so that's fine mr. into session we will move on to our next item which is a minor subdivision add two five one six five Glen Road and director Garland go ahead when you ready excuse thank you mr. chair members of the Commission the applicant proposes to provide the subject property into two lots and construct one additional home the subject property is about 2.7 acres and contains mature tree is but no wetlands floodplain or shoreline or shoreline all of the adjacent properties are developed with single-family homes the applicants proposal would need all ordinance requirements for a lot area with and it would contain enough area for a building pad that makes that back requirements biblical provide additional area my education is one Road both to provide forming Street wind and also just wide air get to allow the construction of a conforming cul-de-sac when Glen Road is reconstructed likely in 2021 they're also providing rate control as required for one additional home the site dreams from South Worthen and generally to the northwest with most from this side to the adjacent properties to the west rate control is required for this development and that we know stormwater that leaves the site is not permitted to be discharged at a faster rate than the water would have before development the applicant proposed a filtration Basin to provide that rate control the applicant initially installed a filtration basin about a year ago and it is adequately some size to provide rate control for both new homes the new lot would be served by municipal sewer but water would need to be provided by private well unless water a new water main would be included in the future when the road is reconstructed and construction project may occur in 2021 true preservation is required for the development and the applicant has indicated that they could accommodate the 22 new trees that would be required to be replanted on the property staff recommends approval of the minor subdivision based on the finding that the Lots would be consistent with the subdivision and zoning requirements subject to the conditions in the staff report all right Thank You director darling any questions director darling this is Mark Riedl can you comment on the archaeological issues first time I've seen that in an item on our packet so it would appear that there could be burial grounds on the site and [Music] could you comment on what sort of recommendation you have to the owner and what issues we should consider there I think it's unlikely that there would be architectural or burial mounds in this area that hadn't already been discovered or dislodged or or otherwise graded out if you look at the and I'm sorry I don't have a copy of it in with my materials this evening but there is a copy of an aerial photo in the staff report it shows that the majority of the north half of the property was wrong propped even into the 50s and there was an orchard plus the home that's shown on the aerial photo on the south end of the property so it looks like there has been enough change to the site that I don't know that it's not likely that they're going to find something but there are burial mounds in the proximity tennis property mostly on the East half of family and behind the Gideon Lane homes so I did put I did let the applicant know that if they did find something there they needed to make sure they talked with cultural resources a professional so they would know what to do if they did find something during either construction of the new home or in the in the future if they plant a garden or or whatever digging might might occur so I think you note this in your report the city has no liability here in approving the subdivision in the event there would be archaeological issues or on the site is that correct that's correct thank you connected are you so you go ahead Todd you see if they did Street reconstruction and they put in water mains with the new dwelling or both dwellings to be required to hook up the water we do not make properties hook up to city water when it is available it's voluntary until you get to the point where you're developing four or more four or more logs so I had the same reaction that I'm sure that people had with this archeological issue section here so are we are we doing a study is that the first step the city of Sherwood is conducting a an archaeological survey for the road reconstruction project with Glen Road ambling Manitou okay there there there may be some burial mounds on the east side of that project so the result of that study will that be areas of potential fines is that what that what the result of that would be and they'd be required to monitor that area during construction is that what it amounts to Greg could you please unmute city engineer Andrew buddy thank you yeah this is Andrew buddy of the city engineer what what that process is doing is its its mapping the known archaeological and cultural resources that are out there and previously known it's right now we're not doing any field exploration as part of that our intent is that we're going to map those areas based using better information that's available now I think a lot of them were identified back in like the 1880 or 1890 so they're quite old they originally originally found and so we're going to map them more accurately and our intent is to probably adjust the project scope to avoid those knowing that if you have to have to deal with it or impact them it becomes incredibly challenging to permit and very expensive okay so you would wait for the result of that study before I would have met him before they would finish with what their design would be right is that the is that the idea well for the city street project yeah that's correct the city completed a feasibility study currently we were in the process of archeological information which will probably take another several months before that and once we know that information then we would come back to the city and try and get authorization to complete final design of the roadways which would take several more months and so construction would only best-case-scenario construction would only be in summer of 2021 this is just for the roadway though just for the roadway yes this says this is not associated with the development here okay a property owner and whoever builds on this lot would be responsible for any issues with burial mounds is that correct yes that is correct so it's possible that our study shows that there is some impact to their site I think it's there is