Planning Commission Approves Business Expansion, Temple Applications
The Brooklyn Park Planning Commission unanimously approved two development applications during its June 11 meeting, clearing the way for a local business expansion and a new religious institution.
BCS African Foods received approval for a preliminary plat, variance and site plan to construct a building addition at 7916 Brooklyn Boulevard. The project includes a dry storage addition to the existing building with a staging area that required a variance because it will be located between the building and public right-of-way. The applicant proposed landscaping to screen the staging area from public view. The expansion will remove 11 employee parking spaces but maintain customer parking areas, according to staff reports.
The commission also approved conditional use permits for BAPS Temple to operate a religious institution and rectory at 8700 Wyoming Avenue North. The organization plans to purchase the existing building in the Enterprise Park area and convert it for religious services without exterior modifications. BAPS Temple anticipates 10-20 people for weekday services and 200-300 people for Sunday services between 10 a.m. and 8 p.m.
Commissioner Cain raised concerns about development fees totaling approximately $87,000 for the BCS African Foods project, suggesting the city review whether fee structures adequately support small business reinvestment. Planning staff agreed to examine the bonding and dedication fee structure to assess potential exemptions or reductions for small businesses.
Both applications will be presented to the City Council on June 23 for final approval. The planning commission noted that conditional use permits run with the property, meaning future owners could utilize the approved uses.

Chair Kevin. Commissioner Wacko, I Commissioner Barr. 00:08:10.100 --> 00:08:14.900

Commissioner Odoma. Commissionerby. Uh I It’s a. 00:08:25.567 --> 00:08:33.367
Approved in full. But Motion made and second, um, uh, and 00:08:33.367 --> 00:08:55.500
motion has been passed. We’ll move now to item number 5.1. OK. 00:08:55.500 --> 00:08:59.367
Hopefully this all works. OK, good evening, uh, Vice Chair
00:08:59.367 --> 00:09:01.300
Frazier, members of the planning commission for the 00:09:01.300 --> 00:09:04.567
record, Kara Donovan, senior planner with the planning
00:09:04.567 --> 00:09:07.767
division. Tonight I am presenting a preliminary plot.
00:09:07.767 --> 00:09:13.100
Experience and site plan application as case number 00:09:13.100 --> 00:09:16.300
24-116 for BCS African Foods. The applicant proposes a
00:09:16.300 --> 00:09:18.500
building addition with a staging area on a newly created
00:09:18.500 --> 00:09:28.734
lot. The site is located at Brooklyn Boulevard and Kentucky 00:09:28.734 --> 00:09:35.634
Avenue just east of West Broadway. The subject property 00:09:35.634 --> 00:09:38.734
is 1.02 acres and abutt’s commercial property to the west,
00:09:38.734 --> 00:09:46.233
south and east, and single family houses to the north. The 00:09:46.233 --> 00:09:48.166
parcel is zoned transit-oriented development
00:09:48.166 --> 00:09:51.567
center District or a TODC. The properties to the west, south 00:09:51.567 --> 00:09:56.367
and east are also zoned to ODC and the areas to the north are
00:09:56.367 --> 00:10:02.233
zoned detached single family estate district or R1. The 00:10:02.233 --> 00:10:04.834
applicant is requesting approval for a preliminary plot
00:10:04.834 --> 00:10:11.367
for the creation of one lot as seen on the screen. The site 00:10:11.367 --> 00:10:14.000
plan depicts the existing building on the western side of
00:10:14.000 --> 00:10:18.233
the property, parking lot and Frontage Road. The site plan
00:10:18.233 --> 00:10:20.834
application proposes a building addition for dry storage on the 00:10:20.834 --> 00:10:23.767
north side of the existing building, which includes a
00:10:23.767 --> 00:10:28.000
staging area for an overhead door. The site plan indicates 2
00:10:28.000 --> 00:10:30.634
parking stalls will remain on the property, including one ADA 00:10:30.634 --> 00:10:37.467
parking stall. The applicant provided elevations so the show
00:10:37.467 --> 00:10:40.634
the architecture of the proposed building. One staging 00:10:40.634 --> 00:10:42.834
area adjacent to an overhead door is proposed on the east
00:10:42.834 --> 00:10:46.133
face of the building addition, and you can see that on the top
00:10:46.133 --> 00:10:50.233
image on the right side, and that line indicates um to the 00:10:50.233 --> 00:10:52.133
left is the existing building and to the right is the
00:10:52.133 --> 00:10:58.300
addition. Um, this staging area requires a variance as the
00:10:58.300 --> 00:10:59.867
proposed staging area is between the building and the
00:10:59.867 --> 00:11:05.767
right of way, which is not allowed in our our code. The 00:11:05.767 --> 00:11:08.467
variants request requires the three-factor test, the first of
00:11:08.467 --> 00:11:12.200
which is reasonableness and asks, is the use practical? Um, 00:11:12.200 --> 00:11:14.800
the proposed staging area for this application is reasonable
00:11:14.800 --> 00:11:18.634
to support the existing business, BCS African Foods.
00:11:18.634 --> 00:11:21.500
The applicant um proposed a screening for the staging area 00:11:21.500 --> 00:11:25.467
on the north and the east sides of the building or of the, yeah,
00:11:25.467 --> 00:11:28.767
of the property, um, to reduce the visibility of that staging
00:11:28.767 --> 00:11:33.000
area from the public rights of way. The second test is 00:11:33.000 --> 00:11:35.734
uniqueness are the uh circumstances on that property
00:11:35.734 --> 00:11:39.900
unique, and yes, so the property is bordered on the
00:11:39.900 --> 00:11:43.266
south by a road, the east by a different road and on the north, 00:11:43.266 --> 00:11:46.367
there isn’t a road, so there are 3 roads fronting the
00:11:46.367 --> 00:11:50.367
property which limit the, um, ability to add a, uh, a staging 00:11:50.367 --> 00:11:57.033
area. The third question is the essential characteristic of the
00:11:57.033 --> 00:12:00.800
neighborhood with this request be um changing the neighborhood 00:12:00.800 --> 00:12:04.033
of the uh characteristics. Um, this application would not
00:12:04.033 --> 00:12:06.166
alter the character of the neighborhood, the proposed
00:12:06.166 --> 00:12:09.767
building addition, both height and architectural materials are,
00:12:09.767 --> 00:12:17.767
um, similar, if not matching the existing building. Staff 00:12:17.767 --> 00:12:20.500
recommend approval of the preliminary plot variants and 00:12:20.500 --> 00:12:23.734
site plan with conditions as listed in the draft resolutions,
00:12:23.734 --> 00:12:29.033
and this concludes staff’s presentation. You Is the
00:12:29.033 --> 00:12:31.133
applicant here tonight? The applicant is available on the 00:12:31.133 --> 00:12:38.767
teams. On teams? Yes. Uh, would you like to speak to this, uh,
00:12:38.767 --> 00:12:44.667
make any comments regarding this application. Uh, hi, my 00:12:44.667 --> 00:12:53.100
name is John. Can everyone hear me? Yes Um So thank you for for 00:12:53.100 --> 00:12:57.100
hearing us today. Um, Business is, uh, the business is growing.
