All right, 00:06:05.233 --> 00:06:09.100 thank you, um, good evening, Mayor and EDA commissioners. uh, 00:06:09.100 --> 00:06:12.734 tonight we have a two-part agenda item regarding an EDA 00:06:12.734 --> 00:06:16.000 owned parcel of land, uh, item 5.1 tonight starts with a 00:06:16.000 --> 00:06:18.533 public hearing, of course, about the sale of this EDA 00:06:18.533 --> 00:06:21.800 parcel and following will be the consideration for 00:06:21.800 --> 00:06:25.467 transferring this parcel to the city of Brooklyn Park, um, to 00:06:25.467 --> 00:06:27.634 aid in facilitating its sale, and I’ll get to that a little 00:06:27.634 --> 00:06:31.734 bit more later, but first, I wanted to give this 00:06:31.734 --> 00:06:33.834 presentation for um all the here now and provide that 00:06:33.834 --> 00:06:36.133 context and background. the public hearing starts and 00:06:36.133 --> 00:06:44.533 consideration comes later. So, as I mentioned, the purpose is 00:06:44.533 --> 00:06:48.300 to hold the public hearing first and foremost to abide by 00:06:48.300 --> 00:06:51.100 state statute for Minnesota statute 469.105 for the sale or 00:06:51.100 --> 00:06:54.266 transfer of land owned by an economic development authority 00:06:54.266 --> 00:06:57.367 and of course here public comment and or questions 00:06:57.367 --> 00:06:59.200 regarding this potential sale and is mentioned following the 00:06:59.200 --> 00:07:02.300 public hearing we’ll move to a second part where you will, uh, 00:07:02.300 --> 00:07:04.367 consider approving this transfer of land to the city of 00:07:04.367 --> 00:07:08.033 Brooklyn Park, but I have a whole slide on that, so I will 00:07:08.033 --> 00:07:12.934 get to that expeditiously here. So 1st, 1st some table setting, 00:07:12.934 --> 00:07:15.634 the property location, as you can see from this map, the 00:07:15.634 --> 00:07:19.767 property is located along Ninety-Second Avenue, um. I put 00:07:19.767 --> 00:07:23.000 in a red arrow cause those always help, but it’s, it’s 00:07:23.000 --> 00:07:26.166 yellow highlighted there. It’s a small parcel. Uh, the nearest 00:07:26.166 --> 00:07:28.367 major intersection for reference is near the southwest 00:07:28.367 --> 00:07:33.266 corner of 93rd and Zane Avenues. It’s a small outlet adjacent to 00:07:33.266 --> 00:07:36.367 the petitioner tonight, Mr. Adam Chisel, who is in 00:07:36.367 --> 00:07:40.834 attendance, um, in his property at 5901 92nd Avenue North, and 00:07:40.834 --> 00:07:44.567 now it’s a good time to note that this property’s small size 00:07:44.567 --> 00:07:47.533 or regular location make it impractical for independent 00:07:47.533 --> 00:07:53.900 development. So for further table setting uh regarding the 00:07:53.900 --> 00:07:57.634 property’s information, the property in question is a small 00:07:57.634 --> 00:08:02.467 0.05 acre parcel identified as Olot A. It abutts 5901 92 as 00:08:02.467 --> 00:08:07.000 mentioned to the Northwest, um. Which is the home of Brooklyn 00:08:07.000 --> 00:08:10.500 Park resident Mr. Schisel. Mr. Sizel has been maintaining this 00:08:10.500 --> 00:08:12.166 property and recently discovered it was owned by the 00:08:12.166 --> 00:08:14.900 EDA rather than being part of his property. And since then 00:08:14.900 --> 00:08:17.667 he’s submitted a petition in the form of procuring an 00:08:17.667 --> 00:08:21.200 appraisal to purchase the land for $2000. This monetary value 00:08:21.200 --> 00:08:23.367 is consistent with the appraised value determined by 00:08:23.367 --> 00:08:26.000 the professional appraisal that was submitted to city staff and 00:08:26.000 --> 00:08:32.400 attached to your packets. So now moving on to property 00:08:32.400 --> 00:08:36.734 history, one of the things we wanted to find out was why is 00:08:36.734 --> 00:08:39.900 this parcel essentially exists? Why is it so small, regularly 00:08:39.900 --> 00:08:42.500 shaped and owned by the EDA through the help of