isresolution 25-10 authorizing the write off of uncollectible debts somethingthat we have to do every year essentially these are accounts orbills that are owed to the city the city every timeunfortunately we're unable to do so usually it's from pass water someone whosold their house full list was in the pack [Music] toal motion second any other discussion questions Delhi B hi Brandy hi thank you moving on to Item B whichis request from the Chamber of Commerce to rent the CR building during theoffseason wave rental fees this is something the council hasbeen approached by the chamber in the past we've been able to work withthem yes so um there's two things before Council one is we typically don't renttheary building prior to First so we're asking permission to do so and thensecond we're asking for fee waiver theal fee with taxes are about $17 the request from the chamber to rentthe creary building during offseason way the rent opion second a motion in asecond and this would be uh the chamber uh when they do this typically it's whenthey do the that so there's always chance withthe weather that toilet might not be available so they are aware that so weappreciate their work on that Del I Colton hi Vernon hi Brandy hi and Davidis I we are going to move on to resolution25-11 which is approving the orderly annexation agreement withand Shar yes so this is something that we'vetalked about um and a few of the past work sessionswe've also um when I say we I mean our city engineer engineer Craig Bren and Ihave been to multiple p and Township meetings to discuss the agreement beforeyou this is the final agreement after a few discussion back and forth with thetown board uh it is essentially an orderly annexation agreement forapproximately 400 Acres on the northeast side of town uh the properties are alllocated between 195th and Highway52 um essentially all the way from City Limits and goes up to4 um just to clarify entering into an orderly annexation agreement does notmean that land is automatically annexed to the city so the property owner wouldhave to petition the city to be annexed um in which in city limits by uh passingthe orderly annexation agreement the township doing so as well uh this lookthis just makes the process easier if the land owner did petition the city tobe Annex we could do it by a simple resolution instead of an annexation by I'm notsure I do um mayor and Council just very very briefly just s us an opportunity tomention what these orderly annexation agreements do and what their value is Ijust would pull out three three items from the agreement that you had in yourpacket the first is sort of the big picture why do we do it cities have thepower to Annex Township abing Township Le by law by Statute um and we can dothat by ordinance without an agreement but there are limitations on how muchland we can do that way and there are other limitations on when cities can dothat and so order the annexation AGS are used uh to to not have to worry aboutthose statutory limitations that allow anex more in another land than than thestatute would allow so that's the first thing that to understand the second isand I'll just tell you I learned this myself last week we had a conferenceamong City attorneys in the state and somebody from the office ofadministrative hearings the state office that handles annexations aim uh to thatand presented about order the annexation agreements you'll see in in paragraphfour of the agreement it's titled consideration by the director that'sreferring to the director of the office of administrative hearings and what thatparagraph says is that uh we're telling the state to do this annexation when weask for the state to do it um it doesn't happen until we ask and then it goes onto say that the office the the state office doesn't need to weigh in theydon't need to dig into the details here we've worked that out and I'm pointingthat out because the office of administrative hearings now has saideven where a city and Township have an orderly annexation agreement unless itcontains this language they're going to open up a full-blown hearing you'regoing to have to have lawyers go to it it's the whole it's the whole deal soit's good that we um as a matter of course have always included thatlanguage in our orderly annexation agreements with our abing townships uhand then um uh reimbursement which is paragraph nine uh you'll see thereimbursement amount there this is reimbursement to the township if we goahead and Annex land for the lost property taxes the property taxes theywon't get on that land and you might wonder about the amount $495 an acreunderstand that um this provision is common in all of these orderlyannexation agreements and it's intended to replace loss property taxes not justfor one year not just for the year of annexation but several years after theannexation and so that's the reason that that amount is a little bit more thanmaybe you would expect to see because of course property taxes on land in thetownship aren't $495 an acre but this is intended to replace it over a period ofyears so I just want to point those things out those are common in all ofour agreements and I'm happy to answer yourquestions any questions from the council and I would I would emphasizeand reiterate too uh what our city administrator had mentioned thecollaboration between the in the city on this projects and keeping those Avenuesof communication open uh between the two