july 13th 2020. it's approximately seven o'clock p.m and i'd like to call to order the regular shorewood city council meeting um my name is jennifer labadie i'm a council member and i'll be filling in tonight for mayor scott zerby tonight with our zoom for format everything we do we'll do in a roll call vote situation so first i'd like to begin by taking attendance council member johnson hi here president council member cycle i present council member sunberg here and council member labity here and our clerk will note the attendance for minutes tonight an agenda has been prepared by our staff and it's been distributed to the mayor to the council and to city staff this agenda has been made available both to the public online and um at shorewood city hall i'd like to request are there any changes additions or corrections that any council members would like to make to tonight's agenda no i have no changes so i'll make a motion to it approve the agenda a second okay we have a motion by council member johnson and a second by council member cycle to approve tonight's agenda i'll once again call for a roll call vote council member johnson aye council member cycle by council member me yes we can hear you mr zank you may proceed thank you so my name is ron zank i'm a resident shorewood 5435 timberlane i had submitted a petition to the full council and the mayor from all property owners on timberlane and requesting a permanent barrier and parking signs reserving parking for timber lane residents and guests this is an older matter that you dealt with four years ago in 2016. we have a tonka bay neighbor not a shorewood resident but a tonka bay neighbor who despite denials from your council in 2016 for a driveway and then and or a dedicated right of way continues to use an access point off timber lane as his as a driveway into his backyard for various purposes um it's beyond the occasional use i think everyone was okay with four years ago in the spring and fall to kind of unload things and load things back up but now it's become more of a routine practice to use the access point we had i talked with greg or emailed with greg and put up a sign saying timberlane guest parking and kind of right out in that area that sign disappeared last week a new sign appeared it said please do not block our driveway right on timberlane and you know there's the resident has a full driveway he's got eight foot setbacks both sides of his house easy access to his backyard none of us have two driveways and so you know we've done i think what we can we've been very patient and gave it a you know fair shot but now we'd like to request that the council work with your staff or direct staff to look at installing a permanent barrier to prevent vehicle access into the backyard from timberlane into tonka bay and if possible to request that the parking be designated for timberlane residents and their guests it's a very small cul-de-sac and we just have the west side so that's all i have i appreciate your consideration okay is there anyone else who would like to speak regarding this same issue okay uh i see that correction piper has her hand up i'm not sure if it's in regards to the same it is not okay okay is there anyone else who would like to speak to the timberlane driveway issue uh that was raised by mr zenk okay i know council member johnson and myself both went and viewed the area in question um unless you have anything to say uh councilmember johnson i'd like to turn it over and to uh our direct city director greg larud and see if you have any comments you'd like to give okay i guess i would like to say that i did visit the site on july 4th i thought it would be a very important day to go and see what the parking on the cul-de-sac looked like just given that most of these homes are lakefront homes and there's nothing more fourth of july in lake minnetonka than being out on the lake and the cul-de-sac was full of cars that presumably were guests i did note the sign that said please do not block my driveway and this was before i knew and had a conversation with anybody about this but it seemed out of place uh so i look forward to hearing from city staff what possibilities we do have uh that are within our authority um so mr zinc just so you know i looked at the email that you sent and there was no petition attached so if you have that can you resend that to me yeah absolutely i apologize if i missed it but i didn't see it on there uh this has been um an ongoing issue since 2016. uh the the property owner in tonka bay was denied an incidental use of right away permit by the council they subsequently applied for a driveway permit but no action was ever taken on it uh staff has been over there and according to the neighbors the use has increased since it wasn't in 16 it was staff's position for the last two years that um the limited use that they were having there is no there is an access it is not a a driveway per se with curb cuts so there is access into the yard um the options we looked at or that they suggested the neighbors suggested and we looked at included uh you know putting a barrier up either a guard rail or rocks or trees that would block this access and it was our position that the expense number one for for a guard rail system for really two properties there's two properties are in the same boat here and um for the uh for the rocks or boulders whatever we might put in was really not warranted simply because we're trying to get these obstacles out of the right-of-way because it could become a maintenance issue when snow plowing and otherwise maintaining the road so if if uh uses truly increased more than just this it you know once or two times a year which i think it was initially um we can certainly follow up on that or we'll take other direction that the council would like to see i stuck my head in the sorry debbie if i'm cutting you off i got it uh i stuck my head into that the axis a little bit uh and maybe a neighbor has a better answer than this but it looks like there's some sort of hobby farming activity that's going on and that that is what this access is being used for okay i did also forward when we we have the pictures of the two signs that were put up i forwarded those to the city of tonka bay for enforcement that is in tonka bay so we have no ability to you know take any action against those signs or not in shorewood but i've asked tonka bay to review their ordinance and follow up councilmember cycle did