[Music] [Music] [Music] [Applause] [Music] Heat. Heat. [Music] [Music] Good evening. Welcome to the June 5th meeting of the Minnetonka Planning Commission. The commission generally meets twice a month on a Thursday. The schedule and meeting agendas can be obtained by calling the planning division or by checking the city website at minnotonkamn.gov. The commission holds public hearings on land use applications. For all land use applications, the city notifies property owners within at least 400 ft of the site and posts plans and information on the website. For some applications, the city also places signs on the properties and places notices in the Sun Sailor newspaper. From a specific process standpoint, the commission makes recommendations to the city council on resonings, subdivisions, conditional use permits, and amendments to the city's comprehensive guide plan, zoning ordinance, and subdivision regulations. We also make final decisions on site plans, signage requests, variance requests, and expansion permits. Unless these are requests are part of an application that must be heard by the city council, in which case we make a recommendation and the council makes the decision. Anyone dissatisfied with a final planning commission decision may appeal to the city council by written request to the city staff within 10 days of this meeting. From a broader standpoint, the city's comprehensive guide plan, zoning ordinance, and subdivision regulations are the city's best efforts to codify a balance between individual rights and community responsibilities. Individual rights are easy to understand. Community responsibilities are more subtle, but the idea is that we as members of the community agree to limit our individual rights for the common good of the group. The planning division, the planning commission, and the city council are charged with managing this sometimes difficult balancing act. We ask you to keep this broader perspective in mind as we review tonight's applications. Again, welcome. Uh, Miss Wishnack, will you please call roll? Yes. Thank you. Chair Henry, absent. And staff, I believe there's a change memo for tonight. Yeah, Chair Maxwell, we do have a change memo for both of the um non-consent items. Uh, the first uh is just some um errors from copying and pasting uh quite frankly. And so those are reflected as changed in your change memo. We had an additional comment for that. And then similarly um for item 8B and um uh Miss Reigns will will go over that that change in her um report but just a typo and an additional comment. Um no other items. Thank you, Miss Thomas. Uh, Chair Maxwell and commissioners, the city council has met twice uh since your last meeting, since it's been a while since we've met. Um, at their May 5th meeting, uh, the council considered uh two conditional use permits for accessory dwelling units that you all um had reviewed and recommended approval of. One was on Oak Drive Lane, that was the conversion of a a portion of the existing building, and then that detached accessory dwelling unit on Sandra Lane. Uh both of those were approved uh on the consent agenda. At that meeting they also reviewed um the items for the first international bank and trust that was the remodel of that office building on Weisetta Boulevard that was also approved. Um then at their May 19th uh meeting the only item um related to the planning commission was the introduction of the interim use permit ordinance which you'll be um discussing here this evening. Um your next meeting I apologize I have to grab the calendar is uh July oh no uh June 26. So we do have a couple of uh weeks um but we do have several items on that agenda already. Uh, nothing else for me, Chair Maxwell. Thank you. Uh, next up is report from the commission. Does anybody have anything to report this week? I'd like to take the opportunity to say thank you to the city for the uh, nice dinner that they put on for all the commissions and the council folks. They did a really great job and thank you very much. Anyone else? I'm going to echo what uh Commissioner Minion said. Uh thanks to the staff for that lovely dinner. There's a couple of things that I want that I took away from that that I wanted to share here. One, the mayor um highlighted that cities are the labs of democracy and as a scientist and engineer, I just love that we can do experimentation here that can be applied wider. Um but really our our role on the planning commission is to listen. We host public hearings for the residents of of the city to come in and we really care about listening and hearing what residents have to say and I think that fosters a sense of belonging in the city. Um and the uh we went over a little bit from the uh city survey um and a couple of stats from that. 94% of residents or respondents felt positive about city planning. 