for e this morning 7:31 it is 7:30 2024 call to order we're looking for an approval of agenda anybody go through it and make sure they got everything on there they want motion to approve I have a do we have anything on the consent agenda just other than minutes it same you we'll help with that I'll second okay h of f in favor I opposed open Forum 3 minutes uh this includes people at home if you have a comment I don't know how do they how do they register at home if they were do they just sign in yep Zoom to the zoom link okay and we'll give you a couple seconds here to chime in is there anybody online can you see okay and there's nobody in the audience today so we will move forward to number five Eda flower pots update still looking for two including you people at home and your businesses if you would like to get two more on that agenda and uh I think all of us are here and we got the we most of us are on it yep that's correct yeah so we do have six of them spoken for I said we're still looking for two people still $200 for the year believe that was the number 200 bucks um they're already planted and ready to go and obviously just the only thing we get us that is that badge or that um placard on the front of your on the planter so you that people can see it every day they drive by they're walking you haven't printed the plaqu yet right nope well the ones that have been paid for right have printed plers stuff yep oh okay um but if don't you obviously they don't who's going to pick the next one but so yeah just waiting for more people to reach out right yeah I reached out to a few people and no one had any interest this year so yep so the Ed did pay for those we've already planted them all cuz we're not going to plant some of them and then not plant them and then leave them as dirt it's going to look weird and odd we didn't plant them so again he out that money whether we get a sponsor or not but currently they're unsponsored they just look like very nice flower pots two are unsponsored two that's correct I got you paid didn't I yep everyone's good to go everyone's paid up want to make sure accounts payable sent you money y CU if not Dave here will send it for me sure very kind very kind thanks man all right so number six did everybody go through the I a contract broker Services I did see they made some slight changes as opposed to our um Survivor clause and yeah we can amend and adjust anything you'd like to on that contract we did that yep yeah so did everybody get a chance to read it are we all liking it good to go Dave my comment is still that I I don't think we need the addendum for construction Management Services I know it doesn't obligate us to something but since we haven't got any uh projects that we're going to need managed on the on the horizon at this point I think it's unnecessary to have that in the contract um again it doesn't cost us anything it just to me if we were going to do a project uh on the scale that would we would want to use that kind of a service um I think we would want to get additional bids on on their cost um for managing different phases of the project but um I don't know does this preclude us from um soliciting bids or we locked in if we did something in the next can we choose to use them or not what you're asking yes for constr construction Management Services yep so that does not up so it's two different separate processes so we could if we if we do want to do a project at the Eda level we could always do an RFP for construction Management Services if you wanted to do that I would assume ieg would be one of first ones to submit an RFP because of ver contract here but it does not obligate us to use them okay because their their proposal and their pricing is in that addendum yes that's I saying if we don't I wouldn't want to preclude us from having the right to to get other proposals related to that and so if you take it out of their contract and it's no longer in their contract then that would not preclude us from going out to picking other people so it is and it is there as an addendum so I think we could cut it but that's that's my opinion mhm I'm not speaking for the group [Applause] here correct it doesn't weld us into the thing though we we can still choose outwards sources for Contract Services yeah yes as long as you remove the addendum out of the contract if you leave the addendum in there then that would obligate us to stick with iig so it does well us into it well if we signed it if we signed it with the addendum yep so if we signed it with the contract which is what um Mr fan is saying that yeah if we didn't have the addendum in there then we would be able to go off for other services if we have it in there then we have to use them and any reason why you don't want them in I would like to see it bid and that wasn't part of the RFP so we didn't get bids from the other players on this piece of it okay so you want to move the strike yes we have a second on that I'll second okay I I would have to agree that they would have to or the others would have to provide a bid on that section of only I think we still approv the contract less that so what I would look for is a one motion and then it would strike the addendum if that's the case okay I'll make a motion to approve the contract without the addendum okay Sean you and it probably isn't going to come into play cuz this only goes through December 90 or 2025 anyway and the likelihood of us having you know something but I don't know but I just don't want us to be handicapped by not being able to that one so and if they threw themselves to come into it well then hey winter chicken dinner I'm right with that M okay I Ser so we pass number six approval of lender Legal Services agreement I didn't see anything in there I didn't like I I didn't see anything that was standing out look pretty straightforward pretty generic contract yeah if we want anything specific we can obviously add it but this was their contract they gave gave me two months ago or a month ago with their RFP it's a very generic standard contract that they have is just basically pay us PR hour and that's we'll do whatever you ask us to do