00:12:57.100 --> 00:13:04.300
He needs some additional uh storage, dry storage. um 00:13:04.300 --> 00:13:11.367
property And, um, he has a, he does have a unique site. with 00:13:11.367 --> 00:13:15.767
special challenges. Um, but I believe what we’ve designed and
00:13:15.767 --> 00:13:22.467
planned. Is a is a great solution. So we welcome The 00:13:22.467 --> 00:13:27.567
chance to work with City of Brooklyn Park. Thank you. Thank
00:13:27.567 --> 00:13:40.033
you. Open it up for the public hearing is the, are there 00:13:40.033 --> 00:13:43.100
anyone from the public that would like to comment on this
00:13:43.100 --> 00:13:49.734
application. And none will close the public hearing and
00:13:49.734 --> 00:13:56.000
bring it back to the commission. I do have one question 00:13:56.000 --> 00:14:00.266
regarding the parking, um, I saw that you are going to be 00:14:00.266 --> 00:14:04.567
removing 11 existing parking stall, and I was wondering what
00:14:04.567 --> 00:14:08.934
the uh rationale is there and, and how does that impact uh the
00:14:08.934 --> 00:14:17.500
uh Customer, um, Requirements for, for parking. Can answer 00:14:17.500 --> 00:14:19.533
from staff’s perspective and then pass it to the applicant
00:14:19.533 --> 00:14:24.900
if they would like to address. Oh, I’m sorry. Um, was for 00:14:24.900 --> 00:14:27.367
staff parking only. Because it’s towards the rear of the
00:14:27.367 --> 00:14:34.567
site. Um, the staff is typically 3 to 4, or I should 00:14:34.567 --> 00:14:41.533
say 3 to 5. Um, in any given shift. Um And I was just 00:14:41.533 --> 00:14:46.166
looking at the site plan. Additional, there’s there’s
00:14:46.166 --> 00:14:50.033
parking on the front. which faces Brooklyn Boulevard. And 00:14:50.033 --> 00:14:54.834
then There’s also additional parking that’s not shown on the
00:14:54.834 --> 00:15:00.867
site plan. On the east side. Just directly attached to that 00:15:00.867 --> 00:15:06.233
sidewalk. So there are Parking on the south. parking on the
00:15:06.233 --> 00:15:13.000
east. The parking to the north is being reduced. But that 00:15:13.000 --> 00:15:19.367
parking on the north is for employees only. And again, the,
00:15:19.367 --> 00:15:25.834
the, the project is. retail in nature. And the addition I, uh, 00:15:25.834 --> 00:15:30.734
is dry storage. So we’re not We’re not welcoming any 00:15:30.734 --> 00:15:36.467
additional patrons. Uh, it’s, it’s, and the employee count
00:15:36.467 --> 00:15:40.800
will stay the same. Does that answer your question? Yes, 00:15:40.800 --> 00:15:49.233
thank you. Does anyone have any questions, comments? I have a
00:15:49.233 --> 00:16:01.000
question. Meeror Um, uh, it is on. Can you hear me? Um One of 00:16:01.000 --> 00:16:04.734
the comments is that you’re proposing, oh, I lost my spot.
00:16:04.734 --> 00:16:10.233
Um Proposing screening for the staging area to attempt to 00:16:10.233 --> 00:16:12.834
reduce visibility from the public rights of way. What type
00:16:12.834 --> 00:16:21.200
of screening would you be proposing? Um, thanks for the 00:16:21.200 --> 00:16:25.000
great question. I, I, it was hard to hear, but I think you
00:16:25.000 --> 00:16:28.367
asked what sort of screening we were planning. And that would
00:16:28.367 --> 00:16:44.467
be landscape and plantings. OK. Thank you. So, yeah, there’s a 00:16:44.467 --> 00:16:49.033
quick follow up question on this, uh, so is this gonna be
00:16:49.033 --> 00:16:51.467
an addition? Is it going to be what’s going to put it is going 00:16:51.467 --> 00:16:55.166
to be attached to the existing building, uh, is that a
00:16:55.166 --> 00:16:59.634
separate? construction altogether. Did you did you
00:16:59.634 --> 00:17:03.400
hear it? Yeah, if you could repeat that, that would be 00:17:03.400 --> 00:17:07.867
great. Is the addition going to be attached to the existing
00:17:07.867 --> 00:17:13.100
structure, or is it going to be a separate building. It is, it 00:17:13.100 --> 00:17:18.900
is directly attached, um, er, can you bring up The um If you
00:17:18.900 --> 00:17:24.400
have a floor plan or that east elevation. Yes, let me pull the 00:17:24.400 --> 00:17:32.233
east elevation. up. So the existing is labeled At the the 00:17:32.233 --> 00:17:37.033
the the top drawing, which is the proposed east elevation.
00:17:37.033 --> 00:17:42.166
The left side of that is is the existing store. And the right 00:17:42.166 --> 00:17:46.166
side of that. is the proposed edition. Showing the overhead
00:17:46.166 --> 00:17:54.634
door. OK. And uh secondly, is this uh how, how do you see the 00:17:54.634 --> 00:17:58.000
thing, how do you see this now because that’s a business
00:17:58.000 --> 00:18:03.300
location. How do you, how do you think it was part The 00:18:03.300 --> 00:18:06.367
customers coming into that area because I, I’ve visited a few
00:18:06.367 --> 00:18:15.000
times. And Looking at apologize I couldn’t make that up. I’ll, 00:18:15.000 --> 00:18:18.667
I’ll repeat the question. Can you finish. No, what I was
00:18:18.667 --> 00:18:23.233
trying to ask here is how would this impact Customs that are 00:18:23.233 --> 00:18:27.800
coming in and out of that place because if I got you right,
00:18:27.800 --> 00:18:32.634
you’re gonna be reducing parking stalls. And Even the 00:18:32.634 --> 00:18:36.266
way the existing. Location right now in the parking is not
00:18:36.266 --> 00:18:42.467
out there. Great. Great question. Kara, could you go 00:18:42.467 --> 00:18:52.834
back to the site plan? Is that what you need? The site plans. 00:18:52.834 --> 00:19:00.367
Perfect. So As I mentioned, there is parking. On the south, 00:19:00.367 --> 00:19:05.166
which is shown on the site plan. And there is existing parking.
00:19:05.166 --> 00:19:10.500
Which is for some reason is not indicated on this site plan. 00:19:10.500 --> 00:19:15.867
But it is along the east. Side of the building. Um, and again,
00:19:15.867 --> 00:19:23.367
we’re, we’re not increasing. Uh, any pat patronage. So the 00:19:23.367 --> 00:19:31.300
parking count for to the public. does not need to change. OK, 00:19:31.300 --> 00:19:39.900
thank you. Commissioner, thank you. Uh, this is for, for staff
00:19:39.900 --> 00:19:44.800
maybe uh to um. Respond to there is a letter from, you 00:19:44.800 --> 00:19:51.100
know, the Hennepin County uh looked into. A comment from 00:19:51.100 --> 00:19:57.000
accessibility point of view and And also this is, you know,
00:19:57.000 --> 00:20:00.800
adjacent or close to Metro Blue Line extension project that 00:20:00.800 --> 00:20:07.100
might be coming. So Still, there are pending items uh till
00:20:07.100 --> 00:20:12.000
they get a final play, you know, play. But how is stuff, you 00:20:12.000 --> 00:20:15.133
know, they didn’t give a concluded, you know,
00:20:15.133 --> 00:20:20.000
recommendation rather they have questions. So how did the staff 00:20:20.000 --> 00:20:25.367
look into that and. And uh this uh. You know, that’s really the
00:20:25.367 --> 00:20:29.667
main corridor where the blue line extension comes through
00:20:29.667 --> 00:20:34.934
and if we are really converting a parking lots, that’s gonna 00:20:34.934 --> 00:20:38.767
reduce, you know, the parking availability for The station
00:20:38.767 --> 00:20:43.767
where, you know, people park for future use, so. What’s, uh, 00:20:43.767 --> 00:20:48.767
what’s uh. remark from that point of view. Thank you, Vice
00:20:48.767 --> 00:20:50.900
Chair and planning commissioners. So there’s a 00:20:50.900 --> 00:20:54.667
couple of points, um, so the Hennepin County, uh, Platte
00:20:54.667 --> 00:20:59.467
review did request or um suggest that a sidewalk be
00:20:59.467 --> 00:21:02.100
extended from West Broadway or um Brooklyn Boulevard, which is 00:21:02.100 --> 00:21:05.767
on the south where there is an existing sidewalk up north to
00:21:05.767 --> 00:21:09.233
connect, uh, pedestrians. This is a suggestion and not it’s
00:21:09.233 --> 00:21:12.634
not required. Um, and I believe that the applicant is looking 00:21:12.634 --> 00:21:17.567
into, uh, whether or not they want to pursue that from a blue
00:21:17.567 --> 00:21:20.166
line extension perspective, it is quite close to the station, 00:21:20.166 --> 00:21:24.100
but staff do not have a, uh, the ability to require sidewalk
00:21:24.100 --> 00:21:26.634
to be installed on Kentucky Avenue North because it’s not
00:21:26.634 --> 00:21:30.467
an arterial, that is the, the trigger, the requirement to 00:21:30.467 --> 00:21:34.200
request a sidewalk. Um, I’ll also note that for the blue
00:21:34.200 --> 00:21:36.934
line extension we will not be allowing folks to park at
00:21:36.934 --> 00:21:39.767
private businesses to then walk to the station and use the
00:21:39.767 --> 00:21:50.266
train. With the So the existing parcel, the entire parcel, the 00:21:50.266 --> 00:21:55.634
5000. Square foot that’s owned by same owner. I believe that
00:21:55.634 --> 00:21:59.867
the property is owned by uh BCS African Foods, yes. OK Thank
00:21:59.867 --> 00:22:19.500
you. Thank you. Yeah Hi, I just have a quick question, um. It 00:22:19.500 --> 00:22:24.300
says here that the applicant must provide a landscape plan 00:22:24.300 --> 00:22:28.667
that meets screening requirements outlined in 152.