88% felt they had appropriate input into zoning and development, which is exactly what we do here. Um, and that was the highest rate in the last four years. So, um, feel like we're doing some good things in the city and in this planning commission in particular. All right. Um, next on our agenda is let's see, where's my agenda? I have too many papers. Um, next is uh public hearing consent agenda items. Item 7A. Um, let me introduce consent agenda first. So, uh, the city staff places items that are considered routine on the consent agenda. So, no staff or applicant presentations will be made. The commission will hold one public hearing and then we'll approve all items on the consent agenda with one motion. Uh, before voting, I'll open the public hearing. I'll announce the item and ask if anyone wants to have a separate discussion or vote on that item. If so, we'll remove it from the consent agenda, have a separate hearing. I may allow additional questions without removing it from the consent agenda. Uh depending on what the question might be. So, I will now open the public hearing on the consent agenda. And the first item is item 7A. The only item is item 7A, a sign plan for Veil, formerly Marsh Run 2 at 11816 YZA Boulevard. And this is um a recommendation or it's a resolution approving the sign plan. Um does anybody from the commission wish to pull this from the consent agenda? Anyone from the public wish to pull this from the consent agenda? All right. Um so I will close the public hearing and may I have a motion to approve the consent agenda items? I'll make the motion. Uh if anyone wants to appeal that decision, you must provide a written request to the city staff within 10 days of this meeting. All right. Next is item eight, the non-consent agenda. So before we begin consideration of these, I'd like to review the steps in this process and the public hearing. First, the item will be announced by the staff and the staff will report on the subject. Then the commission will ask questions. The applicant will then be invited forward to make a presentation or offer comments and the commissioners may ask questions of the applicant at that time. After the applicant is finished, then the public hearing will be opened and anyone present can give comment on the proposal. If you wish to speak, come to the podium, state your name and your address for the record and please keep your comments brief and try not to repeat points already made. The first item on tonight's agenda is item 8A, a preliminary and final plat of Tammy Edition, a two-lot subdivision at 15503 Robinwood Drive. Uh staff, we're ready for your presentation. Miss Thomas. Uh Chair Maxwell, thanks. Uh, this first property on your agenda this evening is a roughly 2 acre parcel on the south side of Robinwood Drive, which I will note here was listed as Ridgewood uh Road a couple of times in your report. That is your change memo um this evening. So, this is on Robinwood Drive east of Tonkawood Road. It was originally platted in the early uh 1950s and then a small area in the northwest corner was added uh sometime thereafter. Topographically, the highest point on the site is centrally located. It's here where the previously existing home had been. The site then falls both to the north and the south. There's a small uh 100-year flood plane area in the southwest corner. And in addition then to that natural feature, there are several um regulated trees on the site, 73 high priority trees and nine significant trees. The owners are proposing to uh divide the property uh into two lots. That new common property line would run uh north to south, really um dividing the property in half. And as was outlined in Mr. Inglesson's report, staff focused our review on two primary questions. The first is simply whether uh the proposed lots meet the subdivision ordinance. And as was noted, um they certainly do. They meet or exceed in many ways uh the minimum lot area, buildable area, and dimensional standards. The next question then was whether the tree protection ordinance uh was met and it also uh is clearly met with just five uh high priority trees being removed and no uh significant trees being removed. really and in short, this is a very straightforward uh subdivision proposal and and we do recommend that the commission recommend that the council uh approve both the preliminary and final plats here. So, with that, I would turn it back to uh Chair Maxwell. Thank you, Miss Thomas. Is there anyone on the commission that has questions for staff? No questions. All right. I live right next door to this property at 15413 Robinwood. I purchased this property about six years ago uh from the other owner and there was a home on there that was not in very good shape. So, I um tore that down a couple years ago and uh it's a beautiful lot. Uh it's going to make a nice uh home for people on Robinwood uh Drive. It's a very close-knit neighborhood there. Um and um if some families can move in there, it' be great. Uh we are re we're going to sell our home and move to Rididgewood Ponds also in Minnotonka and um so we appreciate it if you could approve this. Any questions? I'd have been to answer. So, thank you. Very straightforward subdivision. I agree. No variances or anything like that. So, fully supportive of