our legal 00:08:42.500 --> 00:08:44.567 counsel and the county recorder’s office, we were able 00:08:44.567 --> 00:08:47.300 to find out that the subject properties complex ownership 00:08:47.300 --> 00:08:50.533 dates back to 1991. At that time, the city acquired 00:08:50.533 --> 00:08:53.166 easements over multiple adjacent properties through 00:08:53.166 --> 00:08:55.800 eminent domain. Uh, these properties were later conveyed 00:08:55.800 --> 00:09:00.200 to the city in fee in 1998 by the same owner at that time. In 00:09:00.200 --> 00:09:03.367 2001, the city transferred all of these properties to the EDA 00:09:03.367 --> 00:09:06.066 which then platted the area that same year, creating what 00:09:06.066 --> 00:09:09.934 is now outlet a the subject property. While public records 00:09:09.934 --> 00:09:12.533 do not specifically document the purpose of this outlaw. It 00:09:12.533 --> 00:09:15.100 appears the small parcel may have been intended as an access 00:09:15.100 --> 00:09:19.400 point to the cul-de-sac of 92nd Avenue North, jumping to 2005, 00:09:19.400 --> 00:09:22.567 the nearby properties to the north, now an assisted living 00:09:22.567 --> 00:09:25.834 facility in an early childhood development center were 00:09:25.834 --> 00:09:29.100 subsequently platted as part of the hogs Creek development, but 00:09:29.100 --> 00:09:32.734 the 2005 declaration. of access does not specifically mention a 00:09:32.734 --> 00:09:36.100 lot a, suggesting that whatever act access purpose it may have 00:09:36.100 --> 00:09:39.634 originally served was no longer necessary after the completion 00:09:39.634 --> 00:09:43.400 of that planet development. Now that brings us to the inquiring 00:09:43.400 --> 00:09:47.800 parties current. proposal, but first, I mentioned earlier, I 00:09:47.800 --> 00:09:50.734 wanted to have a slide just for the legal process requirements. 00:09:50.734 --> 00:09:54.100 I mentioned in the beginning that the first step would, if 00:09:54.100 --> 00:09:57.266 approved, uh, would be transferring this to the city, 00:09:57.266 --> 00:10:01.000 and the reason for that now is in consultation with legal 00:10:01.000 --> 00:10:03.634 counsel, we’ve determined that the EDA statutes restrict the 00:10:03.634 --> 00:10:07.467 sale of EDA owned property to only transactions that include 00:10:07.467 --> 00:10:10.367 certain development or capital improvement requirements, since 00:10:10.367 --> 00:10:13.834 Mr. Sizel’s intended use for this small allot will not meet 00:10:13.834 --> 00:10:16.000 these statutory requirements for capital improvements. Such 00:10:16.000 --> 00:10:18.767 as constructing a building or any other development purposes, 00:10:18.767 --> 00:10:21.834 the EDA cannot sell the property directly to him. So 00:10:21.834 --> 00:10:24.467 therefore, legal counsel has recommended that the EDA first 00:10:24.467 --> 00:10:26.767 transfer the property to the city of Brooklyn Park, which 00:10:26.767 --> 00:10:30.367 can then execute the sale to the adjacent property owner. 00:10:30.367 --> 00:10:33.667 This two-step process ensures Compliance with statutory 00:10:33.667 --> 00:10:35.634 requirements while still achieving a potential desired 00:10:35.634 --> 00:10:41.033 outcome. I’ll, I’ll pause there for a moment just because. If 00:10:41.033 --> 00:10:44.367 there’s any questions up until this point or the two-step 00:10:44.367 --> 00:10:47.634 process regarding the legality of the needs here, if there’s 00:10:47.634 --> 00:10:49.100 any initial questions. Otherwise, we can have Q and A 00:10:49.100 --> 00:10:58.200 at the end as well. To go. All right, so to add an extra layer 00:10:58.200 --> 00:11:01.533 to this, there are sewer and water lines running through the 00:11:01.533 --> 00:11:03.634 uh property and near the property that required 00:11:03.634 --> 00:11:06.734 continued public access for maintenance, our engineering 00:11:06.734 --> 00:11:08.734 and operations