then um so rsf3 or a PUD could they become Town Homes these are going to be single family homes that cannot change okay um and then if we could somehow incorporate some of that data like I believe the commission planning commission's job is to think strategically about the city in the long term those kinds of insights are what we kind of need to be thinking about when we're approving these types of things so the more information we can have on that kind of sense of if what we did approve and I get it legally it hasn't happened yet but we have to be keeping those things in consideration yeah when we make these decisions so I would say anything that is in compliance with our plan it it just kind of keeps us moving forward it's an assumption that it's in compliance with our plan it really isn't changing anything proposed in our plan it's when we had these complant amendments and and it seems like we've had a lot we now this is after this application there will be three that we've processed but these applications have also been a couple years in the making and so and this has been through a lot of conversations about okay if we um have the higher density here um doesn't make sense to allow for lower density elsewhere and so I would say these changes are a long time in the making um and everything that I data I have so far we are just still a little bit over three units an acre so we still can't do a whole bunch but I we can do a little bit more um but I would say if a if a property isn't requesting to be a two to three units per acre if a property isn't requ especially if they don't have something that helps justify it like a DNR protected Wetland that they can't impact or Shoreland that they are going to be subject to then it probably doesn't make sense for that District to be applied and um to just any lowdensity residential area no that's cool and I know a lot of us are fairly new to this so we don't have the historical context but we're expected to act in this capacity so it's very helpful to know thanks okay before I make a motion I just want to thank Natalie for the work that she did on this application I want to thank my colleagues for taking the time away from their families to review this material and for the applicants I just want to say you you um you did the best with the with the hand you were dealt um so I thought that this was a a very uh well thought out application with that uh I would like to make a motion to to uh approve this application can I get a second and to confirm we're we're approving the rezoning the preliminary PUD plan and the preliminary plag the whole shebang the whole shebang all right I'm sorry I interrupted your second can I get a second second okay all in favor say I I all opposed thank you for your thank [Applause] you and consider trademarking that whole Hydra like green Corridor that's some fancy word smithing man I'm going to have to look it up that's some word smithing right there I could visualize it I wanted to buy one I don't even know what it is you're like yes no gun pile's getting bigger you can tell I'm I'm fine if you all are cuz there's no bathrooms so are you folks okay to keep going oh I went in there it was okay but okay keep going yep I was surprised are you ready to continue I am ready okay okay Mr chair the next item is 60 it's a public hearing for Fairway Shores Villas at Cook lake so with that I'd like to open the public hearing for the Fairway Shores Villas City file number 24- 006 this application involves a comp plan Amendment and PUD for the construction of uh 75 homes I I think that we're warmed up so uh Natalie thank you so yes the uh Fairway Shores Villas at Cook Lake as you said it will include a comprehensive plan Amendment request with a roning a preliminary planned unit development plan and a preliminary plat the applicant is Fon development they are a local home builder uh and they are developing 75 single family residential lots and five out Lots this property is directly east of the chastic farm that we just reviewed uh and then they are west of cook Lake and with this application an off-road Trail is also Pro also provided which will run along the North Boundary and then move South to follow the Westland West Wetland complex around cook Lake and that is in compliance with our 2040 parks and trails map so the comprehensive plan Amendment would be the first component that we would need to approve in order for this application to move forward the predevelopment density is 2.43 units an acre in a on a property that's currently guided for 3 to five units an acre uh even with the increase that is anticipated for the post-development density they are still not going going to hit that three units an acre so uh the city adopted the conservation residential land use category last month with the review of Woodland Hills and that does allow for density at two to three units per acre it was stated in that application that the part of why we wanted to set this new land use category up is it would not benefit just Woodland Hills but other applications that we were aware of that were having troubles meeting this density while trying to preserve or or trying to work work around and enhance natural features of their site so this does seem to make sense here as well to allow reasonal development of a site that's located within our Shoreland overlay District uh of cook Lake here while catering to supply and demand for a variety of lot sizes so this is a policy decision for the city where there is a high level of discretion um I'll just kind of give you an idea this right here is where the shorel overlay District ends so pretty much the entire SE is constrained by that um so then the resoning request right now they are zoned from R they are zoned rsf2 and