So in this case, the zoning code 00:07:11.900 --> 00:07:14.533 would not allow for the drive-through to go where it 00:07:14.533 --> 00:07:18.800 needs to go for it to exist on this site. Um, so for a factor 00:07:18.800 --> 00:07:20.934 of reasonableness, a drive-through is a reasonable 00:07:20.934 --> 00:07:24.266 use. It is permitted with a conditional use permit in the 00:07:24.266 --> 00:07:31.100 zoning district. Uh, so for the second factor, which is that 00:07:31.100 --> 00:07:33.367 the landowner’s problem is due to circumstances unique to the 00:07:33.367 --> 00:07:38.133 property, which were not caused by the landowner. Um, the site 00:07:38.133 --> 00:07:40.467 was developed at a time where the zoning district looked very 00:07:40.467 --> 00:07:44.400 different. Um, they have a number of vacancies 00:08:38.400 --> 00:08:43.266 just on this property alone. Uh, so to, to avoid altering that 00:08:43.266 --> 00:08:45.266 essential character of the neighborhood.
