Commissioners generally supported the homestead requirement as a way to ensure accountability, protect residential quality of life, and maintain housing affordability, while acknowledging some potential drawbacks for small businesses.

So, yes. Uh as you said just pre just a moment ago, this there's no formal action tonight. Um staff recommends that the commission discuss the concept plans. Um really with a couple things in mind, three questions. Is there merit for the concept to proceed to a formal development review? If yes, why? And then a big one which is the last one on here. So save best for last. What would make the concept better?
I am deeply deeply concerned about the neighbors and the people living here. Will you share a little bit about how you can lessen the impact whether it's noise pollution, light pollution, um trash in the neighborhood? Can I talk about how you operate? You talked about possibilities of a high sign as opposed to maybe a single monument sign. Um timers, things like that. Will you talk a little bit about kind of how you operate and the impact you have with the immediate neighborhood?
I think it's a little bit smaller than I think it's about it went to about a 5,000. We just recently added on to it, so I think it's about a 5,000.
169 is a thoroughare of criminal activity in his words. And he said that sea stores, convenience stores, become meetups for criminal activity. So I said, "Well, what do you mean?" He said, "Well, that's where people go to do deals. They become, in his words, a target-rich environment for police officers.
I would love to see a quick trip, but I do not think that this concept should go forward for a formal development review because it's not the right area. Um, and I don't see what could make the concept better.
However, I am also thinking that I would kind of like to see this go forward. Um just but right sized it. It needs to be something in my opinion that fits into the community.
I think that there is uh merit for a concept to proceed here especially because it's guided for mixed use. There is already a gas station at one of those properties. It's a bit of a dead zone. I I would like to see that gas station redeveloped uh in a commercial way, but a lot of I mean really the public feedback tonight and and in the packet, it does carry a lot of weight that maybe this is a bit much.
The ordinance required licensing for short-term rentals and required that an owner or applicant could not own or have interest in one in more than one licensed short-term rental in the city. There was one exception um in in the ordinance that an owner of a homestead status property in Minnotonka um may operate their homestead property as a short-term rental um and then also hold interest in one additional um home uh rental property short-term rental property in the city.
What it won't do is prohibit rentals in the city, um specifically short-term rentals, um and it won't prohibit investor own rentals of any type. Excuse me. Um, and it won't uh change property related enforcement with those nuisance items as I mentioned before.
Staff claims that current residential nuisance laws are adequate. That's false. Staff claims they'll enforce current nuisance laws and this will be adequate to keep short-term rentals at peace. But short-term rental guests generally do not violate residential nuisent ordinances. What occurs is that there are too many guests, none are working, none are attending school, they're all on vacation, they go in the backyard, uh they have lots of vital time to play. It's the frequency that harms the neighborhood, not the activities that they're doing.
These new homestead requirements, I think, sound simple, but in practice, it really functions as a near ban to many responsible homeowners um with the requirement that they be living in their home for 180 days out of the year.
I think this is an elegant solution having it a homestead property. Um, you've got accountability. You don't have staff having to go over there and um address problems on a 247 basis.
I do think there are good landlords out there. I think there are good management companies out there and uh some of the things that have been presented tonight from them I think have brought up some really good plans to say I think there's value in having some sort of a local agent that can address problems right away.
Um, so the homestead plus one, as long as that one is located in a uh commercial district or abuing a commercial district. Thank you.
