We have review slash discussion slashrecommendation sign variation slashmodification for mural for the bright spot building located at 2378 Wilshshire Boulevard the applicant Molly Williams I assume this is you >> Sarah >> uh members of the planning commission good evening I'm Sarah Smith I'm the development director and I'll be presenting an overview view uh of the request for sign variation/modification uh that was submitted to us from Molly Williams. Uh she's the owner of the building at 2378 Wilshire Boulevard across the street. Um and she is requesting approval uh to allow murals and artwork to be placed on all the building elevations of the building uh known as the Bright Spot. And that's the new the new building renovation in town. uh grand opening was just a week or so ago. Members may recall uh that Miss Williams was here um in mid July or mid July 2025 uh where we heard a substantial use determination to allow for reuse of the building for office space as well as community and private space. And they've gone through remodel and rehab and uh now they're uh looking forward to being open. Uh as part of their remodel activities, they're looking to do some enhancements to the building facade uh on all sides of the building. Uh specifically some mural and some artwork um primarily centered towards the corners of the building. Uh members may recall uh as part of our sign update in 2025, there was new regulations that were put into the into the sign code with regards to murals. Um, one of the most important being, and that's why we're here this evening, is that the new regulations allow for murals, but they restrict them to the side and rear elevations. And the graphics and artwork that's proposed uh by Molly for the building is going to be proposed and uh provided on all sides of the building. So they are requesting sign variation approval which is similar to a v to a variance but it's in the sign code and it allows uh the planning commission recommendation and a city council action to deviate from the sign regulations when certain circumstances are met. Um with regards to the application uh we did route it to staff and involved agencies. In addition uh for tonight's meeting, we also sent out a courtesy notification to adjacent neighbors and and property owners. Um we may or may not have guests with us this evening, but as part of the courtesy letter, we also provided a just a brief description of the request from Molly as well as copies of the graphics. Um we did include in your packet um just a a brief review of the uh request from Miss Williams. uh she is here this evening to provide additional comment. Um with regards to staff's review, we are supportive and have offered a recommendation of approval. Uh we think that the proposed mural and artwork will enhance and also brighten the exterior. Um it's a fairly large building uh as as most of us know and uh it has a long elevation particularly on the Maywood side and it's light and so I think sometimes that makes a building potentially look a little bigger that might just be my personal opinion but I think with the light canvas and adding some brightness and some graphics and some art which I think are are are very playful. I think it's a nice addition to the building and I also think it's representative of, you know, a new uh lightness and brightness and and bringing new new activity into the building for the new business. So, we've offered a recommendation of approval to include conditions and findings. So, with that, I will stand uh ready for questions. Um, and also, I know Molly's here as well. >> Questions for Sarah. discussion amongst the commission. >> If this was just on the rear or side, would it have come to us at all? >> Um I I I believe it would because I think there's again this is new regulation source, but I think there's something in in the code that also says that murals um are subject to I think they require planning commission review. >> Yes. >> Is is my recolle. So you would have seen it regardless. I think um an offshoot of of one of the things I think that we've learned as staff is I think we may look at perhaps putting the this section of the code maybe in a different area rather than signs probably same process you know maybe we'll relook at the the the requirements or the provisions but murals and art we think are probably have different values or review criteria than than signage. it was added in. I think I think that came from the planning commission and I we think it's great. We just think maybe we'll make it its own chapter. Um and so that's something I think that we'll take be taking a look at, but I my recollection is that I think planning commission review um and council action on murals is required unless I'm speaking out of school. >> Yeah, I think it looks really cohesive and really cheery and you know there really isn't that much of it but it's still going to make a big impact. Mhm. >> I mean, it's not like it covers every wall. I mean, I think it looks really nice. >> This is on my daily dog walking route. Our our custom is please give us your name and address. >> Hi, my name is Molly Williams. My address is 5075 Windsor Road Mound. Um I am not painting it. Um the artist that I have commissioned is her name is uh Kada Goolan. She's out of St. Paul. Um, her company is called Kada Creative and she does extensively largecale murals in public