00:22:28.667 --> 00:22:38.200
1024B. Why wasn’t that? Included, why is that uh Uh, 00:22:38.200 --> 00:22:42.467
why, why, why, why was that excluded, uh, from being 00:22:42.467 --> 00:22:46.367
considered. At the moment. Yes, thank you, commissioners. Um,
00:22:46.367 --> 00:22:50.100
this is a good question. So we had a review by the fire 00:22:50.100 --> 00:22:53.166
department and the fire department required that the
00:22:53.166 --> 00:22:55.767
trash enclosure be moved 5 ft from the building. So that was
00:22:55.767 --> 00:22:59.100
part of the reason that the vegetation, uh, screening was
00:22:59.100 --> 00:23:03.367
not required or not originally indicated, um, just north of 00:23:03.367 --> 00:23:05.734
the staging area, um, and I believe that the applicant can
00:23:05.734 --> 00:23:09.734
correct me if I’m wrong on this, but their landscape, um.
00:23:09.734 --> 00:23:13.000
Designer could not turn around our comments in time for this 00:23:13.000 --> 00:23:15.166
meeting, but they will be required to meet those
00:23:15.166 --> 00:23:18.767
standards before a city council approves. And so there’s a
00:23:18.767 --> 00:23:20.367
couple of different requirements, one of which is 00:23:20.367 --> 00:23:25.166
that they need to provide vegetation with the, um, at
00:23:25.166 --> 00:23:28.033
least 80% opacity at 3 ft height, and then also, um, on
00:23:28.033 --> 00:23:30.500
those two sides on Kentucky Avenue North and Kentucky 00:23:30.500 --> 00:23:43.834
Circle North. Thank you. And. Go ahead, Commissioner Cain. 00:23:43.834 --> 00:23:49.100
All right, thank you. And this is for the, the, the staff, um,
00:23:49.100 --> 00:23:53.467
so with this addition, uh, we are probably adding a little 00:23:53.467 --> 00:24:00.367
more uh 30% add to the existing building. I, uh, I recall and 00:24:00.367 --> 00:24:07.900
um I thought in our uh Guidelines and standards uh
00:24:07.900 --> 00:24:11.634
that um uh uh an applicant would have to meet the, the new 00:24:11.634 --> 00:24:15.300
design criteria for the exterior. Which I, I forget
00:24:15.300 --> 00:24:19.133
what the, the colors and the, the brick and things of that
00:24:19.133 --> 00:24:24.533
nature, uh. Is my question is, is, uh, uh, does this not apply? 00:24:24.533 --> 00:24:33.634
Thank you, um, Curhan, um, this, so The architectural standards 00:24:33.634 --> 00:24:38.767
do have class 1 and class 2 materials, would prefer that
00:24:38.767 --> 00:24:41.200
the applicant have matching materials to the existing 00:24:41.200 --> 00:24:44.734
building, as opposed to providing materials that don’t
00:24:44.734 --> 00:24:47.533
match the existing building to keep, to to to talk about the
00:24:47.533 --> 00:24:50.734
variants to keep in context with the existing, um, 00:24:50.734 --> 00:24:59.667
neighborhood. OK, great. And my second question and uh this is
00:24:59.667 --> 00:25:06.000
just uh um Uh, respectfully, just, just my own the uh 00:25:06.000 --> 00:25:11.100
concern here, uh, about the, uh, uh, current development related 00:25:11.100 --> 00:25:16.667
fees outline in the section 2.0. Uh, specifically the, you know,
00:25:16.667 --> 00:25:21.467
73,000, uh, you know, approximate development bond of 00:25:21.467 --> 00:25:27.634
the 3800 cash bond,,,, 2300 escrow and $8000 and park
00:25:27.634 --> 00:25:33.767
dedication fees. Well, I, uh, understand the, the intent 00:25:33.767 --> 00:25:37.166
behind those requirements to protect, you know, the city and
00:25:37.166 --> 00:25:44.500
ensure quality development. Seems like, uh, we should 00:25:44.500 --> 00:25:46.767
reexamine the unintended the consequences for a small
00:25:46.767 --> 00:25:52.000
business owners. Particularly those that are looking to 00:25:52.000 --> 00:25:55.200
reinvest and uh their existing properties, right? So here’s a,
00:25:55.200 --> 00:26:00.500
here’s a small business owner that uh is want to reinvest in 00:26:00.500 --> 00:26:04.800
the city and uh, you know, we, we are putting, you know,
00:26:04.800 --> 00:26:07.634
additional costs on the cost burden that, you know, I don’t
00:26:07.634 --> 00:26:12.834
know if it’s, it’s, you know, necessary, so if we want to be 00:26:12.834 --> 00:26:16.500
a city where small business can thrive, you know, I think we
00:26:16.500 --> 00:26:20.767
need to either lower the threshold for participation. or 00:26:20.767 --> 00:26:23.467
not just through incentives, but rethinking how our fee
00:26:23.467 --> 00:26:28.400
structure, uh, Uh, reflects projects, uh, at scale, things
00:26:28.400 --> 00:26:32.634
of that nature. So, I just proposed that uh we direct 00:26:32.634 --> 00:26:37.300
staff to review the bonding and dedication fee structure to
00:26:37.300 --> 00:26:41.634
assess whether exemptions or Reductions or scale models 00:26:41.634 --> 00:26:44.834
could better support small business reinvestment without
00:26:44.834 --> 00:26:51.400
compromising the city financial, uh, safeguards, so. Um I don’t 00:26:51.400 --> 00:26:55.166
know if uh, you know, if we could uh have someone go review
00:26:55.166 --> 00:26:59.233
that. But to me, it’s just a burden that we want small
00:26:59.233 --> 00:27:03.467
businesses to thrive in Brooklyn Park and to, to 00:27:03.467 --> 00:27:07.300
continue to uh invest in Brooklyn Park, uh, why the
00:27:07.300 --> 00:27:12.033
additional burden on them, so. Thank you, Chair Keen, um, uh, 00:27:12.033 --> 00:27:15.367
First of all, I think staff agrees. Um, we were just
00:27:15.367 --> 00:27:19.033
talking about that earlier today. Um, so I appreciate that
00:27:19.033 --> 00:27:21.634
comment and we will take a look internally and get back to the 00:27:21.634 --> 00:27:23.867
planning commission on that topic. I appreciate it. Thank
00:27:23.867 --> 00:27:35.667
you. Any other questions, comments? Um, I just have one 00:27:35.667 --> 00:27:40.734
quick question, um. I see here we are told to consider 3 00:27:40.734 --> 00:27:47.834
motions. Uh, you know, in order to approve this, uh. Project Uh,
00:27:47.834 --> 00:27:51.767
why, why 3 motions. Why couldn’t that have been 00:27:51.767 --> 00:27:54.734
consolidated into one motion. Um, you know, you know, just
00:27:54.734 --> 00:28:00.166
piggybacking on uh. You know, you know, uh. Question, 00:28:00.166 --> 00:28:03.900
concerns, you know, because it looks it looks like um the uh
00:28:03.900 --> 00:28:08.133
applicant has to jump through 3 hoops. To to to get this done,
00:28:08.133 --> 00:28:11.033
um, you know, again, you know, like I said, I’m following up 00:28:11.033 --> 00:28:15.634
why. These 3 hoops. Why don’t you, you know, simplify it so,
00:28:15.634 --> 00:28:19.834
so that the applicants. could just come in here and and and
00:28:19.834 --> 00:28:24.200
and get it done by one simple motion and you know. Thank you, 00:28:24.200 --> 00:28:27.300
Vice Chair and members of the planning commission, um, I
00:28:27.300 --> 00:28:30.100
appreciate that comment, uh, these are 3 separate 00:28:30.100 --> 00:28:33.734
applications with their own requirements and, um, you as
00:28:33.734 --> 00:28:36.000
the planning commission could approve one, but not others,
00:28:36.000 --> 00:28:39.000
and so they have to be separate resolutions that are also taken
00:28:39.000 --> 00:28:52.467
to city council. Thank you. Any other questions and comments? 00:28:52.467 --> 00:29:01.000
Right. So we will, uh, I will, um, entertain uh emotion. A 00:29:01.000 --> 00:29:06.300
mixed motion. Motion to recommend the approval of
00:29:06.300 --> 00:29:10.000
preliminary platform for BCS development at 7916 Brooklyn 00:29:10.000 --> 00:29:18.166
Boulevard. I OK. Seconded by Commissioner Kain. So we’ll
00:29:18.166 --> 00:29:26.567
move to a roll call vote now. Thank you. E. I Commissioner 00:29:26.567 --> 00:29:39.367
Right Hi. Commissioner. Commissionerdomo. I 00:29:39.367 --> 00:29:44.734
Commissioner Guy. I Commissioner Turner. You have, 00:29:44.734 --> 00:29:53.300
uh. Unanimously approved. Right? Motion passes. And I get a 00:29:53.300 --> 00:30:01.367
motion for the 2nd item. I can make a note. Motion to adopt 00:30:01.367 --> 00:30:04.000
findings of fact for the approval of a variance request
00:30:04.000 --> 00:30:07.200
for a staging area visible from Brooklyn Boulevard, Kentucky
00:30:07.200 --> 00:30:12.500
Avenue North, and Kentucky Circle. North at 7619 Brooklyn 00:30:12.500 --> 00:30:16.767
Boulevard, a deviation where a staging area is located between
00:30:16.767 --> 00:30:19.567
the principal building and the public rights of way. Subject
00:30:19.567 --> 00:30:26.467
to the conditions in the draft resolution. Sucking it, my 00:30:26.467 --> 00:30:36.500
commissioner came by. So I’ll move to a roll call. Thank you. 00:30:36.500 --> 00:30:42.467
Chair Kevin. I. Commissioner Wacko, I. Commissioner Barr. 00:30:42.467 --> 00:30:46.734
commissioner further Commissioner around
00:30:46.734 --> 00:30:53.033
Commissionerdo. Commissioner Guy by. Commissioner Turner. 00:30:53.033 --> 00:30:57.467
Unanimously approved. OK, motion passes. We’ll move to
00:30:57.467 --> 00:31:03.367
the 3rd item, who wants to make a motion? I’ll go ahead and do 00:31:03.367 --> 00:31:10.300
that. Motion to recommend approval of a site plan review 00:31:10.300 --> 00:31:16.100
for the construction of a building addition at. 7916
00:31:16.100 --> 00:31:18.300
Brooklyn Boulevard subject to conditions contained in the
00:31:18.300 --> 00:31:23.634
draft resolution. A second. All right, seconded by Commissioner 00:31:23.634 --> 00:31:31.300
Waco. We’ll move to a roll call. Chair Kevin I commissioner Waco, 00:31:31.300 --> 00:31:37.233