you have anything you wanted to add um yeah so i do i did also drive out um just to kind of observe what's happening currently i distinctly remember talking about this a number of years ago i think the situation really hasn't changed any i mean clearly there they've you know created a driveway that happens to empty empty into timberlane um and it's a mess so um i'm wondering um at the base it looks like they had like some makeshift thing you know that uh i don't know looks like they constructed it where does where does what i didn't know is where tonka bait um began and ended i guess what crossed my mind is we're right in the um in the midst of looking at some of our fire lanes and we're talking about some of those monuments for maybe down on grant lorenz that would um restrict um motorized traffic um on a fire lane is there something similar that we could do um in that situation what i don't know is the legal boundary of you know tonka bay and um shorewood and certainly putting up a sign on shorewood street saying you know for parking parking for the residents i don't see why we can't do that this neighbor clearly is egregiously um misusing his property and uh it's not and i did inform mr thing too before the fourth that their parking is permitted all the way along the west side of that cul-de-sac for our um there is no driveway access there so there's no parking prohibition and we had put up a sign greg like you and i discussed and it it disappeared okay stranger says mayor i think yeah we've been dealing with this uh situation for years and and this uh resident obviously doesn't respect the rights of others and i'm really okay with our uh putting some sort of a barrier in there and just living with i i the inconvenience it has for for street work and such uh i don't think anything else is going to really matter to this guy he's going to continue to be uh imposing uh his wishes on on the other neighbors so i am very interested in doing something of that sort [Applause] so um our city administrator has heard the voices of all the council members tonight um does anyone have a suggestion which how immediate we want to take action or what action we'd like to propose mr larue do you have any suggestions that you'd like to pose going forward i would just say i think uh maybe we should talk at a staff level public works zoning city attorney about what what possibilities are here to get back with the council soon i'm not talking about taking a month and a half that maybe we could actually look at this and have some type of a reporter recommendation back uh for the next meeting yeah i think that sounds great okay we'll add it to the next agenda ask that consider to consider uh on this what did you say chris i'm sorry i didn't hear i i would encourage you to be aggressive in in looking at enforcement on this okay okay are there any other comments relating to the driveway issue at timberlane then i would uh like to ask if there are any other members of the community here for matters from the floor and i see ms gretchen piper has her hand raised welcome to our meeting miss piper thank you members of the council um thanks so much for your service to our community i just wanted to drop in for a few minutes to introduce myself i am a candidate for minnesota state senate in our district district 43 and i am attending council meetings throughout the district to introduce myself listen to matters that are coming before our local communities and i wanted to do the same for all of you i um as i said my name is gretchen piper i grew up in senate district 33 i live in wyzetta now i grew up in hamel i've spent most of my life here most of my family is here um my kids go to orono i went to orono i attended the university of minnesota to complete my mba and i've worked here most of my working life as well i feel that it's important for as you all know as members of the council to run to represent our values and to put our shoulder to the wheel for the work that needs to be done for our local communities and i'm running because i don't feel that that's happening right now and i don't feel that our community values are being represented in the state legislature my experience and i've worked in medical devices and i also have a small consulting business where i help our areas cornerstone non-profits do their work and that i've done fulfilled many roles in helping them achieve their mission uh by raising more money and doing strategic planning and supporting their board members and staff in the environment in elder care youth education health care for health systems and hospitals human rights and workforce development as well as water quality in a few other areas and i work on stuff that matters to our communities what matters to me and i've been effective in forging solutions across difference across differences of opinions and different viewpoints which is i think what's needed right now in our state legislature as is being pointed out in yet another special session with uh really important matters to get our economy back on track such as a bonding bill that's caught up police reform and other matters that are not being addressed at the moment i'm a moderate my intention is to serve as a moderate and to work across both parties to accomplish the important business of our state and i would welcome any questions now or working very well here i echo council member lavadees uh welcome to you and and it's good to see you uh again uh you mentioned uh your interest in eldercare no surprise to a lot of people here that that's an area of interest to me can you tell me uh a little just just really briefly uh where your area of interest is in that area yeah specifically um i recently worked with lutheran social service and they utilized a model of volunteer assistance to our elders as well as some professional care and so most of my experience is on the on the care side thank you ms piper does anyone else have a question they would like to present to ms piper okay then thank you for coming to our meeting tonight and she gave her website um where you can find more information about her could you give that for the audience one more time gretchenpiper.com thank you and thank you for coming to our meeting this evening thank you for having me is anyone else here for matters from the floor this evening okay last call matters from the floor hearing no one i will move on uh agenda item four tonight is a public hearing we have none uh