spaces. Um, yeah, I mean I'm I'm excited. It faces the school, you know, which is fun. Um, the graphic images, you know, are representative of some of our branding. The colors are part of the branding of my company, the Optimists, as well as the Bright Spot. Um, so you see some, you know, some abstract shapes and some more kind of they're called doodles in our branding. Um, but those are and they, you know, they all kind of have intention. Um, you see the use of like two lines together um, in a couple places and that's that's part of our branding that's called twin lines. It represents um, my other company's a travel agency. I think some of you know. So the twin lines kind of represent the road and like cohesive service and connection and community. Um so we've incorporated that throughout as well as um a nod to the branding of the bright spot which you kind of see at the main entrance door that little yellow that's like a person. So that's kind of part of our um our logo is like three circles that represent people connecting um and community. Um so >> playful. >> Yeah. >> Okay. Questions or comments from Molly? >> Well, what you've done with the interior is just magnificent. And this is I think just going to enhance it for anybody who comes in to use your space. So, I I like it. Thank you. >> Yeah, I would agree. I don't I'm not seeing anything that, you know, with the five items in here to follow, it's not, you know, there's nothing offensive about it. It's not going to detract from traffic. Um I It's pretty simple. I think it's it is a weird building, so I think anything to kind of improve that a little bit, I think, is good. But I like that you elongated the height versus going with the the hor, you know, horizontal view, but I can't really see anything that would be offensive or damaging to traffic. Now, the school, the kids might be like, can we paint the side of our school? So, that could create some bigger issues, but no, I don't I don't see anything wrong with it. Review slashd discussion slashrecommendation proposed amendments to the city code chapter 129 zoning. And we have uh three elements to discuss. Miss Rita. >> Good evening. I'm Rita Trap, planning consultant for the city. I'll just be taking the corner setbacks and then I'm going to let Mia do the other two. Um, and I'm doing the cornerard setbacks because I was the one that was in front of you talking about this uh when we discussed it. Oopsie, I got a little heavy. Um, so this is a followup to our last discussion about corner lot setbacks. Um, and this probably provides the best description. So we had discussed this at our last meeting. um and you had made some recommendations and or some suggestions on changes and things that we were going to look at. So um the first one was related to the lot line front definition um and there was a recommendation that we would file it uh whatever the determination was and that we could do it even if it was an equal size. Um there was a change to the column to make sure that it was front lot line length to width. We're trying to just be consistent so we didn't change terms and then a typo. And those were the things that when I went back through my notes that we needed to address. Um, so I'm not going to revisit this unless there's someone that needs the background because we've gone through this and this is just a follow-up to say if you're good with it, then we would move forward to the city council um with this item and make this adjustment. Did I miss anything um or were there any new items that were identified that we should be correcting relative to this topic? thoughts or comments? >> We're going to make good changes, I think. Uh, I'm Mia Colorado Mansfeld, the consulting planner with the city, and I will be talking about some other code updates. The first one is for um ADA parking design requirements and this came about when reviewing other applications. We got feedback from the city building official that the code no longer um meets the state guidelines and requirements. So we're making some minor changes to bring the code into conformance with the recommendations and best practices right now. Um, so currently the code states that stalls shall not be less than 12 feet wide and 20 feet in length. And the design guidelines um care more about the stall um the width of the space next to the stall for creating access. So we are changing the minimum stall size requirements to meet the guidelines which are 96 in wide um and rather than the 12t wide and 96 in is 8t. So 8 foot wide parking stall and then a 96 inch access aisle next to the stall that must run the full length of the stall. So, the code changes are um adding in that requirement for the 96-inch wide or 8 foot wide access aisle adjacent to the stall and then reducing the minimum stall width from 12 ft to 8 ft and also removing the stall length requirement of 20 ft as that's not in the state guidelines. questions for Mia. >> The only question I had was so the handicap stall is actually a foot narrower than a regular parking space. >> In our code, yes. >> No, with this new one, isn't it? >> Well, the change Yeah, because this code has a 9 foot wide minimum design >> standard. And is is 9 foot typical for a non ADA? >> So I think the reason they do that is because you have the access stall which is giving you that extra space >> that you need. >> Okay. >> It is a little