governments which is has paid divid sowe appreciate the I appreciate the city staff uh being able to work along withour city engineer on so I did have one question that i' like to ask in regardsto the 4% for next year starting on the 26 I mean does that increase every year4% or is it fixed to the market or how does thatwork yeah um as I understand the agreement gra state as well but I thinkit's 495 for 2025 and then it would go up by 4% annually that 495 would go upand I mean I think to be blunt about it that's a number that's intended to staya little bit ahead of inflation wants to make sure that they're covered againstinflation and you can anticipate inflation being two two and a half 3% soyou know that's a number that they've picked and we closing to agree to tomake sure that they C depending onl so that would be for any of the land that'snot annexed that we designated business well I think it's I think it'scontemplated that an annexation if the the project underlining this that wemaybe we'll talk a little bit more about either in the next item or later in thefuture at Future meetings I I think it's anticipated that that would go for in2025 it's h so there shouldn't be an issue about but if there was say 20acres or something that been there that would continue on for right so to theextent we don't inex all of it once not may may that495 was modeled after we uh have several or the annexation agreements withTownship and so that 495 is where we are at currently in Township withbuild I just want to understand that if it wasn't all an AC it continued on sothank you yeah you have it just right move resolution 2511 approving theorderly annexation agreement [Music]with I'll second have a motion and a second on the resolution any otherdiscussion from Council Members questions hearing nonea hi hi Bon hiRandy hi and David is I which will bring us to item D which is requested throughThe Joint power agreement with ship so the continuation so bear with me I will tryto use as little AC acronyms as possible um so before you is a jointPowers agreement this joint Powers agreement would be with P Township uh inregards to the parcels that we were just discussing the indexation so we have adevelopment company Ryan Companies who is looking at uh potential developmenton the northeast side of town uh to look at that develop development to see ifit's possible they must complete a um a which is a alternative Urban areawidereview essentially what that is is um environmental review and on the pastwe've got environmental assessment worksheets um because of the land areais larger it's a marent process and so uh because these lands are withinthe township the township would serve as the um government entity that wouldoversee that process because we have an Orly annexation and if this developmentwere to occur uh and those lands would be annexing to the city the city wouldlike to oversee that a process and so what this agreement is is it'sessentially a power sharing agreement with uh P Haven Township or excuse mePine Island Township so that the city of P could oversee that process I'll um to approve the jointPowers agreement with the second motion second and just forthe public as well to be aware as our city administrator expainup this agreement is a collaborative approach between the city and the andthe township um so the township is included the city's included in in theseconversations so it's a very transparent process with that which Iappreciate our city staff working with our attorneys and gettingthis working yeah if I can just one one quick comment about this um uh you allwill be extremely important in reviewing the AAR that the developer puts togetherthen ultimately get submitted under oury the develop puts it together but but tobe clear engineer I mean a big reason why a citywould be a better rgu than maybe a Township is if You' got a non in effectan on staff city engineer this is going to be pretty engineering KY um thesereports there's a lot of technical stuff in it that all of us won't know as muchabout as Craig so that's a good reason why a city will be potentially in abetter position to do this than the so we we'll be leaning a little bit onCraig here to tell us what the I'd also like to add that just beforeyou tonight is just to enter into the joint Powers agreement there will bemany more hearings down the road with um kind of the nitty-gritty details of whatthat 8r entails and in fact we have a special council meeting scheduled onMarch 4th um at 6m which where we will um have further information about the aov thank you we have a motion or secondany other acontract for lead um with um Pat wal for 22 Acres on the north side of town um wehave made two payments on that one for 2024 one for2025 uh we are asking that we uh pay off the contractor needed so we do have aclause that there's no P for prepayment and so that would be paid in full we' bemaking two years worth of payments toing $240,600 and asking that we pay this on250 fund uh just to clarify these are funds that received for the excess rightof way land that the city sold to Prairie Island and so we would not beusing to make this move resolution 252 approving the second a motion in a cheese fast who wants to explainthis one than take it if you want perfectthank you council member um this is more of a public safety issue than anythingum over the years we've noticed that the the traffic is not following thedesignated detour route the