and maintenance departments have therefore 00:11:08.734 --> 00:11:11.500 recommended that the property have an easement created to 00:11:11.500 --> 00:11:13.367 cover the future potential maintenance needs within this 00:11:13.367 --> 00:11:17.367 property. Uh, legal counsel has identified several options for 00:11:17.367 --> 00:11:20.567 ensuring these rights. An example is shown here on the 00:11:20.567 --> 00:11:22.767 PowerPoint slide, but regardless upon an approval to 00:11:22.767 --> 00:11:26.033 the of a transfer to the city of Brooklyn Park, Staff would 00:11:26.033 --> 00:11:28.667 work towards bringing a recommendation to a future city 00:11:28.667 --> 00:11:30.867 council meeting. The overall goal in this again would be to 00:11:30.867 --> 00:11:34.000 ensure that the city maintains necessary access to its 00:11:34.000 --> 00:11:36.834 infrastructure while allowing the property transfer to 00:11:36.834 --> 00:11:40.300 proceed. Another way to put it is the property is so small, it 00:11:40.300 --> 00:11:46.200 is essentially all right away. Uh, financial detail details, 00:11:46.200 --> 00:11:49.367 the proposed sale price again is $2000 based on an 00:11:49.367 --> 00:11:51.166 independent appraisal procured by the petitioner and reflects 00:11:51.166 --> 00:11:54.367 the fair market value of the property, the property 00:11:54.367 --> 00:11:57.000 currently generates no revenue, being publicly owned, and its 00:11:57.000 --> 00:11:59.567 sale would place it back on the tax rolls, generating a small 00:11:59.567 --> 00:12:03.266 amount of property tax revenue for the city in the future. Uh, 00:12:03.266 --> 00:12:05.400 the transaction would incur nominal costs for recording the 00:12:05.400 --> 00:12:08.734 deed, recording the city right away easement and state taxes 00:12:08.734 --> 00:12:12.934 as shown on the screen there. And jumping ahead to the staff 00:12:12.934 --> 00:12:17.166 recommendation. After the public hearing is opened and 00:12:17.166 --> 00:12:19.033 closed after recommends approval of the resolution 00:12:19.033 --> 00:12:21.467 authorizing the transfer of EDA owned property to the city of 00:12:21.467 --> 00:12:24.100 Brooklyn Park to aid and facilitating the potential sale 00:12:24.100 --> 00:12:28.467 to Adam Sheel for $2000 subject, of course, to the inclusion of 00:12:28.467 --> 00:12:31.000 appropriate utility easements to protect public 00:12:31.000 --> 00:12:34.800 infrastructure. Uh, this recommendation is based on the 00:12:34.800 --> 00:12:36.567 property’s limited development potential, the fair market 00:12:36.567 --> 00:12:41.166 value being offered in the Proper protection of public 00:12:41.166 --> 00:12:44.900 infrastructure through appropriate easements. Here now 00:12:44.900 --> 00:12:47.533 would be the next steps if approved, the ED would transfer 00:12:47.533 --> 00:12:51.834 the property to the city via quick claim deed, which is um 00:12:51.834 --> 00:12:54.133 Recommended by legal counsel as the most appropriate and 00:12:54.133 --> 00:12:58.266 efficient method. The city would then review and approve 00:12:58.266 --> 00:13:02.200 any new purchase agreement with Mr. Sizil at a future city 00:13:02.200 --> 00:13:04.133 council meeting, and then in the meantime, staff would work 00:13:04.133 --> 00:13:07.867 with legal counsels of prayer any necessary legal documents, 00:13:07.867 --> 00:13:11.100 including the quick paying deed from the EDA to the city, the 00:13:11.100 --> 00:13:13.934 deed from the city to Mr. Shezel and the right of way 00:13:13.934 --> 00:13:16.467 easement and we’ll also handle recording all the documents of 00:13:16.467 --> 00:13:20.634 the Henin County to ensure the proper sequencing of these 00:13:20.634 --> 00:13:22.934 recorded needs. Um, national equity fund for a 450,000 cash 00:16:29.000 --> 00:16:33.467 settlement. Um, based on the action, we sent that 00:16:33.467 --> 00:16:36.667 information to the lender.