it does feel odd when you say it, but that access stall is what's giving you the room to maneuver. >> I just want is 9 foot by 18 the >> isn't that >> the right size for >> I mean 9 by 18 is what some cities have? >> I think that's what we have too. Yeah. >> Well, that's what we have. That's what it says in there. >> Yeah. >> Yeah. >> It's, you know, there's some people that have 10 by 20. It's somewhere in the 9 to 10, 18 to 20. That's where parking stall sizes are depending on the community. >> And it used to be 12 by 20 >> the So, we're reducing the size >> and adding in the aisle. So, adding in an 8 foot aisle to the side of >> So, now if there's only one spot, it has to be 16 feet wide basically. >> Yes. Am I recalling correctly that this came up with the library? Library. >> Yeah. So what would this have helped for the library? >> They actually I think they ended up doing it. We just did a variance. >> We did a variance. So that was not sure. It was a recognition of a variation to what they should have done >> and this would have supported them. I mean they already other things. >> Right. Right. I think at that time we said they they proposed it in accordance to what they were supposed to do and we recognized then that the code >> was was old. >> Got it. >> And so this got added to our list. >> Okay. Will they have to change it to accommodate this new sizing or is this just for >> new construction? >> New construction. or if you restriped your parking lot, then you'd have to make an adjustment related to it. >> But we wouldn't proactively go and tell people to change things. >> Okay, >> good question. >> Well, thank you for clarifying the resting because I wouldn't have thought of that, but >> or reuse or something. >> Yeah, >> further discussion. Humane pet store. >> So, at the joint meeting in February, um staff was directed to look into a humane pet store ordinance for the city. So, we researched other ordinances um from nearby cities and other metro communities as well as across the state to look at how to recommend um how to bring that into the ordinance to mound. Um the focus of the ordinance is preventing pet stores from selling cats and dogs. uh it does not prohibit them from working with hum like humane society organizations or other adoption organizations to host adoption events. They just can't sell them or keep dogs at the pet store overnight. Um, so the language comes from um, all of the ordinances sort of share the same model ordinance language based off of Roseville. Um, and it adds several definitions that are new with this language. So, animal control authority, animal rescue organization, terms like that. So, those would be added into the definition section of the zoning code. And then we change the um definition of retail store to include pet stores and remove that from the um definition for pet and veterinary services so that veterinary hospitals aren't uh defined the same way as a pet store to separate those uses. Um, and then it prohibits sales, as I mentioned, and requires a certificate of source for animals. So that, um, when you adopt or purchase an animal, there's documentation as to where the pet came from. Um, and it requires inspection as well from the city. And that's the gist of the ordinance. >> Okay. Questions for me. Is there any reason why cats are treated differently than dogs in the language? >> I think it's because of the sort of assumed care. Are you referencing that cats are allowed to be kept overnight? >> Yeah. >> At after a >> um during an adoption event. >> Yes. >> Yeah. That was just the standard that was in all the language. I would presume it's because they have different care requirements than dogs, but I don't know for certain. >> And then for breeders that don't have a retail location, is are they just unrelated to this or >> is it prohibited as well? Just wanted to clarify. >> I believe it's unrelated because they're not considered a pet store. >> Got it. And so breeders and kennels are their own use. >> Great. >> Yeah. >> Um, one thing I noticed at the very end, there's a spot that says for violations under section XX of city code. I'm assuming that will be >> Yes, that will be a reference. >> Yeah, that that'll end up in the misdemeanor section of the code. That'll be filled in for the Okay. in the in the draft ordinance. Um, she emailed me last week and I said it it was on our agenda today, but I want to confirm that we have to still go through council. >> It has to go to council. We have to hold a hearing and the and the notice of public hearing was published in last Saturday's Laker. >> Thank you. and it'll be posted on the um the uh the ordinances will be posted on the city website and on our um and on the bulletin board not less than 10 days ahead. I forgot this was on here, so I'll do this one. Outlets. Um this uh the need for adding a definition or addressing outlots was identified as part of the recent development applications that we had. Um specifically um the improvements related to the water treatment facility. Uh it was noted because we Sarah and I as planners know that you can't build on an outlot like that's just drilled into you. And then when we actually went through the code, we realized it doesn't actually say that any place in the code. Um and so this uh proposed amendment is to address that omission. Um that's how we've been practicing. Um but we