I don't know Gary that's yeah I bet it is 7 o'clock so if I could get everybody's attention hello hello we it is I guess we're all having so much fun here um it is 7 o'clock so I'm going to ask uh that we all kind of uh get our meeting mode on here and first order our business um I'd like to remind everybody please turn your cell phones on silent or um airplane mode so they don't disrupt the meeting and then second would you please join me in Pledge of Allegiance Pledge of Allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liy and Justice all so welcome everyone this evening and also watching on YouTube later on I'm going to start with introductions I'm going to start at the end this time with our chief of police Paul Falls and next to him we have Ron Batty joining us once again sitting in for Sarah s Sala welcome Ron and then we have uh Brian Grim our finance director and Jasper kral our administrator I'm Lisa whan I'm the mayor and then to my left I have council members Kathleen rekin an McGregor Peter vicory Claudia Lacy and then on the end we have our Allison fski with WSB our city engineer uh Gary Peters our Public Works director and then we have also Ali palus who is also acting as our minute taker this evening as well besides being a director of administration so with that uh we'll move on to approving our agenda are there anything any additions you wish to make to the agenda all right hearing none is there a motion to approve the agenda as pres presented thank you Miss rkin is our second thank you Miss McGregor all those in favor signify with i i all those opposed motion passes by we don't have any special presentations tonight so we will move on to persons to be heard and we have three people signed up so you will be um you'll have to come to the uh Podium you have to state your name and address for the record and you'll have 3 minutes we won't take any action on anything this evening we'll listen to what you have to say so uh we'll start with Jody Anderson hello Madam mayor and Council my name is jod Anderson and I live at 6501 West Branch Road I was not in attendance at the last uh working session so I would like to address a few things uh that were said that were not true and as you know I'm sure that we have the case with the city with dog barking uh my dogs are not house dogs that are outside barking they're Guardian dogs who actually take care of many animals I have chickens I have geese I have uh turkeys I have meat chickens goats and I have worked with the city by locking up my dogs at night in the kennel and now I've actually brought them in the house at night since I have I actually have lost more birds okay it in the last session it was referenced that I brought in truckloads several truckloads of birds which I believe it was said those seven several truckloads of birds were actually 30 birds that were replacing 20 that were killed in the last three months because my dogs were Ken and I had no dog presence in the last two week last two weeks of July I lost 15 more birds so of the 30 I lost four immediately 15 I have 11 Birds left of the birds that I purchased in June okay that is a loss any way you slice it and those dogs are necessary those dogs are not house dogs it I I I challenge each one of you to look up Guardian dogs and what they are they are they are specifically my dogs are great KES they are known for their temperament for their intelligence they they actually Ive witnessed my dogs at night when there's coyotes they're not barking this was two summers ago when they were out at night but they weren't barking and like what's wrong with my dogs it wasn't until the pack moved in my the direction of my house the dogs barked for 10 seconds 15 maybe stopped listened to the coyotes to see if they were retreating or moving toward our house and they were they barked another 10 15 seconds stopped and listened the coyotes retreated my dogs quit they don't bark Madam mayor every day all day which is what you said to me last summer when I called you trying to ask for you know how do I address this I didn't thumb my nose at anyone I reached out to you I asked you what I can do you didn't listen to me when I came here the last time and spoke and tried to educate on what a working dog is and so I stand here today and I challenge all of you please do your homework we live in agriculture I did not put a farm together overnight I lived lived on this property since 2015 and I am being mistreated there are we are going through the process legally and we will financially do what we have to do we are a farm I sell meat chickens I sell eggs I sell turkeys and I I sell uh I um sell goats miniature goats and you know I my my operation is minimized I'm not I don't have any I don't have any goats if I don't have dogs it's um you're the all right thank you for your comments and then we have uh John Anderson hello my name is John Anderson and I reside at 651 West Branch Road inist my family has lived on this property for over 50 years and I myself attended Hilltop Elementary Grand View Junior High School graduated from West honka high school and although some of the specific neighbors have changed the plotting of the surrounding land has not changed much since I was a kid in the 1970s this evening I would like to focus my comments on a specific issue that was raised about me in the Mina city council working session of July 15 2024 which a a neighbor of ours was kind enough to send to us when we were in vacation in in Europe and it was very upsetting to me and so I would like to start at Mark 2909 I'm going to quote a brief section that I'll be talking about quote this is another issue and I forwarded the email to Paul and Jasper with the noise regarding dirt bikes and four-wheelers that's come up again it's reared its