I was a youth mentor program that, uh, I recall 00:13:24.900 --> 00:13:27.367 starting and she had the children over and her husband 00:13:27.367 --> 00:13:31.033 Mark. Cortman was teaching them how to play pool and no 00:13:31.033 --> 00:13:35.367 pictures were taken on their behalf, um, because for them it 00:13:35.367 --> 00:13:39.100 was just quietly doing the real work and really honoring people. 00:13:39.100 --> 00:13:42.867 Um, I’m not going to get too into what occurred, I think the 00:13:42.867 --> 00:13:46.533 city is still very much grieving with that. A lot has 00:13:46.533 --> 00:13:49.467 been said around that it is a symptom of something much 00:13:49.467 --> 00:13:56.166 larger. What I will say is that Speaker Hartman. Had a 00:13:56.166 --> 00:13:58.800 wonderful legacy and she was in the perfect city for it when we 00:13:58.800 --> 00:14:01.200 look at the diversity that exists within Brooklyn Park, 00:14:01.200 --> 00:14:03.367 and then we look at the larger coalition and the voices she 00:14:03.367 --> 00:14:07.800 brought to the table within Brooklyn Park. She built that 00:14:07.800 --> 00:14:12.667 legacy out across the entire state. And she, uh, 00:14:12.667 --> 00:14:16.033 Strengthened voices that maybe in the past had not been heard. 00:14:16.033 --> 00:14:21.734 So while Someone committed an ugly and an egregious act. That 00:14:21.734 --> 00:14:27.100 has cost the entire community. The legacy of what the Speaker 00:14:27.100 --> 00:14:32.033 Hartman and what Mark Hortman built in terms of people coming 00:14:32.033 --> 00:14:37.734 together, respecting one another, having discussions, uh, 00:14:37.734 --> 00:14:39.934 building across differences and understanding those differences. 00:14:39.934 --> 00:14:44.767 That is a legacy that will not um be taken away. And in fact, 00:14:44.767 --> 00:14:47.500 it’s going to continue, it’s going to grow. That is very 00:14:47.500 --> 00:14:51.367 much the future, not only of Brooklyn Park, um, the city she 00:14:51.367 --> 00:14:54.300 called home, but that is where we’re going as a state and as a 00:14:54.300 --> 00:14:59.200 country. So while somebody tried to instill a singular 00:14:59.200 --> 00:15:03.500 voice upon our community, upon the state, uh, we know in 00:15:03.500 --> 00:15:07.667 reality that uh there are many voices that were strengthened 00:15:07.667 --> 00:15:10.367 by the legacy of Speaker Hortman, and those voices are 00:15:10.367 --> 00:15:13.467 going to continue. They’re gonna continue to gather in 00:15:13.467 --> 00:15:15.834 strength. And I think that is one of the things that we have 00:15:15.834 --> 00:15:19.133 to remember, and we have to also remember that when we have 00:15:19.133 --> 00:15:23.667 disagreements. The character assassination, the ugliness, 00:15:23.667 --> 00:15:27.934 the lack of discussion runs contrary directly contrary to 00:15:27.934 --> 00:15:31.133 not only our Constitution, which was forged in compromise 00:15:31.133 --> 00:15:36.100 and discussion and often disagreement, but it runs 00:15:36.100 --> 00:15:39.667 directly contrary to the legacy of Speaker Hortman and Mark 00:15:39.667 --> 00:15:44.000 Hortman, who very much lived it and it runs contrary to the 00:15:44.000 --> 00:15:48.934 legacy that our city is consistently creating, so, uh, 00:15:48.934 --> 00:15:52.100 we were blessed to have someone like speaking. Hotman and Mark 00:15:52.100 --> 00:15:55.767 Hotman amongst us, often the Lord takes the best of us away 00:15:55.767 --> 00:16:00.734 too soon, uh, but I would encourage us to. I also want to 00:17:48.467 --> 00:17:52.367 express thank you for that message. um Melissa Hartman 00:17:52.367 --> 00:17:55.400 inspired my current government 20 years ago. I grew up in 00:17:55.400 --> 00:18:00.133 Brooklyn Park and so um I feel very honored um to know that my 00:18:00.133 --> 00:18:08.133 current visions were inspired by a powerful person. Um, the thing I would