of America and to the rep for it stands one nation God indivisible andice for all at this time of the meeting it's um common or typical for me to read an open Podium invitation to our residents open Podium is an opportunity for Eden Prairie residents to address the city council on issues related to Eden Prairie City government government prior to each council meeting these Council meetings typically occur the first and third Tuesday of each month not in the summer we have one a month in the middle of the month but these open podiums will be offered to Residents from 6:30 to 655 p.m. here in the council chamber if you wish to speak at open Podium please contact the city manager's office at 952 949-842-0774 your phone number and subject matter so we can be better prepared for you open Podium is not recorded or televised if you have questions about open Podium please do contact the city manager's office so Mr Geto uh tonight we do have the U people Fest Proclamation uh do you want to make any comment about it prior to me reading the proclamation actually mayor I'd like to turn things over to our Park and Recreation director Amy marle and I think she has some comments before you read the proclamation perfect Amy yeah thank you mayor and Council uh we are excited that people Fest is coming up it falls on January or July 28th through August 4th and it's a free community event where we have activities going on throughout the week we encourage Community uh to check out music food dance that we'll have out at starring Park we also will have movies um people are encouraged to we have field trips to come on those we also would love to see people check out many of our historic sites that are found throughout the city again all the activities are free and you can find them online on our website and well hopefully we'll see you out at the park great thank you um and I I always forget I feel like people Fest was named by somebody pretty famous and someone I know um who who might who might that be uh council member PG Nan I believe um actually um coined this phrase or this name for it so um that's pretty cool well I'm going to read the proclamation Proclamation city of Eden Prairie henpen County Minnesota people Fest week it's got a few whereas statements here whereas Eden Prairie is a community composed of people from many backgrounds races ethnicities abilities and identities and whereas we are a city that is committed to the promotion of diversity Equity inclusion and belonging and whereas our community is more vibrant because of our diversity and whereas cultural sharing leads to Greater understanding and appreciation and whereas people Fest a community celebration of culture is an annual week-long celebration that honors and celebrates the range of traditions that tell the rich story of our community and whereas people Fest offers many free opportunities to experience culture through stories and food music dance visual art and more and whereas the celebration's main event is the people Fest party from 3: until 700 p.m. on Sunday July 28th at starring Lake Park and whereas the people Fest party includes live music dance performances demonstrations and art experiences as well as booths with a variety of cultural and educational organizations sharing their stories activities and Outreach now therefore be it resolved at the Eden prie city council encourages every one to take part in this community celebration of culture and further the Eden per city council does hereby Proclaim July have a lot of great events in this city we really do I know every city has their particular lists but I'm super proud of Eden prairies um and I think um it's just a lot of fun it's in the long list of great amenities that we have here in the city um council member and Ryan oh did you I thought you just you just hit that okay um anything else council member to me oh well you so I no I just thought I thought I mentioned I I think back to the last council meeting and I think I did in June I did a rundown oh yes of you know what was coming up and and we talked about um July 3rd and July 4th and and some of the different events and as you know um July 3rd happened and and we had a a one-of-a-kind drone show uh July 4th did not happen and our plan is um at some point within the next week to be able to announce that um it won't be the same exact event but to at least have the music and the fireworks and and some food back at Round Lake kind of a makeup July 4th event at the end of August um details to come um but we do want to be able to make make that up to the community it'll be it'll be very similar but it won't be the same the same exact event it'll be most likely um only in the evening but look look for information on that that'll be uh coming out soon and as you know you you just talked about people Fest and and we we have a couple different events coming up at Lake Riley and we'll have arts in the park so um as we like to say if you look at the City calendar when you think about the music series and the Eden Prairie players um some of the kids activities there's something going on four to five days every week and to find out information on this rescheduled date stay in touch with us through our website Andor Facebook and we'll have information out um fairly quickly IM minutely and as you said in the next week or so and just let people know I mean that the the the big um exciting part of July 4th really to me but I think to many people was is free and easy the band and the incredible fireworks show and so both of those have been rescheduled for another night yet to be announced but it's coming soon you'll hear about it within the week so we're really excited about that uh again at Round Lake Park um I believe food