The Consent Agenda included multiple routine approvals such as the check register, fire and building activity reports, resolution for Westway Condominiums PUD extension, a change order for the Panaway project, a donation acceptance from the Garden Club, a contract for the Lake Street Landscaping Improvement Project, a memorandum of understanding for the same project, and a professional services agreement for horticultural services. No discussion or changes were requested by the council.

The application proposed subdividing two existing single-family lots at 535 and 555 Bushaway Road into three new single-family lots, conforming to R1A zoning and Shoreland Overlay District requirements. The site has a perpetual conservation easement with the Minnehaha Creek Watershed District. Key considerations included future grading approval by City Council, tree preservation (with a condition for inventory), stormwater management, utility connections, and Hennepin County's review of driveway access. Public comments raised concerns about a suspected eagle's nest, leading to a condition for property owners to follow all applicable laws. The Planning Commission recommended approval with additional conditions, which the council adopted along with a new condition for watershed notification.

Um, and to address the concerns that have been raised about um a potential eagle's nest on the site, um it's typical for um land use approvals um and applications for subdivision to one of the conditions of approval is to follow all applicable laws. Um, but we did add in um specific language pertaining to um following any applicable laws or regulations that apply to a reported Eagle's Nest on the property.
I think um the we're not eagle experts up here and so I'll let the experts let that one play out and trust that that all uh goes according to applicable laws and all that. So, I'm I'm in favor of this.
I also feel good about adding that additional condition where the applicant needs to send a letter to the water district. I I'd be in favor of adding that to um this approval if it has support.