they are requesting to be zoned a PUD and staff's find staff finds there is reasoning to support the resoning request again it's flushed out in the staff report uh as to what factors we should consider when making this type of request and it is ultimately a policy choice for the city and the Planning Commission should decide um or should provide any feedback they have on how it does or doesn't meet those standards so as far as the P preliminary PUD plan again there are several component several requirements of low density residential puds this application meets most if not all of them there the question again with this one is the matter of open space there is a 12% standard because they are requesting a minimum lot size of 55 feet wide and they're they are currently proposing 10.6% open space their exhibit uh was used the wrong number they were going off gross acres and we have to go I'm sorry they were going off of the I can't remember whatever it was it doesn't quite right we have to look at the pre-development number for the net Acres uh and that's how we determine the um that's what it was we have to look at predevelopment they were using the post development acreage and so the open space exhibit they have actually came back at 10.6 instead of 12% however this will be a huge discussion point on this they are showing Wetland buffer widths that are in some areas twice as much as what they need so do we prefer that there is additional enhanced Wetland buffers especially along cook Lake does that make sense or do we want to see this reduced as much as possible to our minimum standard so that there is more open space um we could either way we can probably move that 12% pretty easily Additionally the proposed Trail takes a Less Direct path than what our comp plan proposed our comp plan proposed basically for it to connect to the chastic property here moved down to about here before connecting down a Bass Lake Crossings trail and I estimated that their pathway along the north so you follow the Wetland complex much longer uh which allows for much more desirable views that probably added at least a quarter acre to their Trail Corridor that was not anticipated in the comp plan and so our open space says that if it is a trail that is anticipated in our comprehensive plan that it doesn't count towards open space but arguably there's a quarter acre of this trail that was not anticipated in our comp plan so how should that be factored into the open space so again the city does have some discretion in choosing to accept open space or choosing to deviate from our open space requirement when there's some constraints or additional public benefits that justify that so uh a question for you is do the enhanced Wetland buffers and Trail Corridor uh make it that we can we feel that this meets the open space requirement as is or do we want to see some slight uh changes to the proposed buffer WIS um would be the biggest question so then as far as the flexibilities requested they are again we compare this against the rsf3 standards because they're proposing minimum lot sizes that's more comparable to rsf3 than any other District so the minimum lot area is very similar to the application we just reviewed 6,875 Square ft a minimum lot WID of 55 ft they are proposing uh an additional setback on the front of 25 feet where only 20 feet is required and then they are requesting a side setback of 7 1/2 ft a rear setb back of 25 ft additionally they have the added overlay of the shorel and that District requires 125 ft minimum lot width and again they're proposing 55 ft wide at that overlay requests 20,000 squ ft minimum or requires 20,000 ft minimum lot area there are a few Lots within that um overlay that would only be the minimum requested of 6875 square ft there is a 25% impervious surface limit in the Shoreland overlay and they are requesting 45% impervious keep in mind that is on a Perot basis and that's not including the open space at all that is being proposed and then additionally after reviewing the staff report the applicant uh started to question their ability to meet the materials of the front elevation we have a requirement that only 75% um there's a 75% maximum for one building material and they are proposing the the that was the Hardy sighting and um or smart sighting that they're proposing and they would be proposing different colors different styles of it uh but they would like to predominantly be be able to use that material and I believe the applicants ready to speak to that further and so they're requesting that they be allowed to do an 85% maximum and they also think this will allow for actually more deviation across their different types because it won't all necessarily have to be cut off at 75 they'll be able to have some that meet the 75 While others will have a little bit more deviation uh preliminary PUD plan for the public benefits they this application does need to comply with our public benefit policy and they have met a number of those drawn out public benefits the application I'm sorry the staff report does provide the purpose and intent of each benefit as it was identified for the policy um but I'm going to just quickly kind of summarize where there might be what they're meeting and what questions might remain so the natural resources and features are retained is one public benefit a high quality maple Basswood Community is identified on this property by the city and it follows cook Lake and the Wetland lobe that goes into the center of the site and then it also continues to follow the lake North the applicant is currently proposing 50% of the significant healthy trees on the site be preserved most of them are located within that highquality Community uh my staff report said 68% the applicant is fearful