Public Works has been setting up they've been tryingto shortcut in front on the south side of land legs and um this is will enableus to I talked to all the business owners in the area that I could get ahold of there were a couple that I don't know God was able to get old of or notbut they were all in favor of it and they highly appreciated what the publicworks department has been doing in the past too and it would just close the uhStreet down by the east side of land Lakes on Second Street and Third Avenuethere so that would be completely barricaded off so the only exit route isback through Main Street and following the detour run and I would just beduring Cheese Festival when set up the detail any question question this willbe an action approval for the Second Streetroad closure for chiefest second Motion in a second and I out of the out of thisconversation the only part I would have I would have a request is public worksor cheese fest communicating with Landes and egg Partners on semi TR just toaddress whatever needs they would have because they use Third Street quite abit for on Friday speaking with land lakes andpartners they're they're aware of what this is this process would be so justwant to make sure that they don't get faultedfor issue that the cars SLright speed bups any other discussion from for 2025 we've officially kicked off our bonding request at the statecapital for the Sanitary District we have four or five days plan already ameeting by state legislators and then um yeah we have ourcity audit next few week so we'll go get yeah was there any with theuh with the delay up there do that impactour groups so it's it's definitely a unsituation this year uh up at the state capital with a power sharing agreementand now those agement have gone away um some some committees are still honoringthem so not really we're still schedulingmeetings with legislators um who haven't really heard his whether there will be anot if you recall last year there was not when we wanted to haveone one year this yes hieverybody I'll keep it brief so we get out of here in half an hour wouldn'tthat be something um my main thing with the library right now is one t one titlethat's where my brain has been for the last couple of months and I am happy toreport it's going well we had our book club discussion this morning about thebook The C peeper by Diane Wilson that is a selection this year and last weekwe had a really nice presentation on Pine Island before Pine Island um we hadabout 25 people come to that that was with chrises at the History Center sothat was really kind of a neat presentation uh we were supposed to havea a program last night yeah Monday but we decided to cancel due to the coldcold weather um we were having it hosted at the United Methodist Church and theycanel their events if it's a closed school day so we decided to follow suiton that so stay tuned for that being rescheduled um otherwise this Thursdaywe've got white um someone coming from the the lower Sue agency his name isJohn Robertson I wonder if he's a relation um but he is the tribalhistorian out there and he's going to be talking about the US Dakota War that'llbe at the History Center our author will be in town on Thursday next week on the27th Diana Wilson is coming um and she will be speaking at the Methodist Churchat these are all at 6:30 at night we also have why treaties matter next weekat the United Methodist Church It's a poster display I think there they've got30 different posters that kind of talk about the history of treaties in thestate and uh so that'll impact both the Dakota and the OJNations otherwise U talking about the legislature I am going up to the capitalmyself on Thursday this week for Library legislative day there's a lot ofdifferent issues that are impacting libraries um and actually some nationalstuff that might be impacting the way we are able to provide services hopefullynext week or next month they have a little bit more information and actuallydo a little bit of a presentation on that if there's time at the this meetingand other than that I am working on my annual report already as well sowrapping up 2024 we've had a really good year um last year and look forward tothat continuing any questions forme outside projects outside projects are going well we um got a grant completelyfor all the plants for our pollinator garden and right now we're just workingon getting an additional grant for some of the other things like our path andour peaceful and our our pollinator Garden sign and that kind of stuff soeverything's going well you you might have said it too with with your outsideprojects and you have a Master Gardener that's helping and then you havevolunteers that are yeah we are partnering with partnering with the uhOlstead County Master Gardeners I and Kim Olen has taken up helping us outdirectly and she's pulled in different uh volunteers through that program so inApril to may we will be installing the garden we also have the roots and chootsEco Club at this High School who are going to be helping out so it'll bereally nice intergenerational project um and we'll also be having a couple ofother programs through the Master Gardeners about pollinators pollinatorGardens we're doing our pollinator Garden is around the theory of keystonesand soft Landings of the plantings so we'll be talking about that as well sothere's a lot of different interesting things coming that way so warmweather's
