The Aldine Street right-of-way (ROW) was established in 1938 as part of the Mid Oaks Plat, with
legal
description The portion of Aldine Street that lies adjacent to 77 Mid Oaks Lane, 85 Mid
Oaks27 Lane, 87 Mid Oaks Lane, 89 Mid Oaks Lane, 91 Mid Oaks Lane, and 93 Mid Oaks28 Lane
in the plat of Mid Oaks. The planned road segment was never built, and the City has no current or
future plans to build a road. In fact, City staff identified this ROW back in 2022 as one of many
ROW no longer necessary for public benefit, so the City proposed it for vacation (Figure ·1 ).
The City Council had the opportunity to take action regarding the ROW at its June 16, 2025,
meeting. The City Council did not vote in favor of the proposal to vacate the ROW, which required
a supermajority vote to approve. Staff presented an alternative option: direct City staff to add the
segment to the City of Roseville Pathway Master Plan. The City Council did not take this action,
nor did it direct staff to take any other action to delineate a public benefit of the ROW segment.
The June 16 City Council vote completed the city-initiated ROW vacation process.
For the June 16 meeting, City staff prepared a feasibility memo regarding the potential for path
installation
in the ROW. The staff memo provided various facts, including the following:
•
This segment is not in the Pathway Plan.
•
Because there are existing paths along both Fairview and Snelling, Pathway Plan path
spacing goals are already met.
•
Constructing a path that meets Pathway Plan standards would remove dozens of mature
trees and could harm remaining trees.
•
Preliminary cost estimates for path construction range up to $177,00, excluding costs for
required enhancements to create a sate crossing at Roselawn.
•
The segment scored very low (7 in a range of 5-25), placing it 71-75 in a list of 79 an
ordered list of rankings. The score was calculated by City staff using the Pathway Plan
ranking criteria and process.
Owners of all 8 abutting properties are in favor of this ROW vacation request and signed the
Petition for Vacation. As noted in the staff memo, ROW vacation would help with confusion and
disagreements over how the right-of-way area should be maintained with regard to vegetation
control and debris management. We abutting property owners would appreciate clarity regarding
use of and responsibilities for the segment.
Using the City's own plans, processes, and criteria, this ROW segment is not needed for City
purposes. We therefore petition the City through this owner-initiated request to vacate the Aldine
ROW, retaining utility easements (Figure 2).

## Vacation of Right-of-Ways Pursuant to Minnesota Statute
§ 412.851
## A.
Mayor calls the meeting to order and announces the purpose of the meeting and format
for the hearing. "This is a public hearing to consider whether to vacate public
easements and right of ways.”
“This vacation re
quest was initiated by a petition from adjacent property owns. The Council
will consider resolutions to approve vacating the rights-of-way as described in the
resolution."
## THE FOLLOWING AGENDA CAN BE USED AS THE FORMAT FOR THE PUBLIC
## HEARING:
B.City Manager comments including, brief description of proposed vacated easement,
published and mailed notices, and written objections to the proposed vacation.
It is suggested th
at the City Manager should make a general comment regarding the published and
mailed notices. This should include the following language:
"Published and legal mailed notices have been provided for this public hearing. Legal notices
appeared in the city's legal newspaper, The Pioneer Press, on May 25 and June 1, 2026.
## Mailed
notices were sent on May 28, 2026. A ffidavits of p ublishing and mailing are available in the office
of the City Engineer."
Prior to the hearing proceeding, the City Manager should read all written objections for the
propos
ed resolutions.
C.City Engineer by this time has provided specific information for vacations including a
description and proposed resolution.

Mayor opens hearing to the public. It is suggested that the following comments be made by the
## Mayor:
"In an attempt to provide everyone an opportunity to be heard and yet conduct the hearing in an
efficient manner, we would suggest that rules be used for the hearing for this project. These
would include the following:
1.Individuals should identify themselves by giving their name and address and should speak
into the microphone.
2.
Each speaker will be allowed to speak only one time and should limit questions and
comments to three minutes.
3.
Be courteous. No comments from audience or applause during question/ comment period.”

