all right good evening and welcome to the maple plane city council public hearing I call the meeting to order it is 7:01 p.m. looking for a motion to approve this evening's agenda I'll make that motion motion by council member Fay second second by council member DeLuca any further discussion hearing none all in favor please signify by saying I I iose same sign guys have it four to zero first item of business before us this evening is to delinquent utility bill assessments and I'm going to turn that over to staff before we open the hearing do you need a mic thank you madam mayor members of the council uh before you is the list of uh delinquent um utility bills and miscellaneous payments um that we are seeking Council approval for assessing to the county with that I'm looking for a motion to open the public hearing I'll make motion to open the public hearing motion to open by council member Fay second second by council member DeLuca the public hearing is open at 7:02 p.m. at this time anyone can come forward to the podium to speak regarding the public hearing for delinquent Utility Billing at this time anyone can come forward to speak regarding the delinquent Utility Billing please come forward please state your name and address and you'll have up to 3 minutes and we ask for respectful conversation and it will not be a time of dialogue okay thank you um my name is Tracy herb and my husband and I own a rental property in Maple plane um we have had several tenants move in and out over the last several years and it looks like what's happening for billing is as we have tenants move out that very last bill is not getting sent to the tenant moving out we um just received a notice on October 14th 2024 that um the property was delinquent from a tenant who moved out in 2021 so this in the very beginning of 2021 um the billing date was March 26 of 2021 so this is almost four years later that this tenant has moved out this is the first that we are hearing of this bill and surely the tenant has no idea about this bill either and as ethical landlords we don't feel like we can come to them four years later if we can even track them down and say Hey you owe the city of Maple plane for this water bill and we also don't feel like we should be held responsible for a water bill that we didn't know of either so um I did call and I was made aware that there's going to be some changes to the billing for the water um department and I was also made aware that there was also another tenant who is delinquent um and it did not show up on this so I wouldn't have known about the second delinquency if I hadn't called so my request is that um that be removed from that property those bills be removed from the property Mrs BB um can you please State the address that you're referring to it's 5815 Main Street West okay so this is actually the third time that we've gotten bills years later from tenants who have moved out the first time we didn't realize that it was an issue with the bill not being sent in a timely manner like I don't feel like almost four years later it's a timely manner to say oh guess what you have money do that isn't even ours all right thank you staff I'm going to turn it over to you thank you Madame mayor members of the council I am not personally aware of this one so I will have to check with staff in the office on this okay so then how is that going to look if we need to um approve this tonight because of the county dead County deadline by month end this is our last meeting can I say something so I did call this morning again to say I'm coming today can it because I know it's going to be assessed tonight and she recommend that I just go ahead and pay what was due because there wouldn't be an opportunity to say oh it's been waved um and it to not be assessed to taxes so I actually did pay it in advance um so it may not show up but I'd like to be reimbursed for that payment so okay it won't be assessed to taxes tonight any bills that have been paid will not be assessed to taxes right um but staff will have to follow up with you regarding the refund we can't make that commitment right now right here of course yeah I just wanted to make you aware and to plee my case for these bills so then we will have to since it's been paid we can take this off roles yeah anyone that has been paid will be pulled from these roles if people came in since this was the packet went out on Thursday so anyone that is paid prior or between Thursday and tonight will be taken off before it's turned into the county correct but tomorrow the list is finalized and sent is that correct well we'll send by December 2nd December 2nd is is our deadline so okay all right so will someone just follow up with me yes staff will follow up with you thank you thank you thank you for speaking anyone else for public comment regarding the delinquent utility bills right hearing for none seeing no others looking for a motion to close the public hearing I move we close the public hearing motion by council member deuca for a second I'll second that second by council member Fay to close the public hearing all in favor of closing the public hearing please signify by saying I I I I uh the eyes have it 4 to zero the public hearing is closed at 7:07 um staff you guys will follow up then with Mrs tomorrow and then anyone else that comes in and pays will be removed before the list is sent to the county yes ma'am okay thank you any other discussion hearing none looking for a motion to adjourn I'll make that motion
