I'm going to call the meeting to order. Welcome to the January 20th, 2026 City Council meeting. I hereby call the meeting to order. Members of the public may attend the City Council meeting in person or may watch and listen remotely by viewing the meeting on channel 8 WCTV and at the city's website at wayzata.org. Public comments during the public forum and or public hearing portions of the meeting may be provided in person at the meeting, in advance, or by logging into the Teams call and raising your hand during the public hearing. When your name is called in the meeting, you will be seen in our council chambers and the cable channel. You will be asked to unmute and then you may begin your comments. All public comments should include your name and group that you're representing and you will need to have your camera on. the Next on our agenda is the Pledge of Allegiance. I would ask you to stand if you are able and follow along. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Thank you very much. Uh next on our agenda is our roll call. Let the record reflect that we have one excused absence this evening, Mr. Alex Plechash, and the balance of the council is present. Um earlier this evening, the council participated in a workshop and discussed the following items. An update from our recruiting firm MGT on the city manager recruitment process and then we had a discussion of our uh a a request from a group of residents on a downtown beautification effort. Um and then as we always do in workshop, discuss future discussion topics for workshop. With that, uh the next item on the agenda is to approve the agenda. Uh may I have a motion to approve the agenda as is or does anyone want to make any changes? I'll make that motion, Mr. Mayor. Great. Could I have a second? Second. All in favor, say I. I. Again, we ask our cameras to be turned on if you choose to do that. Before I get to that, I wanted to address the following. Um as federal immigration enforcement activities across the metro and around the state of Minnesota continues, earlier today, the city of Wayzata and Wayzata Police Departments released a statement that will I will make part of the record of tonight's meeting. I'm going to read the statement. The city of Wayzata is aware of recent federal law enforcement activity by the Department of Homeland Security DHS within our community. We want to ensure our residents understand the Wayzata Police Department's role and responsibilities. The Wayzata Police Department enforces only Minnesota state law and the city of Wayzata and the city of Long Lake ordinances as we cover Long Lake with our police as well as Wayzata. The department does not enforce federal immigration law, does not inquire about immigration status, and does not collect that information. Enforcement of federal immigration law is conducted exclusively by federal agencies. Wayzata police do not participate in or collaborate with federal agencies on immigration enforcement. The department is not notified in advance of federal immigration enforcement activity and has no authority to direct, control, or interfere with federal agencies carrying out their lawful duties. The Wayzata Police Department's primary responsibility is protecting public safety and the well-being of all individuals within the city. If Wayzata police are called to respond to a disturbance or enforcement activity, their role is limited to de-escalation and safety, not immigration enforcement. The city remains committed to serving our residents, maintaining public safety, and supporting our community. We want all residents, businesses, and visitors to feel safe in our city when contacting law enforcement. If you witness immigration enforcement, we ask you to stay safe, remain peaceful, and follow the instructions of Wayzata police officers if present as they seek to keep everyone safe. For reference, the statement is available on the city website at wayzata.org and on the city and Wayzata police social media. That was released earlier today. Uh that concludes the statement. I have a couple closing remarks. Um for the record, there have been reports of federal immigration activity in the city of Wayzata for several weeks now. The chief of police, the city manager, and I, the mayor, have been directly involved in working with impacted stakeholders, including local businesses, to address concerns that were brought to our attention. So, I wanted that to noted for the record that even though we released a statement today, we've been directly engaged for several weeks now. We recognize the impact and questions and concerns of many. Unfortunately, to this point, there have been no magnified issues associated with these federal immigration activities in Wayzata. However, due to the ongoing nature of the situation, city leadership, inclusive of the City Council, wanted to provide guidance on the role of the city of Wayzata and Wayzata Police Department to our residents and businesses. Um and with that, I'll offer any additional comments from the council or from city manager. Hearing none, um so we'll move on to the public forum. Do we have any cards or anyone on Teams? Mr. Mayor, we do not. Okay. So, um I'll just close with this. You know, we do recognize that federal immigration activities are impacting a broad set of stakeholders in our community. We are always here to listen to your concerns and we remain committed to listening to those impacted, both now and in the future. And if appropriate, we'll adjust our approach