Remove Item F from Consent Agenda and Add Below

4-0 Approved

Moved by Council Member [0:57] · Seconded by Council Member [0:59]

The city code requires items on the consent agenda to be sent out 3 days in advance. Item F was sent 2 days in advance, so it needed to be removed from the consent agenda and placed immediately below it for proper review.

Development Agreement for DCM farm second edition

4-0 Approved

Moved by Council Member [12:00] · Seconded by Council Member [12:35]

The council discussed the development agreement, particularly the ownership of outlots with stormwater infiltration basins. Concerns were raised about HOAs dissolving and city responsibilities if ownership was transferred. A significant part of the discussion focused on the definition of 'minor edits' to the DA, especially concerning financial figures like oversizing credits. The council decided to approve the DA with the understanding that only minor changes (less than 10% of fees) related to oversizing credits would not require re-approval.

Approval of the final plat for Vineyard Meadow

4-0 Approved

Moved by Council Member [42:30] · Seconded by Council Member [43:08]

The applicant requested to remove the development agreement from the final plat approval to allow for more review time due to receiving it over a holiday weekend, while the final plat itself faced a strict September 10th deadline. Council expressed concern over 11 unresolved engineering comments but proceeded with plat approval, making it conditional on satisfactory resolution of these comments by staff.

Conditional Use Permit for an accessory building exceeding 1,000 square feet (LC Stevens Amphitheater)

4-0 Approved

Moved by Council Member [44:31] · Seconded by Council Member [44:38]

This item was a direct consequence of a recent ordinance amendment, spurred by a past issue (Sundance Greens maintenance shed), requiring Conditional Use Permits for accessory buildings over 1,000 square feet. The city itself was the first project to be affected by this new rule for its own amphitheater at LC Stevens.

Phase Three Bid Award for LC Stevens Amphitheater

4-0 Approved

Moved by Sarah [53:32] · Seconded by Council Member [54:09]

The council reviewed five bids for Phase Three of the amphitheater, focusing on material choices for a new seating wall (limestone vs. concrete) and stormwater management behind the stage (riprap vs. concrete paving). After technical input from a consultant on the necessity of a retaining wall and the condition of existing limestone, the council voted to approve the base bid with Alternate One (concrete seating wall) due to its cost-effectiveness and durability.

Resolution 40, 20226: Council Member Resignation and Vacancy Appointment

4-0 Approved

Moved by Scott [1:03:00] · Seconded by Council Member [1:04:36]

The council approved the resignation of a member and declared a vacancy. The main discussion focused on establishing a fair and timely process to appoint a replacement for a term of approximately two and a half years, balancing the need for speed with public input. It was decided to issue a 30-day notice, with applications due by October 7th, and each council member to submit two questions for the application by September 9th, with a decision to be made at the October 13th meeting.

Award Leeway Daily for Public Facilities Assessment

3-1 Approved

Dissent: Council Member [1:09:40]

Moved by Council Member [1:09:12] · Seconded by Council Member [1:09:18]

Council considered awarding a contract for a public facilities assessment, a strategic plan item for two years. Leeway Daily was recommended (though not the lowest bidder) because they demonstrated significant research and a clear understanding of the council's 'study fatigue,' promising useful and actionable outcomes rather than just another report. The assessment aims to provide expertise staff lacks for planning future facility use and expansion.

Ordinance 26-17 and Resolution 30-2026: Council Pay Adjustment

3-1 Approved

Dissent: Council Member [1:16:03]

Moved by Council Member [1:15:20] · Seconded by Council Member [1:15:45]

The council considered adjusting their annual pay for the 2027 fiscal year. The proposed change involved updating the comparison method to reflect surrounding communities (excluding Maple Grove as an outlier), resulting in an approximate $1000-$1500 increase per member. The last adjustment was noted to be in 2014, making the proposed increase a 21% change over a significant period.

Resolutions 38-2026 and 39-2026: Preliminary Tax Levy for 2027

3-1 Approved

Dissent: Council Member [1:33:55]

Moved by Scott [1:33:00] · Seconded by Council Member [1:33:38]

The city administrator presented the preliminary tax levy for 2027, proposing a 10.56% increase, which would result in a $16 annual increase for the average homeowner. Council members debated potential reductions to this maximum levy, specifically identifying an $80,000 truck purchase that had been deferred to 2028 and questioning increased fire department staffing costs. The council ultimately voted to approve the preliminary levy at the proposed rate, but with an $80,000 reduction based on the deferred truck purchase.

Termination of Part-Time Public Works Admin Assistant

4-0 Approved

Moved by Council Member [1:36:40] · Seconded by Scott [1:36:44]

Following a closed session for preliminary consideration of allegations or charges, the council returned to open session and immediately moved to terminate the part-time Public Works administrative assistant position and post for a new one.

