All right, so if we can go ahead 00:01:26.667 --> 00:01:32.000 and uh enter into roll call. Council member Erikson Council 00:01:32.000 --> 00:01:42.634 members young. Council member Kleanowski. Mayor Winston, Page. 00:01:42.634 --> 00:01:53.467 Council member McGarvey. Council member Tran. Council 00:01:53.467 --> 00:02:14.634 member Tran. Council member, we cannot hear you. We’ll give it 00:02:14.634 --> 00:02:36.667 a few minutes. check We also can’t see her on our screens 00:02:36.667 --> 00:02:48.467 either, so. You can see her. Mayor and council members, 00:02:48.467 --> 00:02:52.133 she’s up on the screen right here for the purposes of the 00:02:52.133 --> 00:02:55.834 meeting, if she needs to ask questions or something later. I 00:02:55.834 --> 00:03:00.100 don’t have my 20 year old vision, so. Somebody laughed at 00:03:00.100 --> 00:03:20.000 that a little too hard. Thank you. All right, good. to start 00:03:20.000 --> 00:03:30.467 this one. Yeah That was our purpose, don’t worry. A few 00:03:30.467 --> 00:03:34.767 minutes, folks, uh. Sometimes we have a few technical 00:03:34.767 --> 00:03:46.000 difficulties. Council member Tran. Can you hear me? Yes. Yes. 00:03:46.000 --> 00:03:54.266 Here. Thank you. Mayor Winston, you have a quorum. Thank you. 00:03:54.266 --> 00:04:04.133 So if we can all rise for the Pledge of allegiance. Hm a flag 00:04:04.133 --> 00:04:11.100 of the United States of America. In one nation under God. 00:04:11.100 --> 00:04:23.533 Invisible justice. All right, so wonderful. So we’re gonna 00:04:23.533 --> 00:04:26.734 head into the public comment portion, so we will go ahead 00:04:26.734 --> 00:04:31.000 and start. Uh, are there any Is there a response to any prior 00:04:31.000 --> 00:04:38.367 public comments. Mayor, city council members, we did not 00:04:38.367 --> 00:04:43.000 have anyone address the council, um, at the May 12th City 00:04:43.000 --> 00:04:46.200 council meeting during the public comment period. Thank 00:04:46.200 --> 00:04:53.000 you. So next, um, I have one person, uh, Miss Colette Guy 00:04:53.000 --> 00:04:57.567 Hempel. So if you wanted to speak, If you can limit it to 3 00:04:57.567 --> 00:05:14.100 minutes, um, name, address, thank you. Good evening, Mayor 00:05:14.100 --> 00:05:19.934 and city council. My name is Collette Guyet Temple. I live 00:05:19.934 --> 00:05:27.467 at 9277 Trinity Gardens here in Brooklyn Park. So While I’m 00:05:27.467 --> 00:05:33.266 here about, again, I have been here in the past, and I am 00:05:33.266 --> 00:05:38.533 asking for a response to this public comment. As many fellow 00:05:38.533 --> 00:05:42.800 Brooklyn Park residents. have been asking me what direction 00:05:42.800 --> 00:05:48.800 are you taking on these items. The community activity center 00:05:48.800 --> 00:05:52.000 renovation. It does not look like the bonding bill will be 00:05:52.000 --> 00:05:59.467 passed. We have been waiting since 2022, when the first 00:05:59.467 --> 00:06:03.867 planning was for the ring conversion, not to take a nice 00:06:03.867 --> 00:06:11.200 shrink away, but to simply save the city money and provide more 00:06:11.200 --> 00:06:13.233 opportunities and more amenities to our diverse 00:06:13.233 --> 00:06:21.367 population. Yes, a 5th grader in 2022 is not likely to see 00:06:21.367 --> 00:06:25.200 the courts being built before at the community center before 00:06:25.200 --> 00:06:29.400 they graduate from high school. They’re now a 9th grader. If 00:06:29.400 --> 00:06:35.300 you do not take action and start building next year. They 00:06:35.300 --> 00:06:38.900 won’t see it before they’re done. Maybe they can use it for 00:06:38.900 --> 00:06:48.100 graduation. So What are you going to do? Are you going to 00:06:48.100 --> 00:06:52.634 ask the voters for a referendum, or are you going to adjust the 00:06:52.634 --> 00:06:58.200 budget? Or are you gonna pray that somebody just comes along 00:06:58.200 --> 00:07:07.367 with 13 to $17 million. Then we have the school district. The 00:07:07.367 --> 00:07:12.634 same 5th graders have not had act school activities if they 00:07:12.634 --> 00:07:18.100 live south of 85th. All the way through their junior high by AO 00:07:18.100 --> 00:07:23.000 School District. Yes, we pay community dollars, community at 00:07:23.000 --> 00:07:28.100 dollars that should have been spent on this. We pay for 00:07:28.100 --> 00:07:33.934 at-risk and highly mobile, we pay for compensatory aid. For 00:07:33.934 --> 00:07:37.266 these schools. So where are these activities to keep the 00:07:37.266 --> 00:07:41.100 kids from being a school to prison pipeline that the mayor 00:07:41.100 --> 00:07:45.734 keeps talking about. I’ve asked, I’ve been here for 4 years. 00:07:45.734 --> 00:07:50.033 I’ve shown you the booklets. I’ve shown you that it’s now 00:07:50.033 --> 00:07:56.400 online. Some schools, no activity is found. Birchgrove. 00:07:56.400 --> 00:08:03.367 Palmer Lake Garden City. Some of these get one thing now 00:08:03.367 --> 00:08:07.200 after 3 years of fighting at the school board after asking 00:08:07.200 --> 00:08:11.166 you. It’s in Minnesota’s constitution, you all take an 00:08:11.166 --> 00:08:17.900 oath. Both sets of government. And yet, these kids are still 00:08:17.900 --> 00:08:23.634 being abandoned. Then we have Huntington Place and no I’m 00:08:23.634 --> 00:08:25.934 gonna have to ask you to uh wrap it up there. You went over 00:08:25.934 --> 00:08:29.634 your 3 minutes, but thank you. I’m sorry, but medically 00:08:29.634 --> 00:08:32.133 speaking, I’m gonna just say it again. I’m gonna have to mute 00:08:32.133 --> 00:08:34.767 you, but please don’t disrespect the decorum of the 00:08:34.767 --> 00:08:51.934 council. I gave you 3 minutes. Can you guys hear me now? All 