a chance yes I think it's unlikely because most of the known information that we're aware of is off of the cul-de-sac family and not off of Glenn okay I guess what I want to avoid is you know these guys that get out there and then I'm really looking for things I don't want to don't want the city to be thought of as insensitive to this site yeah I guess I don't quite know how to respond to that because it's such a small one it it meets very new thresholds okay much larger development start hitting thresholds we have to go through a double use and all that stuff and they start like taking a look at that and start flagging some of that stuff but because this is really just a lot split they don't don't trigger any of those requires yeah okay so we're not gonna get like a Phase three in the middle of this thing right yes like like a like a whole site exploration and you know people with a lot of brushes oh no how was that chance I'm not gonna say I think the way Maria explained it where it was previously farmed and it was previously an orchard there's been a lot of disturbance to this property already so okay it just it feels weird to approve the design when it's that's kind of hanging out there that's alright maybe it's a little risky design really we're just simply approving the subdivision you see they haven't provided a a plan for the for the new parcel with a construction on the new parcel other than a square which we all know wouldn't be a square yeah I guess they have to in midnight at a time but they have plans for it it makes sense like it makes sense in a certain way right now but could be a monkey wrench okay that's that's what it is I guess you'd have to see what the study shows too there ain't any more questions poor director darling or the answer director darling there so the applicant is aware of this study that's going on the correct by the city on this street yes yes he was alerted to the fact that we're doing in a large Archaeological Survey for that the road reconstruction project and you still wish a lot yes right any more questions for director that will move to give the applicants a chance to contribute is the applicant here I think I saw mr. and mr. Hagen Berger hi mr. gold I listened to Riedl I see also vote Sydney I buy the motion passes unanimously moving on to our next and final guess item in hand before regular that kind of housekeeping stuff we do at the end we move on to a minor subdivision at five eight one zero Club Lane when you're ready to director darling done please proceed Thank You mr. chair the applicant this evening proposes to subdivide the subject property into two lots and construct a new home on the northerly parcel the subject property is about 1.7 meters and contains mature trees but no wetlands floodplain or shoreline all of the Jason problems are developed with single homes the applicant proposal would meet all the ordinance requirements the lot area and width and we contain enough area for the building building pads weekend which would be the vacant lot that means the back requirements the applicant is proposing to dedicate some additional land for right a point that would allow for it a conforming roadway width on this it would be in it for 21 feet and that would be the second for me right away with across the length of the property that would mean that the existing home shown here would then be non-conforming legally non-conforming 22 and a half staff has reviewed the stormwater runoff for this particular property the areas for the site run generally to the south west and outlet in the applicant will construct a new rain garden itself corner of the line will rate these walls and impervious that choice with constructive and that rain garden is showing currently piped outlet over pipe over in the minute there would be some private easements that are required for this for the improvement across a property line to reduce the number of properties that the applicants would need to cross staff had recommended that they adjust the slot line slightly so that I wouldn't have to cross on to the southerly property before it crosses into the adjacent lodge Minnetonka Country Club and the applicant has indicated and showing some drawings where they could redesign this lot line over here it would mean a very minor change in the total odd area for the properties municipal sewer is available to serve it serves currently the existing home and could also serve a new home but both mods would require Wells certainly the existing home is currently on a well the new home would also have to be on a well for tree preservation their only review they're only removing two significant trees on the site so they do have to plant six new trees it could be on the new a lot for the new home or it could be spread out evenly along the entire development and with that staff and do you recommend approval subject to the conditions let's listed in the report and I think for your attention this evening thank you are there any questions from the Commission to durga darling darling a quick clarification to the home is currently non-conforming and the plan will not increase or change the nonconformity correct the existing house is currently I believe it's a conforming distance back from the existing right-of-way okay oh yes that as the new right-of-way is dedicated that would be an additional 21 feet I see the home would not would not meet the new sub or the setback I see thank you did we given that this looks like the final division on globalization previously have we gotten any feedback from the neighbors this time not received any letters with minor subdivisions there's no particular notice but I have talked with a couple of the neighbors as they have to call in on other other topics just to let them know what was going on and they did hear from one property on the on the street that had talked with the Alpha the property owner and just was curious on what was proposed on this site but with no particular no particular concerns right any more questions we'll move on the applicants the applicant for this development is say their Bergquist and the property owner is dr. a pretty heavily wooded area this whole backyard the backyard of this lot is really wooded and then this corner here where were where we're angling into Country Club that's really heavy heavily wooded also and I wouldn't want to take down trees there to put pipe through there and I'm not sure if that would be needed or not gonna maybe we could trench part of that and then carry