motion to approve I'll make the motion second any questions from our legal legal team um you seconded well second nope SE yeah I'll second all in favor all right I'm fine with it all opposed I one opposed one okay discussion on the master area plan 2050 comp plan update Zach this is a you thing isn't it uh well it's not really a me thing but I'm going to handle it today um with our community devel director being out um on vacation so um good morning Ed chair and Commissioners so what we're looking for today is this master plan discussion started roughly a year ago maybe a little less than that it's been a little while um it's been kicked around and sorted by the Planning Commission and it's been mostly focused on residential growth and it's also been more focused on you know revamping the downtown area um we have had one conversation with Council uh about this but we feel like it's best to have some Eda input on future growth of commercial and Industrial growth within this area um there is no industrial growth that is planned for the master plan area and we're what we're talking about is the area between 12 5th Avenue and 117th Avenue just uh east of East French Lake Road I will pull up the map to show you um the general area we're talking here so it's the general square that we're talking is this master plan area um it is a few hundred acres um of growth area but basically we're looking at is trying to this is all pre-work to get something ready to go for our 2050 comp plan that will be adopted in a future years um City staff and or city council has updated the map related to transportation and said that we're going to have more north south connections and not the x pattern which connects more East West or Northwest to Southeast and Northeast to Southwest um and they would like to have more of north south connection so we need to update the land use related to the U alignment of the roadways this is the current um existing future land use as we see it in the 2040 comp plan as this is today the master plan is to be able to master plan out or design what we' like to see in this area um for the 2050 comp plan and again this is all pre-work um the master plan does go into a bunch of different details but essentially this is what has come out of a first couple of discussions of the master um uh plan land use discussions of that same square um we have had one public input meeting um that was back in October or November of last year um very well attended by the individuals that were within that um Square which is really good and we will have more of these so this is not over after the Eda discussion but I would like to have or we would like to have some feedback from the Eda on your thoughts on the future land uses of this area um I don't know if you have a map if you have discussions I'm really not sure the best way to handle this but I think it's best to have discussion amongst the Eda related to to economic development is this the area where the spur was we were talking no this is on the back side of like Darwin's place he sold right like uh this is north of 117th Avenue so sharp corner yep was it sharp corner on East French Lake Road correct yep there now a four-way stop at East French like Road in 117th is um this this general area essentially it's our next growth idea is to follow the parkway as it continues to grow North and the city council has made direction that they would from the 2050 comp plan that they'd like to see at least at this time would be to move um development from south to North versus coming in developing from two or three different directions it's a much easier to plan for and so this is why this area was chosen is because this area is kind of our downtown in quotes area um it will not be you know never replace the historic village area for downtown but it will be more of the commercial hub of Dayton in this area has been the General Vision of the council for many many years again I nobody's saying this is going to develop next year nobody's saying this is going to develop in 10 years we don't know when this is going to develop but with the idea is that we have a general land use for when it does develop and when it becomes developable by either access or water or sewer um water and sewer are not in this area they're technically right at the bottom in this little BL blue on this blue line right here water sits right here and Sewer sits down here in the corner of the light purple so there's not water and sewer available at this time like I said the general idea is that we want to plan or have a good plan and be thoughtful before we have actual development come through so so what would all go in this area um So currently so I'm going to scroll back a little bit I'm going to scroll back a couple pages so don't you got all the pictures of the little shops and all that in there um that's in the master plan area y so essentially the different colors mean different things so the red would mean commercial type development um the pink would mean mixed use so that could be some high density that could be some commercial that could be um some smaller shops um the Orange is a high density or apartment buildings and then the yellow gold color would be or should say gold would be medium density or essentially um Town Homes type development again they could be detached or attached um but that's a general consensus at this time this is what the land use is that's projected for from what the Planning Commission gave feedback on this master plan document is actually from March I believe of this year there has been some changes and some updates to it again I'm just trying to get a general consensus that we can change whatever we'd like to um related to planning and yeah so and then once we get kind of the land uses or what we like to see then we can start looking at okay what kind of Street designs do we want to have what kind of downtowns would you like to have so the street designs are do you want to have two lanes in separated stuff do you want to have all the driving Lanes together and have a larger sidewalk do you want to have um no setback fronts do you want to have setback fronts