00:08:51.934 --> 00:08:55.367 right, thank you. Um, so I think we’ll have a response for 00:08:55.367 --> 00:09:00.533 that, but I know that we as a council do not take an oath to 00:09:00.533 --> 00:09:04.200 fulfill the responsibilities of the school board, um. So some 00:09:04.200 --> 00:09:06.467 of that is gonna be aimed at the school board, but we’ll 00:09:06.467 --> 00:09:09.133 have a response at the next meeting, as far as our youth, 00:09:09.133 --> 00:09:12.934 we do have some tough decisions, but of course, those decisions 00:09:12.934 --> 00:09:16.200 are always on taxpayer dime. Uh, so we’ve got to make the right 00:09:16.200 --> 00:09:20.200 decisions and do it in the right way. Uh, so next, uh, we 00:09:20.200 --> 00:09:24.400 can move to approval of the agenda. So. All right. Is there 00:09:24.400 --> 00:09:30.100 a second? All right, so the motion was made by Councilor 00:09:30.100 --> 00:09:33.734 McCanowski, uh, seconded by council members Young, um, we 00:09:33.734 --> 00:09:39.000 will need a roll call. This is for the approval of the agenda. 00:09:39.000 --> 00:09:46.100 Council member Erikson. Council member young Council member 00:09:46.100 --> 00:09:52.266 Kanowski. Council member Page. Council member McGarvey. 00:09:52.266 --> 00:09:59.166 Council member Tran. I Mayor Winston. I, the motion passes 00:09:59.166 --> 00:10:03.100 with 7 yes votes, 0 or no votes. All right, wonderful. And just 00:10:03.100 --> 00:10:07.734 for folks, I think I said it earlier, but, um, Generally we 00:10:07.734 --> 00:10:11.567 try to do uh vote by claim or, but, uh, we had to do roll call 00:10:11.567 --> 00:10:15.734 when we have folks calling in, um, using the Internet or any 00:10:15.734 --> 00:10:18.934 other manner. So we had to do the roll call for that so 00:10:18.934 --> 00:10:22.734 people understand that we’re not trying to break protocol, 00:10:22.734 --> 00:10:25.467 uh, but it’s required when we use this particular format. 00:10:25.467 --> 00:10:30.734 Next we can go to public uh public presentations and then 00:10:30.734 --> 00:10:34.934 we have 3B1, uh, which will be presented by Chief Mark 00:10:34.934 --> 00:10:38.266 Bruulley, and that will be for presentation. A police 00:10:38.266 --> 00:10:42.934 department community awards. Oh, sorry. Mayor Winston, it’ll be 00:10:42.934 --> 00:10:45.634 a deputy police chief Shane Duaul, Deputy Police Chief 00:10:45.634 --> 00:10:47.800 Shane DePaul. Sorry, I was reading off the sheet, so I’m 00:10:47.800 --> 00:10:52.634 not sure how I confused you guys because you look so much 00:10:52.634 --> 00:11:02.500 alike, but forgive me. Do you want to go? She Yeah, we’ll go 00:11:02.500 --> 00:11:05.934 up for her. Mayor Winston, council members, tonight I’m 00:11:05.934 --> 00:11:09.100 here to present the uh Brooklyn Park Police Department’s 00:11:09.100 --> 00:11:16.634 community ward. Uh, to Kate Yanka and Tiffany Adams. On 00:11:16.634 --> 00:11:19.800 behalf of the residents of the city of Brooklyn Park and the 00:11:19.800 --> 00:11:21.934 Brooklyn Park Police Department, you are hereby commended for 00:11:21.934 --> 00:11:28.867 your actions set forth below. In June 2024. Brooklyn Park 00:11:28.867 --> 00:11:33.667 police officers were dispatched to the 7700 block of 68th 00:11:33.667 --> 00:11:37.400 Avenue North. Responding to the report of an adult male who had 00:11:37.400 --> 00:11:41.133 collapsed and required CPR at the indoor pickleball court. 00:11:41.133 --> 00:11:43.900 Fortunately for the patient who was barely breathing, two 00:11:43.900 --> 00:11:46.934 nurses happened to be playing pickleball that evening and 00:11:46.934 --> 00:11:51.934 witnessed the emergency. OK and Tiffany rushed to his side, 00:11:51.934 --> 00:11:57.634 quickly assessed that he had no pulse and began giving CPR. An 00:11:57.634 --> 00:12:00.834 EED was located and applied to the unconscious man, delivering 00:12:00.834 --> 00:12:04.767 a shock. The patient’s heartbeat was restored, and he 00:12:04.767 --> 00:12:08.867 began breathing on his own. He was transported to the hospital 00:12:08.867 --> 00:12:11.467 and discharged that evening. The following day, he was able 00:12:11.467 --> 00:12:14.266 to reunite with Kate and Tiffany and thank them for 00:12:14.266 --> 00:12:18.467 saving his life. The life saving efforts of Kate and 00:12:18.467 --> 00:12:22.667 Tiffany were crucial in rescuing a man experiencing a 00:12:22.667 --> 00:12:25.567 medical emergency. The city of Brooklyn Park and its residents 00:12:25.567 --> 00:12:29.133 are deeply appreciated. of the selfless service of Kate and 00:12:29.133 --> 00:12:32.900 Tiffany. Their actions not only saved a life, but also 00:12:32.900 --> 00:13:08.133 exemplified the true spirit of community. Thank you very much. 00:13:08.133 --> 00:13:59.734 Exactly OK. One Yeah recognition of recognition of 00:13:59.734 --> 00:14:16.233 yeah yeah. The Oh, you don’t, OK. OK. Oh yes, we’re having Oh 00:14:16.233 --> 00:14:29.166 yeah, yeah. to walk all the way around. Sorry. So Got nervous 00:14:29.166 --> 00:14:33.800 for a second. I only got one. I’m not sure why everybody’s 00:14:33.800 --> 00:14:38.100 leaving. You’re gonna miss the exciting stuff, so. Mhm I don’t 00:14:38.100 --> 00:15:02.233 want to get out of this public hearing. All right, so the 00:15:02.233 --> 00:15:05.900 purpose of this next agenda item is to publicly recognize 00:15:05.900 --> 00:15:07.667 and thank outgoing commissioners for their 00:15:07.667 --> 00:15:11.400 contributions to the city of Brooklyn Park. Um, on November 00:15:11.400 --> 00:15:15.500 11th, uh, 1996, the city council adopted a policy for 00:15:15.500 --> 00:15:18.767 recognition of outgoing members to city boards and commissions 00:15:18.767 --> 00:15:21.367 under