the carry a pipe down you know into the Country Club area or does it doesn't have to be piped all the way from the rain garden because there's a lot of trees right there Angie looks like you're unmuted can you answer that yeah I would say it should be piped because as it gets onto that property closer to the catch space and it's really steep and there's strong potential for erosion mmm it could be directionally drilled in there it doesn't necessarily have to be on the hope and cut trench that would take out the trees okay there's also a lot of debris that the previous owner left there you know as far as like branches and stuff and I'm gonna remove all of that but there's quite a few trees right there that's all I had that's the only question I had pyramid Manny I'm not able to unlock dan schmidt he and with Commission and developing a motion so the city engineer developed a responsible detailed memo and part of the staff relations that they complete the conditions of the memo and I think there was discussion of that regarding the the drainage and the tree preservation I'm satisfied with all the conditions that the that the city engineer proposed here and other than that I see no issues with this subdivision I agree with Mark right so it looks like we're talking about staff recommendation with conditions do I hear motion oh go ahead Lisa lightning I make a motion that we recommend approval for the minor subdivision at 5810 Club Lane with the inclusion of the staff recommendations I Second Circuit Oh quick mention Arita one all right so the motion has been made by Commissioner Gulf and seconded by Commissioner riedle that's who recommend approval of the minor subdivision with conditions any discussion on the motion seeing none we'll move in to a vote Commissioner Gorham hi Planning Commission and the City Council that's a lot of non social distancing and some of the areas where these fire lanes are the roads are quite narrow and the idea the option of 15 vehicles at once I think he's a little tricky I think we should just hold off from the tours themselves now we are moving forward with the surveying work so that we'll be ready when we when we're ready or when we are able to do okay would was it considered to do like a walking tour independently or should we just postpone the whole thing I think we'll have to probably consider doing it individually depending on how the epidemic progresses okay that sounds fine for the rest of the work program we've had a list of items that we were considering looking at I didn't do too much changes on those just to get them into kind of a logical logical list an illogical assignment where are we doing working on some of the big chunk with our with our amendments all right now you're looking for feedback resistors how it is if you'd like to make changes or if you'd like to define priorities for any of those ordinance amendments you could certainly do that anyone know any thoughts I'm changing anything or is expressed interest in petitioning the city to officially make it a non-motorized boating lake but now now that I'm saying it I should actually take your solid hotline and communicate to you directly on this matter let's table that or we can certainly yeah Murray what are we thinking about for food trucks do we currently have language in there almost nothing what I think that our past director Nielsen had proposed was doing a conditional use permit for food trucks but they if they wanted to operate in in commercial districts but having a 500 dollar application fee and then only being able to operate most dudes with it summer months it seems so because they operate fairly fairly low volume right I think that's part of it but the big fee is kind of onerous for them yeah it's they don't they don't have usually the amount of business especially when it would just be for a few months in the summer so it's just something to look at maybe putting some standard just simply so that staff can look at that and I don't know that it's a huge rush on that type of on for food trucks we haven't had any requests do I see a food truck at the arctic blast Arctic fever you could have they are allowed in badger subject to council approval okay that was one change we worked on with the Parks Commission a few months bail cool we really don't have a whole lot of areas that I can think of food trucks parking on an extended basis you know we have some Urschel properties that it's this is a huge issue to take on but if they could support certain functions at Freeman Park I could see if we truck it you know soccer soccer on Saturdays they do pretty well to support that where you can you tell me which which pieces here we'll go to the May 11th board if any for council action sorry seemed like most were going to the April 27th City Council yeah it looks like none of them required any additional research a very busy day tomorrow okay our next Planning Commission meeting is slated for the fifth you have much on the agenda for the variance maybe a second variance and a renewal of a home occupation permit all right let's keep going to our agenda then if we're done with this yes we'll on Monday April 13th for a regular City Council meeting it was a rather short meeting we approved the consent agenda we had matters from the floor and no one appeared for matters from the floor no what we had no reports or presentations we had no report from parks or planning when it went to engineering and Public Works we approved plans and specifications and authorized an ad for bids on the Public Works building this is a roofing project when it went to general new business we approved an assessment for five four four zero Wedgwood Drive and then it went to staff and council reports and staff updated us on the Mill Street update badger Park update and that was about the summary of our meeting like I said it was short and sweet we are also doing a zoom meeting format almost exactly like you are doing a one by one roll call the mayor is identifying who is making the motion whose seconding the motion and it's a system that we're all getting used to so if there are any questions I would take those at this time otherwise thank you and I look forward to the reports and summary of this meeting by mark at our next council meeting Thanks thank you councilman gravity any questions for her just her letting us know that our meetings are apparently a lot more popular than hers yeah yeah I guess we drafted our next meeting agenda director darling is getting us you wanted to add