this one. Anyone else? Commissioner Minion had the opportunity to drive the property. Um, we live in a very nice neighborhood. I I'm I I I like the size of lots and uh it's a nice neighborhood. I think it'll be a great addition to the city and uh I like the fact that uh the tree impact is uh really non-existent. So, great. Very supportive of it. Thank you. Anyone else? No. All right. Good luck with your uh application and your build. All right. Next on our agenda is item 8B concerning Hidden Valley Road third edition of two lot subdivision at 16515 Hidden Valley Road. This is Bria. Is this your item? This is Thank you, chair. Uh so the second item is similar to the first in that it is also a subdivision for a two lot preliminary plat and final. This is for Hidden Valley third edition and there is flood plane alteration and an easement vacation also proposed at the property at 16515 Hidden Valley Road. This is in the Okay, sorry just adjusting so everyone can hear me. Okay. Site is roughly 1.4 acres in size and is currently vacant. A demolition permit was issued last month. So, the tennis court, existing home, and there's some minor structures have all been removed from the site. Generally the site has flood plane existing flood plane going from the northwest corner to the southeast corner across the property with the highland areas in the excuse me northeast and southwest areas of the properties property property currently has just one half that has some easements. Um in in those easements there is a sanitary sewer and storm utility going down the middle of the property. There is this purple line which is the water service for the property to the east. So the neighboring site their home um staff has added a condition of approval that this utility must either stay in place or can be relocated but cannot be removed essentially disconnecting that neighbor from the water service. Ley Brothers is proposing the subdivision of the property into two lots again with the flood plane alteration and easement vacation. The current easement as mentioned before is just on the second lot um which is to the east, excuse me. Um this was part of the original platting for Hen Valley second edition which was also by Lacy Brothers but in 1994. Um it is unknown why there was no uh easements for the westerly portion of the site. Um but with this V vacation we would be removing this layer of easement and then proposing new easements consistently over both properties. Um covering those areas of the floodplane alteration proposed area and the relocated utilities um for both sites. The property owner is, excuse me, the applicant is proposing to remove uh third 11 trees, excuse me. There are currently 36 protected trees protected by a tree protection ordinance. Um, of those 11, nine are high priority. So that's 34% whereas our code allows up to 35%. Um, and the other is significant. two significant trees which is actually 25%, I um made an error in the original report that says 42%. Whereas the maximum is 50%, so again they are under that threshold. This proposal will meet the tree protection ordinance. Um we do add a condition of approval for tree mitigation. It's a standard um condition of approval that we require for projects just to ensure that that portion of the tree protection ordinance is followed. So, two single family homes are proposed on the site. One in the northeast corner, one in the southwest corner. Generally, excuse me, divided by flood planes, some trees, and then obviously that easement area. The two properties will each have their own storm water facility, underground storm water facility, as well as the Westerly portion property, excuse me, will have a swimming pool. Um, in this diagram, you can see that the existing water line will be moved. It current it would be in the proposed building pad area. So, it has been moved to this dashed darker line so that the neighbor to the east still has that water connection. The lots each will meet and exceed the subdivision standards. The westerly lot will have a width of 159 ft and a length of 235 ft exceeding our standards of 110 at the uh setback of 35 ft and a lot depth of 125. The easterly lot will have 110 ft in width at the setback and a depth of 230 ft. Again, meeting the standards. This illustration shows the proposed flood plane alteration. Overall, the applicant is proposing 340 cubic yards of flood plane alteration. The green areas are the proposed um deepening or increase in flood plane volume area and then the red would be filling in. So essentially moving flood plane towards the green and away from the areas of the red. For the proposal, we did receive one comment which was asking clarification about parking on the road and the placement of stock fi piles, excuse me. Um for development projects, we require construction management plans which are required at the time of the building permit application. Um, and in that construction management plan, they would provide that information. So, generally stockpiling, we don't allow that in the street. It would be