OK, I’m just going to Evening Mayor Winston and 00:25:31.033 --> 00:25:33.734 council members, the charter commission is presenting two 00:25:33.734 --> 00:25:36.467 amendments this evening to the city charter in the interest of 00:25:36.467 --> 00:25:40.634 shortening the length of vacancies in the office of city 00:25:40.634 --> 00:25:43.900 council member and mayor, as well as reducing costs that the 00:25:43.900 --> 00:25:48.233 city must incur for special municipal elections. Uh, before 00:25:48.233 --> 00:25:52.467 I go on, just a little bit of background, uh, the charter 00:25:52.467 --> 00:25:55.734 commission was first asked to look into these issues in July 00:25:55.734 --> 00:26:02.000 of 2023. By the city council. Uh, and the charter commission 00:26:02.000 --> 00:26:04.467 did so in consultation with the city attorney and with the city 00:26:04.467 --> 00:26:10.033 council. And tonight is the 3rd time that these recommendations 00:26:10.033 --> 00:26:14.800 are before the council on these matters. I’d now like to read 00:26:14.800 --> 00:26:19.634 the amending language to section 2.06. And it should 00:26:19.634 --> 00:26:23.900 read the council shall by resolution at the next regular 00:26:23.900 --> 00:26:27.200 or special council meeting, declare a vacancy on the 00:26:27.200 --> 00:26:31.900 council to exist and call for a special election if one is 00:26:31.900 --> 00:26:35.100 required. The declaration date of vacancy shall be the day of 00:26:35.100 --> 00:26:38.834 the council meeting at which the resolution is adopted. 00:26:38.834 --> 00:26:44.634 Currently, the charter allows 45 days between the declaration 00:26:44.634 --> 00:26:49.100 of vacancy and the call for special election, our, our 00:26:49.100 --> 00:26:52.767 proposal would narrow that gap so that the call for special 00:26:52.767 --> 00:26:54.934 election and the declaration of vacancy would be on the same 00:26:54.934 --> 00:27:01.467 date. And I like to read the amending language for section 00:27:01.467 --> 00:27:08.233 4.03. If a primary election is required in connection with a 00:27:08.233 --> 00:27:10.367 special municipal election needed to fill a vacancy in the 00:27:10.367 --> 00:27:15.734 office of council member or mayor pursuant to section 2.06, 00:27:15.734 --> 00:27:20.033 a candidate who receives more than 50% of the votes cast at 00:27:20.033 --> 00:27:23.300 the primary election shall be declared the winner. If no 00:27:23.300 --> 00:27:27.367 candidate receives more than 50% of the votes cast at the 00:27:27.367 --> 00:27:30.634 primary election. The two candidates receiving the most 00:27:30.634 --> 00:27:34.900 votes shall advance to a special municipal election 00:27:34.900 --> 00:27:38.200 pursuant to Section 2.06 and the applicable provisions of 00:27:38.200 --> 00:27:44.000 Minnesota election law. And at this point I’d just like to add 00:27:44.000 --> 00:27:47.867 that until 2014, uh, Brooklyn Park did not have this 00:27:47.867 --> 00:27:50.533 requirement in its charter, that is to say, we did not have 00:27:50.533 --> 00:27:56.367 a primary. The primary was added, um. In response to the 00:27:56.367 --> 00:28:01.200 large number of candidates who filed to run. In the 2012 00:28:01.200 --> 00:28:08.567 special mayoral election. So the West District special 00:28:08.567 --> 00:28:11.767 municipal election of 2023 to fill the seat vacated by 00:28:11.767 --> 00:28:14.500 council member Susan Pom illustrates the need for these 00:28:14.500 --> 00:28:18.400 two amendments. Susan Pa’s vacancy was declared on 00:28:18.400 --> 00:28:22.634 December 12th, as you can see in 2022 by a special election 00:28:22.634 --> 00:28:28.300 was not called for until January 9, 2023. If I amendment 00:28:28.300 --> 00:28:31.667 to section 2.06 was in place at the time. The special election 00:28:31.667 --> 00:28:35.834 would have been called on December 12th, thus shortening 00:28:35.834 --> 00:28:43.233 the vacancy by almost 30 days. A special primary was held in 00:28:43.233 --> 00:28:45.634 May of 2023 because more than two candidates had failed to 00:28:45.634 --> 00:28:52.500 run. Tony McGarvey received 69% of the votes cast. A special 00:28:52.500 --> 00:28:56.667 general election then followed in August of 2023, and Mr. 00:28:56.667 --> 00:29:00.900 McGarvey was elected to fill the vacancy. If I remember to 00:29:00.900 --> 00:29:04.367 section 4.03 was in place at that time. Mr. McGarvey would 00:29:04.367 --> 00:29:07.934 have been duly elected in May and a special general election 00:29:07.934 --> 00:29:11.033 would not have been needed. Uh, because They weren’t really in on those 00:38:54.033 --> 00:38:56.166 discussions in terms of what was happening at the highest 00:38:56.166 --> 00:38:58.300 levels in terms of who’s going to win what and who’s gonna be 00:38:58.300 --> 00:39:02.100 the loser and who’s gonna consistently be the loser. To continuously 00:41:00.033 --> 00:41:04.033 raising taxes on a city that is overburdened, um, there are 00:41:04.033 --> 00:41:06.533 some difficult decisions that we have to make, and I would 00:41:06.533 --> 00:41:09.900 ask people to bear in mind that we are struggling with those 00:41:09.900 --> 00:41:12.400 decisions so that we can take care of not just our youth, we 00:41:12.400 --> 00:41:16.767 do have a teen center that we’re putting up, but, um, our 00:41:16.767 --> 00:41:21.300 seniors, uh, folks who are just trying to raise families, uh, 00:41:21.300 --> 00:41:23.500 businesses, and there are so many stakeholders that we have 00:41:23.500 --> 00:41:27.767 to balance up here. People were making decisions 00:42:25.900 --> 00:42:30.200 about the Northwest suburbs and Brooklyn Park. That left them 00:42:30.200 --> 00:42:32.834 out of some of the development and opportunities that people 00:42:32.834 --> 00:42:37.033 have got in other regions. So this is a long term inequity 00:42:37.033 --> 00:42:40.834 where Brooklyn Parks. Opportunities have been 00:42:40.834 --> 00:42:43.734 leveraged away to make deals at the state level, and that has 00:42:43.734 --> 00:42:46.100 got to stop for the residents of Brooklyn Park. So I’ll leave 00:42:46.100 --> 00:42:49.000 it at that. Hopefully we have a great outcome within the 00:42:49.000 --> 00:42:52.233 legislature, um. And are there any other comments?