noted this evening so i'll move on again to agenda item number five reports and presentations again this evening we have no reports scheduled i'll move on to agenda item number six which is parks this evening there are no parks items which takes me to agenda item number seven planning tonight there are also no planning items for this meeting this doesn't happen often i'd like to move on to item number eight which takes me to engineering and public works our first item on the agenda is item eight a which is an amendment professional service agreement bar engineering for grant street drainage that is referenced as city project 18-04 and i would like to turn that over to public works director larry brown [Music] thank you on june 10th of 2019 city council approved an agreement for professional services with bar engineering to perform a hydrological and hydrological analysis for the grand street project which is shown on the screen in front of you um the original scope of the project called for many steps steps to be taken that was to review the calculations that were started by wsb perform additional surveying to verify the data that had been collected and to meet with minnesota department of transportation minnehaha crete and the other permitting agencies to try and get this project forward uh they were also bar engineering was also to prepare construction documents for the protection of three home academy avenue and conveyance and command system for the bond which would be uh on his own parcel as who knows as what's shown on the screen the city did purchase the lot off grant street and the existing structure there was demolished our hope was to construct a storm water pond on that parcel or on a portion of that parcel and uh hopefully sell off the remaining parcel as a buildable lot to try and recoup some of the project costs our engineering has studied this drainage issue at length and it turns out that the addition of the proposed upstream storm store uh gets water there faster than it does today what happens is that the uh trading agencies minnehaha creek watershed district and very importantly mndot and the department of natural resources all gathered together in a meeting for us and reviewed the hydrologic calculations and and looked at the results it turns out that in the proposed pond that is being suggested greg feud advanced the next slide um we are not able to contain the entire hundred year event and a few other critical design frequencies for storms if we were to expand the uh pod the proposed pond here it would it would take a dramatic amount of grading because we're starting to get into the upland areas of the parcel that remains and it just it just does not become cost-worthy to pursue enlarging this bond so with that um we conducted a meeting again with all of the permitting agencies and the city of excelsior the outlet pipe to this pond great if you could point it out at the top of the screen uh there you go excuse me the outlet pipe flows down the right-of-way of highway seven ultra to college lake in excelsior and ultimately to gulp and lake um city of excelsior raised concerns regarding the flow rates for the 100 year event as we able to totally continue to the pre pre-developed runoff rate and so they insisted that they would like to see an analysis of all the downstream waterways and water bodies to lake minnetonka where it ultimately ends up staff took a look at this and uh after the meeting with bar engineering and in our city engineer and number one that to well that certainly is an option to take a look at all the downstream water bodies was somewhat of an unreasonable request so we started looking at what the alternatives are for this and said that if we could capture water upstream of this pond we may be able to meet the requirements of the pre-developed runoff rate as this design group started to look at this we did scope out the area that is shown on the on the bottom of the page which is part of the our savior their church site council members who were around at the time that this site was redeveloped may recall that the church property was required to sign a maintenance agreement with minnehaha creek watershed district for ongoing maintenance of their small storm water pond as we looked at their site we proposed that their pond might be able to be enlarged within the trunk highway 7 right away but it would take a construction easement on their property for us to be able to do that staff is proposing that we approach representatives from our savior's lutheran church seek out that easement and in exchange uh take on the perpetual maintenance agreement for maintenance of their stormwater pond it's very small pond and would help us attain the pre-developed runoff rate we believe that with this we can attain the 100-year frequency that's needed and meet the requirements of all the all the agencies having said that uh this area this part of the design is well outside the original scope of the project so we asked bar engineering what it would take to include this as an addition to the scope of the project i'm not going to go through each task they're listed in your report and more in detail in the bar proposal but it involves a number of tasks including soil borings field survey and and certainly analysis the hard part about this is there are a number of tasks with this and it adds an additional forty three thousand four hundred dollars to the project the original scope of the project was forty four thousand seven hundred dollars as i show on the table in the report which brings us to eighty eight thousand one hundred dollars for this project so far so with that uh staff would recommend proceeding with this of course we've council has heard of a number of reports on this and knows how important this is to the neighborhood so staff is recommending that the resolution that the original agreement for professional services with barr be amended with the additional amount of forty three thousand four hundred dollars okay thank you mr brown i'd like to ask if council have any questions that mr brown can answer okay then i'll i'll open it up to discussion for the council i thought you did a nice job just um kind of giving the big picture and what's happening um i don't know i without this cooperation of excelsior to me it sounds like this is a um you know the next best thing and uh it's a big project things like this come up so i i don't have a problem with this thank you i