uh the 300,000 square foot building will be the prop. Um the uh there's also just to the uh to the north of the or to the right of the office building there's a there's a square uh gray area there. Yeah, that's right. Uh that's a fire tank and pump house um location. So um virus suppression system is very robust and it and a lot of pressure toward that uh that exist. They're planning one access point um currently on the south end of the property. Um that would be that would come into the property off of 195th and then um and then that would go into the proposed area. You can see a series of storm water uh ponds there too. So storm water management is is a big part of this site as well. So um that would meet requirements. They have submitted the um initial calculations for storm water and uh um and appear to meet storm water requirements for both quality and also weight control. There is an existing uh drainage that runs through the site. You can't really see it on this this map here, but that um it there's offsite water that comes in through the property and goes through where that first 300,000 foot building is proposed. So that when he realigned, oh that way to reach in store water that site again working that's required the um the east side of the property or on the on the lower portion of the screen there are um potential future buildings. Uh those are not part of this application. But the but as part of the requirements for the submitt, we I was asked developers to show how the the lay of the sites um what the lay and so um showing three buildings east side of property lab. So again, not part of this application, but showing how the property could evolve. >> They have a separate access point. >> Um potentially, yeah, there's a potential that we would just have the one um if all of these um buildings are connected, meaning that all the um same use, there's potential that we'll only get to one. Uh but if it's a say a separate use, say more light industrial, then we would have separate access to it. Right. >> Yeah. >> On that picture where the access comes in 195th wide. What is that black? That's just a parking lot area or it's wide. Yeah, it could be a parking lot area. I guess we haven't gotten to that level of detail yet, but we can the representatives from answer those questions just [clears throat] >> Oh, >> is there an answer to that? >> Yeah, there is. It's it's a gated secured entry for for the >> potential tenants. >> Y the other thing about concept is there trees that are trolling around the site. Uh so that will provide some screening there from the adjacent properties and uh then there are pollinator um areas along those those tree lights as well. So that extend all the way on the east um south west sides questions is uh are you getting an employee issue at some point or yeah the officer department requirements or that what what can we anticipate or is that something you're going to be getting into? >> Uh like as far as number of employees. >> Um yeah, we we can get into that a little bit then representatives may be able to answer some of those questions, but um but as far as the parking rules and and I can just touch on that a little bit. We're looking at uh the parking uh for the employees on the larger shift um because we don't want uh parking lots only built here and um and so provide that information to us and we'll just ensure that we have enough off street parking to meet the needs of So if you don't have any questions, we can handle some of the considerations. [clears throat] All right. So some of the um so as we get into some of these PV considerations um the PV language it's written and um and that has been provided to us. So we're in the process of reviewing that now. Um but a lot of these items incl um all of that information uh was um was reviewed in the A. Um and so uh so we're just going to going to touch on some of that data um and then answer the questions that that you might have. So again the the A really sets the sets the framework for the development and it set certain thresholds uh that uh that we have the developers say under development. >> So y share plan with you. >> Yep. So a PD is a planned unit development and what that is is where it's written into code. It is a um um it is a uh um a special zone within within the city um that brings efficiency to the development. So certain things mean nothing exactness we look at those items to you know to maximize the development a lot more efficient. So that's so that language is very indicated and there's the world. Um and so the city often uses um as like an overlay to a zone district. Um so this will be zone industrial with a PUB overlay. So that overlay of the EU would take whatever the zoning district is and then it can change the various requirements usually make them more strict um that requirement set that addresses. So it has to usually conform to the base zone district and then some so it's basically in addition to that base. Yeah. So, as far as traffic goes, we touched on several traffic improvements that we um during the earlier portion of the presentation here. So, the paving of White Pines Road on the sidewalk and then the black pass on before the 52. As far as the noise goes, again that was addressed in a there were nine uh specific locations that were tested. As far as the noise, there are code requirements um that are laid out in the city code and um um and so um highway 52 is around 50 dB at the readings that we lower 50. So um that would follow requirements the um The lighting again what's uh proposed is uh the half candle at boundary right and then the infrastructure the uh um I think again that's important to emphasize that the infrastructure everything that we saw and those offset improvements would be paid for by the developer would be their costs Can you go back to the lady? Okay. So, you say the proposed B of standard is stricter and more clearly defined than the city's current lighting requirements. Can