highlight is I think 00:32:26.000 --> 00:32:29.300 that the last time when City Clerk Montero and I did some 00:32:29.300 --> 00:32:32.400 research on that. I won’t click on it 01:05:30.300 --> 01:05:33.533 because it’ll take us away from the thing, but it’s a a number 01:05:33.533 --> 01:05:36.667 of criminal offenses, um, couldn’t be listed as a 01:05:36.667 --> 01:05:38.800 predatory offender. Those predatory offenders, when 01:05:38.800 --> 01:05:42.000 they’re released from incarceration are reviewed by a 01:05:42.000 --> 01:05:45.400 committee. That committee then designates them as level 12 or 01:05:45.400 --> 01:05:52.166 3. Uh, based on their level of risk. Uh, level one, victims 01:05:52.166 --> 01:05:55.367 and witnesses are, are, uh, notified when they’re released 01:05:55.367 --> 01:05:58.834 level 2. Victims, witnesses, and law enforcement and many 01:05:58.834 --> 01:06:03.266 other individuals that may be at a specific risk based on a 01:06:03.266 --> 01:06:07.533 number of factors would be notified, um, when a, uh, level 01:06:07.533 --> 01:06:11.367 2 moves to town. And then a level 3 is broad public 01:06:11.367 --> 01:06:15.100 notification. Brooklyn Park right now has 205 uh registered 01:06:15.100 --> 01:06:18.900 offenders, you know, living in the city, 21 of which are level 01:06:18.900 --> 01:06:21.233 3 predatory offenders. Uh, so kind of how we got to this 01:06:21.233 --> 01:06:24.800 point. When I was put in this position, I started noticing a 01:06:24.800 --> 01:06:27.567 number of level 3 predatory offenders that were moving into 01:06:27.567 --> 01:06:30.233 the city. It was an alarming number. It seemed much higher 01:06:30.233 --> 01:06:33.667 than normal. Uh, so I went and take, took a look to see if 01:06:33.667 --> 01:06:37.000 that was true, uh, compared to other cities in Hennepin County, 01:06:37.000 --> 01:06:40.233 and I found out it was true. This data is a little bit old. 01:06:40.233 --> 01:06:43.867 Brooklyn Park actually has 21, not 20, but you’ll see that 01:06:43.867 --> 01:06:48.367 most of the cities around us have very few, um. I looked 01:06:48.367 --> 01:06:50.867 into why that might be, and I believe it’s twofold. I believe 01:06:50.867 --> 01:06:54.533 there’s two things happening here. One, we did not have an 01:06:54.533 --> 01:06:59.033 ordinance or do not have an ordinance that uh restricts 01:06:59.033 --> 01:07:01.100 where predatory offenders can live in the city of Brooklyn 01:07:01.100 --> 01:07:04.767 Park. 18 cities in Henneman County do have that ordinance. 01:07:04.767 --> 01:07:08.400 The other thing that’s going on. And this is kind of back to 01:07:08.400 --> 01:07:14.800 here, is We have a really large number of um group homes, uh, 01:07:14.800 --> 01:07:19.100 congregate living facilities in the city, about 450 or so, 01:07:19.100 --> 01:07:23.367 about half of our level 3 predatory offenders are living 01:07:23.367 --> 01:07:25.667 in congregate uh settings. I believe that is driving a large 01:07:25.667 --> 01:07:28.100 number of why we’re getting a lot of uh predatory offenders 01:07:28.100 --> 01:07:33.567 in the city, those two factors, uh, together. So you’ll recall, 01:07:33.567 --> 01:07:37.800 uh, I came to you and talked to you about some um options uh we 01:07:37.800 --> 01:07:40.500 reviewed some of those options and this is the resulting 01:07:40.500 --> 01:07:43.767 ordinance, uh, that was crafted with the help of our city 01:07:43.767 --> 01:07:46.166 attorney, um, and I’ll go through the language really 01:07:46.166 --> 01:07:49.200 quickly. The new ordinance does show intent. Why did we craft 01:07:49.200 --> 01:07:53.367 this ordinance? Well, it is to, uh, um. The interest to promote, 01:07:53.367 --> 01:07:56.200 protect, and improve the health and safety and welfare of our 01:07:56.200 --> 01:08:00.266 residents. By establishing areas around locations where 01:08:00.266 --> 01:08:02.934 children