The consent agenda included items on a pickup truck switcheroo for the Public Works department (changing from F250/F350 to a Ranger due to Marty's changed role, aiming for budget savings), staffing levels (concern about underperforming staff vs. understaffing), and sales tax on public works vehicles (not tax-exempt unlike police/fire vehicles, due to state statute).

Following resident concerns in the open forum about inadequate public notification for the City Center Master Plan open house, the council discussed the timing of a proposed mailing to all residents. Concerns about the short notice period (less than a week) for the November 12th date led to a decision to postpone the open house.

Council reviewed various expenditures, including significant fuel costs which were clarified as seasonal usage. They also discussed the declining costs of HR consulting (ABDO) due to the new HR hire and tracked janitorial service costs, noting it's not yet cost-effective to hire an in-house person. A $139,000 payment to the fire relief association was questioned, leading to clarification about state fiscal year payment delays and the ongoing transition to the PAR program. Landscape escrow reductions for David Weekley Homes were confirmed as inspected.

The council considered and approved a resolution to enroll in the Met Council's Livable Communities Program and adopt a Fair Housing Policy. The program offers grants for affordable housing development and small area planning. Concerns were raised about the implications of the fair housing policy and potential mandates, but Met Council staff clarified that it operationalizes existing laws and enrollment is voluntary and can be rescinded. The November 15th deadline for enrollment prompted immediate action.

Comprehensive Plan Amendment for Sundance Greens 12th Edition and Dayton Farms Park

This item addressed a cleanup amendment to the city's Comprehensive Plan, necessary to reconcile land use designations for Sundance Greens 12th Edition and Dayton Farms Park with a plat approved in 2018. Although original public notice was noted as improper, the city attorney did not identify a problem. Council member Scott moved to approve, acknowledging past process issues but focusing on current reconciliation. City Administrator Zach committed to an after-action report for staff to improve future processes.

Sundance Greens 12th Edition Development Agreement

5-0 Approved (with amendments)

Dissent: None

Moved by Council Member Scott [00:50:56] · Seconded by Council Member [00:51:17]

The council approved the development agreement for Sundance Greens 12th Edition, which includes credits for oversized utilities and park dedication. Key discussions revolved around amending the agreement to enforce city sign ordinances more aggressively against developers by drawing from escrow funds, with minimal grace periods. There were also requests for specific construction hours (7 AM-7 PM M-F, 8 AM-4 PM Sat) and downcast lighting (south and east sides only, if not prohibited by code) for the associated maintenance building, though the hours for the maintenance building were noted as only enforceable during the DA's active construction period.

Vineyard Meadows Development Agreement

Discussion Incomplete

Dissent: None

The council began discussing the development agreement for Reserve at Vineyard Meadows, an 11-lot subdivision. The developer requested the city purchase Outlot A, intended for water treatment, and asked for a prohibition on 'elevated storage' (specifically water towers, with a height limit of 25ft) to protect adjacent property values. The developer also sought maximum development fee credits, citing increased costs due to a city decision to convert a planned road easement (Outlot C) into an outlot. The discussion focused on the city's benefit from purchasing Outlot A versus obtaining it through fee reduction, and the long-term enforceability of the 'elevated storage' prohibition.

Notable Quotes (20)

this is direction from myself as we reviewed um purchases for this year and um reviewing what current operations are within the public works department. I think has drastically changed over the number of years. Um Marty does a lot of driving around now and doesn't do a whole lot of plowing and doesn't do a whole lot of operational work um because of his position.

Consent Agenda Approval

I just I just want to have it on record. I guess I have a concern about whether or not the issue is that we're understaffed or whether the issue is that the staff we have are underperforming. Um, and that is just a a a concern I have and one that um I want to make sure that we are we are making sure that the staff we have are performing at the level we expect them and that we're not just hiring someone to make up for someone else.

the for the city center master plan will be holding an open house on uh Thursday, November 12th between 6:30 and 8:30. Um we do have a uh kind of a task force that consists of uh representatives of the city council and commissions that meet twice twice a month. Um at our last meeting there's a discussion or or suggestion that we do a mailing to all residents uh for the open house. Um, I'm looking for direction from the council if you would like to do that. Um, it is about a $3,300 cost and there's not a guarantee that it will be received by all the residents prior to the 12th.

Open Forum Response: City Center Master Plan Open House Scheduling

I mean, I think it's important that the residents have a chance as we just heard, right? This is important. This is a big deal. Um people were kind of upset that they weren't invited to the that first round. Um so I think it's important um to get it out.