of over promising and wants to make sure that these are parameters that he can live up to so that's where the 50% is now coming from uh the use of preferred trees in landscaping they are primarily complying with our Northeast District preferred trees list they are proposing higher architectural standards in that the five minimum example or five minimum elevations are required for diversity and he is proposing at least six the James Hardy or LP smart side are tended to be used will allow for 20 plus pre-finished colors uh for a variety of colors within the community and then they will be they're proposing different styles of the building material so they'll be using board and Baton or Shake as a way to uh make it look different throughout each facade um additionally they are proposing lot SI they are meeting the lot size variety public benefit so 48% of the Lots will have a width of 75 ft 72% of the Lots will exceed an area of 7500 Square ft and almost a quarter of the Lots will exceed an area of about 11,000 sare ft so these are fairly large Lots the applicant is proposing larger tree size at the time of planting our bare minimum code requires 2.5 Ines or caliper inches at the time of planting our policy actually says that 4 in is the minimum to receive this benefit uh but a local if expert submitted a letter of concern or an email of concern my way when uh the developer reached out to try to find 4in minimums and it's just simply going to be very difficult for him to be able to supply that tree uh it's just not something that's done and it doesn't meet best management practices for long-term her health of transplanting trees but the applicant in in spirit of trying to meet this um benefit has has offered a threein size minimum which is the maximum for best best management practices um and where he can he will he'll find trees that might exceed that but he'll commit to a 3-inch minimum uh again collaboration with adjoining land owners they have uh they did collaborate with the chastic application to make a stronger more unified application that allows for more connection as well as uh better drainage uh management this one is again a question for um Planning Commission this isn't a public benefit that the applicant has proposed this more of um staff saying well maybe uh the visual termin it uh they have an entrance monument and as you can see they're proposing significant Landscaping it looks like it's going to be quite gorgeous and the idea of the visual terminis it's supposed to be located at the end of the road as a way to encourage neighborhood identity and it does say that entrance monuments can qualify for this PUD benefit the only question really is it's not really at the end of the road um it's going to be as you enter this development when you drive along furly North so do we still consider this a visual termin um if not then I still think there are several benefits they're proposing they don't necessarily need this one but I want to make sure we're calling out credit work it's due extraordinary Environmental Protection so this one is unclear because it depends on how you want to handle the open space if we're saying the open space is fine as is because because they've enhanced the buffers because they've increased the trail Corridor um then I would say they also would need credit as a p benefit because they're exceeding the Wetland buffer widths which would be an example of extraordinary Environmental Protection if we're saying that we would prefer that these not be under a wetland buffer where it's an excess of what we require we would prefer that to be part of open space that um just simply not in a buffer area then um that's fine and then but this standard would not apply so that's kind of a question mark one and then there's some additional benefits discussed in this narrative that are not captured by our policy so again that 25 foot front setback is proposed where we only require 20 fet and then he mentioned in his narrative that a single lawn or snow company as well as a single company for sanitation will be used as a requirement of their HOA and an interest of cutting down traffic to the to the area again the lands scaping buffer yard they will have to have meet that setback requirement along the shared west and south property lines um if since we approved it for or recommended approval of a 25 foot setback for chastic I think that makes sense here as well and then once we kind of work through these components then um should all other requests be approved or recommended for approval then the preliminary plat would comply with the applicable ordinance and requirements they do have to meet the conditions of approval outlined by both planning staff and Engineering staff so there might be some changes to lay out as they work through things uh but the uh ultimately they uh are looking pretty strong at this point so at this point I would say open the public hearing and take testimony and we can I'm sorry staff recommends approval of the several components so we have resolution approving the comp plan Amendment a draft ordinance approving the rezoning to a PUD the resolution find with findings of fact supporting the rezoning a resolution approving the preliminary preliminary PUD development plan and the resolution approving the preliminary plat and again the Planning Commission can make adjustments to the proposed resolutions um and then if anything uh were to if the commission were to find that there's something that is not satisfying our standards uh and recommends denial then findings of faction we provided to staff for city council and that is what I have thank you Natalie with that I'd like to open the public hearing is the applicant in attendance yeah right here hi please sir would you