the policy, commissioners who serve at least 3 years on a 00:15:21.367 --> 00:15:24.367 commission to receive a plaque, while commissioners who served 00:15:24.367 --> 00:15:27.800 less than that receive a cert a certificate or a letter. Um, 00:15:27.800 --> 00:15:30.500 plaques will be mailed to the commissioners who are unable to 00:15:30.500 --> 00:15:33.634 attend tonight’s meeting, so there are 2 who are not 00:15:33.634 --> 00:15:37.900 attending, Patrick, um, Chidester, Community long range 00:15:37.900 --> 00:15:40.800 Improvement commission, so, um, it served from For, uh, April 00:15:40.800 --> 00:15:47.100 1st, 2022 through April 1st, uh, 2025, and then Dwayne Erickson, 00:15:47.100 --> 00:15:49.767 recreation and Parks Advisory Commission, who served from 00:15:49.767 --> 00:15:56.100 April 1st, uh, 2018 through April 1st 2025. But uh we’re 00:15:56.100 --> 00:16:00.500 blessed to have in person Akeem Adenji, uh, with the budget 00:16:00.500 --> 00:16:04.133 advisory commission, uh, and, uh, Kim, if you want to come up, 00:16:04.133 --> 00:16:13.734 uh, served. From April 1st, 2019 through April 1st, 2025. 00:16:13.734 --> 00:16:16.467 Uh, so I’m gonna go ahead and give this plaque, but before I 00:16:16.467 --> 00:16:20.100 do that, thank you for your service. I actually served on 00:16:20.100 --> 00:16:22.867 the budget advisory commission, so it’s not always the most 00:16:22.867 --> 00:16:26.100 exciting one because it’s numbers after numbers after 00:16:26.100 --> 00:16:28.734 numbers, but those numbers are all connected to real work that 00:16:28.734 --> 00:16:32.900 we do with the city, uh, and then you’ve made a number of 00:16:32.900 --> 00:16:34.500 great suggestions and recommendations and just 00:16:34.500 --> 00:16:36.667 sitting in there is always important to making the city 00:16:36.667 --> 00:16:40.467 work, it makes it much more vibrant. So I very much 00:16:40.467 --> 00:16:43.100 appreciate you taking the time and the other thing I forget is 00:16:43.100 --> 00:16:46.900 that uh it’s once a month, but sometimes those money those 00:16:46.900 --> 00:16:49.500 meetings run longer than the 2 to 3 hours. Sometimes they run 00:16:49.500 --> 00:16:52.367 4 to 5 hours and people hang in there and they make it happen. 00:16:52.367 --> 00:16:56.634 So I thank you for uh making that volunteer effort, uh, in 00:16:56.634 --> 00:17:00.266 serving our city and hopefully you continue uh to stay 00:17:00.266 --> 00:17:25.800 involved. So thank you. Thank you very much. I think it’s 00:17:25.800 --> 00:17:57.400 right here first. Yeah Yes just Oh, just me. wrong. Perfect. OK, 00:17:57.400 --> 00:18:32.000 thank you. In case they ask, yeah, OK. All right, so next. 00:18:32.000 --> 00:18:38.367 We have a proclamation, uh, proclaiming the month of June 00:18:38.367 --> 00:18:42.133 202025 as Pride Month in the city of Brooklyn Park, 00:18:42.133 --> 00:18:45.834 Minnesota, whereas the city of Brooklyn Park recognizes and 00:18:45.834 --> 00:18:48.233 celebrates the rich diversity of its community, including 00:18:48.233 --> 00:18:52.867 members of the lesbian, gay, bisexual, transgender, queer, 00:18:52.867 --> 00:18:58.200 intersex, asexual and other sexual and gender minority, 00:18:58.200 --> 00:19:00.767 LGBTQ plus communities and whereas Minnesota’s population 00:19:00.767 --> 00:19:05.834 is made up of 4.1. % LGBT plus according to LGBT demographic 00:19:05.834 --> 00:19:11.000 data interactive and whereas more than 135,000 employed in 00:19:11.000 --> 00:19:14.233 Minnesota identify as LGBT plus, according to LGBT um 00:19:14.233 --> 00:19:17.900 demographic data interactive. And where’s the city of 00:19:17.900 --> 00:19:20.567 Brooklyn Park vehemently denounces all hate and 00:19:20.567 --> 00:19:25.500 oppression, and whereas more than 50 years ago in June 1969, 00:19:25.500 --> 00:19:32.300 a courageous group of LG LGBTQ plus individuals, including 00:19:32.300 --> 00:19:35.000 Black trans activist Marshall P. Johnson stood up against police 00:19:35.000 --> 00:19:38.233 brutality and harassment during a raid at the Stonewall Inn in 00:19:38.233 --> 00:19:41.367 New York City. This act of resistance ignited the 00:19:41.367 --> 00:19:45.200 stonewall uprising, a pivotal moment that galvanized the 00:19:45.200 --> 00:19:48.467 modern LGBTQ plus. Civil rights movement and continues to 00:19:48.467 --> 00:19:52.133 inspire the ongoing fight for equality, dignity and justice, 00:19:52.133 --> 00:19:56.000 and whereas in 1999 President Bill Clinton issued a 00:19:56.000 --> 00:20:00.100 proclamation designated June as gay and lesbian ride Month and 00:20:00.100 --> 00:20:03.834 wears in 2009, President Barack Obama expanded the observance 00:20:03.834 --> 00:20:07.634 by proclaiming June as lesbian, gay, bisexual, and transgender 00:20:07.634 --> 00:20:11.266 Pride Month and whereas Brooklyn Park strives to be a 00:20:11.266 --> 00:20:13.500 united community that understands and celebrates our 00:20:13.500 --> 00:20:16.634 unique cultures. And whereas a city works to increase that 00:20:16.634 --> 00:20:19.367 empowers residents and neighborhoods to prosper. Now 00:20:19.367 --> 00:20:23.533 therefore, I Hollis Winston, on behalf of the city council city 00:20:23.533 --> 00:20:26.900 staff, residents, and the community at large do hereby 00:20:26.900 --> 00:20:30.500 proclaim June is pride month in Brooklyn Park to recognize and 00:20:30.500 --> 00:20:32.567 celebrate the many contributions, diverse cultures, 00:20:32.567 --> 00:20:42.834 and extensive histories of the LGBTQ plus community. So. So 00:20:42.834 --> 00:20:46.500 I’m gonna say a few words, I think when, when you think 00:20:46.500 --> 00:20:49.467 about Stonewall and Stonewall, and I think we’ve often, you’ve 00:20:49.467 --> 00:20:53.500 heard me talk about the civil rights movement and some of the 00:20:53.500 --> 00:20:56.734 violence that it countered that was. Aimed at my community and 00:20:56.734 --> 00:20:59.467 other communities of color, I think that Stonewall movement 00:20:59.467 --> 00:21:04.166 was a pivotal movement in terms of the LGBTQ. IA plus I think 00:21:04.166 --> 00:21:09.000 is the full acronym now, nowadays, um. Uh, folks stood 00:21:09.000 --> 00:21:13.233 up and they stood up against that violence, and I think we 00:21:13.233 --> 00:21:15.867 have made great strides as a community, but I think when we 00:21:15.867 --> 00:21:19.166 talk about a community that has dealt with, um, many an 00:21:19.166 --> 00:21:22.834 internal struggles that people deal with in their own families, 00:21:22.834 --> 00:21:26.634 um, within the community, uh, and then just some of the 00:21:26.634 --> 00:21:29.300 ostriches, ostracization that folks have dealt with and the 00:21:29.300 --> 00:21:32.900 very real violence that people have experienced. Um, I do 00:21:32.900 --> 00:21:35.367 think that this is an important month to remind people of that, 00:21:35.367 --> 00:21:38.934 to stand up against that, uh, that nobody. Deserves to have 00:21:38.934 --> 00:21:43.567 to deal with that level of fear or that level of violence, or 00:21:43.567 --> 00:21:46.767 being ostracized from their family, no matter what, um, you 00:21:46.767 --> 00:21:51.667 know, we are one community that goes for uh across ethnicity, 00:21:51.667 --> 00:21:56.467 gender, um, and uh within LGBTQIA community. So I think 00:21:56.467 --> 00:21:59.166 there are still strides to be made, uh, but we went out of 00:21:59.166 --> 00:22:02.834 the strides that have been made and do our part as a city to 00:22:02.834 --> 00:22:06.734 make sure that everyone feels comfortable where we live, uh, 00:22:06.734 --> 00:22:10.834 in our city, because To be honest, that’s what we’re 00:22:10.834 --> 00:22:14.033 responsible for, uh, here in this chamber is what happens 00:22:14.033 --> 00:22:40.233 within our city. Uh, so thank you. Mr. Mayor And members of 00:22:40.233 --> 00:22:44.467 the council, this this direction, hello, there is also 00:22:44.467 --> 00:22:47.734 a motion request in, in the request for council action 00:22:47.734 --> 00:22:50.900 associated with this agenda item that you were just on, so 00:22:50.900 --> 00:22:53.567 just directing me there will go ahead and make that motion. 00:22:53.567 --> 00:22:56.767 Motion to direct city staff to fly the pride flag in front of 00:22:56.767 --> 00:23:00.500 City Hall during the month of June in recognition and 00:23:00.500 --> 00:23:04.300 celebration of LGBTQ plus Pride Month. Is there a second? All 00:23:04.300 --> 00:23:08.567 right, so the motion was being made by myself, seconded by uh 00:23:08.567 --> 00:23:11.867 council member Kanowski. So we will need a roll call. Council 00:23:11.867 --> 00:23:19.166 members young. Councilman Rick Kanowski. Council member Page. 00:23:19.166 --> 00:23:27.200 Council member McGarvey. Councilmember Tran. 8 Council 00:23:27.200 --> 00:23:31.567 member Erikson, Mayor Winston, I, and forgive me for um not 00:23:31.567 --> 00:23:35.300 saying that I’m used to just reading them. So the motion 00:23:35.300 --> 00:23:39.467 passes with 77 yes votes, 0 no votes. Wonderful. All right, so 00:23:39.467 --> 00:23:48.567 next, if we can move to the, uh, consent agenda. Is there a 00:23:48.567 --> 00:23:54.667 motion to approve the consent agenda. Hello Uh, is there a 00:23:54.667 --> 00:23:58.734 second? All right, so the motion was made by council 00:23:58.734 --> 00:24:01.400 member Kanowski, seconded by council member McGarvey, we 00:24:01.400 --> 00:24:06.834 will need a roll call, OK. You’re voting on consent agenda 00:24:06.834 --> 00:24:13.100 item 4.0. Council member Kliowski. Council member Page. 00:24:13.100 --> 00:24:20.100 Council member McGarvey. Council member Tran. I. Council 00:24:20.100 --> 00:24:28.033 member Erikson. Council members young Mayor Winston I, the 00:24:28.033 --> 00:24:32.767 motion passes with 7 yes votes, 0 no votes. All right, 00:24:32.767 --> 00:24:35.166 wonderful. So next we’ll go ahead and move to public 00:24:35.166 --> 00:24:39.166 hearings, and this will be a public hearing to reconsider 00:24:39.166 --> 00:24:41.367 the recommendation of the Brooklyn Park Charter 00:24:41.367 --> 00:24:47.767 Commission to amend chapter 2, Section 2.06 2.06 in chapter 4, 00:24:47.767 --> 00:24:53.166 section 4.03 of the Home Rule City charter. And I know we 00:24:53.166 --> 00:24:56.500 have charter commission chair, another one of those unpaid 00:24:56.500 --> 00:25:01.200 volunteers, um, Dennis Siarra, so thank you for uh coming and 00:25:01.200 --> 00:25:15.667 making this presentation. OK I know. All right, I think I’m 00:25:15.667 --> 00:25:31.033 just gonna. OK, I’m just going to Evening Mayor Winston and 00:25:31.033 --> 00:25:33.734 council members, the charter commission is presenting two 00:25:33.734 --> 00:25:36.467 amendments this evening to the city charter in the interest of 00:25:36.467 --> 00:25:40.634 shortening the length of vacancies in the office of city 00:25:40.634 --> 00:25:43.900 council member and mayor, as well as reducing costs that the 00:25:43.900 --> 00:25:48.233 city must incur for special municipal elections. Uh, before 00:25:48.233 --> 00:25:52.467 I go on, just a little bit of background, uh, the charter 00:25:52.467 --> 00:25:55.734 commission was first asked to look into these issues in July 00:25:55.734 --> 00:26:02.000 of 2023. By the city council. Uh, and the charter commission 00:26:02.000 --> 00:26:04.467 did so in consultation with the city attorney and with the city 00:26:04.467 --> 00:26:10.033 council. And tonight is the 3rd time that these recommendations 00:26:10.033 --> 00:26:14.800 are before the council on these matters. I’d now like to read 00:26:14.800 --> 00:26:19.634 the amending language to section 2.06. And it should 00:26:19.634 --> 00:26:23.900 read the council shall by resolution at the next regular 00:26:23.900 --> 00:26:27.200 or special council meeting, declare a vacancy on the 00:26:27.200 --> 00:26:31.900 council to exist and call for a special election if one is 00:26:31.900 --> 00:26:35.100 required. The declaration date of vacancy shall be the day of 00:26:35.100 --> 00:26:38.834 the council meeting at which the resolution is adopted. 