Okay, we'll get started. Our first order is we got Ron Barnes. Ron Barnes is here today. Um Andrew has taken a job as a parillegal division of the city police office and Burbach been promoted to promotion would be in order to appoint secondary none. All those in favor say goodbye. I say I told the motion carries unan.

Um this is a followup item from our review doing. Um and basically what we're going to do is we're going to walk through kind of final language on things. We are going to consider resolutions that effectively initiate the process for changing is

all right. Thank you, chair. I decided not to do a PowerPoint tonight because a lot of the sections are long and they don't fit on a neatly on a PowerPoint slide. So, you're welcome to give me some feedback if you want me to never do that make that choice again. Um, but I did that tonight.

So for some of you, you've been through this process before. Um, and for some of you, this is new. So, I'm going to get into a little bit of information. It was in the packet. But the key things for you to know is that there are four different ways, four different statutory and state law process pathways charter commission and the city council can use to amend the charter. And so when those when you all come up with ideas on how you want to amend the charter, I think about it and I often consult with the chair and ask him what pathway he thinks would make the most sense for the given charter amendment. If you might recall, sometimes we go to the we go to the voters. Um sometimes we go to the city council by unanimous um approval. There are four different ways. Those are two of them that we've used recently. So, in this instance tonight, all of the proposals that you've asked me to put together are all on a pathway that is the same. And that timeline is laid out at the bottom of page four of the packet.

Uh it's a proposed timeline, but you should know that the the the dates are very specific and they are in state law. And so, I put together the draft. I had the calendar, the the city council calendar. I had your calendar. I I crunched the dates. I had Teresa double check it. I think Adrian doublech checked it. And so these are the proposed dates. And the key things for you to know is that the council or the charter commission um before you tonight is a resolution that has an ordinance attached to it. So if you all anything you all take action on tonight by resolution will owe to the city council on the 27th of April

and the council will acknowledge receipt of your recommendations and they're going to set a public hearing. My request to them is to set that public hearing for June 1st and to um proceed on a pathway that they could they could take action as early as June 1st um or they could um the latest they could take action is July 1. So once they take action, then we'll publish it in the newspaper like we do all other ordinances and then state law has sort of a a recall type period in it where someone can appeal the the process to amend the charter, put a halt to it and um and there's hope well hopefully that doesn't happen but um if that happens just to know there is a very specific process for that and you all will be notified about that. Um, but otherwise if that doesn't happen then everything will go into effect around September.

Um the other thing to note that's really critical with this specific pathway is that the council has to approve the ordinances with seven unanimous votes. uh that is in the law and so we have to make sure that all seven of them are there and can vote and then most critically vote in the affirmative to adopt it.

So, if you recall, there were edits to chapter 5, uh, and then there were edits to chapter 7, and then you asked me to look into some edits in chapter 12. We aren't ready to bring forward those edits to chapter 12 tonight because we've been having some ongoing conversations about the larger process that's discussed in that section in chapter 12. And so, we think it would be premature to do any editing to that chapter. now um when we know that we're going to have a larger discussion likely later this year.

With regard to chapter 5, there are three sections. You'll see them starting on page six of your packet. They um relate to the sections of the city charter that had a sample petition like the in that was codified into the city charter. all had some discussion um at our previous meeting about your desire my my recommendation to you all and then ultimately your request to me to remove that box because it didn't include all of the information that is required by Minnesota rules and so um I rem removed that in this ordinance you'll see and then we also talked about a desire to continue to have the email address as a part of the city of Bloomington's petition and the telephone number.

So, I want to make sure that you all still um know that I and the city clerk have been having ongoing conversations about what that sample petition will look like. Um, the form of that there will be three different sample petitions. There are other requirements in Minnesota rules that are far beyond what we had in our our little mini sample. And so we will um build out those sample petitions and then we will touch base with Henipin County to make sure they don't have any concerns and then we'll touch base with the secretary of state's office as well before we finalize the the sample petition that we'll have on file down in the city clerk's office if you pass this um recommendation and the council ultimately adopts the ordinance.

Again, um what's functionally happening is that we're stating that we are going to comply with the rules and Minnesota, the Minnesota rules, which are the administrative rules that implement the state statutes, and that the city clerk is going to maintain a sample petition for the public. Um, there are um the strikethroughs and in the in this in the way that's required in our codification rules for the city 5.5 511 516.

