Staff presented the annual process for assessing unpaid utility bills to property taxes. Notices were sent to numerous property owners, and significant payments have been made. A public hearing allowed for resident input, including an online comment regarding scheduling conflicts with school conferences. The City Attorney clarified that the city's process exceeds state statutory requirements for such assessments and addressed a specific written objection, affirming staff's recommendation to proceed.

Staff presented a request to vacate existing drainage and utility easements and establish new ones for the Rogers Drive retail development, located adjacent to Maynard's. This is a former city-owned lot, and the action is necessary to accommodate the construction of a 9,100 sq ft retail building intended for three to four tenants. The process was noted to be similar to previous actions for other local developments.

Jason Arsold from Ellers presented the results of the bond sale for the civic campus project. The city maintained a strong AA rating with a positive outlook. Twelve bids were received, indicating high market interest, with TRB Capital Markets LLC offering the lowest true interest cost. A significant premium of $1,779,000 was generated, which was strategically used to reduce the principal amount of the bonds, mitigating the impact of slightly higher-than-estimated interest rates due to market volatility. The final principal amount was adjusted to $37,265,000.

So, the item before you tonight is an annual thing that the city does to assess to property taxes any unpaid water, sewer, storm water, recycling bills. So, every year past due balances as of August 31st, um customers with with balances due as of that date receive a letter um stating that they're past due and that there will be a public hearing...

I just wanted to note that I have um friends and neighbors in the area that were uh upset that this meeting was tonight as there are school conferences and they wanted to be a part of this but couldn't because of that. So, I just wanted to note that and uh ask if there is a way that you could communicate with the schools to make sure these hearings are not done at the same time of school conferences as many parents would like to attend this.

Cities by statute have the ability to certify unpaid utility bills to property taxes... the statute doesn't have a process for either giving a notice of a hearing, require a hearing, or have anything else related to how a city goes about certifying those kind of bills to taxes. So, like many cities, Rogers has kind of gone above what the statute requires...

Madame Mayor and councel, uh the item before you is some vacation e of drainage and utility easements and establishment of new easements related to the Rogers Drive retail um development, which is the lot adjacent to Maynard's. A little background, this is a former city-owned lot which we sold to the developer.

The proposed new easements are what would match the development needs and still cover a lot of the same areas that were previously established by easements. Uh, this is very similar to what we did with um Asgard and then Twin City Hose earlier this year.

came back affirming the city's double A rating with a positive outlook. Often you'll see these with a stable outlook, but they actually assigned a positive outlook, meaning that, you know, they they are they view uh the your future and finances in a positive light, which might signal potentially an upgrade at some point, which is which is great.

The good news is uh that uh we did receive 12 bids and that is a high number and which is great. That just means more interest and uh more uh you know competitive more competition for your debt. ...the low bidder in this case is that TRB Capital Markets uh LLC uh they are uh the low bidder and those that is the bid that we uh will be asking you consider this evening.

Our pre-sale estimate was 4.4932. If you've been kind of following along with the news lately, the bond market has been extremely volatile and we've seen, you know, increases since we came before you in uh August for the pre-sale. Uh we still were, you know, relatively close to within that estimate, but just a little over. Uh but still manageable given your larger plan for financing those facilities.

I joined this department January of 2020. Um, I joined this department because I was looking for a city that was growing. And in fact, it has grown significantly in the time that I've been here. Uh, it's been an honor to serve in this community, be a part of the growth, and be a part of the continued growth.