00:26:38.834 --> 00:26:44.634 Currently, the charter allows 45 days between the declaration 00:26:44.634 --> 00:26:49.100 of vacancy and the call for special election, our, our 00:26:49.100 --> 00:26:52.767 proposal would narrow that gap so that the call for special 00:26:52.767 --> 00:26:54.934 election and the declaration of vacancy would be on the same 00:26:54.934 --> 00:27:01.467 date. And I like to read the amending language for section 00:27:01.467 --> 00:27:08.233 4.03. If a primary election is required in connection with a 00:27:08.233 --> 00:27:10.367 special municipal election needed to fill a vacancy in the 00:27:10.367 --> 00:27:15.734 office of council member or mayor pursuant to section 2.06, 00:27:15.734 --> 00:27:20.033 a candidate who receives more than 50% of the votes cast at 00:27:20.033 --> 00:27:23.300 the primary election shall be declared the winner. If no 00:27:23.300 --> 00:27:27.367 candidate receives more than 50% of the votes cast at the 00:27:27.367 --> 00:27:30.634 primary election. The two candidates receiving the most 00:27:30.634 --> 00:27:34.900 votes shall advance to a special municipal election 00:27:34.900 --> 00:27:38.200 pursuant to Section 2.06 and the applicable provisions of 00:27:38.200 --> 00:27:44.000 Minnesota election law. And at this point I’d just like to add 00:27:44.000 --> 00:27:47.867 that until 2014, uh, Brooklyn Park did not have this 00:27:47.867 --> 00:27:50.533 requirement in its charter, that is to say, we did not have 00:27:50.533 --> 00:27:56.367 a primary. The primary was added, um. In response to the 00:27:56.367 --> 00:28:01.200 large number of candidates who filed to run. In the 2012 00:28:01.200 --> 00:28:08.567 special mayoral election. So the West District special 00:28:08.567 --> 00:28:11.767 municipal election of 2023 to fill the seat vacated by 00:28:11.767 --> 00:28:14.500 council member Susan Pom illustrates the need for these 00:28:14.500 --> 00:28:18.400 two amendments. Susan Pa’s vacancy was declared on 00:28:18.400 --> 00:28:22.634 December 12th, as you can see in 2022 by a special election 00:28:22.634 --> 00:28:28.300 was not called for until January 9, 2023. If I amendment 00:28:28.300 --> 00:28:31.667 to section 2.06 was in place at the time. The special election 00:28:31.667 --> 00:28:35.834 would have been called on December 12th, thus shortening 00:28:35.834 --> 00:28:43.233 the vacancy by almost 30 days. A special primary was held in 00:28:43.233 --> 00:28:45.634 May of 2023 because more than two candidates had failed to 00:28:45.634 --> 00:28:52.500 run. Tony McGarvey received 69% of the votes cast. A special 00:28:52.500 --> 00:28:56.667 general election then followed in August of 2023, and Mr. 00:28:56.667 --> 00:29:00.900 McGarvey was elected to fill the vacancy. If I remember to 00:29:00.900 --> 00:29:04.367 section 4.03 was in place at that time. Mr. McGarvey would 00:29:04.367 --> 00:29:07.934 have been duly elected in May and a special general election 00:29:07.934 --> 00:29:11.033 would not have been needed. The vacancy would have been 00:29:11.033 --> 00:29:18.000 shortened by a further 8 weeks, and the city would have saved 00:29:18.000 --> 00:29:19.367 $17,639 not including the overtime pay for the city clerk. 00:29:19.367 --> 00:29:23.867 Charter commissioners are grateful for the input received 00:29:23.867 --> 00:29:26.000 from the council, and especially for the supporting 00:29:26.000 --> 00:29:29.634 work done by our staff liaison, city clerk Devon Montero. And 00:29:29.634 --> 00:29:33.467 at this time, I’d like to announce to acknowledge, uh, 00:29:33.467 --> 00:29:35.000 the charter commission members that are present. I just want 00:29:35.000 --> 00:29:42.033 to stand. OK. Thank you and thank you for your work. And 00:29:42.033 --> 00:29:45.400 mayor and council members, that concludes my presentation at 00:29:45.400 --> 00:29:54.467 this time, I’ll be happy to take any questions. How Mor 00:29:54.467 --> 00:29:58.033 McGarvey. And then again, thank you, um, chair for the 00:29:58.033 --> 00:30:00.934 presentation and thank you to uh Charter commission for that 00:30:00.934 --> 00:30:05.500 work that you put in on this, uh, very much appreciated. 00:30:05.500 --> 00:30:08.734 Councilor McGarvey. Thank you, Mayor, and absolutely, thank 00:30:08.734 --> 00:30:12.734 you, Chairakara and members of the commission, definitely. Um, 00:30:12.734 --> 00:30:16.900 just, I’m just curious, uh, what the, what kind of pushback 00:30:16.900 --> 00:30:20.233 there was for any kind of rank choice voting involvement in uh 00:30:20.233 --> 00:30:23.266 or I mean, I, I understand it was part of the conversation, 00:30:23.266 --> 00:30:28.100 but what were the objections to that. So the conversations 00:30:28.100 --> 00:30:31.166 about rank choice voting were, uh, there was under, there was 00:30:31.166 --> 00:30:36.467 a bill in um under consideration. In the 00:30:36.467 --> 00:30:38.800 legislature and it didn’t, it was not approved. And so for 00:30:38.800 --> 00:30:46.100 that reason, it was dropped and actually our, uh, Proposal for 00:30:46.100 --> 