on on driving Lanes um and then we'd have you know different types of structures we want to see it's different types of and this is very in comprehensive at this point we're just trying to figure out and make sure we have the right lane uses available but we had um some general comments that went out during the beginning initial phases of this master plan of what kind of town center would you like to see do you want to see a plaza style Town Center do you want to see a Boulevard style do you want to see a Public Square the general consensus from the the public I think we had 350 or 450 responses so was fairly well responded to um for what kind of kind of downtown people want to see and generally was that people want to see some sort of Public Square Public Town Center area this is kind of what we're talking about with the three different designs um people would like to see something like this with more open space and trees and some places to have picnics and whatever else that's generally What the residents had said back but this is a much greater discussion than just what's on the map of some colors um but again it is good for the Eda to have some more response back of yeah go how many responses we have two yeah 350 340 that's pretty good it's kind of a lot to dump in just 30 minutes of conversation I I don't disagree which is why I was sent out on the packet um to get some general comments or discussions of what you guys would like to see if anything if you don't want to provide feedback today that's totally fine but I would appreciate an email of some responses of what do you see um you can take this and draw all over it and say hey I don't want to see any of this I think this be better over here for the eda's perspective again it's important that we get everyone's perspective when we're talking about commissions and so Council can have as much information as possible when we're looking into the future I think I write in there that they wanted to have a plan together by 2030 so the 2050 comp plan must be adopted or at least the general date of due date is the 2030 time year um City staff with like to have it done sooner than that because the current 2040 comp plan not everyone's all thrilled with um I'll just use that as Terms of Endearment and um so we like to get it done sooner so the earliest we can start on this whole process is the middle of 2025 that's when we get our projections from that Council so next year about this time we'll get our projections from that Council based on population and once we have those and um in population and then how much we have to grow grow um which they are changing our current status from being three units an acre to being four units an acre so we are going to have to work through that process of um challenging that I believe that's what the city council would like to do but um we'll get those in the middle of 25 for confirmation and then we have until 2030 to get it done we'd like to get it submitted and started in 26 that way we can adopt it by 2028 2028 is the earliest year you can adopt a 20-year comp plan all of this work is not to say that anything's going to change today it's all about what pre work to be done for the future and what was the count plan for Oldtown was that 2050 also the historic village yeah the histor yeah 2040 that's correct so as part of the cop plan it's very inclusive of a lot of things we took a bit and piece area of a very high dense area that's going to have a lot of of our um units per acre and said we need to focus on this area of what do we want in this Square in the future a lot of the other or rest of Dayton is really low density residential so I mean we can make changes anywhere on the map we just pick some area to have a master plan on so we could start working on something um that's what staff's perspective was last year and still continues to be that same exact perspective so I I know that um this is a work in progress and yes that um probably the work that's been done up to this point didn't include the the news that that Council wants to move us to a higher density no so what adjustments do you well I assume we're going to have to make adjustments to this plan based on that new information I mean certainly we want to from my perspective want to appeal that designation and try to get that number back down that is the dire lower or or more flexibility or or something to go along with it but um yes since we seem to mostly appeal to deaf ears at the Met Council we um this plan should incorporate that those density numbers yes and how that would impact you know density around the city because ultimately it's the city that we're we're being held to as far as that ratio that is correct yeah so we will have to likely change some low densities to medium densities or some low densities to higher densities um better planning around future Transportation as well and probably incorporating some commercial and Industrial or not industrial commercial development higher densities along the parkway as it continues to extend North and then eventually across the river whenever that does happen across the north side of town um that'll have to be taken into consideration right now we just have it as low density or plan unit development I believe is what it is remember what that density is per acre to be honest with you um I think City staff would like to see that go away as well cuz we'd like to have our own plan and not somebody else's plan so what the planned unit Development Area of the current land use was that a developer must come in and give us a plan and then we'll tell them it's going to fit or not as the city council um City staff's perspective or and and or my perspective is that we should tell them what we want and then they can f figure out if they can make it work or not um if they tell us what they want and then we say no it's really just a waste of everybody's time um if we don't have a general direction but there is a j a large rather large Square on the north side of town um I think it's gray I believe in nature I don't have it on this I probably scroll up a couple and see if I can find nope I can't even get