like to State your case and just please say say your name and the organization you represent if any Mike B on berser on homes and development okay welcome thank you so fa shes so we uh we feel is going to be a great addition P um larger PUD Lots we're currently doing a development in CLA and we've got some lots that vary in sizes not to this scale but um you know doing the Hardy siding the the stone variation we we feel like with the upper bracket it would be it would be a nice addition um I guess any questions you have commissioner anyone what what is the reasoning behind wanting the larger percentage of one material so the idea is so what we do is we try to get every house looking different with the roof line and nobody's really choosing brick today almost everybody is you know the hardboard and stone so we want to have that variation so that we can go to all Spectrum more Stone more hearty siding different colors board and bat and shakes lap siding the goal is to have nothing look alike identical and at 75 Lots it gets to be difficult so that's you know so to make it easier so if you do 75% Stone 25% Hardy you know you're going to run out of ideas pretty quickly but if we can go to 85 that's going to help us some people are going to want more Stones some are going to want less and then you know our specs and models will be doing it on our own and mixing it up I have a question the um the Wetland buffer versus the open space mhm is it basically the open space would be mode ground grass and a wetland buffer would be native plantings that might be a question more for me yeah the so Wetland buffer has specific types of plantings you're supposed to use um and then there's buffer monuments that go on the edge you're really not supposed to do anything within the buffer it's supposed to kind of just be like this um um natural Corridor that uh helps with drainage as well as uh wild light and then the open space they are proposing a different seating than the typical yards so you'll have one seating type for the private yards and then a different seating type to kind of delineate the open space from the private yards so uh it's more of a matter I would say that the open space would be more accessible to uh be able to walk through and kind of use whereas the buffers are going to be less accessible okay with that uh any more questions of the applicant okay with that uh I will make a motion to close the public hearing I don't know if we made it actually I did it to you again told me not to talk all right thank you sir please step on up my apologies and again please state your name and your address my name is Lyn Alberts I'm at 7490 ferlan and I just want to recommend that uh that this development go forward um I've lived there for 5 years that you will not believe what kind of Trail people will like going around cook Lake Cook lake is one of the few lakes in corp I mean and it's an environmental Lake and so I think the far more buffer that you have the better because it's going to protect that Lake and so just from that that point and you know the protection of the trees and that type of thing I think this is a excellent project and I re I commend the city for changing the the law the rules as far as how these are now handled you know the tree preservation and all those different things rather than say well what's the benefit to the Corin there actually are some listing of things that okay you have to hit these things to be qualified for a PUD so I recomend I just commend the city for having that and taking the time Natalie spent a lot of time doing that so I I really think that we corkin made a step up now and you know now we have something that you can rather than just pick and say well I think we should do it because of this or that there actually are criteria now that you utilize to determine what is a good PUD and what isn't a good P so well good thank you we all appreciate your your comments uh anyone else yes both of them have some really great ideas and I really think we should move forward to the development of Corr it's uh you know the homes I know the burds can be building will be really help our whole area increase the value what we're doing my major concern for both developments is making sure the traffic flow is the works because furlane will be main channel to uh Bass Lake and U A lot of times what happens is nothing H happens to control traffic until something tragedy happens so I want to make sure the commission or the commissioner here the Planning Commission and then also our Council which I know will listen make sure that the traffic is looked upon and the traffic controls and the RADS are according to what's going to happen whether we have to put speed bumps on our street I don't know right now without these development people are flying down our road and those are some of our own residents and we're trying to control some of that so so just keep that in mind is the whole idea of the traffic and stuff that's going be flowing back and forth between uh the the two new communities that are going be going in Plus past Lake and whatever else is going to across the street over at the golf course and those areas so again I thank you for your time yeah thank you for your thoughtful comments any anyone please step on up please stay your name and your address you got it thank you hi uh my name is Derek stendel I'm representing Rush CR Golf Club um that's 7801 P 101 on Maple Grove and uh just want the opportunity and thanks for sending out the the information about the meeting just so we could talk and I just want to get a few things out there too we haven't had the opportunity on some of the encroachment that's happening here and and just to just to put it out there we enjoy having the people around and