ugly head again and on the same property yeah they're basically thumbing their nose at the city and The Neighbor Next Door saying we're going to do whatever we want into the heck with you that's going to be coming up for discussion I'll talk with Paul and Jasper and see where we want to go with that and just for reference the address is 6501 us Branch re so I found these comments to be disparaging unfounded an unsubstantiated attack on me and I take this personally I'm disappointed with the lack of professionalism and the prejudgment I heard at this meeting we have zero dirt bikes we have not had a dirt bike on on this property since the 1970s when I was a kid we have two youth-sized ATVs which I brought a a picture they're small Canam for stroke ATVs that we purchased for my grandchildren my special needs daughter and we we have them with the intent to drive them on our 5 and a half acres of property which is Zone acre culture they're extremely quiet they make less noise than lawnmower and they have a factory exhaust these have been ridden two at the most three times this entire summer for no more than 30 to 45 minutes and to give whoever wrote the email referenced in the work session the benefit of the doubt it's possible one of the many at TVs motorcycles side by sides that go down the road or I use the neighboring Properties or bother them I don't know we live in a dirt road in a rural area people run equipment chainsaws tractors Bobcats brush mowers there's noise that's the country my two little ATVs are not contributing much if any and regardless I see this as an attack on me via an email by an anonymous accuser my elected officials are taking this and accusing me of thumbing my nose at the city and neighbor and saying the heck with you and with no fact finding the mayor and the city are now moving forward with some action I feel singled out wrongly accused and being talked about as irresponsible and Reckless this community Mr Anderson I'm going to interrupt you when three minutes are but here's the thing we weren't talking about your property it was it was quoted in them if you listen to the transcript you'll see that it was okay we'll we'll take a look at that it was a different property it was a different property so thank you and then we have Zach Lucas is was yeah okay all right so that concludes our persons to be heard um like I said we don't take action and it was not your property that we were discussing um next we'll move on to our consent agenda items are there any of you wish to remove so that then leaves a any other ones all right that then leaves a approve our work session meeting minutes from July 15th 2024 B is approve our city Council regular meeting minutes from July 15th 2024 and C is a resolution to approve our claims and D is a resolution for a reimbursement resolution for water main project is there a motion to approve consent agenda number a b c and d thank you Miss lazy is there a second thank you Mr Victory any further questions hearing none all those in favor signify with i i any opposed motion passes 5 O and next we'll move on to number e Miss rekin [Music] as common practice if itn't weuse the that's a very good question because back in the day I'm not going to throw anybody under the bus but we were as operators and people doing it were not how can I elegantly phrase this our opinion didn't mean much so um we were shot to when we found this out and um the guy that came up from the gentleman that came up from sort of pumps brought this up he says he's seen it quite a lot with um not only like this situation but a lot of situations where they can get by with a lot smaller pump with put a bigger impeller on um running both pumps at the same time to get the same thing so um a lot of things we found um with not only this but other stuff at our plant too that we've learned valuable lessons um from the original build so moving forward we had s talking with um a2s we have a lot of long laundry list of items that we want to make sure that aren't going to happen with this one so um yeah it's just unfortunate that it happened and we did not know until we pulled the pumps to you know look at them and we weren't you know we just figured because what they normally do on the pumps is on the tag they'll put the size the impeller on there so we didn't say any we didn't know any better because we figured that was the impeller for it why should we not think that se you know would put in the right ones um but when they looked at that they said yeah this has been upsized so and that's when we found out you know that's when they start asking questions um we can run these separately but they will over they they get hot and that's the issue that they have they have to run a lot harder with the larger impellers so so the T on them they CH the well they changed the tank so what happens is on these pumps so when you order a pump you know it has the you know it'll say the ksb it'll say the model number it it'll say Dash and then they'll stamp in what the impeller is on there um does it meet this the qualifications of this pump of course it does but for our operation it needed you know both of them to run at the same time well normally in any operation any lift station that we have we have two redundancy pumps so if one goes bad hey guess what the one can pump this situation we lost the one pump and we weren't keeping up so that's when we decided you know hey what's going on here we pulled it um the pump was extremely warm and that's what we got a hold of and reason we call Minnesota pumps as they have an emergency they're one of the few that you know can get on here right away um they've helped us out many times they asked a lot of questions they brought us up a you know a pump that would work they put that in to get