regularly congregate in concentrated numbers wherein 01:08:02.934 --> 01:08:05.667 certain predatory offenders are prohibited from establishing uh 01:08:05.667 --> 01:08:08.266 temporary or permanent residence. This is actually 01:08:08.266 --> 01:08:11.133 directly out of state statute. Um, it urges cities to do this 01:08:11.133 --> 01:08:18.900 type of work. So here’s the restrictions. Restrictions are 01:08:18.900 --> 01:08:22.734 500 ft of any public park or playground,, 1000 ft of any 01:08:22.734 --> 01:08:26.500 childcare facility, school, or place of worship, and then 01:08:26.500 --> 01:08:29.634 additionally 1000 ft from the residence of another designated 01:08:29.634 --> 01:08:32.800 offender. Remember, uh, the offenders that this targets are 01:08:32.800 --> 01:08:36.033 level 3 predatory finders, those that are the highest risk 01:08:36.033 --> 01:08:42.533 of reoffense. Um The map of what is excluded will be 01:08:42.533 --> 01:08:47.767 maintained by the chief of police. And there are some 01:08:47.767 --> 01:08:51.533 exceptions. Um, if a, let’s say someone builds a daycare and 01:08:51.533 --> 01:08:54.166 there’s already a predatory offender living in the area. 01:08:54.166 --> 01:08:57.467 They don’t then get kicked out because of daycare went in, 01:08:57.467 --> 01:09:00.166 right? Also, if the predatory offender is a minor and they 01:09:00.166 --> 01:09:03.800 live with their parents. That’s also someone that’s, that’s an 01:09:03.800 --> 01:09:06.634 exception to the rule as well. Uh, and there are several 01:09:06.634 --> 01:09:09.200 exceptions. These are, are pretty commonplace in all of 01:09:09.200 --> 01:09:13.634 the ordinances that we looked through. There is um something 01:09:13.634 --> 01:09:16.734 that is a little bit unusual that is a part of our uh 01:09:16.734 --> 01:09:21.367 recommended ordinance, and it, uh, focuses on property rentals, 01:09:21.367 --> 01:09:27.233 um, if a, uh, uh. Someone who owns a property, uh, rents any 01:09:27.233 --> 01:09:30.000 place, including like a motorhome to someone that is a 01:09:30.000 --> 01:09:32.667 predatory offender, and they do that knowingly, they could be 01:09:32.667 --> 01:09:37.500 in violation of this ordinance. And then what is the penalty? 01:09:37.500 --> 01:09:41.734 The penalty is a misdemeanor, and then there are also some 01:09:41.734 --> 01:09:46.367 options for some civil remedies. for the city. you guys have any 01:09:46.367 --> 01:09:55.667 questions? Any questions from counselors? I can’t see if uh 01:09:55.667 --> 01:10:02.567 council members train. need to get a picture back up. No, I 01:10:02.567 --> 01:10:20.133 can’t actually. stop sharing. Um, I think in instances 01:10:54.800 --> 01:11:00.667 like this, the goal is less about uh using the um The 01:11:00.667 --> 01:11:03.867 criminal aspect and more about when someone says they want to 01:11:03.867 --> 01:11:07.166 move to our city, the, the process will be, it goes to our 01:11:07.166 --> 01:11:09.300 detectives who handle this. They look at the map and they 01:11:09.300 --> 01:11:13.634 say, nope, that’s not gonna work. You can’t move here, um, 01:11:13.634 --> 01:11:17.200 and so hopefully we stop it before it even gets to that 01:11:17.200 --> 01:11:21.033 point. Now we have some remedies there in case we miss 01:11:21.033 --> 01:11:24.734 some or for some reason, they are able to uh move in or if 01:11:24.734 --> 01:11:28.900 they’re in violation, um, and they’re living in the city, um, 01:11:28.900 --> 01:11:31.533 without notifying us that we would have some remedies, both 01:11:31.533 --> 01:11:35.934 criminal and civil. So then maybe I misunderstood it. That 01:11:35.934 --> 01:11:38.767 applies to the individual wanting to move here, not the 01:11:38.767 --> 01:11:43.533 person. Assuming they don’t own the property they’re renting 01:11:43.533 --> 01:11:47.667 from someone. I was thinking it was. Applied to the person 01:11:47.667 --> 01:11:51.400 renting the property, uh. Or would both cases be false or 01:11:51.400 --> 01:11:54.767 true. So let’s say that we have a level 3 predatory offender 01:11:54.767 --> 01:11:58.900 that moves into town, they rent a place and we find that, find 01:11:58.900 --> 01:12:03.133 out that they’re living here in violation of the prohibited 01:12:03.133 --> 01:12:05.767 location, and we find out that the person renting them says, 01:12:05.767 --> 01:12:09.467 yeah, I, I know there are level 3 predatory offender. Now they 01:12:09.467 --> 01:12:13.400 would both be in violation of this ordinance. Both the renter 01:12:13.400 --> 01:12:15.934 and the uh person who owns the property that’s renting it to 01:12:15.934 --> 01:12:20.367 them. And then one final question, if I may. Does that 01:12:20.367 --> 01:12:25.200 violate any Any civil rights, human rights, whatever the case 01:12:25.200 --> 01:12:32.467 may be, uh. For a landlord. Do they have to ask that or these 01:12:32.467 --> 01:12:35.300 Level 3 offenders have to announce that prior to moving 01:12:35.300 --> 01:12:39.133 or prior to renting a property. Yeah, that’s so, that’s a good 01:12:39.133 --> 01:12:43.367 question. Um, a level 3 predatory offender has, that’s 01:12:43.367 --> 01:12:46.400 broad public notification. So if a level 3 predatory offender 01:12:46.400 --> 01:12:49.634 moves to town, we’re gonna send an alert to everybody in that 01:12:49.634 --> 01:12:53.800 entire area, and that goes to the property owners by mailer. 01:12:53.800 --> 01:12:57.100 We’re also now doing it digitally as well, um, I 01:12:57.100 --> 01:13:00.734 suppose there could be a situation in which the landlord 01:13:00.734 --> 01:13:03.467 says we were not aware of that, uh, and that could be the. 01:13:03.467 --> 01:13:06.734 defense to this violation, but also we would make them aware 01:13:06.734 --> 01:13:09.367 of that, and then if they don’t take action, they would then be 01:13:09.367 --> 01:13:26.934 in violation. A family home. parent or grandparent. 01:13:41.400 --> 01:13:47.233 Relative home and, and it’s close to the, the location that 01:13:47.233 --> 01:13:56.867 was stated like. healthcare, uh, no, um. You know, uh, nursing 01:13:56.867 --> 01:14:05.367 home or the um facility like daycare. Like school. Mayor 01:14:05.367 --> 01:14:08.734 Winston, members of the council, um, Councilman Tran, uh, that 01:14:08.734 --> 01:14:11.400 is a good question. And actually there is an exception 01:14:11.400 --> 01:14:17.667 for The goal is not to make people homeless. OK, um, if a 01:14:17.667 --> 01:14:20.367 level 3 predatory offender then becomes homeless, they’re 01:14:20.367 --> 01:14:23.100 probably at greater risk of reoffense, which of course 01:14:23.100 --> 01:14:27.266 would put the, the. The society at greater risk, right? So 01:14:27.266 --> 01:14:31.000 there is an exception if someone is living with, uh, a 01:14:31.000 --> 01:14:32.767 family member, like their parents, they’re living at 01:14:32.767 --> 01:14:35.934 their parents’ home. That exception does exist because it 01:14:35.934 --> 01:14:40.266 would frankly be higher risk for that predatory offender to 01:14:40.266 --> 01:14:44.500 be homeless and then Homeless in Brooklyn Park, uh, when that 01:14:44.500 --> 01:14:47.133 is the case, we can’t keep track of them, which is 01:14:47.133 --> 01:14:51.033 something that we do with level 3, actually all level 12, and 3 01:14:51.033 --> 01:14:54.000 predatory offenders, we check on them annually. We’re 01:14:54.000 --> 01:14:57.367 checking on level 3 predatory offenders in a much higher 01:14:57.367 --> 01:15:01.100 frequency and knowing where they are, they are is, is 01:15:01.100 --> 01:15:06.266 critical to reducing reoffend. Yes. And, and make uh awareness 01:15:06.266 --> 01:15:10.533 to to the neighbors. In the areas that is a part of what we 01:15:10.533 --> 01:15:14.567 do with the broad public notification.