00:30:50.900 section 4.03 is kind of a compromise with the Uh, rank 00:30:50.900 --> 00:30:55.200 choice folks, so the idea of basic idea behind rank Joyce, 00:30:55.200 --> 00:30:57.500 as you’re probably aware, is to have a candidate with a 00:30:57.500 --> 00:31:06.900 majority vote. And, um, so we came across Uh This idea of a 00:31:06.900 --> 00:31:12.767 sort of jungle primary and so it gets us. The outcome of rank 00:31:12.767 --> 00:31:17.533 choice voting while using our existing voting method. So, 00:31:17.533 --> 00:31:29.300 it’s a hybrid proposal for lack of a better term. Thank you. 00:31:29.300 --> 00:31:32.100 All right, so I’m seeing that uh I’m not seeing any of the 00:31:32.100 --> 00:31:37.367 comments from Uh, council members, so we can go ahead and 00:31:37.367 --> 00:31:42.767 open up the public hearing portion. Of this Are there any 00:31:42.767 --> 00:31:45.200 residents that have any comments they’d like to make 00:31:45.200 --> 00:31:49.567 towards this. Or any Other commissioners who would like to 00:31:49.567 --> 00:31:51.266 say anything regarding this during the public hearing 00:31:51.266 --> 00:31:58.567 portion. All right, seeing that uh there’s no further comment, 00:31:58.567 --> 00:32:03.634 we’ll go ahead and close. Oh, we’ll go ahead and close the uh 00:32:03.634 --> 00:32:07.500 public hearing portion. And then we have um council member 00:32:07.500 --> 00:32:11.200 Kanowski. I want to say thank you to the charter commission 00:32:11.200 --> 00:32:13.400 for all the work again on this, and I’ll go ahead and make the 00:32:13.400 --> 00:32:17.834 motion. Um, to waive the reading and adopt on first 00:32:17.834 --> 00:32:21.834 reading an ordinance amending chapter 2, Section 2.06 and 00:32:21.834 --> 00:32:29.033 chapter 4, Section 4.03 of the Home Rule City Charter. Like So 00:32:29.033 --> 00:32:34.367 the motion was made by uh Councilor Knowski, seconded by 00:32:34.367 --> 00:32:36.800 council member McGarvey. You were at the same time roughly, 00:32:36.800 --> 00:32:44.467 so. I was Yeah All right. So the motion has been made and 00:32:44.467 --> 00:32:48.800 seconded, we’ll need a roll call vote. If you’re voting on 00:32:48.800 --> 00:32:54.800 agenda item 5.1. Council member page. Council member McGarvey 00:32:54.800 --> 00:33:01.033 Council member Tran. I. Council member Erickson. Council member 00:33:01.033 --> 00:33:10.166 Jong, Council member Klinowski. Mayor Winston. I, the motion 00:33:10.166 --> 00:33:14.233 passes with 7 yes votes, 0 or no votes. All right, wonderful. 00:33:14.233 --> 00:33:19.900 Um, Uh, I know I feel like a round of applause to, to, uh, 00:33:19.900 --> 00:33:24.033 not ourselves, um, but the resilience of our charter 00:33:24.033 --> 00:33:28.367 commission. I know this has been gone over multiple times, 00:33:28.367 --> 00:33:32.634 uh, so thank you for being patient as volunteers, uh, to 00:33:32.634 --> 00:33:36.834 go back and work on this again numerous times. So I very much 00:33:36.834 --> 00:33:39.500 appreciate that and uh it looks like the work paid off and 00:33:39.500 --> 00:33:43.233 we’ll have more efficient, um, election structures when it 00:33:43.233 --> 00:33:47.567 comes to this and um We won’t have to wait for some for folks 00:33:47.567 --> 00:33:49.734 to fill specific seats. So I think that’s a win-win. So 00:33:49.734 --> 00:33:55.634 thank you so much. Thank you. Mayor Winston, I just want to 00:33:55.634 --> 00:33:58.000 point out that this is the first reading, it’ll be coming 00:33:58.000 --> 00:34:01.634 back for the 2nd reading. Yes, but this was a This is a little 00:34:01.634 --> 00:34:07.000 bit of a hurdle, so thank you. All right, so next we’ll move 00:34:07.000 --> 00:34:12.200 to. Let’s see. There are no further land. There’s no land 00:34:12.200 --> 00:34:18.000 use, no general actions, so, uh, no discussion actually items. 00:34:18.000 --> 00:34:20.166 So verbal reports and announcements. Any council 00:34:20.166 --> 00:34:26.500 member reports and announcements? council member 00:34:26.500 --> 00:34:32.900 Page. Thank you, Mayor. Um, just a couple of things. The 00:34:32.900 --> 00:34:36.100 first thing is just, uh, just appreciation for the city staff. 00:34:36.100 --> 00:34:39.834 We had a lot of items under consent today that I had a lot 00:34:39.834 --> 00:34:45.166 of questions and so I just want to personally thank all of the 00:34:45.166 --> 00:34:48.000 departments for explaining, um, part of our job is to 00:34:48.000 --> 00:34:50.634 understand what we’re looking at and sometimes it’s a little 00:34:50.634 --> 00:34:53.834 overwhelming. So as well as the council members, I just sort of 00:34:53.834 --> 00:34:58.500 say thank you. Um, and then I do want to address a little bit 00:34:58.500 --> 00:35:02.300 about um a conversation that I had. Over the weekend in 00:35:02.300 --> 00:35:06.567 conversation with Stillwater closing, some friends of mine 00:35:06.567 --> 00:35:09.767 are long term employees of that facility that’s closing, which 00:35:09.767 --> 00:35:14.033 led to a larger conversation, which I think directly impacts 00:35:14.033 --> 00:35:16.266 Brooklyn Park and the conversation of like when we 00:35:16.266 --> 00:35:19.367 were kids, if we didn’t have something to do, we were doing 00:35:19.367 --> 00:35:23.033 something we shouldn’t be doing. And I think that really falls 00:35:23.033 --> 00:35:26.100 into the area. I don’t have any answers at the moment, but I 00:35:26.100 --> 00:35:29.567 think we need to continue that conversation of having things 00:35:29.567 --> 00:35:34.867 for young people. To do, I eat the basketball courts, etc. Um, 00:35:34.867 --> 00:35:37.634 we can’t give up. We have to keep fighting for that because 00:35:37.634 --> 00:35:40.734 our kids