and uh all these new developments and everybody coming in so uh we like to be an asset and and be a nice resource for the area too uh just a couple things that that maybe are concerning um you know obviously drainage is going to be a big thing especially with with this development and probably a little bit of yours but mostly this one with the you know as you look at it right now it's our B is our 17th hole and then you guys are quite a bit higher and so I'm worried about you know the drainage coming back onto the GF course and not necessarily once it's completed but especially in construction where things get to be dirt and then we get rain and then it can come on down so just you know trying to figure out maybe we work together on a mindful way to to Sil fences and things like that and and U um at the boundary uh or the the border of of we have a fence going on there sure and also that that kind of leads into the trail that is proposed um right between the houses so it's on the back edge of the houses right next to the golf course so I don't anticipate and that's a it's a 17th hole and it the area where most of it is going to be um you know you don't get a lot of traffic like a driving range but there is the concern of golf Falls coming and you know we've we sold some land um to the north of our golf course and we were able to put in some covenants and and um expressed our concerns that you know when people people built houses there this is what they you know could expect that if it does happen um subsequently people built the the woods at Rush Creek at they call it the woods at Rush Creek and then they cut down all the woods and that always happens they name it after what used to be there you know now we're dealing with people there that are understanding that you know they're next to a driving range and and things are going on lot less traffic on this pole but that is a concern that's going to be if they're going to border right right you there's people playing right here and there's this could be a very busy walkway so just something that we need to think about and then the last thing is noise um we fire up lawn mowers at 5: in the morning usually in the summer and they all start heading out and I know corpin is aware of this I saw the signs on the Lions Park where it said this is a loud stinky you know everything happens at the at the at the park over there and so just so that's aware too and and it all I add is that you know when you have these houses in the building just so people know because a lot of times if you have some developers let's say that you talked to and they said sure we'll take care of that and then they didn't and then people call and complain to us about something it's like well you know we've been here for 28 years and this is what we've been doing so those are just some of the concerns and uh you know as long as we can kind of figure those out or if there's anything that I can do to help be happy to be you know have a conversation about it or however that's going to work out will be you know a resource because it's you know I think it's great to have all the everybody everybody around here and uh potential new clients right there we go you know one one potential solution could be if you're concerned about noise complaints maybe offer them a discount on membership get them get them out there at 5: in the morning it could be a business opportunity we charge double but not in this case thank you for your comments and anyone else with comments no okay well with that uh I will entertain a motion to close the public hearing I'll make that motion I will second it all in favor I all opposed okay with that so discussion and I guess so Natalie uh I think I'm missing a category so comp comp plan amendment resoning to PUD preliminary PUD plan preliminary plat preliminary plat I knew it was something once you get the Pud plan the pla's nothing yeah that's that's that that's what I thought so uh I think that the first two are really easy so just so some quick comments from me and then I'll I'll turn it over to my colleagues with the comp plan amendment reiding to conservation residential I think that that this is the whole reason why this guidance category exists it it was made for this um so uh I am in favor of recommending approval of the comp plan uh Amendment with resoning to PUD I'm uh I'm in favor of recommending approval of that and then where I think you know some additional discussion is warranted is on the preliminary PUD plan so who would like to start the discussion and just because I'm I made some comments about comp plan Amendment and resoning the Pud don't think that you can't add your comments as well okay I I just wanted to kind of set out my thoughts on this who'd like to start okay um yeah I I think um it looks like a really well thought out plan and maybe it's good to leave it up to the discretion of the of the Builder as far as the Wetland buffer because I I like the fact that they've got that extra Wetland buffer in there to protect cook Lake and I think there was an issue with the trail going into that Wetland buffer so maybe you know that has to come out of there yeah I'm okay with part part of the Wetland buffer being part of the open space because as far as I'm concerned the open space and the trails that that kind of takes care of that and if they end up extending that trail around cook Lake if May Grove ends up doing that that that would be really great um and it looks like we've um kind of accommodated for that here I think there was something in here somewhere I could could find it but I thought there was something about some additional screening by the trail by the golf course to kind of protect people from balls there was some discussion at the parks and trails