Mayor, members of council. Um, we need to remove item F out of the consent agenda. This is related to city code that states that 3 days before um a council meeting must be made aware on the consent agenda [clears throat] items. This was sent out 2 days in advance. So it needs to be removed from consent agenda. I just ask that it adds right below consent agenda, please. Thank you.

What can often happen is if the HOA maintains ownership of it and there's a DNU easement placed over it, AOAs don't always stay intact if they don't have a lot of reason to stay intact and then they just dissolve, don't pay their taxes and then you have properties all over and tax forfeiture. So the city owning them is sometimes just a little bit easier if you will to avoid that. So again, neither one is a right or wrong answer. Both are commonly done. Either ownership or easement.

But if if the fee if you're charging a different amount than what we agreed upon. So in this case I mean I think we're we're still trying to work out the developer has upsized utilities and so there's a credit that's given for the difference in the upsizing. Um that's what would change and you're working out the details on that. Okay. But there is already predetermined. You're just working the details out.

I have some frustration around all of the things that we've had to uh digest in the last 24 hours. And um you know everybody else had a holiday. I guess that doesn't apply here um for for anybody up at this table. So it's it's right and you know, everybody's got stuff to do, but um I like seeing the development agreement with the final plat so that we can digest the whole thing at once and and stir it around and and land where we need to. When it comes in pieces like this, I don't love it.

Development Agreement for DCM farm second edition

we can't we got tabled on the wershed. We've been working diligently with city staff, city engineers, and watershed to get everyone on the same page, which in turn got us to moving the road, removing a lot, changing the high water mark, all these things that the conditions have really dwindled, but now we're against a deadline of the 10th.

If so, if you do not do anything, if you table them, it is approved based on the 60-day rule. So, the the default is approval if no action is made. the the council can also ask the applicant to provide an extension.

So you do have to look at one of the alternates I believe in this case which would be if you're looking to do the limestone. It still would be constructing somewhat of a new limestone wall by moving them or we just award the base and we work with them to still salvage what's on site and put it in front of that wall. So she's saying so this is the she's saying this wall these are the that's the small section of seating right now. Y she's saying this yellow line is the new wall.

So, you want to concrete? Yeah. It's cheaper. It doesn't look you want a concrete wall. Well, it doesn't look any different. It looks the same. It's cheaper. And the limestone that's there is cracked and falling apart.

So, one of So, one of my big concerns in this, first off, there's [clears throat] a big difference between appointing someone for like 6 months versus two and a half years. Like two and a quart, two and a third. Yeah. Like that that bothers me that we can't have a special election.

Resolution 40, 20226: Council Member Resignation and Vacancy Appointment

Mayor Council, you guys have been elected by the individual of the city to represent them. It's your turn to make a decision on how that gets representation taken care of because you've been elected by the residents of the city. So they elect you to be up here for your opinions and your thoughts and what your drive is.

I think the biggest thing for Leeway Daily is that they did a ton of research on us. And one of the main things that stuck out to us is that they are they heard loud and clear from the council that you guys are study fatigued and they are now looking to just do another study. So that was one of their main comments that stuck out to us is that we'd like to have something that comes out of this that's actually useful

Award Leeway Daily for Public Facilities Assessment

I'm a no. I just hate this to Wait. Huh? You said I I think. Okay. All those in favor say I. I. I'm a no. And you're here. No. Okay. I just make a decision on my own. I don't need somebody else to tell me what to do.

So what that does in short because I didn't put it on a slide um 6210 is what the mayor is currently at. Using this new comparison, it'd be 7875. Council members at 49.68. The new the new um item next year would be 61.88. So, it's roughly a,000ish to $1,500 per member as an increase to the pay. still doesn't mimic how much time and effort is done on the council. And I think that's unknown by most residents of how much time is done by the mayor and council. So I think it definitely most certainly reflects the actual work that's being done. Although it still doesn't come close to the actual work.

Ordinance 26-17 and Resolution 30-2026: Council Pay Adjustment

I haven't had a 21% pay increase for 25 years.

Ordinance 26-17 and Resolution 30-2026: Council Pay Adjustment

I'm already to pick on you. You got a truck. You got an $80,000 plow rig that can come off of there and save the 2012 that you're repairing because I believe you said this new $80,000. You got two of them for 2027. I believe one of them is just to have a spare in case one breaks.

Resolutions 38-2026 and 39-2026: Preliminary Tax Levy for 2027

It is in the levy amount. Yeah. For the 987. It is included in that 987. Also, when there's, and I would prefer to see a cap than just to roll the dice and see where it comes out, the $78,000 added hours for the fire department. We don't know what that we don't know what that's for other than maybe it's for a Sunday shift.

Resolutions 38-2026 and 39-2026: Preliminary Tax Levy for 2027

I just I historically when we set a number in September, that's pretty much where we're at.
