Um, first item on the agenda tonight is the approval of the agenda. Do I have any requests for changes to the agenda? Seeing none, entertain a motion to approve the agenda. All those in favor say I. I. I. Opposed. All right. The minutes for April 28th are approved. We have one public hearing this evening. This is Dell Road Musa line boundary 2025-05. This amendment to a comprehensive plan adjusting the municipal urban service area Musa boundary updating the land use designations within the Musa boundary for nine properties along Del Road in J will be walking us through this request. Yes, I will. Thank you. Thank you chair commissioners. Um the city's initiating this comprehensive plan amendment and as the chair mentioned there's kind of two parts to it. One is the Musa boundary change and the other is a land use change that kind of correlates with that Musa boundary. Um, kind of just give you an idea of where we're at in the world here. Southwest corner of uh a bean prairie just south of the recently approved Marshall Gardens project. Um, as you some of you may recall, part of that project included improving Dell Road. Um, not necessarily part of the Marshall Gardens project, but kind of correlating or tying those two projects together. Um and part of that improvement down road is an expansion of of sanitary sewer. Um one of the things that uh we noted or was noted during the review of the permit from the Met Council is that portions of the property are not located within the MA boundary. The Musa boundary is an area within the city that's established by the city through a supply process that identifies those parts that can receive sanitary sewer services or perhaps services. And so we need to change the comprehensive plan to adjust that use of boundary. Um and then I do have in your packets with the current um current um boundary of of the the music boundary and the current demand use. So looking at your streets here also including your packet. The light area here is guided low density residential light yellow area. The light green area is is guided rule. Uh both residential predominantly residential uh land uses low density um not uh not going to see any attached family units or subdivision in this area uh because of this change. But this is what's shown currently is is our land use. and this kind of brownish line that kind of squiggles through the center of it. That is the current mucus boundary, the the southern boundary of the metropolitan urban service area for the city prairie in this area. Obviously, it goes beyond these uh eight or nine properties that are shown on your map. Um, and I'll get to that in a minute, but we're focusing on really these eight or nine parcels that are addressed on your map here. What we're proposing is an adjustment to the Musa boundary. basically adopting the Met Council's understanding of the music boundary is which is this yellowish line here. Um and then the corresponding land use as you know north of the music boundary is low density residential and south is rural or uh parks and open space. The existing use of line is shown just for reference purposes that will be that will go away with this change. Excuse me. So really, I hate to use the word housekeeping a lot, but this is a housekeeping measure. We're adopting the M council's uh line for these nine partials. Uh and we're adjusting our land use uh for those pieces just to accommodate that change. It's obviously part of our how our land use and zoning is structured is um rural property is not to receive um sanitary or sewer services or use of services. And then uh so that's why we're changing those areas to be a low density residential so that they so that they could receive the second super sources. My understanding is we're just setting the stage for uh those properties to connect in the future if they so desire. This this action here is not automatically connecting them uh to our sanitary super service. Um just really allowing that height to go into those parcels. Um obviously on the west the west and on the east side of the kind of the subject area the the line the music boundary is that is kind of that squiggly character that followed that old um contour line. When we do our comprehensive plan amendment update in 20 well 2027 2028 uh we'll correct that for the remainder pieces. We're just focusing on these nine pieces so that we can get that permit moving along so there's no delay in that uh construction project. Um with that be happy to answer your questions. The staff is recommending approval of this modest change to comprehensive plan use comprehensive plan use boundary uh just to kind of correct that issue uh for these nine nine persons. So stand for any questions. Questions for the city? Yes. I'm sure is the city of Chanasen or Chasta on the other side of the use the boundary or is it just simply rural just simply rural so Chan is over here um and obviously there's no so our our music boundary and I don't want to draw the whole thing but probably goes to the city boundary here um and Chan H may have a different boundary they don't necessarily need to connect. Each city has their own boundary. Okay. I think that's where I was just confused. The Musa boundary doesn't necessarily reflect the municipal city boundary. True. True. You can be in a prairie and not be in the Musa boundary, the municipal service area. You can you can both as is the case now. anything south of that boundary line here. Um, let me show back. Anything south here, you're obviously in the city. You're just not in the laundry. Got it. All right. Thank you. And then you you had mentioned that they don't need to necessarily connect into the city sewer by us doing this. They can maintain their own for a period of time. Yeah. And I'll defer any questions like that to um the city engineer. Uh but this this action is not intended to have them connected. This is just changing our coverings and planning maps, but they may have to in a certain time period by us doing this. Um depending on if whether or not they have a suitable system or features like that. Okay. How come you just doesn't follow the property lines? Good question. Um, chair, the part of the issue is these parcels on kind of the top of of the parcel is on turn. They really drop down uh from a rain perspective. So there may be substantial difference in in elevation from the the southern portion of this parcel to