Rental Capacity Exemption Request at 20002062nd Place

4-0 Approved (1 Abstention)

Dissent: Council Member Friedrich abstained, expressing confusion and a desire to question the applicant directly.

The request for an exemption was from a homeowner seeking to rent out their property after a voluntary, temporary relocation. Council discussion centered on the interpretation of 'financial hardship' as outlined in the city ordinance. Concerns were raised about the accuracy of information provided by the applicant regarding market loss and the purchase price of comparable properties. The council clarified that true hardship should involve unforeseen, extreme circumstances, not personal financing choices or voluntary moves. A suggestion was made to create a policy to define hardship more clearly for future requests and potentially add an application fee.

Parks and Trails Commission Appointments

5-0 Approved (Unanimous)

Moved by Lanterman [01:47:59] · Seconded by McKe/Mayor [01:48:00]

Mayor McKe and Council Member Lanterman presented their recommendations for two open positions on the Parks and Trails Commission following a robust interview process with three strong candidates. They nominated Margie and Tony Wickman. The council also discussed keeping the application of the third strong candidate, Deb, on file for future vacancies.

Notable Quotes (3)

The record therefore contains no competent evidence of a market loss on the block during the relevant period to the extent it shows anything. It shows growth... the applicant's relocation is voluntary and temporary with a stated intent to resume occupancy in or around July 2027. No circumstance compels a sale of this property and accordingly no force loss has been demonstrated.

The thought process was if there is a drastic market downturn and you have large numbers of people with massive amounts of negative equity, it needed to be an escape valve to prevent the ordinance from being a taking... I I wouldn't say the prospect, even if he was going to face a moderate financial loss on a two-year purchase of a home, doesn't rise to the level of invalidating the intent of the ordinance.

My interpretation of hardship is you have a family, the bread winner dies unexpectedly, and you have a widow who has no work experience and is going to lose everything unless he or she can can get some kind of relief. To me, that that is the intent.