would echo that position as well uh i think the problems for the neighbors is serious enough that we need to address this so i am supportive as well so i could see on video that a couple of other people were having a hard time hearing councilmember sunberg's comments but i'm going to paraphrase them as that she was supportive of the yeah maybe i was covering my microphone or i need to be closer is that helping yes okay if all i'm saying is this has been an ongoing serious problem for the residents and i fully support this proposal okay perhaps um council member stenberg you could can you adjust your volume at all it's very difficult to hear you i did check that sorry i don't know what's going on okay well i heard support i am supportive as well so i'm i'm well i guess i should well i'll make a motion and we'll see what happens i'm going to make a motion to approve the amendment to professional service agreement bar engineering for the grand street drainage project city project 18-04 a second okay i have a motion made by council member johnson and a second made by council member cycle um if there are any other comments i would entertain those at this time otherwise i would call this matter for a vote council member johnson aye council member cycle aye councilmember sunberg yes and council member labadie aye we have a unanimous approval and the matter has passed also thank you for that vote i i greatly appreciate your patience in that uh with this uh the administrator laroud and myself and city engineer buddy will reach out to the representatives of our savior's church to seek that easement okay thank you mr brown i think that sounds appropriate are there any com other comments by council okay then i would like to move on to agenda number um item eight b which is also under engineering and public works this is a professional services agreement wsb and associates for construction inspection and engineering services woodside road lane reconstruction also known as city project 19-04 once again i would like to turn this matter over for a presentation from our public works director mr larry brown thank you on april 27th city council did approve plans and specs and authorized ad for bid for the woodside road and woodside lane reclamation project this also does include a water main extension along those properties along those roadways um the woodside project extends from howard's point road uh to the sac and woodside lane from woodside road to the north terminus it also includes the as i said the extension of water which it doesn't does include directional boring water being on kathleen court the uh there is a section you can see on the screen that's highlighted in orange uh there's a section between the end of woodside and boulder bridge drive where uh water beam is to be proposed as part of this project it was included as a bid alternate um and we got we did receive favorable pricing for that but it does include seeking an easement from a property owner to make that connection to bridge drive from the woodside cul-de-sac staff is currently working with that property owner we hope to have that wrapped up soon the bids were opened for this including that alternate on thursday june 11th and council did award the contract to new look contracting on june 22 of this year in uh in light of that um staff did solicit a proposal from wsb and associates uh they did supply proposal for a cost of 138 thousand one hundred dollars it's noted that our own city street inspector will also be assisting with these services uh mr uh andrew will be on site the uh as it's noted that as the project proceeds through construction uh we did receive approval from the minnesota state archaeol archaeological society the minnesota indian affairs council and the minnesota state historical preservation office for the project to proceed what it means they will continue to be on site as we perform construction and as long as we do not run into any artifacts or something similar the project will proceed but they will be on site costs with this are not included in the proposal being considered tonight those are undetermined at this time but for this area we feel that we've done a very good job of studying the area we're doing a reclamation which is minimal invasion to the area so we'll be all right the uh feasibility report for this and the cip list this project at 1.3 million dollars the construction bid amount was 828 961 and the bid alternate is thirty two thousand three hundred and fifty five dollars so with that we are well under the uh capital improvement amount um almost by three hundred and seventy one thousand dollars so that's that's news i'm sure we'll see some change orders in the project as there are in most projects but we ought to come out well under budget on this project so with that i'll turn it over to any questions you may have thank you for your report mr brown council are there any questions comments or concerns i have a comment that i would like to see this trend of coming under budget continue i think this is the fourth one in a row which has got to be unheard of that's great uh i'm prepared to make a motion if there isn't a further discussion you know this is something that's been in front of council for some time we followed it through the process so for members of the public who are joining for the first time this is a something that is larger than just wood sign lane it's part of a large cip process capital improvement process so i think we are all well familiar with it so with that i will make a motion to approve the resolution to accept the proposal for construction services for the woodside road and woodside lane street reclamation and water main extension project city project 19-04 a second okay we have a motion made by council member johnson and a second made by council member cycle is there any additional discussion by council then i would like to call this matter for a roll call vote council member johnson council member cycle aye council member sunberg yes and council member labadie aye this motion has been unanimously approved thank you with that i'll move on to agenda item 8 c and that is professional services agreement wsb and associates for construction inspection and engineering services woodside road oh pardon me woodside road lane reconstruction wait am i reading it again aren't i yep i would like to strike all of that and i would like to move onward and not re-discuss therefore i'd like to go