the northern portion of the parcel. And the the Musa boundary as we've shown it here with really these four lots actually five lots,000 or 10,20 and then these four pieces it doesn't follow the boundary the property those parcels um are there there's a a bluff uh in the property. So south of that line it really drops down. So we don't see that that's appropriate for uh urban densities. Uh, so that's why we drew the line there. It's kind of a topographical. I hate to say that because we're kind of trying to fix that. We're really just adopting what my council believes is the boundary while also balancing the goal of preserving natural resources in that area. Mr. Question question, Jerry. If a homeowner wants to connect to the sewer line, would that be at the homeowner's expense or is that the city will take care of that for the homeowner? It's usually at the homeowner's expense. Thank you. Is there any zoning requirements that they would have to comply with by doing this change? Are we not changing the zoning uh guideline? Uh chair commissioners, no, we're not proposing a zone change at this at this time. um the way our comprehensive plan and the way our zoning ordinance kind of is set up is there's not a direct correlation with every zoning district to every land use category. So in both of these situations, it's it's rural or low and say residential and there's a number of of zoning districts that fit those uh those criteria. So we don't need to change the zoning district at this time. Okay. Thank you. Other questions? This is a public hearing. I live at 999 last property where it kind of jogs through my property line comes up into my property in that corner. Uh, how does that get compromised as far as the news line comes through? I imagine that's where the story would come through at some point. So, you're at 999 99 right there. They have a property next door too. And then you see down in the southwest southeast corner where it cuts across into across the property line is that then it comes back up. This is all proposed. Uh just adjustment of the mus line doesn't mean that's where lines are going in that direction until uh the Dell road becomes accessible through uh the neighboring properties to the east. Is that correct? or is there time to do the sewer before dynamics? Mr. Chair, um these lines don't represent where the sewer line is going to go. Okay. Okay. Uh it's just more a boundary what properties are. So line cuts across the corner of the property instead of on the property line then that's kind of a deviation from a property line or it is a deviation on the other ones too. Um so that was kind of my question. I just didn't quite understand that that the bag is here. Yeah. A line of sewer lines is what you're indicating where they were building. Correct. Jared, is that true? That is the correct statement. Okay. It's not a sewer line. And yeah, and this is just proposed for the future at some point. Um, well, the the musine is proposed. I call it musine initiative. It's a Mus Musa boundary. It's the boundary of the Musa area. And we're just uh in this area, the yellow reflects what my council believes the Musa boundary is. Uh and so that's what we're adopting here. The actual sewer line where services are going to be provided. That's it. That's a separate line of those two properties for 99 single. Um what we're proposing here is north of the abusive boundary uh for 9998 and 9999 um is a low density residential which is our lowest usually single family residential zone or landings. Okay. And uh so it's just more of an adjustment of primarily that yes and um use over the area over the total area. So basically develop all the all the way through the property. Is that how I'm reading this stuff or you put a house or setting anywhere in the yellow area? Is that is that a new guideline like a new guideline for development versus the old sea line which is kind of a weirdly shaped curve. Miss Green which was undeveloped. Chair um chair that the developability of these parcels is independent of of these two lines or the colors here. It still steep steep slopes if there's any wetlands on the property or soils all of which may limit the developability of the parcel that's independent of this um versus pump station or something like that. Yeah. having that and um that actually may help because if the soils don't support um the subject system then sewer network would be the only feasible option to subdivide if you wanted to build below this where the sewer line would be you build pump station if you want to go lower down in the property and then pump it up to the sewer line perhaps perhaps yeah but again that's that's more the other ones that couldn't do that cuz the whole development line was on fire. I think you're getting into more of the details of a development proposal versus what this is is more of a global look at okay definition. Um, just curious. I didn't really have I mean I just I just kind of seen this and just thought thank you. Thank you. Uh, any other comments? If not, motion to close public hearing. Move to close the public hearing. Uh so chair just understand so basically that line you can run a sewer up to the yellow line. Basically it's just allowing that if I mean through development and everything that's just that's just what it's setting as the boundary for sewer lines. It's setting the boundary of where um a priority parcel can be served. So, you like run something close to that line. You know, the house has to be there. Yeah. Yeah. Okay. Any other discussion? Jeremy, is it a fair statement as to the area in which Met Council would be building the area in which Met Council would certain that's what the use of line essentially is, right? Yeah. the the man council establishes the boundary within the city and their um their planning for their own um systems including wastewater management are based on the developed acres and the intended densities within the Houston we're effectively adjusting the line but we're really not adding any developable pieces because the lots are pretty small I think the overall change is 6 acres um with all through all this process. Um, I would like to move to recommend approval for amendment to comprehensive guide plan adjusting the municipal urban service area usage boundary and the corresponding land use designations as recommended by staff represented in the May 27th, 2025 staff report.
