Planning Case 26-03: Variance for Reduced Front Setbacks for Deck Addition
Dissent: None
Moved by Commissioner [00:15:36] · Seconded by Commissioner [00:15:58]
The Hendricks family requested a variance to expand their upper deck at 4936 Three Points Boulevard. The existing 4-foot deck was deemed insufficient for recreational use. Due to the corner lot status, the proposed 10x14 addition required a variance from the 30-foot front setback (Three Points Blvd) and 20-foot side setback (Crest View). The proposed deck would be 13-15 feet from property lines but further from the curb due to a substantive right-of-way. Staff reported no concerns from DNR, Public Works (with a note for utility locates), or the Fire Department. Staff recommended approval, noting the lake views and unsuitable backyard terrain. The applicants received support from close neighbors, and no adverse comments were received from broader notifications. Commissioners found the request reasonable, visually appealing, and without traffic obstruction concerns.

the the reason for it is that you know obviously a 4- foot deck is kind of a challenging for full recreational amenities for a house which is nor normal and customary to include a table and chairs or or various uh typical deck type of amenities.
from staff's perspective, we feel that it's a reasonable request that the the street side deck is quite small. ... it actually affords really really lovely views and specifically to the lake area and it seems quite reasonable to want to put on a what I would call a very standard residential deck size.
we always wanted to hope to expand the deck because we love the view and we never wanted to leave the neighborhood. So, we're just hoping um, to have that opportunity so we can really be out there as a family and um, and enjoy.
It's a really nice looking enhancement and I'm sure it'll bring you lots of joy being out there. With additional space.
I think it's very reasonable. It's they got the support of the three closest neighbors. It's I don't know if you guys get a chance to drive by, but it's up on a hill so it's not blocking anything. I think be a great enhancement.