required to be on the property. As for parking, it's not so straightforward for a site like this. So, it's something we would look at during our administrative review of the building permit. But we do after the build the construction management plan is reviewed and approved by staff, it is uploaded online so the public can see the standards. Oops. Staff finds the request reasonable, meeting the subdivision, tree protection, and flood plane standards. Uh, therefore, staff recommends that the planning commission recommend that city council adopt the resolution approving the proposal for preliminary and final plat. And with that, I'm available for questions. Thank you, chair. Yeah. Thank you, Miss Reigns. What questions do we have? No questions. Commissioner Banks. Yeah, thank you. Thanks, Chair. Uh just a quick question on that u the water line that would have to be moved for the neighbor. Um how does that impact the neighbor in terms of timing or um like maybe does it have to rip up their yard or how would that how would that process work? Chair Commissioner Banks. Um, so as a conditional approval, we have added that the applicant will need to work with the property owner and let them be aware as well as obviously get a letter of authorization, but I would imagine to do the work, they would either need to do some type of drilling or some disturbance of their property, but they would work with again that property owner to make sure everything's comfortable. And have you did you get the sense that they've already spoken with the neighbor? Has there been any communications so far? Chair, commissioner. Yes, they have said that they've spoken with them and they are not worried about getting a letter of authorization. Okay. All right. Thank you. Other questions. All right. At this time, we invite the applicant forward to give a presentation or comments or answer questions if you're here. I don't believe the applicant is here. Okay. I see someone coming down the aisle. Uh yes. Uh so I'm not the applicant. Uh my name is Joseph. I'm an engineer. Uh I can answer questions. Are you you with this particular proposal as Yes. Okay. Uh yeah. Does anybody have any questions for the engineer who's not the applicant but representing the proposal? Yeah. Commissioner Minion. So, just to help with the uh concerns of the neighbors, uh I drove this property. I didn't see any huge obstacles to uh driving off the street and onto the property. Um would you say that it would be reasonable to request that some of the vehicles servicing this property would be able to park on the property itself instead of on the street? I think they raised a good question about school being out, but uh timing, things like that, we don't always know. Is that a is that a reasonable request to for us to assume that people working on the site could park on the property while they're there? Uh, sure. Yeah, as long as there's room. Okay. Thank you. Any other questions? And before you leave, can I get your name and your company that you are representing for the uh civil site group and yeah, we're just the civil engineering consultants. I think it's another beautiful property, another beautiful neighborhood, and if we can be divided up and make a couple of uh nice homes out of it, I think it's uh for the better for everybody. Looks like the city has again done a great job of the planning and making sure that all the codes are met. Uh this one was a little closer to take a few more trees, but uh it still met the thresholds. Looks like uh it's all the boxes are checked. Thank you to the city and to the applicant. Commissioner Waterman. Yeah, echoing that. I'm supportive of this. I'm excited when we have these opportunities to do subdivisions generally, but also just when they're really clean. It's kind of amazing that we have a meeting with two of these. Uh they're very straightforward. So, uh very much in favor of this. I have one um question that we got from the uh change memo. There was somebody from the public who wanted to say who said, "Would the city consider a shared driveway to minimize imperous surface?" And generally, I know we don't like that. Would you staff give some comments around why you recommend against shared driveways? Uh, Chair Maxwell, I'll I'll start and my colleagues may jump in. uh shared driveways certainly from a natural resources perspective are are a good thing in that they they do minimize uh imperous surface. The flip side of that is uh we don't require shared driveways if there's not a natural resource um issue like a wetland in the way, a flood plane in the way. But what we often find is that down the road, 10, 15 years, the second owner, the third owner, there are a lot of disagreements and a lot of misunderstandings about what the legal document actually says and who's responsible for what and who pays for what. And so, um, uh, while good in theory, they're not always great in practice. So, again, we do allow them and encourage them when there's a clear natural resources reason. in in this case there there just simply