Uh the EDA last month did request to to bump that up to 100,000. Um, so the reserves aren't going to continue to fund this ongoing. And and I think that, you know, you described that accurately, John, that at the time that that EDA levy got zeroed out, it was because there was a couple of years of very little spending. And the the logic was why keep collecting money that's not getting used. So we passed that point in my mind. We we are taking action on some things. We purchased some property. there's more in the pipeline and there's expenses that go with it and so there should be well there is a budget you know there's sort of two separate things what do we spend and what are we taking in but I think it should be reflected in the levy um >> yeah I agree >> again but that's a discussion that you know Scott and three other people are going to have and we were presented with a budget that showed a 19% increase and that's not going to fly So things are going to come out somewhere and I don't know how that'll all land but I think our consensus is that we're not somewhere between a 6 and 8% increase in the levy is is what the appetite of the council is and how we turn that into a budget is going to take more time. I mean, wouldn't we, if we're requesting a $100,000 budget, wouldn't we at least at a minimum try to levy to cover the budget? >> So, we're not taking that out of reserve. >> I think that's what makes sense. Point of order, Mr. Scotch Lock. I'm reading the point of order now. Okay. Uh, new business. Let's go to six. Concept plant group curbside waste. John, is that a you thing? >> Yes, thank you, Mr. Chair. Uh, curbside Waste has applied for a concept plan to add uh different types of yard waste. Uh, different types of waste, I should say. In 2022, they received a conditional use permit for a transfer station specific to yard waste only. Uh, they are requesting to add construction demolition waste, municipal salt waste, and single stream recycling. Uh so curbside just started operation this past April. Um the question of what what is a transfer station? Uh generally it's a large building where uh the garbage trucks come in, they dump their load. um a front end loader picks it up and and puts it into a larger truck and then that truck goes to its uh either a larger processing station or to a larger facility whether it's a landfill or a recycling place or a yard waste place or processor. Um with uh the whole process of of adding waste it's not a simple process. Uh the first part is that they've made a a kind of a notified the MPCA that they intend to apply for this. Um they will need to complete an environmental assessment worksheet which takes 12 to 14 months uh to go through. Um that is reviewed by the MPCA in the Minnesota Environmental Quality Board. on the city's end. Um they will need to apply to amend the the city code to allow transfer stations of different ways other than yard ways and then obtain a a conditional use permit for transfer station for those other specific ways. Um in our code right now we're specifically only allowing yards. So this is where the amendment is required. Um the intent with conditional use permits of any type is it is a permitted use with conditions and so those conditions are intended to mitigate any nuisance factors that might come up by the the land use. So in this case uh the question is with the the additional waste is there any change in the visual appearance of the property? Um no there's not. They're not planning on building there's no bu building additions. Um everything's going to look as it is currently. Uh with the noise, is there any additional noise with the different types of waste? Uh potentially uh with the building right now, currently there are uh six doors. None of maybe it's five doors. Um no, none of them have actual door. They have door openings, but no doors themselves. Um with odor, additionally, the different types of waste are going to have different odors. Uh same thing with the litter. Uh with traffic traffic uh curbside is staying that no additional traffic would take place. Currently curbside is operating under capacity. Um if they run at capacity uh the building is so only so large to accommodate so many trucks. So it would not change the traffic. >> You said uh there'll be more noise potentially. H how do you come up with potentially? Um, I I think of construction uh debris as being heavier, for example. Uh, you know, you have, and I'm just making assumptions here, where you have like concrete that you're going to be moving, it's going to be noisier um moving concrete or demolition debris than it would be uh grass clippings. >> Does concrete smell? >> Um, I don't believe so. >> Okay. So, if we have concrete making noise, potentially. >> You see where I'm going with that? >> Yep. >> Okay. I I don't I I walked it out in in all wind conditions. I didn't get a whiff of anything. So, whatever they're doing, they're doing and they're doing their job. Um the these are small loads that are not they're not commercial loads that are coming in. is, you know, cleaning out your garage and and getting rid of stuff. >> So, they've been running for how long? >> April. >> Any uh complaints? >> Not that I'm aware of. >> Nothing. >> There's several residents that have concerns. >> Well, they can have all the concerns they want. If they haven't had a complaint, they weren't concerned enough to make a complaint. So, if we were to say, "Okay, long as they're doing their job and they're following through." And I do have a little bit of information I can add to this, too, just for the group. >> Um um you know, curbside here, they they they're the owner is also based here in Dayton. He lives in Dayton. Um and it's a great business. Um, and you know, as John had said, they had estimated they were going to be doing 40 loads a day. Right now, they're doing anywhere from five to seven loads a day. So, >> 20% capacity. >> Yeah, they're very far off of what their capacity is. um they