I move to adopt resolution number 2026 2C number one uh a resolution recommending the city council enact a charter amendment by ordinance amending the city charter section 5.05 05 5.11 and 5.16 relate to the initiative, referendum and recall

she's available to answer any questions as we go along and to um supplement my uh information.

7.6 fix is a very simple edit um because we are entering a section of years that has fiveweek December and so it has created some um challenges for us in being as specific as we want to be to make sure that we're complying with the uh city charter. as the third week could be open to interpretation. So internally we discussed with that and ultimately the finance team suggested December 23rd. You all discussed that and um again this is not um truth and taxation hearing. We're not going to be holding that on December 23rd. This is just a not to exceed date for adopting the actual budget for the following year.

I move to adopt resolution number 2026 2C and recommending the city council enact charter amendment by ordinance amending city charter section 7.606 66 relating to passage of the budget.

This particular section had not been updated in a while and had not contemplated the use of credit cards and electronic funds transfer. So, the folks in the finance team went back to the um the words on paper and thought through all the different ways that they make dispersements, looked at the requirements in state law, which are referenced here, um and came up with some sample language for us to consider. And some things for you to just know in mind here. Um, the city is making um transactions participating in transactions all over the world. Um sometimes when our when our staff travel our officials travel um so um there are that contemplates the use of credit cards. We also take electronic fund transfers. Um our own dispersement process requires very detailed receipts which is discussed here. Um we have to co code all of our receipts with the city fund that taken out of and we do not make proposing that we will not disperse city funds with digital currency. There was some discussion internally about what that term means. It means something to the people in finance. What it means more colloquially is Bitcoin and things like that.

I move a resolution recommending the city council enact a charter amendment by ordinance amending city charter section 7.10 relating to dispersements

There are a couple clarifying edits that were made throughout sections. Um this was suggested by our finance department uh because these our existing charter language was clear on how many votes we needed to uh issue bonds, but it was not clear on how many votes we needed to adopt the resolution awarding the sale of those bonds. And because it was unclear, we wanted to make sure um we're always want to be very exact, but we want to be especially exact um when we're doing um publicly financed um bond deals. And so we didn't never wanted there to be ambiguity. So this is an effort to clarify that. Similarly, um similar edits are made in each one of these sections. clarify this requires for in section 7.14 permanent improvement revolving fund um the uh permanent improvement revolving loan sorry I'm adding extra words a permanent improvement involving fund um which is used to finance public improvements and then the second part in 7.15 are tax anticipation certificates um and then the last section 7.16 are emergency debt certificates. And if you recall the last time we met and we discussed this, these aren't often used, but when we do need to use them, we need to be um they all need to be on the same page kind of vote required.

So, there's been no substantial change in the number of votes required. It's just a clarification. Clarification.

Just to be clear on that. I think on the awarding sale as we would say majority, we're just taking the existing on one particular day that we were awarding the sale, only four council members were able to make that meeting. We needed every vote. So, we were worried that if we needed five, um, >> we wouldn't have it to award and we sold them that day. Also, too, the the issuance is um the creation of the process, the start of the process, whereas the sale is sort of the completion of the process.

I move adopt resolution number 20264 C. Uh a resolution recommending the city council enact a charter amendment by ordinance amending the city charter sections 7.14, 7.15, and 7.6 Six relating to permanent improvement revolving funds, tax anticipation certificates and emergency debt certificates.

Again, this is in that same finance chapter and this relates to general obligation chart and the limitation that was imposed related to net debt. Uh so there was an effort um initially when this was first put in place uh it was prepared by our bond council. So the requests that you made for edits were similarly uh reviewed by outside council. Um and so there was some minor tweaks that were made there. There was also clarifications that um were sought from um commission members after the packet went out. So we reviewed those um questions and requests. And so you see a revised version in the packet from what originally published. This was published um earlier this week and um has slightly different um language at the beginning of subdivision two.

we just wanted to make sure that um in our conversations that we had in January, um net debt kind of indicated that it was a type of bond. Instead, it's just a structure of an event of of accumulation of general obligations. So hopefully by um putting the reference to the statute in here and very specifically um identifying general application throughout it more clarity to you.