wasn't. Thank you, Miss Thomas. Any other comments, questions from the commission? Oh, okay. I'm also in favor of this. I appreciate this kind of development um in the city and these are still relatively large lots with setbacks that match the rest of the the area. Um, and to the staff's point, they do meet the uh guidances for uh subdivision and the the tree ordinance. So, I'm in favor of this. Um, sounds like we're probably ready to make a motion. Next item is item 8 C, an ordinance amending several sections of the zoning ordinance pertaining to interim uses. Uh, Miss Thomas, I believe you on this item. Uh, thank you again, Chair Maxwell. Before I get into the proposed ordinance changes, I want to give a little refresher on uh interim uses uh in general for the commission and our um viewing audience. Um, as you may remember, for each zoning district that we have in the zoning ordinance, the ordinance outlines permitted, accessory, conditional, and uh interim uses. Permitted and accessory uses are typically those that can be reviewed and approved administratively by city staff with a building permit. So think a house and a shed on a single family home. Conditional and interim uses, however, are allowed only if they meet a series of standards that are outlined in the code and only if the council approves those uses after first being considered uh by the planning commission. So think uh drive up windows or um garden stands in parking lots. The main difference between a conditional use and an interim use is that a conditional use we say runs with the property. So that means once it's approved as long as the standards of that approval continue to be met and the use doesn't cease for more than a year um it can just continue. I think a really good example is TCF Bank building had a drive-thru facility up at Rdale and even though TCF Bank became Huntington Bank, they didn't need any other approvals. That conditional use permit for their drive-thru just stays in place. Um, interim uses are designed for temporary purposes and those do expire um at a specific period after a specific period or at a specific event. and that is outlined in the resolution that the council um approves. Um for instance, the seasonal garden stands that we've approved as interim uses pretty regularly have a 5-year expiration date. So after 5 years, they have to come back and we review um you know how things are going. So conditional uses never expire. Interim uses can expire. planning staff recently uh had a conversation with one of our school districts regarding placing a a temporary building on their property. Um they're planning a full addition but uh aren't able to do that in time and so want to place this temporary building. After reviewing the ordinance um staff found that our current interim use ordinance would not allow for that. It doesn't provide a clear way to permit what we think is a a reasonable temporary use. And so that led us then to consider there are likely a lot of other reasonable uses that our ordinance just doesn't contemplate. Um as it stands if someone proposes something that's not clearly identified in code um really the city only has two options. To completely deny what would otherwise be a reasonable use or to potentially allow it as a conditional use. our conditional use um list at the very bottom says other similar uses as determined by the city. But approving something as a conditional use um leads us and possibly to have now a permanent use for something that is better to be temporary. And so after consultation with the new city attorney, we thought we should we should make some changes um to our ordinance. And we're proposing um three this evening. Um the first is to grant the city planning staff the authority to determine what uses are similar to things that are already outlined in code. And we we do that right now. In fact, we've done that in front of this commission where we've had say a school or a daycare proposed in an industrial district and we say, "Well, schools and daycarees aren't clearly called out, but we do allow for public buildings and a school and a daycare is similar to a public building, so we think you could approve this as a conditional use." So, we already do that, but our code doesn't technically allow us to. So this first provision is is to establish that in writing that the city can do that. Um it's the planning staff that makes that determination that the application can move forward. The second change is really to broaden uh the general interim use standards. Um they seem to be very specific to the very specific interim uses that we've called out in our ordinance right now. We'd like to just broaden those. And then the third is to allow as interim uses things that are conditional or similar to um so I I was trying to think of um a conditional use right now that we might have that we might not want to be there permanently and so we could direct them more to an interim use. Um the changes are really intended to give the city more flexibility, more tools um as we review uses that we