you actually tell us what that would look like? >> Yeah, that's um that's one thing with the u I think we'll we're going to have to define that a little bit more because it's hard to understand what a gambler is. >> Um so um I think as we um as we get into that we'll maybe compare it to the main street. We did take some uh uh readings some photometrics um readings on main street and we'll be able to get you information on this you can kind of visualize what that >> yeah you know let's face it lighting noise water electrical use are these big topics that have been conver like I said that's why um this was kind of the introduction We wanted additional time to to put those things together. So when we come back in December, we're kind of trying to gau what are concern and look for what issued by that time. So >> yeah, that's a good question. I know like on main street we're shooting for like a one foot. >> So So just I don't have the readings right in front of me, but that's in the process because everyone put their lighting >> as all right for the the infrastructure again that's the developers uh cost the buffers and setbacks so the uh city code does lay out the requirements for um setbacks in the I2 zoning district. And um as you can see here, this um goes a little bit beyond what the uh the standard is here. There are also building aesthetic and material requirements and um and that is written in that PUB language that that we received as part of the application as well. So buildings of that those sort of materials on a green space ratio the uh the minimum green space um in the it district would be 25% what's being proposed with this development would be 35%. So 10% more leaf space than what is that is what is required per with the trees and landscaping from the concept that we show trees around the perimeter perimeter of the site and then some office also the storm water management that's uh another requirement again we meet NPCA requirements for Minnesota control requirements for storm water treatments and storm water management and uh um again those calculations were were submitted by the developer reviewed and um initial Looks like what the goals does meet. >> All right. The height. Um the coal requirement is 45 ft. Um that's for a a structure height. What's being proposed with the speed is a a 60ft building night and then through a conditional use permit could be um increase to 80 ft for the equipment um that would be potentially inside the building. So um one um one consideration with that is that um setback for the building height would increase by 2 ft for every foot above that 45 ft. Um so again with this initial building uh really not really not doesn't all that help with much with the setback requirements but future developments this PUB money would cover the entire development so that will be uh inspiration in future plans and wetlands there was a wetland delineation uh study that was uh in report that completed that was approved through the no decision from the uh county um soil and water conservation district and there is a wetland in the far northwest corner that's um mostly in mind in the ditch which is not uncommon we do see wetlands in in ditches a lot um and so that's if that is impacted that would need to be mitigated through the economy estimates the parking ratio again because really isn't anything to for the Florida dating center like this. There is for office building but not the data center. So looking at fighting the street parking for for the employees of electric ship as far as the the water. So for um for the full build out again this was a facility we are there' be approximately 152,000 gallons of water used per day um and that is for ultimate build out. So um what we do for each of the proposed each of the proposals or each of the submittals we go back to the a wave and make sure that they're under that threshold. This case they'll be with this initial building in space. And the other the other item in the A or excuse me the P language is the uses the uses. So those are all outlined as well in that language. That's water usage. Can you equate that to something? I've heard I've heard Peter I believe it was Peter um in the first conversation with a couple people and we had the first meeting of the public meeting equated water usage to an 18 something like that. So yeah and that that's correct and it depends what golf course I should 500 golf and so it it depends on the golf course um or yeah 300 yard yeah but um but it's also comparative to uh a residential subdivision with size. So if this 482 acres were uh to be residential subdivision uh depending on the density but if you look at the um comparable lots as in the Pine Tree Valley subdivision there. Um, this water usage is very comparable uh to what the resol I pulled up those numbers, Craig, but we did do an analysis. We're comparing our local residential subdivisions. And so we took all of the residential units east of Highway 52 um and calculated the water usage by that area. It's approximately 133 acres residential. If you calculate that um gallons per acre per day, it equates to about 303 acres. If we break down um this development per acre, uh they're requesting about 315 pounds per acre per day. So it was within about um eight gallons per acre per day. If we compare this um the water that has been incorporated through the AR compared to our current stretches and the the city does have a water appropriation per minute through the GN and that's up to 166,000 or 166 million gallons a year. Um last year we uh reviewed the water usage report and we were over 113 mill. So, so there's capacity in the DMR appropriation >> questions. You also have the storage capabilities. >> Yes, we do for certainly for this first phase as as part of the second phase. Um and through just natural um growth within the city um another tower be um right now we're looking at that that is in the city's comprehensive plans to have a um another log tower in