it there oh maybe here yeah so this I'm going to it's grayed out and shaded out but it's this General Square I'm talking about here we could change some the densities in that area as well um in commercial and higher densities versus what is a right now sitting as a plan unit development type so but there will have to be some consideration for commiss fashion like that's exactly what we're talking about there has to be some consideration for what M council's telling us too and we did not have that information when we started this process I'm kind of curious on how met Council we the city of dayon has an agreement that we did years ago with them for the three units beravor how all of a sudden if that's agre an agreement that's in place how all of a sudden can they change that agreement just because they want to I don't believe it's an agreement if it is I that would be news to me I believe it's adopted as part of the comp plans um during their when met Council makes their projections for what the the Met Council area is they set each individual um Community with a certain uh designation and we are um emerging Suburban Edge and we can get change designations at any time by met Council and that will change what our densities are and what they'll do is they won't designate Dayton as 4unit anchor they designate emerging emerging Suburban Edge communities as four units Anor in order to fulfill the needs of their sewer plant and so what they'll do is they'll change the whole entire emerging Suburban Edge and not specifically Dayton um they can also change Dayton from being Emer Suburban Edge to being Suburban period um and that will change our designation for how many units an acre and that's adopted every 10 years as part of the comp plan it looks like they're eliminating the emerging Suburban Edge and only having Suburban Edge and then they're moving us to that designation I think so that's correct so we'd have to appeal and say we need to be emerging Suburban Edge again which would mean that we'd go back to the yeah three but I got out of their presentation was that they're not going to have that designation at all correct yeah that's part of met council's plan so that that the agreement that you'd be referen to is be that would be my guess if that's what they're you're talking about for an agreement which is done every 10 years yeah unfortunately is that Leo Dean's property just north of that yes judment from 117th that whole it said 640 in that right along East French Lake Road and what's classified as now is he still EG or go to this is only future land so what future land use means is that you can stay what you are today forever nobody's pushing you out nobody's saying at the city you have to move what the future land use is trying to do is say if you want to move this is what we'd like to see there as in we'd like to see it be commercial so that will eliminate or help or assist you finding buyers for what you're looking to do how big is that Lake the lake yeah not that big it's not huge basically a giant SW SW giant swamp cross it yeah would it be um Scenic restaurant view type of thing cuz cuz if so and we could we could add commercial along the property line or the lak shore I'd be more favor to see sure shops uh I would say that you could use it as a natural landscape yeah I wouldn't recommend boating no on S Lake no but I'll tell you there's I get out on on my motorcycle on on that road once in a while which is why I really appreciate that fourway stop sign going in there but uh um there are regular and I don't know what that means if they meet weekly or people just show up when they want to but like a crowd of bird watchers that stand along that road and look at that Lake and I've stopped a couple times to see what they were looking a park in there some restaurants for a natural place which is why the park was suggested by the Planning Commission is cuz it's it is a natural beauty it looks very nice to the eye and it is very good bird watching and and it's a bird Haven there but it's not for recreation as in right but in terms of having some Scenic value clearly it does to that group that is correct I would think it does period grco wouldn't have built their campus on the side of the lake if they didn't think it was good they also cleared a bunch of trees and replanted a bunch of trees so that they can able to see the lake and then make it you know beautify it a little bit but so what do you think a shot at some some parking there and yeah I think to your point that we take advantage of the you know of that Lake being there I mean they always have value for some just to add a bu more highing just that's wrong spot I think would it be beneficial to include some sort of walking and biking trail and some viewing points along the way yep yep so that that's in the plan already with 3ers Park District so three Park District is planning having a trailer on the lake or whatever we can then incorporate that right now we're focusing just on land use but I do appreciate your points and I agree that some Trails involved would be intended um overall in the comp plan if we were to update the comp plan some parks and trails would be let's leave it nice and just add some restaurants in there because the red is total commercial right red is total commercial so that means be restaurant huh commercial commercial commercial what is it industrial or commercial nope red is just commercial that is no industrial buildings industrial is can't remember what color it is I think it's purple or yeah yeah so there's no industrial plan for anywhere in this I think it's 600 and some Acres 640 yeah and that way you can keep Leo in his spot with what he does on a regular basis and when the next generation of Leos take over they can still have their stuff uh the trail apart and some restaurants in there that don't you think mhm yeah and I don't remember the Diamond Lake Trail The Three Rivers future Trail does that go on the east side of the lake or the west west side west yeah so gr CO's trail that they built along West fren Road will be that trail will it connect to the side um I believe longterm we have planned as