haven't thought of but property owners or residents or business owners uh may think of. We did wonder whether or not we should do this since we're in the middle of a full zoning rewrite, but we thought we don't know what the outcome of that is and that's a year away and and so let's do this. Um, now I do want to uh point out before I end here that none of these changes changes the process. So interim uses will still have to come before this planning commission. They'll still have to be approved by the council. We're just maybe again broadening those uses that you may see. So with that, I would turn it back to the chair and commission for questions. Thank you, Miss Thomas. What questions do we have? Commissioner Minion, will you talk a little bit about how this will impact things that are already in play? How things that somebody's already started a plan or started a process, how they'll impact them and um how it will actually help the process and all for people who moving forward will making different applications and and what it means for them. Yeah. Uh, Chair Maxwell and Commissioner Minion, um, this change will not impact existing interim uses. They can still operate under the resolutions that they were approved under. Um, so they can operate, they're not um, uh, non-conforming. They're conforming with what their approval was. Um, when their time expires, just as they would have before, they would need to come back under under this new ordinance. From our perspective, um this is only a a good change in that, um while we as planners like to think we know a lot about land use, sometimes somebody comes up with something that is really uh interesting um that we just simply haven't thought of. And I think this um allows us to allow them to contemplate something that otherwise we might just have to say no to. I don't want to imply that this means that we will think everything is a great use and everything will be approved but it it just um allow gives us that tool. Does that answer your question? Would you say in general would make our city process uh flow a little bit better, easier on staff and easier on councils and commissions? Uh, Chair Maxwell and Commissioner Minion, I I like to think so, and I um, Miss Wishnack may add to this, but I like to think when we bring uh, ordinances, this one and others before you, really the intent is to make sure that our planning process that your process that uh, the process that people need to go through is more clear, it's more efficient, it's more effective. Um, that's the goal of of planning staff. We don't want to make things more cumbersome. Just the opposite. It's probably more of a process question than anything. Um, and thank you. When the 5 years is up, for lack of a better word, is the city proactive in reaching out to the applicant or is the burden on the applicant to say, "Oh, oh, okay, my 4 and 1/2 year calendar reminder just went off. Now I need to go back to the city." Uh, Chair Maxwell and Commissioner Hansen, I like to think that we're proactive, but ultimately it does fall um to the uh the owner, so to speak, of that interim use. I can think of one very recently about 2 years ago, uh, a provider that used to put up um fireworks uh tent in in Minnetonka, their um interim use permit had expired. Uh, we saw a tent going up. we had to go back and and look and their their permit had expired so they had to come back um through the process they weren't able to locate here that year. So um it's not foolproof um but uh but we do try to track uh as planners uh things on our our calendars. Commissioner Banks. Yeah, thanks Chair. Um for that the third point you mentioned um was noted here allowing as interim conditional uses um or other similar uses. Could you just give an example of when something is um interim but you will allow a conditional use for that? Uh chair and commissioner banks. I'm just pulling up the ordinance so I can give you a a actual um example. Um right now um for example in our R1 zoning district which is our single family um lowdensity zoning district um schools are allowed as conditional uses in that zoning district and large accessory structures are allowed as conditional [Applause] uses in that same district. The only things that are allowed as interim uses are uh home occupations and commercial kennels for dogs or cats. That's it. So in the which is strange, we have not issued a permit for that to my knowledge. Um, and so if someone were to come in, say a school district, um, or uh, a leasing office or something like that for a new development and want to put up a large accessory structure. Right now, their only option is no, you don't get to or apply for a conditional use permit, but we don't really want that to be up forever. So what this standard says is we will allow as interim something that's already allowed as conditional or a similar use. So kind of opens up that conditional use permit list for temporary uses if that makes sense. Yeah, it does. That's exactly what I thought you meant by that statement. So anyone else? All right.