deserve to have something to do, so they’re not 00:35:40.734 --> 00:35:45.033 looking for things that are not good for them, so I want to 00:35:45.033 --> 00:35:50.367 publicly say we, I am going to continue um to look at 00:35:50.367 --> 00:35:53.000 opportunities there, um, I do think we can ask the public 00:35:53.000 --> 00:35:56.300 sector. I do think we can just ask everybody for help until we 00:35:56.300 --> 00:36:00.000 get it done, because we are not going to give up in Brooklyn 00:36:00.000 --> 00:36:02.734 Park on our youth. Our youth who have things to do when 00:36:02.734 --> 00:36:06.634 they’re young, grow up. To hopefully live in Brooklyn Park 00:36:06.634 --> 00:36:10.133 or in the surrounding communities and be strong 00:36:10.133 --> 00:36:13.834 humans that deserve our support and our recognition. So I just 00:36:13.834 --> 00:36:17.567 want to say that we will continue in my family to look 00:36:17.567 --> 00:36:20.934 for opportunities, um, even when people say no, we just 00:36:20.934 --> 00:36:26.233 look at it as a not right now. And so we will continue to 00:36:26.233 --> 00:36:32.100 advocate for um the youth in our city. Thank you. Council 00:36:32.100 --> 00:36:42.634 member McGarvey. Thank you, Mayor. Um I would just like to 00:36:42.634 --> 00:36:48.567 once again announce that the 44th annual, it’s rapidly 00:36:48.567 --> 00:36:52.300 approaching national veterans wheelchair games, a major 00:36:52.300 --> 00:36:56.500 adaptive sports and rehabilitation event for US 00:36:56.500 --> 00:36:59.767 military veterans with disabilities will be held in 00:36:59.767 --> 00:37:03.533 Minneapolis, Minnesota from July 17th through the 22nd, 00:37:03.533 --> 00:37:09.900 2025. And the bowling event will be held right here in 00:37:09.900 --> 00:37:14.400 Brooklyn Park at Boleo, and they need volunteers. So 00:37:14.400 --> 00:37:18.467 unfortunately, I don’t have the website right in front of me, 00:37:18.467 --> 00:37:22.900 but if you Google, uh, Annual National Veterans wheelchair 00:37:22.900 --> 00:37:28.033 games, I guarantee you that you will be able to find the 00:37:28.033 --> 00:37:31.767 opportunities to volunteer and uh I’m going to be working with 00:37:31.767 --> 00:37:35.500 communications to get something about this out on the park in 00:37:35.500 --> 00:37:39.500 the park pages, etc. and all of our communications, uh, avenues. 00:37:39.500 --> 00:37:52.734 Thank you, Mayor. I’m um. Um, so just quickly that, uh, just 00:37:52.734 --> 00:37:56.367 a reminder that Tater Days is gonna be, uh, this upcoming 00:37:56.367 --> 00:38:00.100 weekend. Um, I know that, um, Uh, Doctor Smith is going to 00:38:00.100 --> 00:38:04.400 say a few things about that, uh, give you more of the details, 00:38:04.400 --> 00:38:08.133 and we’ll say we regarding not just community activity center, 00:38:08.133 --> 00:38:12.834 but the legislative agenda overall this year, um, I’m not 00:38:12.834 --> 00:38:15.734 gonna get too into detail, uh, but I think for the last few 00:38:15.734 --> 00:38:18.300 years, we’ve been a little disappointed and I think one of 00:38:18.300 --> 00:38:22.100 the things that as a city, We have to realize is that if we 00:38:22.100 --> 00:38:24.734 look over the last 30 to 40 years, we have been 00:38:24.734 --> 00:38:27.900 underinvested in. There’s numbers that prove that there 00:38:27.900 --> 00:38:32.767 are state level policies, whether it comes to LGA, how 00:38:32.767 --> 00:38:35.834 housing dollars are allocated, even when we talk about 00:38:35.834 --> 00:38:38.367 congregate care facilities in there are statewide policies 00:38:38.367 --> 00:38:42.767 that have been made and Brooklyn Park residents have 00:38:42.767 --> 00:38:46.734 for quite some time, had to carry that burden. Unknowingly 00:38:46.734 --> 00:38:49.400 carrying that burden and not understanding what was going on 00:38:49.400 --> 00:38:54.033 in their own city. Uh, because They weren’t really in on those 00:38:54.033 --> 00:38:56.166 discussions in terms of what was happening at the highest 00:38:56.166 --> 00:38:58.300 levels in terms of who’s going to win what and who’s gonna be 00:38:58.300 --> 00:39:02.100 the loser and who’s gonna consistently be the loser. So 00:39:02.100 --> 00:39:05.800 we don’t know what’s gonna come out of this year’s legislation, 00:39:05.800 --> 00:39:09.734 um, legislative, um. Uh, session. Uh, what I will say is 00:39:09.734 --> 00:39:14.000 this, is that when I look at somebody I vote for for the 00:39:14.000 --> 00:39:17.500 legislature. I have a governor. And the governor looks at 00:39:17.500 --> 00:39:22.300 everything from a statewide level when it comes to my state 00:39:22.300 --> 00:39:27.166 senator or to my state or to my house rep. I look at them to 00:39:27.166 --> 00:39:30.834 represent Brooklyn Park. I look at them to fight for Brooklyn 00:39:30.834 --> 00:39:35.634 Park Park Park tooth and nail, and, uh, I have no expectation 00:39:35.634 --> 00:39:39.500 that anybody will ever leverage or weigh what is rightfully 00:39:39.500 --> 00:39:44.200 Brooklyn Parks to make a grand deal at the state level. The 00:39:44.200 --> 00:39:48.800 governor exists to fight at the state level. Our state electeds 00:39:48.800 --> 00:39:54.033 exist for us. Uh, even at the city council level when people 00:39:54.033 --> 00:39:56.634 are elected from a particular district, they think of that 00:39:56.634 --> 00:40:00.233 district first, and then we all have to interact together, uh, 00:40:00.233 --> 00:40:03.467 and I think that is something that is incredibly important 00:40:03.467 --> 00:40:06.166 for people to understand, um, in that we’re going to continue 00:40:06.166 --> 00:40:09.300 to fight to make sure that Brooklyn Park gets their fair 00:40:09.300 --> 00:40:15.300 share. I do not think. That as Brooklyn Park gets more, um, 00:40:15.300 --> 00:40:19.467 diverse and more aware of what other Regions and other cities 00:40:19.467 --> 00:40:23.166 have gotten that now people should say, well, the jig is up. 00:40:23.166 --> 00:40:27.033 No more local projects for you guys for 10 amount of time. Uh, 00:40:27.033 --> 00:40:31.266 I think. We have to realize that when we have folks coming 00:40:31.266 --> 00:40:34.367 up here saying we want X, Y, and Z for the youth, and we’re 00:40:34.367 --> 00:40:38.734 looking at a $13 million price tag, or we’re looking at 00:40:38.734 --> 00:40:41.900 ripping out something that people have grown up with and 00:40:41.900 --> 00:40:45.033 find incredibly important. That is in the decision that every 00:40:45.033 --> 00:40:47.734 other city is making. That’s a decision that we have to 00:40:47.734 --> 00:40:50.033 grapple with. And we’ll grapple with that decision once all the 00:40:50.033 --> 00:40:53.200 data is in front of us, but this is a moving thing. But I 00:40:53.200 --> 00:41:00.033 think when you look at a city who is adverse. To continuously 00:41:00.033 --> 00:41:04.033 raising taxes on a city that is overburdened, um, there are 00:41:04.033 --> 00:41:06.533 some difficult decisions that we have to make, and I would 00:41:06.533 --> 00:41:09.900 ask people to bear in mind that we are struggling with those 00:41:09.900 --> 00:41:12.400 decisions so that we can take care of not just our youth, we 00:41:12.400 --> 00:41:16.767 do have a teen center that we’re putting up, but, um, our 00:41:16.767 --> 00:41:21.300 seniors, uh, folks who are just trying to raise families, uh, 00:41:21.300 --> 00:41:23.500 businesses, and there are so many stakeholders that we have 00:41:23.500 --> 00:41:27.767 to balance up here. But I don’t want to have to balance folks 00:41:27.767 --> 00:41:31.734 at the state level either at our, our state representatives 00:41:31.734 --> 00:41:35.467 or senators, I do not wish to have to balance that against 00:41:35.467 --> 00:41:37.900 everything else. We should be fighting for ourselves as a 00:41:37.900 --> 00:41:42.734 city and a state legislators should be fighting for us first 00:41:42.734 --> 00:41:45.834 and foremost, and secondarily, everybody else, and that’s not 00:41:45.834 --> 00:41:49.367 being me being rude, but I have a governor that balances the 00:41:49.367 --> 00:41:52.900 whole state, uh, and I’m not asking, uh, our folks at the 00:41:52.900 --> 00:41:57.100 state, um, legislature to, to To look out for the whole state. 00:41:57.100 --> 00:42:02.133 I really need them to look out for all of uh Brooklyn Park and 00:42:02.133 --> 00:42:06.367 to understand The inequities that have occurred in Brooklyn 00:42:06.367 --> 00:42:08.900 Park and before, I’ll close out on this. I didn’t mean to go 00:42:08.900 --> 00:42:14.200 this long. But before people try to tie this to race. To 00:42:14.200 --> 00:42:18.467 racial disparities, I would like people to realize that. 00:42:18.467 --> 00:42:22.834 1015,, 2030, 40, 50 years ago before Brooklyn Park looks like 00:42:22.834 --> 00:42:25.900 the current Brooklyn Park. People were making decisions 00:42:25.900 --> 00:42:30.200 about the Northwest suburbs and Brooklyn Park. That left them 00:42:30.200 --> 00:42:32.834 out of some of the development and opportunities that people 00:42:32.834 --> 00:42:37.033 have got in other regions. So this is a long term inequity 00:42:37.033 --> 00:42:40.834 where Brooklyn Parks. Opportunities have been 00:42:40.834 --> 00:42:43.734 leveraged away to make deals at the state level, and that has 00:42:43.734 --> 00:42:46.100 got to stop for the residents of Brooklyn Park. So I’ll leave 00:42:46.100 --> 00:42:49.000 it at that. Hopefully we have a great outcome within the 00:42:49.000 --> 00:42:52.233 legislature, um. And are there any other comments? Anybody 00:42:52.233 --> 00:42:56.834 else who would like to make? All right, so then we have um 00:42:56.834 --> 00:43:01.734 our city manager reports and announcements. Good evening 00:43:01.734 --> 00:43:08.100 again, Mayor council, just a few reminders, um. We have our 00:43:08.100 --> 00:43:11.900 tater Days parade scheduled for this weekend, this Saturday, um, 00:43:11.900 --> 00:43:17.767 the parade will take place from 10 to 11 a.m. and the community 00:43:17.767 --> 00:43:21.533 gathering will follow the parade. Um, it will be held at 00:43:21.533 --> 00:43:26.767 the CAC from 12 to 4:00 p.m. again, music fun, entertainment 00:43:26.767 --> 00:43:30.567 for the entire family and community. Um, in addition to 00:43:30.567 --> 00:43:36.734 that, a, a meeting request was sent to invite um in regards to 00:43:36.734 --> 00:43:40.767 Juneteenth. This is from the Juneteenth committee, um, 00:43:40.767 --> 00:43:43.834 requesting your presence for a promotion recording which 00:43:43.834 --> 00:43:48.266 changed the world challenge. So basically this will take place 00:43:48.266 --> 00:43:53.000 this Thursday from 4 to 7 p.m. you can choose a time. And you 00:43:53.000 --> 00:43:57.767 can stop by any and they will only need to for about 10 to 15 00:43:57.767 --> 00:44:01.634 minutes to record some a special message um in regards 00:44:01.634 --> 00:44:04.800 to Juneteenth and they’ll compile all of that, all of 00:44:04.800 --> 00:44:08.500 that information for the marketing that’ll go out. And 00:44:08.500 --> 00:44:13.500 that’s it. Thank you. So I’m just, you know, city manager 00:44:13.500 --> 00:44:16.567 Strobel isn’t here, but I just know that this is a 45 or 15 00:44:16.567 --> 00:44:20.166 minute meeting. We’ve never had this before. So maybe you need 00:44:20.166 --> 00:44:24.567 to be here a little bit more often. But, uh, all right,