a city have planned to have a Looper around the trail or some sort of Trail connection around the lake um but that is not part of three R park districts General Trail they are going to go from the south side which will be start in this green little spot here and go along the west side of French Lake who one is that now um this spot right here the whole East Side East Side East Side is a bunch of various bunch of high dollar homes yeah a bunch of different owners I mean again this is not the city forcing anybody out this just if you want to redevelop or want to sell we would like to see this here if it's not going to be a house so we're isn't where's Sovereign Stables right now Corner out of this master plan area Okay Y and that answer your question yeah yeah if you have any other comments please send them to me um send VI email or talk about them now it doesn't matter is it big enough can you add a beach in there so people can go swim in now you can't not that L there's 100 yards of cattails before you get to any real water duck and it's well you'd probably sink out of sight yeah I think just quite a bit of muck and it would take a lot of restoration to do that and I don't know if the DNR would like that that's the it's a big caveat again I think your point is valid it's just I think that there'd be a lots more Hoops to jump through then along with the fact that it's so you guys plan on adding Trails do you guys plan on adding any Pavilions you know for future party rentals that way they can enjoy that lake at least maybe not go swimming but enjoy the view mhm and generate some revenue from that yeah we wouldn't likely you know again all of our Pavilions are public and you can go to them anytime you'd like if you like to reserve them as in you want this specific one for a certain time you can contact us at the city and then we can help you reserve it so that we can mark it off so nobody else takes it but it's really a first come first serve for The Pavilions any of them in any park period if you reserve it is there a fee for that yeah it's a small fee yeah $25 I wantest say 200 bucks no I don't think it's that much um maybe the $200 is like that plus a deposit if we have a deposit for any damage done but I think it's like $50 I think and typically don't call me on the number it's in the fee schedule typically if you have pons you also have a small playground something for the kids to play mhm so that's another thing I want to add on there oh that would be tough with it with the the way the land is I mean there's no place where you're going to get any of that's going to be at least 100 150 yards off the lake for sure I mean there's Cattails for a long ways wasn't even your Trails I mean you can Overlook the lake but yeah you're going to have to overlook some Cattails for there is kind of a High Ridge along the lake about 15 maybe 300 yd off I guess uh to where that's where your Trails probably would be yeah there's still buffers there's still lots of things we can't put it right on the lake you know not that kind of L no no there's no sand any more discussion on the number eight can we move to nine you all done yeah okay oh I'll I'll email you my thoughts sure yeah that'd be great again please take a look at the master plan and reread it if you'd like to um idea is again to get as much feedback as we can so the council can make an informed decision about all the commissions and all of the recommendations that come from those so would be appreciated number nine discussion ad Mangus veterans Foundation iup Event Center correct so um good morning Ed chair and Commissioners and this is not my item but I'm taking over for John on this one um so we had we discussed the Event Center related to Dean pumpkins we discussed the Event Center related to Fisher Farms Event Center um and then we now are going to discuss Magnus veterans Foundation again this is just about the event center itself and the business related to the event center this is located directly across the street from currently Fisher Farms Event Center which is here um the current one that we're looking at is um Magnus veteran Foundation I believe most of the community knows where that's at it's just over 30 acres in size um they'd like to host events as they have in the past they like to be able to have an event center classification so that they can host events whenever they'd like to as part of their fundraising abilities um again this is an agricultural use that only can be used in agricultural you um land they are able to based on the codes which is why it's coming in front of you today if they weren't able to do it by code we would not have this in front of you today but again General consensus or conversation related to the business itself of the Event Center would be appreciated from they're not a business they're nonprofits an that is a business in order to be a nonprofit you have to file with the state you have to file with the federal government you have to have a design of a 501c3 that is a definition of a business if it was a personal use it wouldn't have to have any those classifications that's so and does this give them a bit better access to what they want to do instead of everybody drive through their when you when you do an event they going to come in through the second driveway and go around the back does this give them better access to the to an event thing because I mean you gave Fisher their gig I don't see why we would be even having this discussion it should just be automatic for them so they've been hosting events here for a while um and have the same essential setup as the Fisher farms and events area um but in order to host events consistently on egg property you have to be designated an event center if that's the main purpose of the property so um I know that they do a lot of things for veterans which is very much appreciated in the community and they are a a general asset for the community overall um but in order for them to host events consistently or be able to do them whenever they'd like to the event center process is the correct process to use because it is essentially egg land that they're using for