trucks I believe we'll or at least some deserty something I don't want to give too much away I'll let um Amy I get that out on online but uh so we're we're pretty excited about that and then um just again in in the um Spirit of talking about all the kind of fun things going on in our Parks we have two events this uh summer at Riley uh that we're calling picnic in the Park Mr Geto I picnic on the farm picnic on the farm ah I was going to try to memorize that picnic on the farm uh and celebrating uh not only Riley Park but uh our history and we um some of you may not be aware but Eden Prairie has three original log cabins that were constructed in the 1850s that are still in existence two of them are privately owned I won't give addresses away but one of them is at Riley Park uh next to the barn in next to the uh brick um Al Al Shaka brick Farmhouse from the 1870s but so at the Log Cabin will be some fun activities and uh celebration again of our history from way back in the 1800s so we're excited about these two um fairly newer type activities I believe um picnic on the farm one in July one in August so again go out on our website go out Facebook and you'll uh see more about all that Amy do you want to add anything that I don't want to well I am stealing your thunder but do you want to add anything to that sure the first picnic on the farm is going to be next Wednesday night from 6 to 8:00 p.m. we'll have a pizza truck there so people can spread out a blanket bring chairs and enjoy Pizza meal and we'll have drinks for people um you can enjoy a tour of the historic Dorne camper house we'll have games and artifacts for people to enjoy and we'll also have live music so it should be a beautiful night by the lake I know my wife and I on Saturday went down to Fort Snelling to the gift store and purchased on behalf of the Ed per Historical Society a lot of um old games that are handmade kind of wooden kinds of fun things and we'll have them out on a table for kids and so it should be um should be a lot of fun thank you Amy for you and your staff and helping to organize that the other one's on a Wednesday also right correct so okay um all right moving on we have um approval of the agenda and I believe um just one Council me two council members have council member I'm sorry my fault no one council member report that's on me I'm sorry mayor but there's an additional consent oh yes I'm sorry so we have we brought on just today today yesterday um a uh permit for the Lions Club um for what would actually be our our planned celebration that you were just talking about okay on yeah so that so having the Lions Club with an onsale temporary liquor permit for the I'll call it makeup 4th of July event council member rep yes and then um um council member and Ryan you have a council member report yes okay uh is there anything else to add to the agenda if not is there a motion to approve usually a listing of of items that are fairly routine housekeeping per funct U but nonetheless need to be passed by the council um Council uh you have the right rights of course to pull any of them for further conversation discussion or clarification uh anybody want to question or um pull any of these items thank you mayor I'd like to pull I believe one I would talk to Mr gon R which one r r the Miller Park courts and I like to have it pulled is just a separate vote on it separate vote perfect um so if there's a motion to approve a through W um minus r um and then we'll vote on that I'll move to approve items a through W with the exception of item r on the consent calendar is there a second any further discussion all those in favor say I I oppose okay Council uh member fryberg uh go ahead ask your question or CL ask for clarification one mayor one thing we can do I talked to council member for this Amy because I think it'd be good there's been a lot of Workshop discussion over a period of time some council meeting discussion this is a big project you've talked about it quite a bit um but I think it would be good if it's okay with the council that Amy kind of give us an overview of how we got to where we are and what led us to this point of what I think is really good news because not only did you direct us to do these outdoor courts we've got really good bids but I think it would be good if if she kind of took took you through um what you well know um what we've been through to get here sure mark would you mind if I just ask you just so I'm very clear what um are you looking for a particular something from from staff that caused you to to raise this oh absolutely the reason I asked to have it pulled um number R is the size of the of the contract itself um I don't believe it s belongs in a consent just for what it is it's not that I'm you know when against but I believe it deserves a vote uh it has appeared in the local paper now as far as Eden Prairie News and um since they've given attention to it drawn attention to it I just believe that it's it's due a visible vote excellent no it's very fair all right Amy yeah thank you mayor and Council uh just to bring everybody kind of up to speed on this project the Miller Park Court project it started approximately four years ago as staff rep up starring Lake there is still a need for additional pickle ball courts uh to meet the needs they looked at locations a potential design of an indoor pickle ball court complex and at that time the estimated project cost was about $4 to5 million just for the facility um and then you look at inflation postco and we looked at the cost of Maintenance and Staffing the facility that cost more than doubled uh when we presented that to you uh several months ago we also looked at the numerous privately owned indoor pickle ball court facilities