I. Commissioner Barr. Commissioner Fraser.
00:31:37.233 --> 00:31:44.400
Commissioner. out down. missionary got by. All right. 00:31:44.400 --> 00:31:48.266
Commissioner Turner. Unanimously approved. All right,
00:31:48.266 --> 00:31:53.734
thank you. The motion passes. When will this be presented at 00:31:53.734 --> 00:31:56.367
City council. Uh, thank you, members of the planning
00:31:56.367 --> 00:32:00.367
commission. This will go to city council on June 23rd. All 00:32:00.367 --> 00:32:04.634
right, June 23rd, we’ll be at city council. Thank you.
00:32:04.634 --> 00:32:21.800
Congratulations. All right, we’ll move to item 5.2. Good 00:32:21.800 --> 00:32:24.133
evening, acting Chair Frasier, members of the planning
00:32:24.133 --> 00:32:26.800
commission, uh, for the record, Matt Hayes Regan, associate
00:32:26.800 --> 00:32:33.634
planner. Uh, presenting Bap’s Temple, uh, Debile 25,110. I’m 00:32:33.634 --> 00:32:39.266
coming in for two conditional use permit applications. Um, so
00:32:39.266 --> 00:32:44.133
this is just a general location map, um Baps Temple has 00:32:44.133 --> 00:32:49.500
submitted CUP applications to use 8700 Wyoming Avenue North
00:32:49.500 --> 00:32:53.767
as a religious institution and for the operation of a rectory 00:32:53.767 --> 00:32:57.667
as an exclusive accessory use to that religious institution.
00:32:57.667 --> 00:33:02.834
Um, here you can see according to the general location map on 00:33:02.834 --> 00:33:06.000
at the property location is just northwest of eighty-fifth
00:33:06.000 --> 00:33:16.233
and West Broadway. So 8700 Wyoming Avenue North is one 00:33:16.233 --> 00:33:20.000
parcel located in the Enterprise Park edition. Uh, 00:33:20.000 --> 00:33:24.934
Enterprise Park was established in October 1991. A CUP allowing
00:33:24.934 --> 00:33:28.000
the operation of a religious institution has not been
00:33:28.000 --> 00:33:35.367
previously granted for this property. This map shows the 00:33:35.367 --> 00:33:40.166
zoning districts of adjacent properties, uh, in relation to 00:33:40.166 --> 00:33:42.567
uh 8700 Wyoming Avenue North, uh, as you can see from this
00:33:42.567 --> 00:33:47.634
map, uh, zoning designations of the adjacent properties include
00:33:47.634 --> 00:33:52.467
multiple family R4 district to the east and business park to 00:33:52.467 --> 00:34:00.400
the southwest and north. Now this is an overview of the 00:34:00.400 --> 00:34:03.567
city’s criteria for applicants, uh, when submitting CUP
00:34:03.567 --> 00:34:06.400
applications. Um, as you can see in the attachments that
00:34:06.400 --> 00:34:10.100
were included in the staff report, uh, Babs Temple has 00:34:10.100 --> 00:34:16.500
satisfied these requirements. So included in the applica uh
00:34:16.500 --> 00:34:22.100
applicants submittal was, um. Two different uh architectural 00:34:22.100 --> 00:34:27.166
analysis is done. Um, so Bab’s Temple is proposing to use uh
00:34:27.166 --> 00:34:31.900
existing utilities on, on the site conditions on this 00:34:31.900 --> 00:34:34.033
property because no alterations are being proposed to the
00:34:34.033 --> 00:34:37.934
exterior of the property. Um, and I Architectural analysis
00:34:37.934 --> 00:34:41.567
was the scope of the plan set for the CUP application. This 00:34:41.567 --> 00:34:45.400
is versus a formal site plan. Um, the exterior renderings
00:34:45.400 --> 00:34:50.634
include a site summary, which include a site area of 8.71 00:34:50.634 --> 00:34:54.500
acres, 232 parking spaces and a screen waste enclosure. I’m
00:34:54.500 --> 00:34:58.734
just a note about the parking spaces is Steph has reviewed on
00:34:58.734 --> 00:35:02.467
the parking spaces against the number counts um that were 00:35:02.467 --> 00:35:05.100
included in the staff reports and provided by the applicant,
00:35:05.100 --> 00:35:08.767
and there’s more than sufficient parking demands, um,
00:35:08.767 --> 00:35:12.367
at peak times, um. For the applicants in their proposed 00:35:12.367 --> 00:35:20.500
use. Uh, this is an interior rendering, um, which also 00:35:20.500 --> 00:35:23.634
includes a code summary, included, uh, in the
00:35:23.634 --> 00:35:27.033
anticipated areas, um, is, but they’re proposing as a, as a
00:35:27.033 --> 00:35:31.166
rectory, uh, staff from the city’s building fire and 00:35:31.166 --> 00:35:33.834
engineering departments have approved the rendering
00:35:33.834 --> 00:35:37.033
submitted for this specific application with the
00:35:37.033 --> 00:35:39.734
understanding that additional review will take place when a
00:35:39.734 --> 00:35:45.100
building permit application is submitted for a staff review. 00:35:45.100 --> 00:35:48.834
So again, just an overview, I know commissioners, you’ve seen
00:35:48.834 --> 00:35:52.033
this before, uh, but religious institutions are conditional 00:35:52.033 --> 00:35:57.467
use in the business park district, uh, pursuant to
00:35:57.467 --> 00:36:01.200
Section 152305 of the zoning code, uh, the listed factors 00:36:01.200 --> 00:36:04.467
are used when making a determination on a conditional
00:36:04.467 --> 00:36:07.500
use permit application. Planning staff have reviewed
00:36:07.500 --> 00:36:10.734
the plan against these requirements and uh staff has 00:36:10.734 --> 00:36:17.100
determined that the requirements have been met.