Open Forum Response: City Center Master Plan Open House Scheduling

It just it feels like a waste if they're not going to get it in a timely manner. Sure. We'll find a new date, but it has to be like as soon as humanly possible.

Open Forum Response: City Center Master Plan Open House Scheduling

In October, we spent $8,340 on diesel and just short of $12,000 on gas. In September, we spent 20 $2,27 on gas, zero on diesel. in August. 10,000 on gas, 4,600 on diesel. There's just a huge gap in there. I would think they'd be somewhat consistent.

Payment of Claims

I had asked if the ABDO costs are going down now that we've hired our HR person. Yep. Um, and how are we tracking that? And I think you mentioned in the budget, but if you wanted for these minutes.

Payment of Claims

So, um, apparently I was under a misunderstanding of how the operations dollars work in total for when we get money back from the fire relief and when we don't for the state. Um, that is related to 2025 operations. We don't get a payment till October of 2026, which seems absolutely asinine to me for how long and delayed that is, but that's exactly what happened.

Payment of Claims

to qualify again I I want to be clear it's not that the city is agreeing to develop affordable housing. It's that the city is agreeing to create the conditions in which affordable housing can occur. Um that is through zoning uh land that allows a density of eight units per acre.

Consideration of Applying for the Livable Communities Program (LCA)

once you adopt a fair housing policy, there's no reason that you can't resend it later or change it later. Um and the fair housing policy um model ordinance that we provide to cities throughout the region is really a policy that condenses the federal requirements with the state requirements in one document so it's clearer for your residents to understand the law the state and federal laws that the city is already obligated to be in compliance with.

Consideration of Applying for the Livable Communities Program (LCA)

I just have a comment and again my disclosure I'm the new guy. Um, so I don't know much about any of this stuff, but also want to make sure that we as a whole completely understand everything about the program and we're not just jumping into something without knowing every single detail of it. history has shown again decisions were made and then we found out they weren't the best decision.

Consideration of Applying for the Livable Communities Program (LCA)

The only reason I'll say anything is just so that it is um, people that are watching this meeting and didn't watch the planning commission meeting are aware that this was improperly noticed originally and was not correctly uh, notified uh, after the fact.

Comprehensive Plan Amendment for Sundance Greens 12th Edition and Dayton Farms Park

I'm going to make I'm going to make a motion to approve it. Uh, I understand some things probably weren't done 100% correctly on this deal. Uh, I don't believe any of that changes the fact that in 2018 things were approved.

Comprehensive Plan Amendment for Sundance Greens 12th Edition and Dayton Farms Park

John and I already talked we are going to do an afteraction report. After all um this process gone because um I can admit that it has not gone well from staff's perspective including my own and that we need to do better.

Comprehensive Plan Amendment for Sundance Greens 12th Edition and Dayton Farms Park

Can we put something in here about our sign ordinance and about that the developer will um follow our sign ordinance and if they don't, we will take the signs down ourselves and we will charge them for that.

Sundance Greens 12th Edition Development Agreement

The moment you break the rule the fine applies. There's no 30-day, there's no 60-day. The moment you break the rule, the fine applies. That would be my change.

Sundance Greens 12th Edition Development Agreement

As far as I'm concerned, I think this is a fair ask based on context from city code. The only way to ensure the site stays as harmonious as possible for years to come is to have it conditioned in a contract, to have it in writing. I feel detail needs to be included regarding adequate and appropriate screening types and I think my neighbor plans to speak to this and I respect what he requests. I asked for outdoor storage restrictions and sight lighting.

Sundance Greens 12th Edition Development Agreement

So, there's a couple things. Um first of all the restriction that I asked for was primarily for water tower not above ground storage. I changed the language to say like maybe a building no higher than 25 ft cuz I don't know what you know above ground storage you know you guys could get clever and it could be you know 600 ft tall.

Vineyard Meadows Development Agreement

All I'm asking is don't put some, you know, now that you, the city, own it, you know, don't put something there that's going to devalue the the value of these lots that we're putting in.

Vineyard Meadows Development Agreement

The city It sees no benefit to develop this particular outlaw A. However, we're asking if we could use it for water storage. Possibly the owner does not want water storage there above ground. However, if we were to go back with something below ground because we still don't know what we're doing in the old village, then all of a sudden there is benefit to the city. So to me, if I see if we're going to actually use it, if we're taking this piece of property and we're going to use it for something that we want to build, we should be paying for it.