that have really popped up across the Metro many of which are close to Eden Prairie and this kind of gave us pause moving ahead with an indoor facility so we s additional designs for outdoor complex um and ultimately worked with both the Parks and Recreation and Natural Resources Commission along with you the city council at work sessions and our scheduled commission meetings to recommend and approve this design for Miller Park and just to remind the public it includes eight pickle ball courts One tennis court and one basketball court it will have shaded seating areas and tables and one unique thing about this complex is it will be lit uh to extend the hours that people can use this facility particularly on the shoulder season so people can play you know when it's dark at 5 o'l well into the evening out at the park so we've been working with both our consultant isg and the Riley Purgatory Bluff Creek Watershed District to acquire the appropriate permits to move forward with construction and we're pleased that the bid opening for the project it was June 27th we had seven bids ranging from 1.4 million to 1.8 million and we would are recommending going with the lowest bidder which is good minson construction out of Minneapolis and they had a bid of 1, 449,000 uh with that construction can start this summer and hopefully wrap up before the end of fall and provide some play out at those new courts before the end of the year we're excited to expand the athletic opportunities and meet the growing demand for pickle ball and other athletic sports in Eden Prairie is that sufficient for so and and and Council councilman fryberg number one let me be very clear I think that was a really good idea to have that pulled and have this conversation because I think you're right it gets in the paper people want it's a lot of money you know me that I'm interested in precedence and consistency for the future so then I wonder are we sending or should we be a message to staff hey you know don't put anything over a certain dollar amount that's in consent the reason I that Mark is that J item J is awarding the contract for the Prairie Center Drive in Fran low intersection and we awarded it at 1.5 million so that's a larger item than this one and we didn't pull it but again I'm saying I think it was a good idea to pull it because of the public awareness so go ahead if you have a thought on that okay my thinking and answer to what you just said is my motivation is when it got brought out in the paper like it did it drew attention to it and I guess the public residen Eden Prairie deserve a straight up vote rather than consent it's probably not a bad idea when it gets to a certain point we might want to discuss that rather than put it in consent because when you look at consent there can be some things like basic like a few potholes in theory as opposed to a large contract so we may just want to think that over a little bit down the road but this one was definitely had to do with being in the paper combined with the size and and Mr G we can talk this at a workshop or um you and I can talk it offline at some point but maybe when we're listing out a long consent maybe we do put a couple asteris or dollar amounts that this one is over a million you know and you all have known about it like Robert this is nothing new you you look at our CP CIP you know for the next 10 years it's $150 million or something for Road reconstruct so there's nothing I I made that up in case someone's factchecking me um but so but so we've known about this but nonetheless that idea you've got me thinking Mark about you know sometimes we think of these per funter housekeeping and they are but right sometimes they get some big ticket items and maybe we owe it to the public just to have a little uh explanation in the moment or something any thoughts Rick before I we vote on this I don't want to give you guys more work I'm just thinking to work some question so the general definition of consent is not about a dollar amount necessarily it's about um and it's not only perfunctory but it's something that um you pretty much have a feeling have full agreement and full understanding on is not a public hearing it's not an ordinance it's not a report and you know as you said many of the capital projects that you talk about leading up to this buying a fire truck buying a police car patching a street doing a park playground replacement those final votes end up on here and sometimes you've had quite a bit of discussion sometimes you haven't um quite frankly I would say um we can kind of think of these things ahead of time but the best thing is to say let's pull it off and talk about it like we did tonight because I think it's going to be I could think about a hard and fast rule about dollar amounts and then you're going to have um purchasing lime at the water plant sure or I so I I think of all different variables to this May so um we do our best sometimes I think these bigger projects that are high-profile in the community we do a report and we talk about in this case I know we spent previous meetings talking about this and this is a conclusion of that but but Amy obviously was able to really give you a quick synopsis if given given a little bit of notice and to Mark's credit it really is up to each of us as five council members to make sure that we not just read the uh consent item but actually go into our notes right and find out what they I mean I'm I'm assuming on some level we do that in a cursory way but at any rate it would be up to us to dig a little bit deeper if we want to have more information so thank you so but um I just when I when I noted the um Fran low intersection construction was even more than this one then it made me think well