00:36:17.100 --> 00:36:22.567
slide does give and um. An application analysis, uh, 00:36:22.567 --> 00:36:26.367
against the CUP application. So you do see how a religious
00:36:26.367 --> 00:36:29.000
institution is defined, uh, in the zoning code. You also see
00:36:29.000 --> 00:36:36.400
table, and I’ll just move this up, um, table 152.609.1. Uh 00:36:36.400 --> 00:36:39.567
this outlines the principal uses in non-residential
00:36:39.567 --> 00:36:43.400
districts. Uh, the business park district is located in a 00:36:43.400 --> 00:36:46.033
non-residential district. You can see, uh, just from my
00:36:46.033 --> 00:36:48.800
highlights there, where religious institution is listed
00:36:48.800 --> 00:36:52.734
as a condition. use, as well as uh directory is listed as a 00:36:52.734 --> 00:36:57.233
conditional use. And then just a caveat about rectories is
00:36:57.233 --> 00:37:02.567
that they are allowed as an exclu exclusive accessory use 00:37:02.567 --> 00:37:05.500
to religious institutions, um, so when you’re reviewing your
00:37:05.500 --> 00:37:08.900
staff report, you saw that the CUP was drafted and, and the
00:37:08.900 --> 00:37:12.100
CUPs were drafted in a way that it would, um, first be granting 00:37:12.100 --> 00:37:15.367
one for the religious institution, and then the
00:37:15.367 --> 00:37:26.000
rectory contingent to that. So this first slide um is the 00:37:26.000 --> 00:37:32.367
conditions of approval for the religious institution? And then 00:37:32.367 --> 00:37:35.567
the second slide, um, again is the conditions of approval for
00:37:35.567 --> 00:37:40.467
a rectory. Um, again, this, uh, CUP and these conditions here 00:37:40.467 --> 00:37:43.734
on the slide are subject to the requirements and the approval
00:37:43.734 --> 00:37:52.100
of the previous uh CUP that was listed on the last slide. With 00:37:52.100 --> 00:37:54.834
that staff’s recommendation, uh, is approval of both conditional
00:37:54.834 --> 00:37:58.100
use permits, one for the operation of a religious
00:37:58.100 --> 00:38:01.767
institution, and then the second, um, for an operation of 00:38:01.767 --> 00:38:06.634
of a rectory inside of that religious institution. With
00:38:06.634 --> 00:38:09.367
that, that, uh, concludes staff’s report, and I’ll stand
00:38:09.367 --> 00:38:13.000
for any questions. Thank you. Do we have the applicant here 00:38:13.000 --> 00:38:17.767
tonight? I would like to speak um we do have members, um, yep,
00:38:17.767 --> 00:38:19.634
from the applicant team and then also just when the public
00:38:19.634 --> 00:38:23.033
hearing is open, I do believe there may be somebody virtually 00:38:23.033 --> 00:38:33.867
uh on teams as well. Uh, good evening, everyone. Uh my name 00:38:33.867 --> 00:38:38.166
is Asit Wahani. And I’m the president of the local chapter
00:38:38.166 --> 00:38:41.634
that we have in Brooklyn Center. Uh, so I just wanted to 00:38:41.634 --> 00:38:46.800
introduce, uh, BAPS here to the public and to the the staff
00:38:46.800 --> 00:38:52.667
here, uh, BFPS uh Swamina and Sunsta is a global uh social, 00:38:52.667 --> 00:38:56.834
spiritual organization. Uh, that kind of focuses on
00:38:56.834 --> 00:39:02.200
individual growth and fosters the ideals of faith, unity, and 00:39:02.200 --> 00:39:06.467
selfless service kind of focus areas are academics and career
00:39:06.467 --> 00:39:11.166
personal skills and talents, cultural curiosity and affinity, 00:39:11.166 --> 00:39:14.500
a volunteer service, uh, morality and spirituality. Uh,
00:39:14.500 --> 00:39:17.533
we’ve been in Brooklyn Center for about more than 22 years.
00:39:17.533 --> 00:39:21.533
Uh, we have a conditional use permit there as well. It’s an 00:39:21.533 --> 00:39:25.033
industrial zone, and there too we conduct our activities on On
00:39:25.033 --> 00:39:28.367
a weekly basis that includes religious services, uh,
00:39:28.367 --> 00:39:31.467
cultural classes, cultural celebrations, study groups, and 00:39:31.467 --> 00:39:35.166
even we do a lot of community work too, like we have been
00:39:35.166 --> 00:39:38.934
doing walkathons for the past 25 years that have benefited a
00:39:38.934 --> 00:39:43.233
lot of organizations like the American Cancer Society, the 00:39:43.233 --> 00:39:47.000
Susan Komen Foundation, uh, Nature Conservancy, and even
00:39:47.000 --> 00:39:50.734
the local fire department. We also do annual blood drives, 00:39:50.734 --> 00:39:53.634
annual food and clothes donation drives, health fairs,
00:39:53.634 --> 00:39:59.734
health. s etc. Uh, while we have good memories, uh, of, uh,
00:39:59.734 --> 00:40:02.533
uh, living in Brooklyn Center. We love the neighborhood, but 00:40:02.533 --> 00:40:06.166
we’ve outgrown and we need to expand. So we’re looking for a
00:40:06.166 --> 00:40:09.934
bigger facility, um, that meets our needs and the city of
00:40:09.934 --> 00:40:12.800
Brooklyn Center has been very kind and we worked very closely 00:40:12.800 --> 00:40:16.300
with them and they are giving us a letter of recommendation.
00:40:16.300 --> 00:40:19.567
Uh, so we looked at a lot of places around the Twin Cities,
00:40:19.567 --> 00:40:23.367
because we have membership all over the Twin Cities, uh, uh, 00:40:23.367 --> 00:40:25.900
and after a great deal of research, we found this
00:40:25.900 --> 00:40:30.233
building, the said property on 8700 Wyoming, which meets all 00:40:30.233 --> 00:40:35.000
our needs in terms of the size, uh, the height, uh, the parking,
00:40:35.000 --> 00:40:39.166
the neighborhood is great, and uh it’s easy access from the
00:40:39.166 --> 00:40:43.133
highways, so, uh, and meets our current and future needs, so 00:40:43.133 --> 00:40:45.233
we’re really excited and we look forward to being a part of
00:40:45.233 --> 00:41:00.767
this community. So thank you very much. Thank you. We’re 00:41:00.767 --> 00:41:07.133
gonna open it up for. public hearing first. All right, so
00:41:07.133 --> 00:41:10.767
we’ll open it up now for the public hearing, um, do we have 00:41:10.767 --> 00:41:16.867
anyone, um, Present or online that would like to speak to
00:41:16.867 --> 00:41:27.300
this. Just needs to be husband. Hi, my name is Mark Dufney. I 00:41:27.300 --> 00:41:30.567
own the building directly across the street from the 00:41:30.567 --> 00:41:38.000
proposed site. Um, question I have is how, how busy. Is the I
00:41:38.000 --> 00:41:41.934
mean, yeah, being that you’re on this uh call now, you could 00:41:41.934 --> 00:41:45.166
probably speak to it as far as like how many people come in
00:41:45.166 --> 00:41:48.900
and out. I mean, what, what, what days is, uh, you know,
00:41:48.900 --> 00:41:56.734
does all that, uh, happen. I just want to confirm if you 00:41:56.734 --> 00:42:01.000
want me to answer that question specifically or wait till all. 00:42:01.000 --> 00:42:10.100
Questions have been answered. Answer that one. Do we have 00:42:10.100 --> 00:42:22.934
anyone else that would like to comment. to none will. closed 00:42:22.934 --> 00:42:28.166
the public hearing. And you can address the question. Excellent.
00:42:28.166 --> 00:42:33.500
Um, thank you, uh, again, acting Chair Frazier. Um, so we 00:42:33.500 --> 00:42:36.734
did get number counts, um, and we can certainly provide those,
00:42:36.734 --> 00:42:41.567
um, if somebody did not receive those, um, but according to the 00:42:41.567 --> 00:42:45.400
applicant, um, Babs Temple anticipates 10 to 20 people, uh,
00:42:45.400 --> 00:42:48.734
for their weekday morning and evening services, and then
00:42:48.734 --> 00:42:52.767
Sunday services, uh, schedule anticipates 200 to 300 people 00:42:52.767 --> 00:42:57.367
between 10 a.m. to 8 p.m. um, they do anticipate traffic
00:42:57.367 --> 00:43:01.300
during these hours. to be minimal, um, as most members 00:43:01.300 --> 00:43:05.100
travel to and from, uh, the temple as families typically
00:43:05.100 --> 00:43:09.467
with 3 to 4 per vehicle. I can also just say that the city’s
00:43:09.467 --> 00:43:11.467
transportation engineer to review these number counts that 00:43:11.467 --> 00:43:16.233
did not have any concerns based off of the figures provided.