a business and currently you can't operate a business on egg land besides one that's doing for egg purposes like farming when did they apply month ago okay month and a half ago nothing will change from what they do today I mean the EV CER we wouldn't have a problem here we we don't have a problem do we no we created the problem because we wrote The Event Center coordinance after several of these businesses already existed so it's trying to you know get them compliant with the new rules that we made but we don't have to in my view we don't need to change how they've been doing business just because we have a new ordinance we just want them under that umbrella and to be properly permitted correct for that year so you're CA I'm yeah absolutely I did see something in there um you know some question around whether or not they'd be allowed to park on on the grass versus some kind of gravel or improved yep surface and I I don't know why we would want to require that I mean or care about it right mean generally in the code also use you know one of their fields for overflow parking or most of their parking and I don't know why that's a problem for us so I don't think it should be in there because in the code it states that you have to have an an impervious surface to park on we have to provide that as this is there's an issue with this related to Staffing because we can only follow the code city council can then say we don't need to follow the code or we're going to do this I mean the city council has the jurisdiction to not follow the code if they don't want to but as staff we have to follow what is in code and that's what was adopted in the code so that's why the question is coming up is do we want to do that or not because it's a general question of they are currently not code compliant do we want to do we do we care is the general question from staff yeah we allowed it at Deans to park on the field so I would say we would do the same thing here yeah that's it's up to them if they want to tear up their field in my opinion MH overflow but you're saying that it's we have that in the in the code is Curr today so we need to change it there not in a specific permit correct if you don't want it ever like so if you want to just do and to say hey we've done it before we're going to do this for now and it's going to be fine you do not need to update the code we don't have to update the code in order to do that and that would be up to the council's discretion to to be able to say we're not going to do that and we're not going to allow or we're not going to enfor we could have that language in this I saying that we're not going to enforce that of the correct got it you got it so our main question number nine is will you approve yeah General consensus of do you are you approval of event centers in Dayton as from a commercial perspective related to the Eda is why the question is coming up you in yeah yeah it's basically like Dave said it's to get everybody up to snow y what's good for one is good for all Sean Dave I'm good good to go yeah do we need a motion on this or we just all General general direction so that the feedback will be provided to council no different than planning commission's feedback will be this will be on the Planning Commission in two days so the Planning Commission has not seen this yet at least given Direction on it so that direction will be given two thumbs up for us okay sounds good okay you ready number 10 UDA discussion resolution do you approved by city council what do we got there yes so um again Eda chair and members of the um Eda want to provide the um enabling resolution that is coming from city council to be able to oversight with the Eda um to give a brief history the Eda was established back in 1990 um it was then amended by Voice vote and not by resolution um in 2014 is time frame somewhere in there and so because it was a Voice vote oversetting a resolution technically was not an official action by the city and it should not have been motioned or moved forward we operated for many many years with that process um our new attorney from the city had as they're going through a document said that we don't have the correct resolution to operate the Eda that sits today we need to update that resolution so that it's correctly operating as in you are able to do what you're supposed to do so general just for background again if you pass something by a resolution you have to re re um amend it and or adjust it by another resolution if you do it by ordinance you have to do it by again another ordinance in order to offset the previous one um it was previously done by resolution then it was done by Voice VT so that technically was not an actual um process and so this is getting this up to um par with what should have happened back in 2014 um this resolution is what was passed and discussed with that Council so this has the updates from Council of what they'd like to see um related to the Eda and and moving forward with the Eda but a a general resolution was provided at the last meeting on July 203rd which would have been last Tuesday or was it the 9th was it the nth the n9th meeting yeah okay yeah so the n9th meeting then it was updated by the City attorney based on the conversation at that meeting and this is what you see today in front of you is what will be provided to the council at the August 12th meeting related to adoption so we're all square we are all square yes any questions about that we good any comments when you read through it yeah adjust um that you know as always I guess I found a table there but we'll get to to that I guess before the council meeting yeah just let me know what I'm it and I didn't Mark the Spot exactly but it says six year for turn links it says six years then it says four years then it says six years again so I think the four was the tiple yeah I think it's generally supposed to be six-year terms okay correction yeah so that'll be correct anything else um no I'm I'm glad for us to get to this point because there's been a lot of confusion around a lot of confusion who does what and who's you know what Authority which group has and so on and this cleans