us by and that's what we found out about this you know that you know if you look at the actual um pump chart that shows what it is at that capacity for that impeller they are overe exceeding what that pump can do so so who the contractor that did this um I'm trying to think who put that in in the time um it would have been I'm trying who built the plant um I Dr Canen Canen so it would have been one of their subs that would have installed it at that time and stuff so they would have subcontracted it you know have doation subract we should but I mean there's not I mean they didn't do it I mean technically it was in within spec so I mean there's not we can hold against them you know but I mean it's it it will not happen again I'll tell you that because you know we made sure this is one of the new other things that we've written out um you know one of the other aggravating things is the our high service pumps in there were stop production in 2009 2009 but who checked that so why why were they put in well we didn't know I mean a Tre was new to on so the supervisor were supposed to be double cheing all of this like is on they weren't there doing what they were supposed to be doing they did I mean but i' be honest to us I mean the pumps they brought in I mean we didn't know that they were you know I mean we find this out when we got a hold of WW goats because we had one going out the impellers were getting bad he said oh yeah they how old are these and they were shocked that we told they were put in in 2016 he goes they were stop production in 2009 that's why when they found the impellers for us we said how many you have in stock yeah and they said we have eight I bought all eight yes it's expensive but you know what when they go out and we don't have one and we can't find it we're going to be so so I bought all eight we have enough to change all of them out one more time which we probably will not need uh for quite a while yet but uh yeah I mean there's just little quirks here and there that you find you know through the process that you know well I mean you know and it's stuff that we find out later you know we we take it at face value that you know that what the engineers are going to offer us you know is you know is quality so so you don't think we have recours no I I mean not anymore I mean it's been you know pushing what eight years everything is within spec so I mean I mean it it matches you know if you look at the pump matches what we what they have you know it doesn't matter if it's outdated or not so we have specify exactly well we're you know that's one thing that when we're talking to a2s when we were doing initial plant design we brought this up and they're well aware you know of what what took place so um I kind of related it to what you see with trees and developments what they do is they you know they they'll go up to the whale and tree farm and say Lisa what do you got that cheap that we can put in and you know for trees that we can get cheap and put in this developments seriously that's what happens that's why you look at these trees that are out there the Bark's terrible you know they're all beat up already and stuff but did they meet their did it meet spec for what you know they had to put in of course it diday hour to Che all good stuff well I mean it was part of the contract so like I say but the pump that they put in I mean it matches spec it does its job and what it's supposed to be you know you know you know at that time do we you know not knowing that it was of function so they said they stopped making it years before I mean was that they're still in service I mean there they still have them you know they're still out there so I mean they're you know they're making you know parts for it and stuff like that so I mean I guess I mean I don't think we have anything you know I mean there's nothing really we can do about it at this point anymore I mean it's like buying a car and you J wants to I I think I think where where you're going is like who's accountable for this and really the the pump was probably specked out during design and the the person that we pay for like construction observation is looking at the spec and the and the the sheet for for that and it met that during that time so this is probably a design piece when they Chang Me In Color doesn't that change it like the pump that's up changing the doesn't that change the pum it would they probably change it to meet the spec probably a smaller pump larger impeller met the spec met the spec signed off on it the the person doing the site inspection said okay the engineer signed off on this good to go lo and behold bu eight impellers to well no that's totally different it's a to but this is you know I mean it's something you find out down the road you know and stuff so um it's good to put more time in the design of it and getting well the inspection process you know more too and find out what it's going to be so what's the um as far as pum oh no we don't I mean the the high service pumps are exactly the same but there's no um lift station it's gravity flow to the main that flows down to one so I mean this one has because it pumps into the main for Spain that comes from um lift four on Kings Point that's why you had to have a lift station there all right well it has to get fixed so correct yeah a lot a lot of things happened back then with you know that we didn't like I mean you know and I say I won't old hash Old Wounds but I mean it really between Mike poock and myself we were pretty devastated what was told us so so um I agree I agree fully agree and understand and it's good that we that we hear this on on the air so to speak um so we're looking to uh replace the lift station pumps at the saltwater treatment plant um the we got a bid from Minnesota pump