00:43:16.233 --> 00:43:23.467
Thank you. All right, we’ll bring it back to the commission. 00:43:23.467 --> 00:43:30.867
Uh, any questions, comments? I have a question. Commissioner 00:43:30.867 --> 00:43:40.233
Cain. Um And review of the interior uh plan, um, just 00:43:40.233 --> 00:43:43.634
curious with uh uh rectory. I, yeah, maybe it’s designed
00:43:43.634 --> 00:43:48.300
within the plan, but I thought, uh, with the rectory that uh
00:43:48.300 --> 00:43:52.634
you needed a, uh, you know, private bedroom, a full 00:43:52.634 --> 00:43:58.400
bathroom and shower, kitchen access, um, Um, kind of a
00:43:58.400 --> 00:44:04.767
living and, you know, seating area and then I thought the um 00:44:04.767 --> 00:44:08.100
The, uh, heating and ventilation has got to be kind
00:44:08.100 --> 00:44:12.367
of separate from, uh, uh, uh, from the overall building 00:44:12.367 --> 00:44:18.100
perspective. Is that true and do they have plans to have a
00:44:18.100 --> 00:44:22.033
separate, if you will, if you will, living quarters within um 00:44:22.033 --> 00:44:26.166
the space. Acting Char Frazier, uh, members of the planning
00:44:26.166 --> 00:44:29.867
commission, we do have a member from the architecture team if,
00:44:29.867 --> 00:44:32.567
are you willing to speak to that. I, I can’t say from the 00:44:32.567 --> 00:44:35.834
building side that this will come in for a building permit
00:44:35.834 --> 00:44:38.367
review, um, and what is a requirement as one of the
00:44:38.367 --> 00:44:42.300
conditions is a change of occupancy, um, as part of this 00:44:42.300 --> 00:44:47.000
application, um, but I, I will defer to the architectural team
00:44:47.000 --> 00:45:03.500
that we have here. like Uh, Oh, I’m I’m. Sorry. Hello, I’m Dan 00:45:03.500 --> 00:45:05.500
Pelenan from Tushi Montgomery Architects out of Ridgefield,
00:45:05.500 --> 00:45:10.634
Minnesota. Uh, working with Bab Simple and, uh, what we have 00:45:10.634 --> 00:45:14.734
right now, um, What we’re really trying to do is get the
00:45:14.734 --> 00:45:17.867
approval of the use on the building. Uh, if the approval
00:45:17.867 --> 00:45:22.266
of the use was not, uh, granted. They would not want to spend 00:45:22.266 --> 00:45:26.400
all the money uh for uh architectural plans and
00:45:26.400 --> 00:45:30.200
engineering plans and, and things like that. So, The plan 00:45:30.200 --> 00:45:35.000
that you see right now on, in your packet, uh, the floor plan
00:45:35.000 --> 00:45:38.266
is the existing building. Uh, we will be going through full
00:45:38.266 --> 00:45:43.133
architectural, uh, Drawings, uh, and getting their program, 00:45:43.133 --> 00:45:47.834
getting the, the rectory, uh, done, all the exiting, uh, and
00:45:47.834 --> 00:45:51.734
everything else. The exterior of the building, uh, at, at, at 00:45:51.734 --> 00:45:56.900
this time just is gonna remain the same. So the interior plan
00:45:56.900 --> 00:46:03.934
will be, will come as through the building department. makes 00:46:03.934 --> 00:46:17.166
sense. I like that strategy. Any other, any others. No. 00:46:17.166 --> 00:46:28.367
mission at Waco Thank you. Uh, one. Owned by This gonna be 00:46:28.367 --> 00:46:34.233
under lease or is it gonna be owned by the. example. Acting 00:46:34.233 --> 00:46:36.900
Char Frazier, members of the planning commission. It is the
00:46:36.900 --> 00:46:43.900
applicant’s intent to purchase the property. to purchases. OK. 00:46:43.900 --> 00:46:49.233
Is already acquired or is it’s in the process just. You know
00:46:49.233 --> 00:47:04.734
it is in the process of being acquired. Oh, thank you. 00:47:04.734 --> 00:47:14.000
question. OK Um, businesses in this building or is this empty 00:47:14.000 --> 00:47:18.767
and you’re taking the whole thing like. Um, I didn’t share
00:47:18.767 --> 00:47:22.567
Fraser, um, members of the planning commission, um, they 00:47:22.567 --> 00:47:33.500
would have exclusive occupancy. For this use. commissioner. 00:47:33.500 --> 00:47:37.166
Yeah, I know you said a line there, but uh I just wanted to
00:47:37.166 --> 00:47:42.667
know, um. The, the, the building look the the location 00:47:42.667 --> 00:47:46.367
of the building. How is this surrounded the neighborhood and
00:47:46.367 --> 00:47:51.166
the same instead of business. The entire areas of business 00:47:51.166 --> 00:47:54.100
location or there’s residential as well. It does, um, I can
00:47:54.100 --> 00:48:06.767
pull up. This is the best illustration. Um, so the, um, 00:48:06.767 --> 00:48:10.900
items you see highlighted in pink, those are businesses, um, 00:48:10.900 --> 00:48:13.767
usually Monday through Friday, um, for those that are adjacent
00:48:13.767 --> 00:48:17.834
to the the um. Property we’re discussing, and then you do
00:48:17.834 --> 00:48:21.500
have a town home community in that residential for that 00:48:21.500 --> 00:48:24.400
multiple family district, um, behind them. Or what would be
00:48:24.400 --> 00:48:31.266
to the east. OK, so, um, How is access to that location? Have 00:48:31.266 --> 00:48:36.567
you guys look at it in and out of the, the Location because if
00:48:36.567 --> 00:48:41.634
if I see this, I mean, I I I You know, it’s religious areas 00:48:41.634 --> 00:48:45.233
so they were going to be in and out. Several times a day,
00:48:45.233 --> 00:48:51.867
pretty much. So how is the The traffic going in and out of 00:48:51.867 --> 00:48:56.467
that. Location acting Frazier, members of the planning
00:48:56.467 --> 00:49:00.634
commission. So, um, the in and out of um access to the 00:49:00.634 --> 00:49:03.934
property is limited to Wyoming Avenue. So if you go to that
00:49:03.934 --> 00:49:08.033
usage chart, it is in that business park district, um, and
00:49:08.033 --> 00:49:12.834
there is, um. You can see exits and entrances north and south 00:49:12.834 --> 00:49:18.367
of the property, that would be utilized. OK, thank you for
00:49:18.367 --> 00:49:26.834
your answers. Hold Um, I This question might be more. To the 00:49:26.834 --> 00:49:31.634
staff than uh. You know, the people, um, He, uh, look at the, 00:49:31.634 --> 00:49:36.834
uh, Uh, alternatives to consider, um, one, the first
00:49:36.834 --> 00:49:41.367
one is uh recommend approval. Of the COPs with modifications, 00:49:41.367 --> 00:49:47.100
uh, but from What we are hearing there hasn’t been any
00:49:47.100 --> 00:49:49.867
modifications considered yet because they are waiting for
00:49:49.867 --> 00:49:52.900
approval before they submit anything for modifications, so 00:49:52.900 --> 00:49:56.734
can can you kind of uh Offer more um explanations on that.