that all up I think it also uh covers Us going backward um and basically said this is this is what we meant all along and so anything actions that were taken in that period of time or you know I don't know what the right is absolved you know we're we're accepting them as as what they were not trying to apply a different set of rules to them so I think this is this is what we needed we've been bouncing around around on this trying to get the right information for quite some time and now I think we're there so I'm good with it yep and as this resolution States that's why you approve the documents earlier is that this resolution allows you to have your own legal and your own Brokers and any other Professional Services you'd like to have as the Eda that you feel are progression of the Eda itself and how they how you operate which is why you approve the documents here um today is because as part of the resolution and direction from Council is that that's the general consensus from Council so so what's the next step for this then at the next council meeting they'll adopt it adopt it yep and we go to work and then you this is what so any updates so what we previously had updated with bylaws will have to be now updated with resolutions in the future the bylaws will be very generic and essentially say what we're trying to do and and be a general consensus of strategy and this will be your actual powers of what you're able to do and what you're not able to do based on the Eda this is the resolution so any updates to what the Eda can and can't do um to um commissioner Fashion's point is that it will updated through the resolution so that everybody has a state mandated Charter by state so this is I I will say that a majority of this follows exactly what the state statute is 46990 through whatever and and in those gives you the power to have the individual Professional Services how's the council flavor on this over they all are we a 0 or are we a 42 or a 32 or hope it's not a 42z that's six um General consensus from what I've got from the council is after the updates were discussed and talked about this is what will be passed yeah very likely we will show again I accepted all the changes that happen on here just cuz it doesn't matter to the Eda what changes were there because there was some language that was asked about we want to have this in there and the council said no so there's no point in even talking about it um but the redline version will be provided to council so they can see exactly what changes occurred between the two versions of what was on the 9th and then we will be on the 12th so this is generally what will be adopted from what my perspective is yeah well I always thought that the state statute was the Authority for us and that's essentially what they studied yep that's what this follows Yep this follows there's eend current on the council there certain me MERS who on a regular basis like to beat up the Eda with no with no due process as far as I'm concerned and I I personally feel that uh it's wrong at every level especially for people who are in in charge of this city so I want to bring that out there it's wrong moving on sure [Applause] okay discussion August meeting date potential move what do you got there um you guys seem to have the perfect dates um I try to take vacations when there's not Council meetings and there happens to be an Eda meeting every time I take a vacation so the next vacation time that I have planned is U I'm spending a week away with my family again and I will be G on the 19th through the 23rd which happens to be your next Eda meeting again you can most certainly have the meeting without me you do not need me here and I can make sure John is available to be here at the meeting if you'd like to keep the same date otherwise you can move the meeting whichever one you'd like to do providing the fact that I don't plan on any more vacations the third weeks of months that I'm aware of but it may happen again who knows so where do you want to land it guys again you can keep it the same date let me verify John's available I believe he is 1 2 3 it's a 19th is what we would normally be and you're on vacation so can 12 or the 26th any other conflicts with other uh so the 13th you cannot have a meeting the Tuesday oh I guess you could in the morning morning yeah so that's election day or primary election day which is why it's the 13th um let me check and just see if John is available so John is here on the 20th if you'd like to have the Eda meeting he can most certainly run the meeting again if that that works that's fine I do not have to be here um if John were to run the meeting likely there'll be more conversation around the master plan stuff and more future land use items um I know that's one of the things that John wants to work on with the Eda and seeing your perspective on those things um and then also seeing what we can do for code updates and and so on and so forth but to economic development of the community so but again if you want to move to a different date do we are we going to be stepping on the 20th decisions made by other councils is there anything in the way of that so they they're going to hear anything that we want that they're going to hear before this I don't think I'm making myself clear yeah if we hold it any time like the 13th uh 6th 27th does anything have to be heard by Council first oh so no the only thing that's um in August is the Magnus feder Foundation iup related to the event center which you just heard today okay other than that there's no other Economic Development things that you're going to miss or not be able to provide your feedback on for the council for the 27th meeting of August how about the 13th that work for everybody that's election day oh that's right the uh 20th he'll be gone that's that's fine I don't have to be here doesn't have to be here no I'm okay with second with 20th John will be here to run the meeting in my absence which is totally fine you want to give him a shot out the chair that's up to you that's not me I mean there we um with the resolution passed the city administrator would be the executive director of