Appeal of Administrative Denial for Massage Establishment License

4-0 Unanimously Passed

Dissent: None

Moved by Mayor Roe [00:32:51] · Seconded by Councilmember Groff [00:33:14]

The council, acting as the Board of Adjustments and Appeals, heard an appeal against the administrative denial of a massage establishment license and two individual therapist licenses. Staff cited inconsistencies in application information (work history, residential addresses, business names, alleged unlicensed work) as grounds for denial, hinting at fraud. The applicants, through an interpreter and representative, attributed errors to language barriers and misunderstandings, denying any intent to defraud. They also revealed ongoing issues with securing a lease for the proposed establishment, leading to a desire to withdraw the application if the 'denial on the basis of fraud' could be expunged from their record. Council members expressed concerns about the process's clarity and the strong implication of fraud in the denial reason, preferring to grant the appeal without immediately approving the license.

Vacation of a Portion of a Utility Easement on Wheeler Street

4-0 Unanimously Approved

Dissent: None

Moved by Councilmember Schroeder [00:51:33] · Seconded by Councilmember Graff [00:51:34]

The council considered a petition from the property owner at 2870 Wheeler Street to vacate the north 4 feet of a 15-foot utility easement. The Public Works Director, Jesse Frihammer, recommended approval, stating that the remaining 11-foot easement would be sufficient for the 12-inch storm sewer pipe. The applicant explained the need arose from a garage addition that encroached due to the home's original placement on the lot. The public hearing drew no comments.

Kraus-Anderson and LHB Architects presented the 90% construction documents for the Maintenance Operations Center (MOC) and Veterans Park project. They detailed the design of the North and South MOC facilities, including sustainability features like solar array reinstallation and stormwater collection. The budget estimate is $62.1 million, which is $2.1 million under the project's $64.2 million revenue. The schedule outlines bidding in late October/November, contract award in mid-December, and construction in phases from summer 2027 to late 2029. Council discussed the possibility of a future expansion phase based on bid results and market conditions. A public commenter raised concerns about the construction manager at risk process and vehicle bay design.

whereas the city of Roseville is located on land obtained through a broken treaty that was the Excuse [clears throat] me, that was the first home of the Dakota and Ojibwe people and where many continue to reside and whereas the city of Roseville recognizes that this treaty entitled non-Native people to live and work on traditional Native lands and whereas despite centuries-long and ongoing erasure of indigenous people from American history and unjust federal policies of assimilation and termination that ripped children from their families, Native American people have persevered

Massage establishments are a regulated industry because in many cities licensed or non-compliant operations have been associated with some type of illegal activity or they may not meet um, health, safety, or professional standards. So, ensuring the accuracy of this information provided on the application helps the city confirm that the establishment is legitimate and operating within the expectations of the ordinance.

I think they would like to withdraw their application, but they don't want to do that until they've had a chance to try to get this denial overturned, because they're going to be asked in the next city, 'Have you ever been denied?' And what are they going to say? They're going to have to say, 'Yes.' If that's indeed what happens. What we would like, in all fairness, is to just be able to say goodbye to Roseville, and say we tried, we're sorry, whatever reason, you didn't want us to be here.

I certainly would prefer not to have the outcome of this evening be a denial on the basis of fraud because it doesn't appear to to be the case.

We have met fairly often this year. There seemed to be more um meeting business for us to handle. We updated our rules and procedures this year to make sure that they were up to state code and Roseville City code, I guess. We um have approved what eight officers, two sergeants, and one commander.

So, and it sounds like we still do have those four openings. And so, uh let's get the word out there and hopefully we can get those filled as soon as possible and get those folks on the street.

The city would still have an 11-ft easement. We just have a uh small diameter storm sewer pipe that serves it. So, uh staff is supportive of this easement as we still have adequate um with and and capability to replace that pipe if we need to in the future.

this property is a little bit unique in that the home was actually moved onto the property and when it was set it wasn't quite square set square on the lot and so in the process of the addition it was discovered that it encroached somewhat into that easement

So, you'll see how that reflects in that estimate where there's there's no longer anything underneath that parking lot, and then those costs then are spread out through the MOC north and south. Uh the next major item was the construction restoration of the park. Um you will see that number did go up slightly.

we call a guaranteed maximum price. That then would really set that contract amount for the project. And that's what it we would be at risk for, um that we would be responsible for bringing the project in at or below that number. Um unless there's any, again, council or ownership changes that are added scope of work type items.

Yes, um as I said all along, I've been very supportive of the MOC and I'm very excited that we're actually going to get this started uh before I end uh my terms.

I think really address the challenges we have. They also address the the challenges maybe that the council put for- forth and into the process in terms of um What's the word I'm looking for? Fitting into the neighborhood in multiple ways, whether it's visually, whether it's looking at sound, whether it's you know, looking at all those aspects of integrating into both our site as well as the surrounding area.