what is it that makes us think that we should pull it so okay with that we need to vote on R um let's see we don't have a motion on it so is there a motion to approve R um move to approve r on the consent agenda okay accepting bids and approving Construction contract order okay uh is there a second second any further discussion all those in favor say I I I opposed all right we have a couple code Amendment uh public hearings this evening uh Mr Geto we do mayor thank you and for both of them our community development director Julie kle is going to give you overview so I will uh turn things directly over to her I would just note that since both code amendments are in the zoning ordinance um we have public hearings associated with these even though they're not necessarily high-profile code amendments got it Julie mayor members of the council the first code Amendment on the agenda this evening is for the industrial Flex Tech zoning district and I do have a PowerPoint presentation a brief one that I'd like to share with with you so this code amendment is born out of the city's comp plan Aspire 2040 as a part of that comp plan the city created a new designation called industrial Flex Tech and the map on the slide um illustrates much of the area in the Golden Triangle is guided as industrial Flex Tech at the time that the Golden Triangle developed industrial standards uh for development were much different than they are today those uses have evolved over time and the designation is really intended to provide more flexibility and reflect modern conditions for those uh employment uses so as a part of uh not only providing that flexibility and ability to adapt to market conditions it also would promote a streamlined review in what staff is proposing so we are proposing to remove the cap on office uses in the I2 and the I5 zoning districts in both of those districts right now by code property owners are allowed to have 50% of their building as office use as you know sometimes waivers come in through the Pud process where folks ask to increase that so by having this uh cap removed there would be more flexibility to adapt in the moment and not add process in addition the flex service zoning District also has a cap on office you said 15% of floor area the only zoning district from an industrial stand point that would um maintain that 50% cap is the I General zoning District that is intended to be the city's more heavy industrial zoning district and there are only I'm going to say a handful of parcels uh within the city that are zoned I General so that in a nutshell is what this uh code amendment allows for and uh provides consistency with the comp plan policies and and Julie uh relative to the um what was the legislative bill they were missing middle Bill trying to um kind of push cities to allow more residential into their commercial areas which did not pass uh however we do that here in Eden Perry lot so let's just say one of these I2 or I5 or Flex properties came up and an apartment building was proposed it would simply go through our process and we would look at it as a council and see if we wanted to change zoning uh and and and look at this would not impact that in the slightest correct process it has no bearing on that whatsoever okay Council any um any questions before I open it up to um public hearing okay if not this is a public hearing is there anyone in the audience wishing to address this code Amendment industrial Flex Tech by the city of Eden Prairie please come forward seen no one um council is um you can still ask questions after we vote or after we go ahead and make a motion so is there someone that would make a motion and we'll get a second move to close the public hearing and approve the first reading of an ordinance to amend city code chapter 11 related to office uses in the industrial and flex service zoning district is there a second is there any further discussion or questions all those in favor say I I I opposed okay on to the next Cote Amendment mayor members of the council the second code Amendment this evening is for the RM 2.5 zoning District that is the city's high density residential zoning district and I do have a PowerPoint presentation for that as well um this zoning or this code Amendment addresses Landscaping requirements for that zoning District so as you might recall from development project review the city has Landscaping requirements that are based on the size and scale of a building and then separate IND distinct from that are the city's tree replacement requirements so this does not propose to uh adjust anything with regard to the tree replacement requirements it only addresses Landscaping in prior to 2016 the city only allowed trees to count towards a landscaping requirement throughout the city in 2016 you might recall we went through the process to create design guidelines and as a part of that there were a handful of code amendments that were instituted including uh a major overhaul of the Landscaping at that time we decided to add in the opportunity for things such as perennials planting beds and shrubs to count towards that Landscaping requirement developers were doing that anyway it's part and parcel of what they do when they design a site um and we just weren't allowing credit for that so at that time code was amended to allow up to 25% of the shrubs perennials and planting beds to count toward that Landscaping requirement at that time we discussed let's start at that 25% and we won't really know if that's the right number until we've had a chance to really test out the uh ordinance through actual development projects that have come forward so um as I said U the design guidelines were also in play at that time to provide some direction to