and communication as the situation evolves. Thank you. Moving on to new agenda items. Uh thank you for allowing me to do that this evening. Uh on our consent agenda tonight are is the following. Approval of the City Council regular meeting minutes of January 6th, 2026. Approval of the check register. Approval of municipal licenses. Receipt of the police activity report. Receipt of the building activity report. Approval of the City of Woodland fire protection services uh for uh January 26, January 1st, 2026 through December 31st, 2026. Approval of community room and cable TV studio use agreement with Lake Minnetonka Conservation District for 2026. Approval of the second reading and adoption of ordinance 855 authorizing the issuance of general obligation equipment certificates for the fire department ladder truck. Approval of a settlement agreement and release with Dray Trustee LLC. And approval of a dedication of a tree and plaque in celebration of the 250th anniversary of the United States of America. Uh we have no items for the public hearing tonight, so we'll pass uh pass that item, which is eight, and move on to new business. We have only one new business item tonight, which is consider adoption of resolution 05 2026 approving the development agreement and final plat for 565 Ferndale Road West. I will turn that over to city manager and our city uh community planner, I believe. >> I'll just turn it over to community development director Sharp. Okay. Thank you, Mr. Sharp. Thank you, interim city manager, council. As stated, this is a final plat for Ferndale Bluff and development agreement action before you this evening. The action requested by staff uh and recommended by staff is that the council adopt resolution 05 2026 approving the development agreement and final plat for Ferndale Bluff. Traditionally, final plats are on the consent and development agreements are on the consent agenda for City Council. However, this one's a little bit different as we conditioned their preliminary plat with some changes to allowing flexibility in the roadway width. One of those conditions also included they resubmit their preliminary plat, which they have done so and is included in your packet and is before you on the screen. So, in the air of transparency, we wanted to make sure that we had this uh presented before council, open before uh the public uh just because revised preliminary plats are slightly more uncommon. And so, we wanted to move through that uh procedurally. The pre- preliminary plat consists of three different lots and two outlots, which are identified. The final plat uh same diagram only uh in this instance, apologies. Uh the Apologies, the the screen's uh coming up through me for a moment. I've identified the three different lots and then uh contained within your packet is a agreement which also combines two of the outlots to two of the single-family lots. So, you can see that they are color-coded and north is to the left side of the screen. The proposed motion this evening is to adopt resolution 05-2026 approving the development agreement and final plat for 565 Ferndale Road Rest West. I would also like to note that the uh applicant has filed a notice of dispute over the proposed uh park dedication fee, which is before you at on the table this evening and will be resolved at a later time. With that, I stand for questions. Uh questions of staff at this time. Hearing none, um I guess uh I would accept uh a motion to adopt resolution 05-2026 approving the development agreement and final plat for 565 Ferndale Road West, but also noting the notice of objection from the applicant uh related to park dedication fees and directing staff to work with the applicant to resolve that matter. Uh we've motioned and seconded an adoption of resolution 05-2026 approving the development agreement and final plat for 565 Ferndale West, also noting that there was a notice of uh objection or notice of dispute uh by the applicant related to park dedication fees and we're working uh directing our staff to work with the applicant to resolve that matter. Um next on the agenda is the uh city manager's report and discussion item. Uh Ms. Yeager. Uh thank you, Mayor and council. I just have a few updates um for the council and the listening audience. Um the first I wanted to report that the Klapprich Park opening celebration was this past Saturday, and there were a lot of people out in the park enjoying the skating, checking out um the new park features despite the cold temperatures. So, I just wanted to say thank you to the Parks and Trails Board for helping plan that event, being there in the community for showing up. Uh the next thing I want to call out is that in February, our council meetings are off-cycle. There's a precinct caucus on February 3rd, so our regular council meetings will be on February 10th and February 24th. So, those are off a week. And last, I want to highlight but um cuz this is the last meeting before um the Chili Open is that the Chili Open will be coming to town again this year on Saturday, February 7th. I believe they do still have tickets available. Um I believe programming starts with snowga snow yoga at 9:00 a.m. Tee times starting as early as 10:00 a.m. There's some live music, a chili cook-off, um and whatnot. But, if folks are interested in learning more about what events are offered at what times or if you have yet to sign up and want to, go to wayzatawestmetrochamber.com to look up more information about that upcoming event.