would like to add CND recycling, general waste, one as a service to the their customers, but two to get this building up to capacity to where it should be. So, um and I I have I I know that they talked about they would add the overhead garage doors. They have different processes they can use as far as mitigating odor. I don't know what that is, but apparently there is a process. >> Whole bunch tree fresheners. >> Yeah. Um >> and they still have to go through the the MPA the PC I mean and >> yeah, nobody does nothing in the state without MPCA involved and they're not an SQ, they're LGQ. >> Um I think more they were just bringing it to us just to get some sort of preliminary like we're on board with this or not before they move forward. >> Yes. So, the intent with the concept plan is that there's some I'm going to say a general signal from the council if they're supportive of the project or not before the the applicant spends a bunch of money on this with the EAW that I mean that's going to cost over $100,000 to complete. >> So, Sean, they're normal trucks that they're picking up garbage, the residential garbage are not dumping here then. >> Correct. But if with this change they'd be able to is would that be one of their ideas is to >> I don't I still don't think it would be normal yard waste >> yard normal garbage. It would have been normal garbage. Everything that here >> go is sorted and goes to the landfill or recycled. So >> the the curb sides intent is that it be organics recycling. So if you have organics of you know you're you're cleaning out your fridge that goes in a separate waste can um that then comes here. >> Will they be taking cars and converters and all that kind of stuff? >> No. Got another location Dayton that does that >> converters or big money. >> So So then what they're really asking for is not to bring actual like residential waste here. So let let me start at the beginning here. So the Three Rivers Park District purchased this property. There's several buildings there. Um one of them is this house which I believe was built in 2022. Uh the appraised value is for the house itself is $400,000. Uh Three Rivers has offered to sell it to the city for $100,000 um under the condition that we move it by October 1st. So the question the our cost to move it um to the site on the old village is somewhere between $500 and $550,000. >> Holy >> So first question is should the city purchase the house and the second question is uh and this doesn't have to be answered today is what do we do with it? One option is move it to the site on uh the old town and another option is just to sell it to somebody else. Well, based on on what I see here, you're talking 650,000 for that house. And what what's it worth? The 400,000 appraisal was going to cost you the more to move it than the house is worth. >> That's one of the numbers we're going to have to discuss. I'm with you on that. Um it was a little bit uh interesting of an application because site plan reviews typically are accompanied by a companion conditional use permit or something like that. However, this is just an expansion of a an existing facility um where that was the only topic of conversation necessarily to the site plan review. So the existing outdoor storage from staff's perspective or understanding is that it's been operating in a non-conforming capacity. uh where the outdoor storage was established prior to the allowance of outdoor storage by way of conditional use permit in the industrial districts. Um so that uh was not necessarily the topic of conversation though it was brought up during the planning commission meeting overall. Um >> what was their reaction to that? >> Well, it was just more so explaining because it is operating in a legal non-conforming capacity. There's no conditions a part of the site plan review for the office expansion that you can tie to the outdoor storage as it wasn't considered a part of the site plan application overall. Um so I did talk to the property owner and he is um short shorter term within the year uh he plans to kind of uh scale back his capacity on the site and offer it up to other users that are an existing uh landscape company that's already operating there. Uh where the outdoor storage is stuff or the items out stored outdoors um is going to be reduced overall um just in connection with these uh this building addition. So, on top of the office expansion, they're also going to delineate parking on the front side of the um building with asphalt uh which has not been delineated for from my understanding historically not a part of any site plans that have been approved for this site or anything. So, they are going to identify parking on the site. Um and all of the outdoor storage items are to this point going to be um moved behind the build the front of the building that anymore. >> Uh I cannot but I can pull up a uh a GIS or just an aerial that will zoom. >> Hayden, what's their business model? What do they do? >> So Tom Spaner owns Northwest Landscapes uh and they currently is uh owning and operating both of those sites here. He got conditional non-compliance by a zoning change or how did he get there? >> Grandfather probably. Actually, it is in the zoning ordinance that says any expansion or new construction on a non-residentidential property requires a site plan review by the planning commission and city council. Now, I will say uh council member Fishant that that is something that uh I've kind of questioned just going through this process because I've not seen that typically in zoning ordinances. Um and that might be a question that may be posed when you see this next Tuesday. uh whether these are the types of things that you want to see for review by the city council. And if not, I've seen things where if it's um it it set it sets a threshold of maybe there's a certain square footage that if you're going to expand your existing building by 50%, maybe that's when it triggers a site plan review or something like that.