city provide some more protecting fire protection capability. So, so yeah that is that is planned and in the existing planned but didn't answer my question we currently have the capacity yes Yeah. Well, I was going to say I have a question on going back to the issue. Can can we bring up that that slide of the first building? So in that first that first phase which does not include those three buildings parallel the 195th in that first phase you have a good idea what you're looking at as far as or employees not construction employees of course the employees that will be in that phase. Yeah, commissioners. Uh, for the first phase, we would target hundreds of construction jobs. I know you qualified them as as temporary. >> And then we would say, uh, dozens of um, permanent and semi-permanent jobs, >> and it's been no secret. We've talked about the the traction we're gaining, the momentum we're gaining with the US-based Fortune 100 company, and they are in the tech industry. And so this first building depicts where we're gaining that momentum in and these warehouse size computers um do have permanent jobs um but they are limited and so uh related to traffic. You get the benefit of that as well with you know limited cars moving in and out on on a full scale development of 400 plus acres. We would say thousands of construction jobs, hundreds of permanent and semi-permanent jobs. But to answer the question, phase one, um, we've described it as we as we said it. >> Yeah. So describe it as dozens. >> Yep. What is a dozen? Two dozen, five dozen. I mean, you got to have some, you got to have some idea. >> Yeah. 30 to 50 permanent jobs would not be unusual um for a initial phase of a tech campus >> with with a data center and an office building. >> You mentioned there if I may. Um those are questions too that would um come with final applications including um like when a development agreement is uh considered for the job. That's kind of when it gets into the nitty-gritty of put it on paper of um job creation, who pays for what, things like that. And so in this first phase, um we're really just looking at uh the preliminary path of where buildings are, storm, water, things like that. Um but that definitely those conversations are coming with more detail. Great. >> Thank you. Anything else? There's something invention about energy that powerful. I believe, and correct me if I'm wrong, but I believe it left it open um when we were talking about other uses for the future land because the Q would lay out the guidelines for that entire property. And so I think it was in the PD language as a potential use um on uh it's not being proposed in phase one, but having it in the QD language doesn't rule it out for the future phases of the project. That's page four on page four. Sorry because Elizabeth that lists the the proposed uses there that refer to okay so we're online at this Why don't I'm good at this point. Chris, >> uh, one quick question. The water that's that's potentially going to be done as a cost by the city. Yeah, that that's still something to be determined because as the city as the city grows again in comprehensive plan the city cost just with the the projected growth that we're we're experiencing. Uh that would be joined by the city but all of those items are in development agreement. Um and that will be that will be so that's yeah >> and just so that the water tower issue was on the book before this ever. So this is not pushing the water tower issue that was in the long range comprehensive plan before this came into existence. And I'll I'll kind of touch on that too. Just use the opportunity to um educate everyone a little bit um on public infrastructure. So as Minnie has said, so it was it's been in the fans um I believe like actually it was probably one of my first weeks on the job. We started planning for a week of water gone and uh so when there's any kind of new development whether it's residential or commercial uh people talk about rack and sack fees all the time and what that is is it's sewer access fees and um uh water access fees and then there's storm water as well. Um so any development pays whacking sack fees and so what that does is those are fees paid to the city to support the addic infrastructure and uh those fees are paid for acreage and so for large scale development like this um it would actually contribute quite a bit towards so we chose when I was on council the way I can say for that purpose as a developer brings property into the city. Then those wagon sack fees are discussed and established and those go to the water and the sewer fun. So that's that's a pretty big deal. When we first did that, I know that was controversial to people. It was fairly new, but I think pretty common. So those are play with her. Anybody else? Just one more thing about the fence. You want to make an exemption have a opaque fence. So I'd like to know what material would be used, what size. >> Yeah, those are those are some details that we'll get from you as well. Go ahead. >> Yeah. So, right now the PD language is pretty flexible and from if if we wanted to add a solid fence that help with screening that would be either a wood or that but right now we're not antic language for future possibilities. And what size potentially? >> Uh 8. >> So that's not that's not in the plan at this point. >> No. >> Once again, it's PD language for the future to set future language or certain assumptions. So if we come up with second, third or fourth project and we wanted to use a more of an opaque fence that that would be allowed either wood or fence update or and that would be kind of combined for maybe security and for screen. >> Well, that's what I was wondering. So was that that is something the city could uh have a say in. >> Yeah. >> Yeah. Sarah Anything else? >> Um I just have a few other since you're talking about water kind of came to mind. Um I know just some questions some kind of questions you've had about um the water source