developers as to best practices that the city was looking for so fast forward to 2024 uh we've had eight multifam projects in that zoning District in the past seven years seven of those projects have had a floor area ratio of one or greater floor area ratio compares the amount of floor area to the size of the lot so we're talking about projects that have very tall um expansive buildings on smaller lots and so many of those projects six of them have received waivers from the Landscaping requirements in part because they just don't have enough room to put all of the trees and that would be required with only a 25% credit for the uh shrubs and perennials so infill projects with those large buildings and small sites are really kind of that pinch point if you will so staff is recommending that we allow a greater percentage of the required caliper inches to be substituted by those planting beds shrubs and perennials uh but we're not proposing it across the board in the RM 2.5 zoning District only those projects that have a floor area ratio of one or greater and then in addition to that you can see the seven um design guidelines listed below the development would have to prove that they are meeting five of those seven design guideline requirements so you wouldn't just be able to come in and uh blanketly count 50% of the Landscaping you would have to meet these other standards as well and with that I'd be happy to answer any questions that you might have I have a quick question is this comparable to what other cities are doing right now uh mayor members of the council I I would say yes that it is of course every city has their own flavor and flare of how they um address Landscaping within the city but many of them do yes include uh increased credit for the Landscaping we wanted to in 2016 take a more cons conservative approach to that and see how it looked and how it worked in actual test cases council member Nelson I must say that I've liked the additional landscaping and flowers and flowering bushes it gives a nice look to the city makes it a look a little more homelike to the big buildings and um I like this a lot and would like to encourage them to do a lot of that kind of thing as it seems to keep the look of the building better and a little more home like at the same time so I'm certainly not opposed to this and I agree with council member Nelson I think it um could have some positive outcomes I do I do wonder if we're getting the Landscaping in a way already plus we were getting trees and on those sites with the um ratio of 1.0 or greater um not enough room to put trees on weren't we still getting cash and lot of in terms of going toward uh the trees and then we could use those elsewhere across the city so we're not going to be getting that because Julie can we will be getting that but Julie can answer that it's not related to the tree replacement mayor members of the council that oh so it's only the Landscaping tree piece of it got it yes the tree replacement payment and L option is still on the books remains unchanged this is just for the Landscaping requirement the number of trees that are planted as a part of the Landscaping requirement do we still have flexibility I'm thinking of um the Ellie and The Border their southern border along the Smith Cafe line that I I was hoping to have a lot of trees in there just plastered trees and do we still have that flexibility and I don't think I got we got enough my personal opinion and do we still have the flexibility with a um developer like uh of the ell to push a little bit back and say we really want you have more trees here within your 100% than just putting bushes or or something I mean can we still have that conversation absolutely mayor members of the council and we do on a regular basis have those conversations with the developers reacting to the specific conditions that exist for that uh particular proposal what are the surrounding uses how is that site laid out council member fryberg one thing that I really liked about it it was your presentation it's not like someone can just come in everyone it's going to be cart Blanc you have to measure am I right five out of seven correct okay that puts it at a pretty good you know level still gives the flexibility but good cross check for you thank you I know our last project where we had a tree issue was was not residential it was commercial it was up um U Mr Geto it was up um a part of I didn't even know it was Eden per it was up in Opus it was American Family Insurance at that point we were trying and Lisa you had some issues and concerns that there just wasn't room to put trees in there and yet you wanted more trees but in that situation again is there no flexibility I realize that's not tree preservation replacement I get it but is that a situation we still there might not even be enough room to put bushes I mean is there still a way that then that gets somehow in lie of and we can use that money we allowing these buildings on these sites that they're just not room uh to plant trees mayor bushes mayor members of the council in that case when we're talking about Landscaping solely the uh relief measure would be a PUD waiver request so the city does not uh accept a payment in Le in response to a reduction in landscaping uh that is only applicable in the tree replacement so if somebody just truly didn't have enough room for trees or panas we run them through the Pud process and I'm I'm I'm assuming that's incredibly rare but okay Council any other questions before we um open up this to the public okay if not um is there anyone in the public that would like to come and address the council tonight on this code Amendment RM 2.5 Landscaping by the city of Eden Prairie seeing no one Council