are you guys good I'm good okay good evening and welcome to the mle pl city council business meeting this September 23rd at 7:21 and I'm calling the meeting to order please stand if you're able and join us for the plge of IED alance to the flag of the United States of America and to the repblic for which it stands one nation under God indivisible with liy and for we have our agenda before us this evening uh looking for a motion to move approval of the agenda so moved moved by Francis I'll second second by Beck any further discussion hearing none all in favor of approving the agenda as is please signify by saying time saying what saying saying time time wow I I a same sign that say I okay hearing none the agenda is approved five to zero okay um first item business this evening is visitors to be heard any visitors to be heard right there are no visitors to be heard so we will continue on next item of business this evening is our consent agenda on our consent agenda we have items a through f August 26 city council Workshop minutes August 26 city council business meeting minutes August 26 city council public hearing September 9th city council Workshop minutes employee handbook resolution 24-9 23-2 arpa funds designation mayor can I pull e and Fe for two quick questions and F for a clarification okay items E and F have been pulled from the consent agenda this time looking for a motion to move approval of consent agenda items a through D so moved move by DeLuca second second by any further discussion hearing none all in favor signify by saying I I I oppose same sign motion carries for to zero council member Fay let's start with um item e employee handbook okay and the employee handbook uh back last month we tabled uh this uh duee to uh some questions in regards to the part-time employees and their eligibility for benefits and I want to get on the record that that has been addressed and if so where um we got stung several years ago by this and without referencing labor law um where do we where do we note other than just noting that they're not eligible for benefits okay we will I will have administrator cander answer that or whoever wants it thank you madam mayor uh councilman Fay um so I reviewed this uh the ACA requirements uh which talks about benefits we do not have 50 or more employees that work 30 or more hours per week so we are not required by law to offer benefits to part-time employees I got that email I'm just going on record that it is in fact been addressed due to the ad ACA and the um U fact that we're under 50 employees correct okay and then number two uh Jacob uh after the battle of badges I reached out to you uh in regards to the mandated uh direct deposit um uh for all employees um and with the fire department having the largest employee base uh I've been made aware that there are some firefighters that um are not going to the direct deposit and I'm wondering if there's uh any consideration given to any members of the fire department as far as not requiring them to come pick their checks up at City Hall administrator coer thank you madam mayor mayor council member Fay um that has been discussed uh between myself and the fire chief um when payroll is done I will hand over the paychecks to him and they can pick them up from him rather than coming to the office because a lot of times they work and we're not here um and as far as requiring direct deposit the state uh statute does allow us to require it however there's also a state statute that says if they write letter saying they don't want to do direct deposit we can't force them so that kind of answers that question that answer your questions that's all I had okay so that is for um item e let's look at um item F resolution 24923 D2 the funds designation and I just wanted a clarification I don't have it in front of me I'm going for memory there was a uh amount in there that we discussed some time ago in regards to signage and I just want to confirm that we have pulled the prepaying of the signage out of the arpa uh total pool is that correct Jacob administrator Callander thank you Madame mayor council member Fay um that is correct and I want to pull that up I'm I'm glad that you pulled that from the agenda because I wanted to touch base on something on that I just have to find where it's at here in here it is uh so there was two changes uh since the workshop on September 9th one the upgraded sound and mic system went up it was $337,000 it's now 44327 there was another quote in there for $ 6700 that was part of I thought it was something that was completely separate um so I added that in there um I took out based off of the conversation that was had at the last meeting um the city signs remove that because we can use Capital Improvement funds for those whenever we decide that we're going to do that um and then I changed the totals down here it only changed a couple thousand um for the total that we would end up taking out of uh Capital Improvement for those Street projects thank you for that explanation Mr colander there are other questions regarding the ARA arpa fund designation and those two changes as noted and and uh this I guess would be a question to engineering do the residents on both Independents as well as Maine and those side streaks are they aware that they're getting an overlay and a mill in overlay that would be to our administrator the engineer wouldn't be communicating with our residents I'll turn it back over to our administrator thank you Madame mayor uh council member Fay um Kevin will be working on I believe we have some information in the upcoming newsletter that'll be going out about that thank you any other questions from any council members there okay with that I'm looking for a motion uh to move the um employee handbook item e and resolution 24-9 23-2 oura funds designation I'll make the motion to approve both of those okay it's been moved by Fay second second by Francis any further discussion all in favor signify by saying I I I oppose same sign