for project as you saw the water looping. So all the water that the city or other this well being used would be city water. There's no ground water well to be filled. Um and then water would be meter on both ends of the water and not so uh check that against what appropriated as well as waste water through what they consider. >> Yeah. Yep. So the so any user over 25,000 gallons uh this is part of the NPC would be considered a significant industrial user so for instance Lando Lakes is a significant industrial producer SI city by the way um so we have a separated meeting with with Lando Lakes um and so um it went when the property was developed as we were through the um the development agreement and agreements. We also have um a wastewater agreement uh with with the developer as well and so we have a state with the property. So what that does is it sets limits for certain strength of waste um and it will be monitored and testing will be welded so we can monitor the the strength of the waste water to make sure it's within uh for us to be able to treat. So, >> so is that an agreement like we've had analytics where space which they've never come so yeah but I might get the numbers wrong but I think it's in the $100,000 per day and I think they're using 40 sounds. >> Yeah. So they have land for instance has that reserve let's just use 100 range and they're using 40% they pay for correct yeah yeah to a certain extent paying for the user fees that they're also um yeah buying a little additional capacity so they review that every once in a while I think the last thing was 80 was I believe it was 22 when they relocated. I think it was a larger um threshold at the time. So that you also mentioned testing. So the constituents are also tested both suspended solids and other things. >> I would expect this to that kind of >> Right. Right. Yeah. not contributing that to that amount but yeah testing is done um in in that agreement we set the testing schedule for that so that we'll receive um their their test result slots testing our facility anything else >> north of north further questions, I can kind of go on next steps. Um, and then if any questions arise, we can we can go back. And so, um, again, this is not typical to have a work session, but we thought, um, that it would be a good opportunity to help, um, educate what the applications consist of and then in addition give planning zoning commissioners extra time to consider the applications and be able to ask questions. And so typically when the city receives um like a preliminary plan application, we review it. It goes through um many engineers. It goes through legal counsel and then staff would uh come back at the public hearings with any conditions that we feel would be necessary on the city's behalf. And then when it comes before you for a public hearing, um we would have those recommendations. Uh we've only had those applications two weeks and with the the large scale of this development, we're still going through the applications, going through the detail, compiling those conditions, which is why the city isn't having any public hearings then so that we have to uh I know this is a very emotionally charged um development and we've heard a lot from a lot of people from both for and against the project and so um I just want to remind everyone that there there will definitely be time to hear every issue and so there's uh many public hearings before us um this is just the beginning and so those public hearings will come um unfortunately ely there there's just a process in the way that the city hears those applications and so again right now the city is um only considering the preliminary plat along with the preliminary development plan. Uh typically we've always done the conditional use permit and the resoning permit with the preliminary plat but we thought it would be beneficial to look at the preliminary plat first prior to deciding the reasoning and the conditional use aspects of the not sure if that sparked any additional questions at all. I got one question for Ryan. It may be ahead of time and we'll keep it keep it short as possible. What makes this different from other data center plans that are out there? I I think um this is a very unique opportunity for a small town in a state that we call home. It's our headquarters for companies. We've been in business for 85 years. It is a uh generational opportunity um to take advantage of um what initially is a US-based Fortune 100 company who wants to invest hundreds of millions of dollars, provide very very strong jobs, contribute um through property taxes to your school, uh to your city, to the county. um genuinely form community partnership and relationships uh with the city and and do that without asking the city to make investments into a business park. Often times when Jared and I and the Ryan team are going into a community, they have invested in the infrastructure to create a business park. Um, we knew that would not be the easiest that we would have to pay for those costs to help build momentum and build that mouse trap to responsibly attract a really good company. And in in the difference between this and I would say other technology campuses, data centers with it's been no secret. We've talked about data centers since February. We're talking about data centers right now. is the state of Minnesota. You should be proud of the state of Minnesota. The state of Minnesota has consumer guard rails in place very diligently preparing for this wave of tech into our state. And so I think uh what you're going to see is development in Minnesota whether it's light industrial or technology based um will be very carefully and critically researched and analyzed to protect the consumer and contribute positively uh to the community. >> Okay. So, just like I said, this is this is an introduction to a really big topic. Um so at any point before December um or beyond December um obviously the file of you are offices are always open.