00:49:56.734 --> 00:50:01.467
What, what we are supposed to be considering. Acting to 00:50:01.467 --> 00:50:03.900
Frazier, um, members of the planning commission. My
00:50:03.900 --> 00:50:06.300
understanding is the language that you’re referring to as the
00:50:06.300 --> 00:50:08.100
alternatives in the staff report, is that right? That’s
00:50:08.100 --> 00:50:13.734
correct, yes. OK. Um, that would be is if you have any um 00:50:13.734 --> 00:50:17.400
Uh, any additional or maybe removal of these conditions
00:50:17.400 --> 00:50:23.400
that are listed for either of the CUPs, um, that, um. you 00:50:23.400 --> 00:50:28.734
think would be necessary. OK, um, yeah, I understand that
00:50:28.734 --> 00:50:33.100
because, um, you know, uh, you know, you know what the CUPSR 00:50:33.100 --> 00:50:37.200
now is very kind of bland in my, you know, estimate, you know,
00:50:37.200 --> 00:50:39.934
they are waiting for something to happen before something else
00:50:39.934 --> 00:50:43.634
happens. So, uh, it’s difficult to offer any kind of 00:50:43.634 --> 00:50:47.033
modifications without knowing what to modify. So, um, so
00:50:47.033 --> 00:50:50.667
that’s where, um. I’m having some, uh, you know, I had some, 00:50:50.667 --> 00:50:56.667
you know, you know, um. Our concerns, but confusion with
00:50:56.667 --> 00:51:01.734
the language. So, so, um So right now what we are 00:51:01.734 --> 00:51:07.100
considering is just To consider if they can purchase the build
00:51:07.100 --> 00:51:09.767
or if they’ll be able to do anything after they purchased
00:51:09.767 --> 00:51:13.500
the building. Is that correct? That is correct. Um, so what 00:51:13.500 --> 00:51:17.533
you would be approving if you do approve are the conditions
00:51:17.533 --> 00:51:21.000
listed one for this religious institution and then second for 00:51:21.000 --> 00:51:24.800
the rectory, so two different CUPs, so it would be these
00:51:24.800 --> 00:51:27.900
exact conditions, um, that these conditions have been
00:51:27.900 --> 00:51:32.166
vetted by staff. They do, just to use an example, um, the 00:51:32.166 --> 00:51:34.834
architect had mentioned about needing to come. men for
00:51:34.834 --> 00:51:38.100
building permit review, that is covered under number one. So
00:51:38.100 --> 00:51:42.467
the applicant will need to meet um the building code 00:51:42.467 --> 00:51:45.767
requirements, um, when they ultimately do submit a building
00:51:45.767 --> 00:51:49.400
permit application. So they will need to meet all those
00:51:49.400 --> 00:51:54.100
requirements. Um, we do use, I, we do use general language, um, 00:51:54.100 --> 00:51:58.367
a lot of times for these conditions. You are correct. OK,
00:51:58.367 --> 00:52:01.567
that is after they have purchased the building which 00:52:01.567 --> 00:52:05.367
they haven’t done it yet. I will refer, I guess to the
00:52:05.367 --> 00:52:09.000
planning director. My understanding is this is not a
00:52:09.000 --> 00:52:14.500
contingent to the sale. A chairreer members of the 00:52:14.500 --> 00:52:18.100
commission, you know, certainly the, the, the step of applying
00:52:18.100 --> 00:52:21.634
for a building permit, you know, that, that can’t happen until 00:52:21.634 --> 00:52:26.667
the, the sale occurs, um, uh, on the property and, and, um,
00:52:26.667 --> 00:52:29.000
so, you know, that, that’s a later step. I think what what
00:52:29.000 --> 00:52:32.634
can be what’s kind of a head scratcher here is, is that, you 00:52:32.634 --> 00:52:35.734
know, often as a planning commission, we’re accustomed to,
00:52:35.734 --> 00:52:41.133
you know, looking at at physical changes to a property, 00:52:41.133 --> 00:52:45.533
um, and, you know, offering. asking questions and offering
00:52:45.533 --> 00:52:48.567
comments on physical changes, you know, often in the form of
00:52:48.567 --> 00:52:52.100
a site plan review in this particular case, there aren’t 00:52:52.100 --> 00:52:56.634
any changes to the site that are proposed, um, and nor are
00:52:56.634 --> 00:53:00.867
there any changes necessary to accommodate this proposed use, 00:53:00.867 --> 00:53:03.567
um, and we, you know, as the commission, we’re not usually
00:53:03.567 --> 00:53:07.367
getting into the weeds of the interior floor plan, cause
00:53:07.367 --> 00:53:09.367
that’s not usually necessary, you know, for the type of
00:53:09.367 --> 00:53:11.634
business that’s before the commission, um, in terms of a 00:53:11.634 --> 00:53:16.300
conditional use per. our site plan review and so on. So, um,
00:53:16.300 --> 00:53:19.767
That, that, that I, I can see, I can understand the question
00:53:19.767 --> 00:53:23.266
because there isn’t a lot to get your hands on on this one. 00:53:23.266 --> 00:53:26.467
It’s just, you know, can they meet the conditions for, for
00:53:26.467 --> 00:53:29.166
the use for the, for the religious institution and for
00:53:29.166 --> 00:53:33.000
the accessories of the rectory, it’s, it’s, um, But that’s all, 00:53:33.000 --> 00:53:39.834
that’s all that’s on the table. If the sale falls through and
00:53:39.834 --> 00:53:43.000
we pass this, could somebody else come in and then 00:53:43.000 --> 00:53:47.367
automatically go do that. Um, at the chair Frazier, uh,
00:53:47.367 --> 00:53:50.467
members of the planning mission, uh, CUPs do run with the 00:53:50.467 --> 00:53:54.834
property, so if um the CP was granted tonight, um, it would
00:53:54.834 --> 00:53:59.567
run with the property. Now, if it, so your your um example was
00:53:59.567 --> 00:54:03.200
that they would come in and use it as a religious institution, 00:54:03.200 --> 00:54:06.500
so theoretically then yes, they could use it with the, the CUP
00:54:06.500 --> 00:54:11.867
as granted. Thank you. And you know, they could also any 00:54:11.867 --> 00:54:15.033
future owner also has all the other rights conveyed to the
00:54:15.033 --> 00:54:17.133
property through this zoning district. So, you know, it’s
00:54:17.133 --> 00:54:19.634
not to say this has to be a religious institution, yeah,
00:54:19.634 --> 00:54:34.767
right. Any other questions, comments? Yes You, you on one 00:54:34.767 --> 00:54:40.734
side on the on the at least on the. North side, right? So It 00:54:40.734 --> 00:54:46.634
is a is a parking fence or? Can you please say that again? The
00:54:46.634 --> 00:54:54.500
parking fencer. Oh, I see, um. I don’t know if there’s a fence, 00:54:54.500 --> 00:54:57.634
I guess along that I’m unaware of that being the case of
00:54:57.634 --> 00:55:00.634
whether there is a fence, um, running the length of that 00:55:00.634 --> 00:55:06.166
property. There’s um. There’s screening on the, on the
00:55:06.166 --> 00:55:11.100
western on the eastern portion of the property between the The 00:55:11.100 --> 00:55:14.367
between the parking lot and the town homes. There is, there is
00:55:14.367 --> 00:55:19.100
a, there is a landscape landscaping landscaping,
00:55:19.100 --> 00:55:23.834
landscaping and a, and a fence, OK. Yes, there is an actual 00:55:23.834 --> 00:55:29.734
fence. There is, OK, OK, good. Um, just to maybe for, for the,
00:55:29.734 --> 00:55:34.634
the intended user. Are there any, um, plan, you know, like 00:55:34.634 --> 00:55:37.200
cars staying overnight or, you know, what’s the management
00:55:37.200 --> 00:55:44.200
looks like at this. You know, um, or in terms of, you know, 00:55:44.200 --> 00:55:48.500
cars being abandoned or anything. Great you want In
00:55:48.500 --> 00:55:53.233
other words I. Um, actinger Frasier members of the planning 00:55:53.233 --> 00:55:55.900
commission. We do anticipate there would be overnight
00:55:55.900 --> 00:56:01.233
parking for that wreck to reuse, um, so, um, somebody who’s 00:56:01.233 --> 00:56:03.367
associated with the religious institutions staying there,
00:56:03.367 --> 00:56:08.800
living there, um, on property, so yes, there would be that, um,
00:56:08.800 --> 00:56:13.000
anticipation for there would be some overnight parking for that 00:56:13.000 --> 00:56:17.233
person or persons who would be um residing in the rectory.
00:56:17.233 --> 00:56:26.834
Yeah Thank you. Any other questions, comments? I do have 00:56:26.834 --> 00:56:31.667
one question about the rectory, um. The construction of that, 00:56:31.667 --> 00:56:36.467
is that going to align with the existing um. Look and feel of
00:56:36.467 --> 00:56:41.300
the building. Um, acting chair Frasier members the planning 00:56:41.300 --> 00:56:44.567
commission, um, no modifications are being made to
00:56:44.567 --> 00:56:47.734
the exterior, um, so this will all be interior modification.
00:56:47.734 --> 00:56:50.900
So even the rectory will be entirely within the current 00:56:50.900 --> 00:57:00.166
structure. Um, yeah. Thank you. Right, um, we will move for a 00:57:00.166 --> 00:57:06.834
motion. They have two motions on the table. I’ll read the
00:57:06.834 --> 00:57:12.467
first motion. Motion to recommend a resolution 00:57:12.467 --> 00:57:17.033
approving a conditional use permit. For the operation of a
00:57:17.033 --> 00:57:22.367
religious institution located at 8700 Wyoming Avenue, North 00:57:22.367 --> 00:57:29.834
Brooklyn Park, Minnesota 55445. Second by Commissioner Gabba.