should have that in case just to make sure that no one um has the opportunity. So we have inserted a proposed definition um which is a parcel of land um described by reference in a plat as a lettered outlot which is intended for open space, rightway, utilities, essential services, drainage or to hold for future platting in order to facil facilitate development. Um, and I'd say over the years we have all of these reasons in mound. Um, so we tried to think of all the reasons why we've had outlots. Um, and that kind of describes them. Um, and then we did want to add in the building permit section, just to be uber clear, uh, that you can't issue a building permit for these um, situations except for um, if you are going to actually build a water treatment facility or you're going to put a playground in or some type of feature like that. we want to be able to be able to do those things um but not have like a private development that would occur on outlets. So that is the reason for uh doing this change um and that's the language we're proposing but open if there's questions or ways that we could improve it. >> Okay, questions from Rita is today the only people who own outlets >> who own them. >> Yes. No, no. Developer, private people can own outlets, but we want to make sure that private folks don't put anything on those outlets. Associations like an association that has like a townhouse association, they will own as an outlot the open space that's around them that's like lawn area. And so, we want to make sure that structures aren't put on those things. >> So, for example, we own several outlets. Um, you know, outlot B comes to mind in downtown mount >> that has people have wanted to purchase that. >> It will get repl >> and then it gets replatted. That's the part of the definition that says for future platting in order to facilitate development. So when the original plat happens, if you don't know what to do with it, but you know you're going to want development, you put it as an outlot which forces the actual platting to happen again so that you'll revisit how it's going to be used. >> Okay. Thank you. >> And in the case of a homeowners association, we want to prohibit extra structures from the outlaws >> like a Yeah, you don't want to have an accessory structure, a garage. >> I see >> those kinds of things. >> That's not really what their intended purpose is. >> Further comments, >> questions? the the very bottom where it's got no building permit shall be issued except for essential services, service buildings, park facil is all that defined in our definitions like what is a government structure or park facilities? Do we have that defined? >> Those probably I the essential services and essential service buildings are defined. The park facilities are probably not defined nor are other governmental structures. That was Sarah and I's planning generality to allow us to have some flexibility >> on sign monuments. Do we want to prohibit private sign monuments? >> Those sometimes are constructed even on private. Like if you have a neighborhood association, they might have a sign monument. They're not as common as they used to be. They used to be all the rage and lately I don't feel like there's as many of those. and like maintaining them. Someone's got to maintain them. A lot of times now they're actually getting put on like one person's property >> as opposed to be putting on an outlet. >> There's not as common as I said as they used to be. >> So I I debated that. I even debated taking it out, but this gives us some flexibility with it. >> That makes sense. No garage. Yes. Sign if they really wanted. I guess that that attracts for me. Yeah. >> Yeah. And we're not getting a lot of new development of like an association maintained um lately. City Council liaison update cap. >> Well, the last couple meetings our agendas have been really lean, so I really don't have anything of much interest. Um, the last meeting we did approve the the new LLC way finding signage that um the parks commission worked on with uh Bolton and M and they it looks nice. It should be up in the next couple of weeks. Um, and thank you for everybody who came to the open house. It was great to see you all. And really, that's all I've got tonight. >> Okay. Um, we also, some of us also were at the open house for the bright spot uh for the grand opening a week ago yesterday. Um, very very nice events and I think the council did a great job uh at the open house on the 23rd. I thought that was fun and I think we can just build on that. It was I met a lot of people um and it was fun seeing the kids and so I thought it was a really nice event for a first time. So, thanks for everybody for attendance. Uh, just a couple things uh happening in our world. Um special events are going to start soon. Um you know, music in the park, uh they're having two events in July and August. Um because of the construction and parking, uh issues with commerce with the water with the water project, they are opting not to do a June event. Um farmers market's going to start at the end of May. That's super exciting. Um our team is meeting with the group on Thursday just logistics and um gearing up for the season and projects that are happening just to so everybody kind of is on the same sheet of music. Um it I enjoy that farmers market so much. Um we do have the final plat has come in for Fern Lane Town