Front Yard Setback Variance Request for 20 Circle West
Dissent: None
Moved by Commissioner Padilla [0:11:15] · Seconded by Commissioner Day [0:11:20]
The discussion focused on the unique lot constraints at 20 Circle West, including a 50-foot setback from a rear pond and a 40-foot front setback set by a neighboring property. The proposed new two-story home would largely mirror the existing footprint and not encroach closer to the street. A commissioner inquired about the pond's flooding history, which staff was unaware of being an issue. The commission ultimately found the variance request reasonable given the property's specific conditions.
Notable Quotes (3)
The request is for a front yard setback variance... The proposal is to tear down the existing house and build a new one. The new home would be generally located within the same footprint of the existing house... The request is uh reasonable given those conditions and the unique circumstance here is the pond in the back that requires that 50-ft setback and the 40-ft setback established by the neighbor to the south.
Just curious about the pond and any history of flooding uhover the years with that pond? Has it risen upto to become an issue at all uh for residents that live alongthat pond line?
Um it seems uh to be in part a function of thecurvature of the road and the way that the neighbor to the south's propertyaligns there, so I think this is reasonable. They're building basicallywithin the footprint on aotherwise constrained lot, so I support this.