commission it didn't make it into their official recommendation so um I think where I saw it yeah and and to the I spoke with the applicant about that um and I don't want to put words in your mouth so feel free to step in uh but the the desire to add trees in that area not echoed by the applicant because those are premium lots that that with the golf course view that's considered a premium lot so he doesn't want to block off the view if something is absolutely desired he'd be open to possibly a fence Al being right on a golf course your house takes a beating you end up repainting your house keep in mind it's not uh keep in mind it is a little the golf course is a little lower so I think that can help a little bit but um and then he did talk about oh and then the Hardy sding should be able to help if the golf balls hit the houses and then the um you were open to potentially like a a fence like a green chain link fence or something like that that could blend in but still provide a view and provide a little bit more protection so if we absolutely want to add that uh I don't currently propose that but that would be I think kind of the compromise so there's actually um my sister has offence to keep her dog in and to keep her rabbits out of her extensively landscaped yard and it's black and you almost see right through it you barely see it at all and it's like way cheaper than like a Cyclone Fence or something like that too um so different considerations for fence might be a good idea there and it's flexible too so a golf ball would hit it and and it wouldn't hurt anything uh let's see um I see you did amend the tree preservation plan because I think there was some something in there that said if you say you're going to preserve 90% And 25% of those die or they're compromised because of the development thing I have to replace them so I can understand that and I think there's a lot of ash trees in the inventory yeah so there is a number of ash trees but they were all in Fairly good condition so if they um mine were until last fall yeah so I think yeah I they're going fast we can certainly talk about what that might mean for it uh but that's why I also was 50% of the healthy significant trees should be preserved I I don't think he should get knocked if he later has to remove a an ash tree I can understand that um I I like the the um quality of the housing the siding the colors the the um stone treatment all that I think that's really nice um both of these developments have been really thoughtful that way um um I think that 25 setback for the buffer yard probably meets the intent of the buffer yard ordinance um I think the site monument at on where it is on furlane that that sounds fine too because you're entering the development and it it looks like it's a really nicely landscaped Monument so I like that I think that's the extent there's an HOA so that maintains the open space correct okay yeah looks like a very nice development that's all I have I thought this was particularly well done I I I liked it a lot I I like the fact that the last two items the applicants work together I thought that was really I mean that's nice to have nice to see and I I also like that enhanced buffer in view of the open space I think that I think that's just really well done and that's the extent of my comments okay moving on Down the Line my question uh especially upon hearing the concerns or just comments from the um from the representative of Rush Creek is is there a reason why that trail couldn't be moved because it goes like this it goes like that and then up and back around the houses why can't it just go in front of those houses cross the street and then go down and behind and then there's no concern so where we can have it away from the road we would prefer it so when you have it on road it's just never you know you're walking around CR we would prefer where we can to get off-road trails so sure I get that but if it's like then putting if it's requiring screening that I would prefer not to see fencing go up uh to to break up that view and so I get that but I think in this case it might be worth considering allowing it also like I used to back up to the um Regional Trail in uh Maple Grove and if you don't have enough of a buffer sometimes it does feel weird to have a trail going through your backyard you know um so I'm just saying that was a a a thought that I had after hearing some of your comments is just wondering if you could just dip that down run it in front of that one street of houses it still has to cross street Street c and then come back in and around where it is so just a thought uh and I would prefer something like that although I understand you want to keep it off of streets it's not going to be a super busy street though that's the back of the development so save the people who live there and anyone who's coming to visit them I don't feel like it's going to be a a high traffic area so that's a thought that I have and I would just saying I'd prefer that over a offence um and then otherwise everything else my only question is the perious surface percentage cuz it's significant so if we look at that because the percentage that you're uh giving the 45% is per plat if you were to no per lot per per lot only going to be that bad on the smallest L right so if we so thank you for correcting me because I'm I I guess what I'm asking is if we look at this whole site right what is our impervious surface I don't have that calcul but it is significant okay cuz that's where I feel like that is but when and so if there had been way to kind of figure out what that is and present it alongside because to me if you're looking at those individual lot sizes it looks like there's such a significant deviation but I think when you