motion carries 5 to zero next item for business this evening before us is item number 7A accounts payable and I will turn over the staff want to a little synopsis thank you madam mayor members of the council uh for our batch as you can see it's a pretty large one uh we have the two pay estimates uh on the street project one for $541,500 518 and then the second one for $1,140 27205 um I did confirm with the engineer that they have double checked that to make sure that those items were truly done and and complete and they have verified that uh we have payments to the Fire Relief pension contribution uh according to our budget of $528 40 we have a $36,000 State Fire Relief Aid um one thing I just want to note for the council I'm asking to approve this the pension contribution check will be cut tomorrow we are going to hold the Fire Relief till the end of September because we should be getting the true funds in our account by the end of September and then we will issue that if it's anything different I will let the council know at the next meeting um and then City checks $241,500 that is in the packet that basically breaks down how these sums were derived is there a reason why we deviated from that standard practice I can't that would be my fault I didn't realize that okay um I can pull those up if you'd like to see them why don't you I think it would be acceptable if you do can you attach them to the packet I can yeah before I can attach them tomorrow yeah yeah that right are you comfortable approving them without seeing it in detail though or are you well yeah I mean it's he's ass Mr can speak to thats we're we're about 40% done and the representative of the work that's completed so I I don't have any concerns about that okay all right so um if we could have the detailed invoices added to the packet tomorrow that would be helpful and appreciated we'll do any other questions regarding accounts payable okay I'm looking for a motion to be moved to approve accounts payable a through D I'll make that motion motion by council member Francis I'll second that motion staff reports they have all been submitted in writing from each department um I will turn it over to um engineering Lego you don't you don't have anything to do you're good nothing okay um Administration do you want to update us uh yeah I just wanted to point out uh a couple things I won't go through the whole list um but on the finance side um end of August um the Public Works budget is getting there uh so we'll be watching that a lot closer um I'm not too worried about it but just wanted to throw that out there um and I'm really happy to report that the interest that we've earned this year is 235,000 of that uh amount um is just from bond interest which can only be used for the bond if there's any uh um what do they call it when we change them um change orders for the project can be paid with by those funds or we can use them um to pay more on the bond or towards other projects so I was just uh super excited to see that so well and I did note that and I have a little star there for interest and just want to say kudos to staff um nice job paying attention to that and um moving things around to capitalize on our funds to do that thank you right any questions um for administration or Finance okay hearing none I'm looking for a motion to move approval of all staff reports a through F I'll make that motion motion my council member F second second by council member DeLuca any further discussion hearing none all in favor signify by saying I I I I oppose same sign motion carries 5 to Z new business this evening is resolution 24-9 23-3 adopting the pr preliminary Levy and I will turn that over to staff thank you madam mayor members of the council um from the last uh Workshop that you guys discussed the budget I was not present at that meeting um there was not much to change from that um so we are recommending the approval of this resolution uh key element of the budget is a proposed tax levy increase of $132,200 representing a 7.54 uh% increase from 2004 this includes a general Levy increase of $262 or 0.14% um the majority of that Levy uh comes as debt for our new 2024 Street project of 13,171 uh which is 4 5.05% of that budget um I'll stand for any questions otherwise we recommend approval of the resolution any questions for staff or comments from Council and just to clarify that this can go down but it cannot go up once it is submitted that is correct thank you with that looking for a motion to move approval of adopting resolution 24-9 23-3 approving the 2025 preliminary Levy and budget so moved moved by council member DeLuca second second closed session and Mr lman would you like me to read this or would you like to I I can read it if you like great I will turn it over to you please mayor and uh members of the council um there's two items to close today one is pursuant to Minesota statutes section 13 d05 subdivision 2B the meeting is going to be closed to discuss allegation or charges against an employ following the closed session the council will an open session to report on any uh decisions made regarding employee discipline the second item uh pursuant is pursuant to Minot statute section 13d 05 subdivision 1 A4 the meeting is being closed to discuss personal medical data of an employee um just a note um before um and what the I'm sorry staff is looking for uh motion to go into close session um just a a housekeeping note is that both of these uh meetings under the open meeting law to be recorded um and we will record have separate recordings for each um and it'll be noted on the record on the recordings so that we're looking for a motion thank you Mr L before I offer a motion one motion will handle both uh correct all I'm looking for is a motion to convene to a to closed uh closed session based on um A and B on the staff report then I'll make that motion motion by council member Fay to into close session looking for a second second second second council member B to go on close session