um let's go ahead and maybe make the motion second we can still have further discussion if uh you wish is there someone that would make a motion move to close the public hearing and approve the first reading of an ordinance amending the Landscaping requirement in the rm- 2.5 zoning district there second second is there any further discussion all those in favor say I I I opposed all right passes unanimously payment of claims are there any expenditures in the classic days checks that you wish to question I know they don't exist anymore hardly um any expenditures you wish to question um in reading the did yeah I know but sorry but you weren't you w going uh council member you're looking around so I just want to thank you council member Nan thank you mayor um I'm just going to read um I I'm I'm very excited to announce the commission or the board has approved you use of the autonomous vehicle in Ed PR Southwest Transit and as many of you know Mark fber and I both of us in the commission slbo um initially there would be an operator behind the steering wheel with the aim of achieving full autonomy within 2 years time frame based on our learning and experience so you don't have to worry about initially totally autonomous the avies are scheduled to arrive in E Prairie by Late July or early August with the resident beginning to see them shortly thereafter our Target is to commence operation between October and November this year Southwest fris currently finalizing the details such as the number of stops exact route in need impr once that is completed we will deploy five AVS to serve the area we are committed to engaging with the community providing the opportunity for questions and fostering overall Community involvement um Mark fber do you want to add anything to the comments since you are part of the commission well one thing that's that's kind of neat that uh when the vehicles show up and there's a good picture picture of them right there that we're talking five of them and to give you an idea is that Miami has 10 Arlington Texas has five I think um pester what's that pester Minnesota right well was no Arlington Texas had five I don't know about any other those two there another one in youa those two stuck in my mind I think Scott sale Arizona had five yep so we're going to be very well served you know this is going to be a pretty neat setup and working right now on seeing if we maybe at a upcoming maybe Brewfest type of event or might be one there so the last comment is um um I'm going to use uh M cases name m Cas and I and somebody else with us we drove in the same Atlanta yeah in Atlanta last year um totally the operator was be behind the vehicle um but it was a quite interesting ride so we have already experienced that um the same company that we are using here so it's a great step for edur and Southwest so just a little U background here um Southwest Transit um is is run by a commission of seven members uh two Commissioners from Eden Prairie two from chasa two from Chanhassen and one used to be I think still writer representative is that accurate um and um it used to be around a five or6 million almost like a small City uh operation I think it's probably similar um and they manag 10 now 10 million when I I haven't been on it for a while um it's it's a really incredible organization they win U Awards all the time as like one of the best Transit agencies in the nation and we have it right here in Eden Prairie obviously with um Co changing Dynamics people not going downtown as much the express bus not being as filled um the south house Transit still there's still great needs out here for people especially from an equity standpoint to be able to get to jobs to move around the city and part of the problem was trying to fund right eventually how you have these commuter circular circulating Roots uh and one solution we're clearly as a society moving toward this artificial intelligence U part of our life and our world and these cars are phenomenal so just uh I think you said this I just want to underscore that there will be a driver in each of these vehicles uh for a while you know quite a while I'm not sure anyone knows yet but um uh the goal at some point uh in society and I don't know if we're five years away or less or 10 um these would become driver or less they would be incredibly safe I mean they all the computer stuff in fact some you look at some of the data and they're safer than human beings that are making flawed decisions at times so I think that's where we're heading and I agree with Mark that Across the Nation some larger cities are experimenting with this and I'm thrilled that um Southwest Transit decided to go down this path and and and and basically run a pilot um and in the beginning they will be looking at you know what what's the best uh efficient use of moving people possibly from the opum campus to somewhere from you know somewhere else circulating around to the mall I mean that you all are the experts but anyway so here in Eden Perry our two representatives are our two Commissioners are council member Friberg and and council member Ryan so thank you for your service and um just add this will replace replace the prime service those area eventually um it's not instant it's not in October going to replace Prime not not totally but those particular route oh on particular Prime routes but Prime will still for all the oh yeah nervous out there Prime is still going to be here absolutely current status um indefinitely but um for certain Roots goal would be to see if this can can uh supplement and take some heat off Prime did I say that right okay yep thank you all right um any other council member comments about anything Mr Geto anything else to councilman fryberg did