on to item eight c which is the health services agreement wsb associates for construction inspection and engineering services enchanted and shady island reclaim city project 18-11. and i would also like to turn that one over to our public works director mr larry brown thank you this is very similar to the last item uh city council approved plans and specifications an authorized ad for bids city project 1811 on april 27 2020 uh the improvements do involve a full-width bituminous reclamation and overlay for all of the island roads with the exception of shady island point i'm sorry uh enchanted point i'm sorry the utility improvements include minor sewer casting replacements for ini reduction and some storm culvert replacements the city did open bids on thursday june 11th and awarded the project on june 22nd 2020 again as part of this project this also fell under the review of the minnesota state archeology archaeological services minnesota indian affairs council in the minnesota state historical preservation office is you can well about imagine uh the islands are are considered a very sacred ground for the for the native american community and we get back find some uh indian burial mounds out there but our work out there ought to be again very minimally invasive to the area so again they will be on site during construction and will guide us through that process the fee from wsb to perform those services for construction engineering is 68 000 and uh once again we are well under by leaps and bounds this time but by uh the cip amount being listed at two million one hundred and eighty two thousand zero twenty seven uh with the construction bid and the construction engineering services that puts us over a million dollars remaining in the in the bank for what we've got bids are proposed so far so with that staff is recommending approval of the resolution i should just highlight and reemphasize that uh enchanted point there was discussion regarding whether to uh under this project as far as a reclamation it's a currently a aggregate roadway and based on the feedback that we've received from the residents they did not want to bear a special assessment for that project so they chose not to move forward with that we will consider under a separate contract at a later date what's called auto seal we've done that before and it was very much appreciated by the residents out there so you'll see that fourth coming at a later date okay thank you for the presentation mr brown um i'd like to turn this over to council does council have any questions for mr brown or comments or concerns regarding this item which is 8c i'm fine with it larry question and when would you do the auto seal is that just something you do at the completion and uh is that a major expense or something that's going to have to come back to us i mean how would that piece be handled uh we would probably do that in the fall of the year and it's a fairly minor expense almost this is very typical seal coding so it will it will come back either as an authorization for quote uh more than likely in the fall of the year i think you did a good job working with the residents they seem happy with that so i'm i'm okay with that too great yeah i also think you did a great job mr brown and this is a perfect example of when residents have come to council with concerns and come to city staff with concerns that we listen to their concerns and sometimes we alter our plans according to them thank you for your work on this matter thank you so are there any other comments questions or concerns if not i would seek a motion on this matter yep i think i'm gonna put a tracker behind me for times we've come under budget so look for that at the next council meeting with that i will make a motion to approve the resolution accepting proposals for construction engineering services for the enchanted and shady islands street reclamation project city project 18-11 a second okay we have a motion by council member johnson and a second by sec council member cycle are having any other comments or concerns at this time council if not i would call this matter for a vote council member johnson council member cycle aye council member sunberg yes and council member labadie aye this matter has been unanimously approved thank you thank you mr brown this moves us to agenda item number nine which is general new business specifically 9a is calling for bond sale for projects and with that i would like to turn it over to our city administrator mr greg larud city council members since uh the council approved the street reconstruction plan in may of this year we brought several projects forward two were approved for engineering tonight and bids have been awarded and we have several others that are in the pipeline staff has discussed uh the the ability or the desire to move forward with bond financing now we visit with mr shan sweeney at david brown associates who is here tonight and will go through the bond issuing process as well as the financial projections but the environment right now it seems to be very favorable for issuing bonds and in addition to that we've already seen that um our bids have been coming in under and in speaking with city engineer buddy uh the uh pond project uh could is also probably a very favorable bid environment now that was originally a 2021 project we are looking to move that up into this year and so it would be included in the financing that was proposed tonight and so with that i would just request that the meeting can be turned over to mr sweeney he can go through uh through the financing thank you mr larud mr sweeney would you like to address the council yes thank you good evening council members uh we provided some materials for your packet ultimately a resolution that initiates the competitive sale of bonds to fund nine projects as greg mentioned uh eight of those projects are in our 2020 street reconstruction and capital improvement plans that we've recently spent a couple of years working on and the additional project of smithtown ponds was adding added based on one the favorable construction bidding climate but also the favorable financing climate uh ultimately we have about seven million three hundred seventy thousand dollars in projects identified for finance with issuance costs capitalize interest bond rating fee those sorts of things we're looking at an issue of seven million five hundred thousand dollars ultimately the structure of that issue is