consider the whole um development as a whole I I was guessing it would actually seem like it was much closer to that 25% I would agree okay and um otherwise I have no other concerns um I super appreciate because I live on a maple and Basswood uh Community natural resource so I appreciate that that's being preserved um and I would agree um that some of the work that's been done um by staff o over the last couple of years um is making a significant impact and I'm excited for that and I also just want to say that both of these uh PUD proposals were so uh you did such a phenomenal job the the two of you and laying these um specific things out the way they were organized and I just feel like this has raised the bar in the presentation of puds um to the commission so I greatly appreciate that [Applause] yeah um I I love the the summary questions too I think that's super helpful so thanks for including those I was thinking the same about the trail even perhaps I don't know another idea maybe it's on the north side of uh like near the sidewalk maybe it combines with the sidewalk I don't know of lots 18 17 16 15 something to think about but totally agree I think sometimes well the safety issue as well as just overall having a trail in your backyard but would love the idea of the trail around the lake protect the lake at all costs I think that's great um I'm curious what do we know like what the percentage of Villas then in corkran I mean I'm like thinking about how we're catering to this audience do we know so it's not that um someone outside it's not going to be an age restricted community it's just that that's the that's the demograph traffic so if someone that's younger than 55 wanted to live there they can okay um so it's so um I would say I don't have data today on how much of our homes are Villas compared to a traditional single family home typically the Villas refers to just the one level living and I don't I just don't even have a great gauge on what that percentage is but I will say that um when we've been talking with applicants about that with a desire to have an age restricted community um staff's message at this point is we think we actually have quite enough that are age restricted you can Market to that age group if you want but we would prefer not to see any more age restricted because we do have a number um so I think that's kind of the balance to strike is it's okay to appeal to that market demand but allow for the market demand to change as well so yep okay that that goes along with what my thoughts were as well um that's all I have one one other consideration there um on the North End by the trail on out lot sea is there space there that there could be some Landscaping added between the backyards and the trail some screening we talking about okay here let me yeah the north North End you're talking about right here yes but on the south side of the on the south side of the trail to screen those backyards actually from the trail CU we commented about you know their backyards being open to the trail I mean it looks like there'd be space to maybe add some screening from the backyard however again these are the lots that back up to the golf course and so often times the screening is is not desired they want be able to see it may just leave it up to the residents yeah yeah residents can always put in their own trees as well on their property or their own privacy fence mhm yep I personally don't have any problem with that trail running right where it is because I think it's going to be nice much nicer to walk that walk that that's fine then a sidewalk in front of a house put hard hats on the well you know you're by a golf course so why not uh I just have one one question Natalie uh if we adopt it 25t setbacks does this also mean that these setbacks include upper yards and plantings or am I missing something so the 25t rear setback um that is separate from the buffer ordinance if that's what you're talking about uh the buffer ordinance um again it's unclear how best to handle puds but what I'm what staff proposes is that that same 25 foot yard setback be applied because of the surrounding pews are also at 25 ft okay all right So you you're recommending that as a condition yes yes okay yeah I'm I'm in favor of that uh any further discussion uh with that uh I would uh I would like to make a motion to approve the application can I get a comment is this I am absolutely one who likes to keep our city taxes low however we are at a point where I think that we're getting more planning information than our twers planning department as a city can handle um and I think that that was evident this week because stepping away to gain uh continuing um pursuit of professionalism didn't allow them to work on the developments for these for these packets and we I didn't get my packet till Tuesday Morning NE and I I know and I'm not and I'm not faulting planning so we are we are working on it dilig I got it I just wanted to be noted that I am in favor of uh getting them some of the assistance that they need in order to make sure that we are meeting the demand that's currently taking place without missing anything because I think they did a phenomenal job for not missing anything this week so Natalie are we kind of supporting that yes uh yeah so the the good job thank you for that input yes the reorg I think will will help that in the long run so it might be that it doesn't address everything quickly but we I know I know it's out there go go online and look at no I I already know it's out there I know what's been proposed and I know she's been been uh appointed as the interim so I I'm aware I just feel like it this week in particular it needed to just be said so I wasn't uh asking for any kind of thing I just wanted it to be