works at $1 13,819 68 uh tri state was much higher and so we're looking to award the contract to Minnesota pump works in the amount of 13,819 um 68 is there a motion to approve that thank you Miss rkin is there a second thank you Mr vicory any further questions are you sure are you sure yeah make sure that the pumps and propellers I mean need the specifications that we think we're getting um all those in favor signify with i i all those opposed motion passes by V so that concludes um basically all of our items so we'll move on to our administrative items staff reports Water Treatment Plant update Gary Peters do you need to add anything other than what we talked about at the work session no I mean um we had a nice update and yeah and then from now on once we have meetings and stuff that you know prail to that and what we're stepping up to was kind of give you a brief overview of where we're at and what we're doing okay good moving forward with that any other um good to have you back yeah I was I mean if I may um thanks for everybody bearing with me and you know missed a few meetings so it's good to be back I I appreciate it it seems everything is is moving forward budget wise and and everything else we have going on so I appreciate everybody stepping up and and kind of doing their part while I was out kind of recovering so um I don't really have any other updates um other than yeah we're going to be really focused in on this water treatment plant moving forward over the next few months and um we're going to be trying to make decisions and and pushing this along to try to get it get it done in a timely manner so that's it good um staff uh staff yes yeah um so we scheduled the ribbon cutting for the gene linear park for September 4th at 4M for the work session so hope you all can make it we'll have some shaved ice come join you some some what shaved ice shav shaved what shave ice and real quick y I was going to ask what happened to the bear it's gone um actually Dean Johnson um one of the yeah residents that live there in home time I don't it's an old show but he actually took it was going to redo it and it is so rotted and so bad so unfortunately there I kind of asked same question we looked at a drainage each head down there if they got it fixed um they're going to have a ceremonial burn at their pits uh you know this summer so unfortunately the bear will be gone it was it was unfortunately just rotted too bad that they could even fix it so well it it looks the park looks great I was over there the other day it turned out really nice good yeah lot of well that's all we could put in in that space and no I'm amazed at how manys people man to fit in there well it's only supposed to well they will not be because you have to have the handicap assess ible and it's made for one extra car we are putting signage up that there's parking down below and we will not be allowing them to park we're putting signage up to at the wellhouse because they're parking that in and they will not be parking there either so emergency situations we need to get in there so and Paul they need to run radar there so I I wonder if I can ask this question is there any kind of rules that should maybe be posted there will be yes we have we have it the sign being remade right now um one of them will be no chairs on the court we had a we had somebody put a chair in the court and it sunk in because it's the special they actually did call they felt really bad um they did call notify us um if we get some decent weather in to dries out we will be putting some uh just some blackjack in there to to fill up the ho in there they felt terrible so but yes there will be Park rule signs put up again so well even for duration on the courts is there something like that there really is no it's first come first sered and it's you're probably thinking pickle ball usually you rotate with pickle ball or yeah I know but if we're putting up a sign we should maybe because there's some groups that can stay there for hours well it's kind basketball yeah okay um any other Planning Commission August there may be a meeting is there anybody who wants to but um why don't we wait and see if might 19th okay um all right other staff reports otherwise Council reports anything off calls should decrease the amount of other calls respond will [Music] so it's less than last year after all that went down but our total partnership cover ground RS two hours next meeting that's we talk we we tried to push we tried we tried to push it along believe me was really close to get everyone to vote and move forward and we had it derailed by one person went over one Ground start at on time and check and nice [Music] everybody timeline on when decisions will be made yeah yeah we I think I think more than just the two of us were frustrated I think others were too yes yeah and yeah it was it this in one individual kind of do well everything kind of anyhow so um so yeah so um attended that that meeting in the next I'll be at the next one on the 13th and hopefully you'll be able to make that one to us so that's good tomorrow I'll have the public saf our quarterly public safety meeting with uh St Bonnie and then um also National Night Out so um the chief and I we tried to P me off on Lieutenant anyhow un fortunately you're stuck with me again so um the chief and I will be going out um and visiting and that's it and then yeah don't forget about the ribbon cutting at four o'clock on the 4th and then we'll see everybody out here on the 19th and we'll find out if we have a commission meting or not all right with that we can be adjourned sorry at the last meeting the Chris the county said that trying to put together interested okay okay great great great all right good that's it then is there a motion to adjourn um Peter