00:57:29.834 --> 00:57:57.634
We’ll move to a roll call vote. I I I. I I Commissioner I Uh Um 00:57:57.634 --> 00:58:04.567
Oh yes, motion passes. We’ll move to the 2nd motion. A boar. 00:58:04.567 --> 00:58:07.567
I’ll make a motion to recommend a resolution approving a
00:58:07.567 --> 00:58:11.000
conditional use permit for the operation of a rectory for a 00:58:11.000 --> 00:58:14.734
religious institution located at 87. 100 Wyoming Avenue North,
00:58:14.734 --> 00:58:21.200
Brooklyn Park, Minnesota 55445. I second. I by Commissioner 00:58:21.200 --> 00:58:30.166
Turner. Move to a role called vote. Chair I Commissioner Waco 00:58:30.166 --> 00:58:51.567
far I I Yeah I’m I uh Or more than in motion passes. 00:58:51.567 --> 00:58:55.834
Congratulations, this will be presented at the city council
00:58:55.834 --> 00:59:18.266
meeting on June 23rd. Right All right, so we’ll move on to Ah, 00:59:18.266 --> 00:59:26.467
verbal discussion items. Any old business that we need to 00:59:26.467 --> 00:59:37.133
talk about. Right. City council member updates. Thank you, 00:59:37.133 --> 00:59:45.500
Madam Chair. Um At its regular meeting on May 27th, the city 00:59:45.500 --> 00:59:48.467
council approved on consent both the items recommended for
00:59:48.467 --> 00:59:52.500
approval by the planning commission. And those were the 00:59:52.500 --> 00:59:57.300
drive-through variants for the Park Commons. And the CUP and
00:59:57.300 --> 01:00:04.734
site plan review for the soda shine car wash. Thank you. 01:00:04.734 --> 01:00:10.567
Thank you, council member. Planning Commission. Any 01:00:10.567 --> 01:00:21.367
comments from the planning commission. I The car washing 01:00:21.367 --> 01:00:26.667
by the festival that’s closing or closed. Is there a car wash
01:00:26.667 --> 01:00:28.634
by festival that’s closing. There’s a car Way festival
01:00:28.634 --> 01:00:31.100
that’s under construction. Under construction. Yeah. OK. 01:00:31.100 --> 01:00:37.400
Yeah. The hair is so OK. That’s uh that came through planning
01:00:37.400 --> 01:00:41.033
commission as the clean freak car wash actually came through 01:00:41.033 --> 01:00:45.367
twice, um, second time for assign variance, yeah. I have,
01:00:45.367 --> 01:00:49.567
I have a quick question, um, what’s, what’s going on on uh?
01:00:49.567 --> 01:00:54.467
Brook Brooklyn, uh Boulevard by uh Boom Avenue, you know, 01:00:54.467 --> 01:00:57.100
there’s a road closure there. What’s happening there? Are
01:00:57.100 --> 01:01:03.467
they Brooklyn Boulevard and Boone. No, not, that’s not boon, 01:01:03.467 --> 01:01:08.900
though, um, by, you know, close to boon, you know, as a. Uh, um,
01:01:08.900 --> 01:01:14.100
um. Is it road construction or or or or developer or I think 01:01:14.100 --> 01:01:16.233
it’s a road construction, you know, there’s the road is
01:01:16.233 --> 01:01:19.467
closed. I’m just wondering what’s what I don’t know. I’m
01:01:19.467 --> 01:01:33.233
sorry. Yeah, I don’t know. Yeah Last time we were together. The 01:01:33.233 --> 01:01:38.166
microphone has a mind of its own. Yeah. Yeah, I think it’s
01:01:38.166 --> 01:01:40.867
they turned it on upstairs. Remember to turn on your mics, 01:01:40.867 --> 01:01:44.233
everybody. Yeah. I think I’m taking it on. OK, anyway, but I
01:01:44.233 --> 01:01:51.800
wanted to note, uh, what it is um. Uh, I’m I’m from Brooklyn 01:01:51.800 --> 01:01:57.367
Boulevard, uh. What Brooklyn Boulevard, I can’t get the name
01:01:57.367 --> 01:02:04.767
of the street correctly, I think 7676 Avenue. a building 01:02:04.767 --> 01:02:08.567
under construction. Yeah, but, but it, but it, African foods
01:02:08.567 --> 01:02:12.767
that is, that’s Christina’s childcare. Mhm OK, yeah. I’ve 01:02:12.767 --> 01:02:17.100
been saying it and I was like, I, I did they mention this in
01:02:17.100 --> 01:02:19.266
our meeting because I just lived not too far from there,
01:02:19.266 --> 01:02:22.867
so, you know, my eyes were kind of. Yeah, that’s um that’s um 01:02:22.867 --> 01:02:26.634
um. Property formerly owned by the city’s economic development
01:02:26.634 --> 01:02:28.834
authority. This is a project that’s been years in the making,
01:02:28.834 --> 01:02:32.767
so it’s exciting to see it. The work is going on strong for 01:02:32.767 --> 01:02:38.467
what I’ve seen so far, so let’s go. Yeah Is there a limit to
01:02:38.467 --> 01:02:42.834
how many car washes the city could have. Or, uh, you know, a 01:02:42.834 --> 01:02:46.000
saturation of a market. I’m just curious. So the question
01:02:46.000 --> 01:02:48.634
is, is there a limit to how many car washes the city can
01:02:48.634 --> 01:02:55.100
have, um. I think the best way I can answer that is Generally 01:02:55.100 --> 01:02:57.734
speaking, we’re running out of places in the city where and
01:02:57.734 --> 01:03:05.266
car washes would be allowed. Um And I would, I, you know, at 01:03:05.266 --> 01:03:07.900
risk of speaking for the entire city council, which is not my
01:03:07.900 --> 01:03:12.667
role. I will say that it’s pretty clear that the council’s 01:03:12.667 --> 01:03:17.100
intent with development, uh, you know, is shifting to higher
01:03:17.100 --> 01:03:20.200
value development contributes more to the city’s tax base, um, 01:03:20.200 --> 01:03:24.367
car washes of course are an important part of life for
01:03:24.367 --> 01:03:27.233
folks who drive cars, um, but they do not do much to
01:03:27.233 --> 01:03:30.767
contribute to the city’s tax base like on a value per acre 01:03:30.767 --> 01:03:34.100
kind of a measure, um, We’ve been looking at over the last
01:03:34.100 --> 01:03:37.934
couple of years, um, so I, I wouldn’t anticipate that we’d
01:03:37.934 --> 01:03:40.467
be opening up a lot of new areas for, for, for uses such 01:03:40.467 --> 01:03:53.734
as that. Any other questions, comments? All right, we’ll move 01:03:53.734 --> 01:04:01.734
to staff liaison comments. Oh, me, OK, um, so just a 01:04:01.734 --> 01:04:06.467
commissioner’s, um, so 2 weeks from tonight is regularly
01:04:06.467 --> 01:04:09.734
scheduled work session. Do not plan on there being a meeting
01:04:09.734 --> 01:04:16.133
that night, um, for July, stay tuned. We currently do not have 01:04:16.133 --> 01:04:19.634
any applications in, um, for consideration at their regular
01:04:19.634 --> 01:04:24.033
meeting, um, however. Um, you know, we know that there are 01:04:24.033 --> 01:04:27.000
some discussion items that both staff and planning commission
01:04:27.000 --> 01:04:29.734
are interested in, you know, talking about we’re still
01:04:29.734 --> 01:04:34.800
interested in, you know, on working on kind of the, uh, 01:04:34.800 --> 01:04:37.467
planning education about about laws and and review processes
01:04:37.467 --> 01:04:40.734
like we did last month with our engineering colleagues, um, so 01:04:40.734 --> 01:04:43.934
we’ll, we’ll be looking at, you know, what’s next for that and,
01:04:43.934 --> 01:04:46.033
and kind of what the schedule will be for the rest of the
01:04:46.033 --> 01:04:51.367
summer. So, um. Stay tuned, um, for what, what that schedule 01:04:51.367 --> 01:04:54.567
will, will be, uh, and whether there will be a meeting, a
01:04:54.567 --> 01:04:58.467
regular meeting in July, um. On that. So I think that’s all
01:04:58.467 --> 01:05:05.367
I’ve got. Thank you. Thank you. So that concludes our agenda