Homes. Um we anticipate that'll be going to council sometime soon. Uh we're waiting for updated title work right now. So, as soon as that gets um delivered, uh we'll get that geared up um uh and slated for a future council meeting. Uh as coun as planning commission just may be aware, final plat is the is the second part of the planning process. It does not require planning commission review as long as the plaid is consistent with the original approvals that were granted. uh the plan or the council actually also granted uh an extension because the timeline uh between uh the approval of preliminary to final. We we were getting close to that year and so the council did um as allowed by the code extend that. Um so we'll be seeing that uh at the council level sometime soon. Um I am going to be out just for a week. Um and in my absence you can sure reach out to Jesse. I'm gone Tuesday the 12th through the 20th. Um, but that will be in and out. You won't even know I'm gone. I'm also on select jury duty for the first two weeks in June. >> So, in Wright County, so I don't I I just have to call in every day and if I get on a case, I get on a case. I'm I I want to, but I'm super busy. So, um, but it that's just that's just the way the cookie crumbles. Uh, but I'm kind of excited about it as well. But I it shouldn't it won't take me out of action, that's for sure. Um, other things uh it's busy. Um, we uh are really excited uh to have Kate Vote joined us. She's out of town. Um, but she'll be back in in a day or so. But um, she's been a great addition to our staff. She's very sharp and her and Sarah are working really well together and um, it's nice to have another another person, another body. So, we're we're thrilled to have her. This is the this is the second part of the planning process. It's a preliminary plat and then they got their approval of their land use and the vacation. This is the plat that they will actually record and as long as this is consistent with everything that got preliminary approval, it'll get approved by the council. So, it's same project. It's just the it's all the technical stuff that they actually get reported. >> Well, I mean there there were some conditions. >> Oh, always that we weren't 100%. Yeah. Yeah. It has to meet all the conditions. Yes. Yeah. That that all gets checked as part of the review. >> Okay. >> Yeah. >> Great. No, we haven't um the I think I sent out as FYI the concept plan. Um we haven't heard back from them since they were there. My guess is they're working on stuff, but I haven't heard anything back. What about the Halstead Bay? >> Um, we are waiting for some information to be delivered to us so that we can submit the comp amendment. So, it's in their court. So, we're just waiting. >> So, has the condos property actually been purchased? >> Um, I don't know. I know they're working on it. >> Okay. >> At least that's what I was told. That was a couple of weeks ago is what I was told as if they were trying to get to close. >> Okay. >> So, about 15th of April maybe I I was information because I I keep checking. Are they selling and are they planning to build the next building? >> Um I I I've heard through the grapevine they're on my list to check in with um that uh they're looking for additional building permits soon. I've heard that through the great vine, not from them. Um but we will we will be circling back. I don't know. I've heard that >> some may have sold, but I that's not been field verified. I I've heard that two for sure have sold. One for um investment purposes and that person's renting it. >> Then I heard another one sold and I actually heard a third may have just sold too. So really, but again that that's not verified. Anything else from the from the commission? >> I don't have anything planning related, but I would like to just very quickly state that um I don't know how many people are aware of this, but last month I was in Washington DC. Um my husband had business and we were out there and I had nothing to do. So, I learned I think I knew this, but I didn't ever experience it, that you can contact uh Representative Kelly Morrison's office and request tickets for a White House tour. The other thing you can request if they're able to is they have interns who will give you a private tour of the US capital. So, if you are heading out to DC, I would say contact her office and request that. It was amazing. like I had an intern who took me through like secret tunnels and you know and then I looked at everybody else who's like 200 people in a tour like the regular capital tour and I thought oh gosh no I don't want to do that but no it was really good um the interns in her office were wonderful the process was easy it was just a website form and so I just wanted to plug that if if or if you're talking to people in the uh community who are going to DC have them contact our office and request that it's if you can get in on the private tour of the capital it's really Because the main tour you could you don't you can't go into any of the chambers. So you don't get to see the the actual chambers of the Senate or the um House of Representatives with your tour guide. You could sit there all day if you want. Like nobody was chasing us out. A lot of security. You do have to go through checkpoints every time you go in. But so I just Kelly Morrison's office was wonderful to work with on that. >> Okay.