we're fi we're financing utility reconstruction in new construction over a term of 20 years and street reconstruction over a term of 12 years really want to avoid particularly on street reconstruction having a term on financing that's longer than the life of the asset we thought 12 years was safe and honestly we want to move through a series of projects over the next five years and having the ability to get projects in rotation and paying off debt more quickly is something that we thought was beneficial we are pledging a tax levy for a portion of the repayment of this bond issue that's associated with street reconstruction and some storm sewer reconstruction that was eligible under our street reconstruction law we've discussed with staff having some flexibility of being either able to levy tax apply franchise fees or storm water utility fees for the repayment of that portion of the debt we want to give you that flexibility through the budget process that as additional projects are contemplated over the next five years we have some flexibility in how we repay this debt these bonds would be callable anytime or you could prepay anytime after february first of 2027 the reason that we have that call protection is it's somewhat expected in the marketplace investors want to be guaranteed some interest at least for a period of time and if we shorten our call period or our prepayment ability it starts to cost us something in interest expense and so we've we've essentially set it where we don't think it will impact pricing of the bonds as i mentioned this would be a competitive sale process and how that works is if you choose to authorize the sale this evening we would go through the process of purchasing a credit rating from standard and poor's that essentially assigns a letter grade to our ability to repay this debt and we would use that credit rating along with an offering document called an official statement that would be drafted to market this bond issue to underwriters that would uh provide us with bids on the sale date which is uh right now set for your meeting date of august 10th so on august 10th in the morning we'd receive bids for the purchase year bonds and we'd present them to you that evening for award we think we have a few great things working on our favor one is current interest rate climate two uh an excellent credit rating and a in a a great ability to demonstrate our our ability to repay this debt which will be reflected in a very good credit rating and so with those two things we think you know we will will do well in the marketplace and even as i look at sales today i've provided you with a preliminary schedule that applies those serial interest rates that we see in the marketplace today and i'm at an average interest rate of about one and a half percent and so over a 20-year term granted you know we're front front end loading this debt a little bit meaning we're paying off principal more briskly in the early years than we are in the late years uh but even so uh there's not often in our history that we're borrowing money at one and a half percent and so adding smithtown pond you know in the likelihood that we can maybe get underway with that this fall seemed to be uh good planning both financially and from a bidding standpoint for construction and so two good reasons to add that project to the mix and ultimately we think uh at least from the perspective of borrowing money that we're hitting the market at a very good time again those interest rates won't be locked in until our day of sale which is august 10th when we receive bids and present them to the council the action that you're taking tonight is simply initiating this process and allowing us to purchase that credit rating and put together the offering document ultimately bids will be received on august 10th and presenting presented to you for award and at that time is when an interest rate commitment would be made so with that i'm happy to answer questions on the structure the preliminary financing schedules or the resolution that initiates this process okay thank you for the presentation mr smee does anyone on council have any questions uh a question can you hear me okay yes but you you mentioned that you expect our crazy credit rating to be very favorable do you have any guesstimate what you you would expect that to be oh double a plus at a minimum [Music] under standard and poor's it's kind of consistent with previous bond issues it's been a while since we've done this but the city's always had and maintained a pretty good credit rating yes and monitoring sales of adjoining communities they've been faring very well through the credit rating process and i expect no less for your issue yeah that's important for us as well so thank you you're welcome are there any other comments or questions for mr sweeney go ahead patrick sorry i do have questions for city staff first i want to applaud the addition of smithtown ponds uh by taking advantage of the low interest rates and expediting that the one question i have is pertains to our last meeting and it's possible that city engineer has started looking at this but we don't know the answer that to that yet but i noted as we talked about shorewood oaks drainage and we did the surveying of it the location of where we think the connection to these some plastics baskets are as opposed to where they actually are the depth may change the pricing of that project so i don't know in your survey and that's been done thus far have you confirmed your your thesis or are we uh are we running into more surprises than we thought uh we haven't gotten to that point the survey helped us identify this other small utilities that would be right in the areas we want to dig uh we have not confirmed the depth that we talked about last meeting and so i am still in the process of trying to uh better track down that information so then from a dollar standpoint and maybe this is a question for for shannon at that point you know what flexibility should we be putting into this uh bond understanding that there might be overruns that are not anticipated we do have contingency built into the project cost for each of the projects and we have nine projects so uh that that's a good way of addressing it i would also mention that we have a series of projects over the next five years so even next year there's some intention to go to market again for additional projects that we'll be undertaking and implementing as part