the um Eda I would have community development director step in cuz it's the same general aspect of what we'd like to see but for the same question do you want to have I'm fine with it yeah I have no problem with John running the meeting keep the same keep same okay mind you the same every event thing just let's see let's see what he can do okay y same 20th keep it the same you got it okay potential move staff update broad updates board updates sorry yeah um Ed chair and Ed Commissioners I do not have any updates besides what was discussed today um appreciate the resolution being finalized and or will be finalized here in August I'm looking forward to having that behind us and moving forward and seeing good things happen as part of the resolution as well we have to have some strategies um for what we'd like to see in the future I think that's going to be very important for the Eda overall and see if we get some direction um I do know that it's always been a a struggle for the Eda to have Staffing behind um the Eda to be able to do something essentially because it's does take staff time to do those things um I am slowly getting there just taking some time so looking forward to the future of what what brings to it but do we as an ideia need to to acquire a part-time individual to assist I I don't know at this time if that's the direction but it could be um that would have to be a request of the council for um taxing Authority unless you want to run it through your fund balance that you currently have um you could look for a part-time individual if you'd like to um that's that's a no or a yes but if you'd like to have more stuff done or more staff time to dedicated to the Eda I don't know if I can give you any more of my time at this time um currently okay not that I'm I'm probing I'm not I'm just want to make sure that you know we heard this song andan A lot the last admin I'm not trying to deter work I'm just saying that I'm I'm getting there it's just taking time I have as I pan off and move more Finance stuff to my account and stuff below me and then able to spend more time on other items which would be then the Eda uh question about the link property I think it's the the truck shop that's running out of there the lean property Al's place oh oh we got a fence around it now is all that uh it seems kind of weird there's a fence in a truck shop in there um it's not supposed to be a truck shop in then just fill that one out yep I know he watches the meetings sure okay call the ball anybody any other updates well I have a question um so we're in budget time yes but we've not really discussed budget in this in this group um we did discuss budget at the last meeting which was in June and we discussed that 62,500 was the number we wanted to utilize is that was sent out it was supposed to be discussed at the last council meeting and we did not get that out or I did not get that out yet so I did send it out on the last weekly update to the council they'll let them know that the Eda is looking for 62,500 um for operations moving forward for tax ly purposes so again we are still in preliminary tax levy time we can utilize and remove dollars and move dollars we'd like to if that's something the council would like to move forward with we will from that direction first staff but 62,500 was the request from the last time I remember that's changes have happened sounds about right who's our treasure Jack that was Jack do we need to assign a treasure we need to uh refresh my memory what that 625 covers draw a blank 19,000 operating there was there was a couple of different things that came up that amount get some allowances in there for turning I can provide the detail of that to the Eda as well just to confirm I think it was broker time there was legal time there was Professional Services time there was some marketing dollars there was some boy there was just a general miscell General miscellaneous number I have the breakdown on my other last week's sheet or last month's sheet is it in this packet as well I do not believe it's in the packet no I no it was discussed at the last meeting though in June what were you looking for Scott I just want to know where they are because uh this budget is going to be extremely tight I mean personally I'd like to uh the budget is after an 18 there's an 18% request increase and I know I have my number in my mind and however I would like some of the ladder truck included in that so that we learn to pay for to plan for things before we just go borrow we Pro instead of and right now even at my number I can't get any of that ladder truck in there so and this is on top of that lad Truck Yeah so there is options from the council there is option from the council as well if you don't want a tax levy for it you could authorize use of current funds to operate and be allowed to have a budget that way and it would just be using Reserve dollars for that current balance of the budget or current balance of the Eda 637000 um you've actually earned interest this year you're welcome um you're at 600 you look at the camera and say you're welcome yeah we're not the city we work for the city yeah so um yeah we have earned interest this year on um Investments so I think we're at 683 th000 when I check 683 y when I checked this morning and that's without a tax levy this year so that our balance has increased this year even while we have not had tax levy because of the amount of Interest I think we've earned $115,000 worth of Interest or 20,000 about 13 something rate like that I'll take it so we have earned money this year that's not the balance has not decreased it's the only thing we've expended from the Eda so far has been the flowers that's it and we pay pay the G uh okay she donates her time okay but we're buying the pl the plant pl we buy the plants and she she donates her time she did a fantastic job year they look really really nice so we appreciate her um that's Jane ramuno I believe it's her name I'll throw this out there again so we got two spots open flower pots if you are a business or if you were an individual or whatever you want to do we've got two spots uh talk to Zach at City