of our plans if the overruns were significant enough to you know require additional borrowing we'd be able to do it at that time granted you know we're trying to take advantage of some great interest rates right now but we expect them to remain low for a fair amount of time and lastly we have pretty great cash balances in most of our funds and we have the ability to cover some of our contingency with those cash balances particularly in our street reconstruction fund so i think those are the three things that i think about you know when i try to address cost overruns did that answer your question councilmember johnson sure did anymore are there any other questions or comments or concerns i'll go ahead and make a motion um to that calls for the uh bond sale um that's highlight highlighted by resolution what number is this uh i don't know what it sorry i'm doing a bad job so i will call it twenty zero seven two step once a year and i've got uh some news that you probably already know that i would like to share with you regarding tour de taka and then also end with a little bit of community education news so let me uh get the presentation up if you i don't mind i'll do that right now or greg are you pulling that up where am i you are thank you very much yep and is that something that you can see how about now i don't see it yet tim okay well we're getting there you say when should have it now i don't see it yet all right well i apologize so i'm going to move forward and present verbally with you tonight so i don't waste any more of your valuable time uh two to tonka was scheduled for the first saturday in august like it usually is and uh this year unfortunately with covid19 as many things have had to be catalog again this year we are waiting from direction from the governor on what the school year might look like for k-12 and then we'll adjust our announcements and our offerings once that happens and that's expected as you probably know at the end of this month so look for the community education catalog somewhere around august 15th this year instead of its typical august first arrival in your mailbox but that's good news to share because many peers of mine across the state are doing a don't do the catalog this year which i i believe is not where you want to be because that is our number how about um city engineer mr buddy uh we'll just let you know that the surveyors along strawberry lane and around that corridor should be wrapping up here here in probably the next week or two with packets you know sandy it's a little bit hard to hear you just i mean we can hear you but it's really fuzzy is it any better a little bit a little bit yeah just talk louder i can do that scream let us sandy so candidate filing packets for our three seats will be available on friday and we'll have electronic packets on our website and we'll have hard copy packets at city hall however we will be handling candidate filing a little bit different this year we do have two council member seats four-year terms up for election as well as mayor four-year term we are going to ask that excuse me that those seats um that the candidates who would like to file call city hall and make an appointment versus uh just coming in to city hall so that we're ready um as you know we're we're working staggered shifts so we have a little bit less staff capacity and um the county has recommended either doing an electronic process for filing or scheduling appointments and we're comfortable scheduling those appointments so um that'll be the word that we're getting out there is that we'd like candidates to call i'm sending electronic packets and hard copy packets ahead of time so that they can look at that material and get everything ready so when they come in it'll be a fairly brief process uh to get them going so uh and to actually file uh of course this year the two dollar filing fee uh the petition in lieu of that fee uh can be electronic and uh if a candidate chooses to go that route it is 10 of the um shorewood voters that is required for that petition and or 500 whichever is less which 500 is less so 500 signatures on that petition but it can all be electronic um filing opens tuesday july 28th through election day will be open till five that night and that's august 11th uh there is a two-day withdrawal period which ends at five o'clock august 13th so um just an update we've had a significant amount of election judges drop out due to covid kind of like a complicated game of tetris trying to staff our polling places um we've had a lot you know i just i think our returning judges who are um willing and able to work we completely understand and support anyone who isn't and we have had a really great response to our recruiting additional and new judges and so we're really excited about that however we still need our experienced judges to train our newer judges in the polling place so we are fully as staff we have five members on our team and additional people that can help out and if push comes to shove we're willing to go work in the polls so um it's been an interesting year for elections i've been doing this 15 years i can say it's never quite been like this so um but figuring it out and um like i said i've updated before there have been um an overwhelming response to the absentee early voting at the county uh they've just been inundated which i think is a really good thing um but we'll still be open at the polls and ready to go on election day so that's all i got okay are there any questions for sandy a very logistical question but are face masks required when visiting city hall well well with paws i say we are all wearing face masks and we have we have a sign out front that asks people to wear a mask when they enter city hall and if they do not have one one will be provided and we have a little box at the table in front of the counter for them to put one on i have not heard of anyone not wearing one since we started that and that is we will proceed with the election all of the election judges even though they do have the plexiglas barriers they'll still wear masks all of the staff will wear masks asking we'll put up the same signs just as we have done and we don't know what the governor will do between then and now things have been changing daily weekly um with what with what we're doing in the polling places but we will also ask that they wear a mask into the polling places for the safety of our judges and the public so that's our that's our tact so far with what we know today that was a great question council member johnson does anyone else have a question for ms stone okay thank you how about our a report or from our city attorney mr tim keane uh mayor members of the council uh we have nothing further report good meeting thank you and how about city administrator mr greg larud update on just a couple of items i'm sure the council council is aware that the governor released the cares of funds a couple of weeks ago and set up a process whereby the city can claim its share uh shorewood share is approximately 579 thousand dollars staff has submitted the paperwork we anticipate our distribution will get here um next week of the week after we have them until the end of the year expenses until the middle of november and then we have to return any unused funds by the end of the year there is still some question on some of the guidance but i hope to have a report to the council on this use within the next meeting or so and what our plans are for that the other item is for the past couple of months staff has been looking at the amount that the city of excelsior bill shorewood for sewer conveyance we have a 1991 agreement whereby the city agrees to reimburse excelsior for their costs related to conveying sewer in a couple of parts of town our review of that uh appears that we've been overpaying uh what we should be paying so i just want to let you know about that now i don't have any definitive information but we'll keep you updated as we keep looking at it ourselves and visiting with excelsior staff okay thank you are there any questions for mr larud um i have one question um about the fire lanes and i know we've gotten some emails those tours were put off because of the pandemic but it sounds like as a friday that we can independently tour those um those fire lanes and i just wanted to check to make sure that we're still on schedule that we can do that fire lanes one through eight have been staked and are clearly marked um fire lanes nine and ten should be finished up before the end of the week okay thank you thank you mr buddy i'm not sure did i ask you if you had anything else i did i just wanted to see nod your head one more time all right i do have a question for uh administrator larud have there been further discussions with excelsior on some of the other things that have been raised uh as part of the meeting that i attended about collaboration with shorewood uh no we haven't had any further discussions yet so i think that there's a to do there for because one of the things that was discussed on the excelsior council meeting during their work session was the idea of a subcommittee with four members two from excelsior two from uh sherwood council and i think we should probably get that in play i know one of the things that's hot on our item agenda is the lake mary project and i know that there was limited appetite on excelsior side to discuss that within our time frame so i think we need to get this subcommittee up and running okay uh are there volunteers on this council who is willing to participate i think it's the mayor and i and i'm speaking for him in absentia okay i will contact christie tomorrow and see where she's at on their appointments yep and on their side it was likely candidates were the mayor and then council member kushner okay okay thank you mr johnson councilmember johnson um for volunteering the mayor and yourself i'll volunteer the mayor for anything there you go um are there any other questions comments or concerns from mr larud okay hearing none i'll go around the council table uh councilmember johnson nothing to report this evening council member cycle nothing to report council member sunberg likewise nothing to report and myself i attended the um we continue to work on with the excelsior fire district the upcoming budget we are still in the process of working on that um when we do finalize items i'll i'll report back mr larud may want to chime in on that as well he's been very very involved in that matter as well one thing i did want to just um share with you guys at the meeting it had nothing to do with the the actual business portion of the meeting but i found it very interesting the excelsior fire district is treating every call that they respond to as a covered response call they're employing the protective gear and the measures that they've been trained to do as if it were a covid call so i just wanted to let you know that because i found that very impressive so mr larue do you have anything to comment with the budget the efd budget i don't have anything to add except to say i think we're really close i think it's just about put together as is the police department i anticipate that both chiefs will be either at the 27th meeting or at the first meeting in august to present their budget thank you and i i agree with that with the fire board so fire district i don't want to keep everybody beyond uh but i did want to ask a question you mentioned every single call is being treated as a covet call does that mean that they are using new ppe for every single call i believe so but that is a question i would take up with uh chief mackey that is the impression he gave us but again um i did not ask that specific question but that was the impression i got yeah i guess the follow-up question i would ask him and i'm happy to to relay this to him but you know given the ppe shortages that hospitals are experiencing and other surges around the country uh you know make sure they're they're looking at their policies with the shortages uh as a key consideration i think they are the reality is if a firefighter comes into contact with it we have to quarantine the whole staff that was on that call and we we lose a good portion of the the firefighters you know they they all go into quarantine also they are the the first responders in many cases in some of the assisted living facilities and senior facilities so because of that they're taking extra precautions but um if you'd like i can verify that question with chief mackie and get back to you or he'd be more than willing to chat with you about it he's a great guy i'll reach out i haven't actually haven't had many interactions with him as uh as i knew our former chief gerber quite well so i'll i will follow up with him directly great mr larud is there anything you'd like to comment on that no okay so unless there are any other comments from counsel or questions i'd look for a