## Dear Councilmembers,
I'm writing to convey by opposition to the city building a trail
between Ryan and Roselawn. The project will clearly harm the
old growth trees in the area. The feasibility report by Dana
Schumacher clearly shows the loss section 3.3.1 and Appendix
D. It is imperative that Roseville keep as much as it's old growth
canopy as possible.
I have no opinion on whether or not the right of way should be
vacated.

## RE: ALDINE STREET RIGHT-OF-WAY TRAIL FEASIBILITY STUDY
Thank you for taking the time and effort to review my comments regarding the Aldine ROW trail
proposal which has the potential to have a significant impact on my adjacent property use, enjoyment,
and monetary value. I read the TRAIL FEASIBILITY STUDY and found the arborist's work in Section
3 thorough and revealing.
## FEASIBILITY STUDY SECTION 3. Tree Study
The arborist's rating of tree quality is consistent with our observations in that the trees in the ROW are
mostly in good or very good condition (Appendix D). Further we have observed that the trees on the
adjacent lots are also in very good condition. Appendix D also shows the existing quality of each ROW
tree and the quality expected after construction damage. Every living Oak tree shows significant
reduction in quality and health due to the proposed construction in either option.
The arborist's analysis in Section 3.3.1 (page 5) also raises red flags for this proposal.
1.From Paragraph 2, "Even a single pass from heavy equipment within the critical root zone (CRZ)
can initiate a cycle of long-term decline."
2.It also points out in paragraph 4 that disease from damage to one tree's roots, stems, or trunk can
be communicated to adjacent trees via extensive roots and infect and kill an entire stand.
3.Paragraph 5 states that either of the two construction options/methods included in the study "is
likely to adversely affect the long-term health of the trees."
Alarmingly, the above findings together suggest that this work could initiate Oak Wilt killing of oaks in
the ROW and transfer Oak Wilt across entire stands of oak throughout the Mid Oaks neighborhood.
The question I heard from the City Council to initiate the study was: is there an ACA compliant pathway
through the ROW that would avoid loss of trees? Clearly the Arborist has answered NO. A very clear
NO. And not just the ROW trees but all the Oak Trees in adjacent lots could be at risk from damage-
initiated disease.
This study makes it clear the risks and costs of this proposed project far outweigh the benefit to the City
at large. It also warns of a potential tragic loss of many of these quality trees inside and ouside of the
ROW. Once these trees are damaged or gone, they cannot be reclaimed.

## a) DISCUSS AND CONSIDER A RECOMMENDATION REGARDING THE ALDINE
## STREET RIGHT OF WAY
Staff provided background information on the Commission’s initial discussion of the Aldine
Street right-of-way (ROW), which took place at the August 7, 2025 Parks and Recreation
meeting. Since that time, the following actions have been completed:
• Several commissioners toured the site.
• Staff prepared site inventories of trees and topography.
• Staff researched accessibility requirements and tree preservation.
Staff emphasized that the Commission’s goal is to work toward an eventual recommendation for
the City Council.
The Commission reviewed the list of questions provided by the City Council, noting that not all
questions need to (or can) be answered immediately. These questions include:
• Should the ROW become a park trail?
• Does it provide recreational value?
• How many trees impacted/removed?
• Detailed impacts on vegetation and trees?
• Neighborhood engagement process?
• Use Park Dedication funds?
• Does a 30-foot-wide park make sense in Roseville?
Staff presented the results of the site analysis, which included the following findings:
• 57 inventoried trees, including 24 with a trunk diameter greater than 10” DBH (Diameter
at Breast Height, the standard measurement).
• 7 large oaks measuring over 20” DBH.
• 8 invasive green ash trees (estimated removal cost: $3,000–$5,000).
• Ground cover primarily consists of invasive buckthorn.
• Encroachments reduce overall accessibility.
• The right-of-way is located near several homes, with one as close as 18 feet.
• Preliminary Analysis: Informal trail routes appear possible with limited impact.
Because the right-of-way would serve as a community connective trail, it must comply with
PROWAG (Public Rights-of-Way Accessibility Guidelines) standards, which include:

Executive summary
Title: Willow Pond Maintenance EAW findings of fact and record of decision
Recommended action: Motion to adopt Resolution certifying the environmental assessment
worksheet (EAW) as an adequate examination of the environmental impacts and accepting the
record of decision, declaring no need for an environmental impact statement for the Willow
Pond Maintenance project.
Policy consideration: Does the findings of fact and record of decision for the EAW satisfy the
requirements for making a negative declaration regarding the need for an environmental
impact statement (EIS)?
Summary: Staff requests adoption of findings regarding the EAW for the Willow Pond
Maintenance project, located north of County Road B2 West, east of Hamline Ave North, south
of Brooks Avenue West, and west of Dunlap Street North. The EAW was distributed for public
comment via the city website, a news release, and the Environmental Quality Board (EQB)
Monitor on March 31, 2026.
The EAW examined the potential environmental impacts of the proposed project. Projects
determined to have the potential for significant environmental effects must do further
environmental review, in the form of an environmental impact statement (EIS).
The city received comments from three agencies ( Minnesota Pollution Control Agency,
Metropolitan Council, and Department of Natural Resources) and no public comments during
the comment period. The comments and responses are included in the attached findings of fact
and record of decision document (Exhibit A to the Resolution). Responses will be sent to the
individual commenters following the city council’s record of decision in accordance with
Minnesota Rules.
Review of the EAW is complete. City staff find that the Willow Pond Maintenance project does
not have the potential for significant environmental effects and does not warrant an EIS.

## Executive Summary
This feasibility study provides a summary of work completed by TKDA for the City of Roseville at the Aldine
Street Right of Way located between Ryan Avenue and Roselawn Avenue in Roseville, MN. The purpose of
the study was to review existing conditions and determine an accessible route to link Ryan Avenue to
Roselawn Avenue that would meander through an existing woodland space with the main priority to protect
and preserve the heritage oaks.
TKDA considered the existing conditions and 2 options as follows:
Option 1: Install raised boardwalks on spread pan supports under oak trees’ critical root zone areas
and stabilized gravel paths outside of these areas.
Option 2: Install stabilized gravel paths along the entire length of the path alignment.
Option 1 is the recommended solution because it preserves the majority of the heritage oak trees with
minimal to moderate impact while also providing an accessible route through the site.
Option 2 may provide an accessible route through the right of way and is less expensive than Option 1.
However, it will have extremely negative impacts on the oak trees that would decline within 5-10 years if this
option is advanced.

It was infonnally suggested that there may be room for a creative third option: the
neighborhood working together to create and maintain an info1mal path in the right-of-way,
perhaps a wood chip path that winds around the few trees at the south end. Toward this option
and as a staiiing point, we are asking the city to fo1mally smvey the remaining right-of-way,
so that it is clear what land is and is not included in the right-of-way.

been created by this process. I get it's complicated and the easy answer is to just vacate the
ROW and move on, but this trail is one of the things that makes this neighborhood special and
stand out from any other neighborhood in town. Below I have a handful of thoughts and ideas
I'd like you to consider and direct staff to bring back for discussion.
The City needs to conduct a survey of this ROW. Where is the path, where are the
fences, sheds, big trees, etc.? That's the first step to make a decision about the future of
this path.
The comment at the meeting after both votes failed was that status quo remains. But
that's not the case because the western portion of this trail is more than likely on private
property as the western 20ft of ROW were given back to the properties to the west.
Now you have residents knowingly or unknowingly walking on private property along
this trail. The status quo for the past 50 years is most likely gone. Again, a survey
should be conducted.
The western 20ft of ROW that never was is peculiar. Clearly a mistake by the
forefathers of the City. Mistakes happen. The City never did the correct title work and
installed city infrastructure under private property. The only way for the City to remedy
that is to pursue a prescriptive easement and to pay the market rate for that easement
after an appraisal. I believe when you are pursuing this acquisition, you could do the
same for the trail and pay for the path to remain on private property through that
easement. The public has been using this path, similar to the infrastructure underground,
for over 50 years and likely has a legal right to continue to use the path. Shouldn't be too
heavy of lift since the City will already be pursuing this for the underground
infrastructure. If the City does pursue this, I'd suggest they adequately delineate the
path to ensure people don't walk on private property. A low split rail fence should be
sufficient.
The other option is to reroute a path on the 30ft ROW. I think you have a willing group
of volunteers that would clear buckthorn, weed trees, etc. to make a new path. This is
my assumption. I'm sure the neighbors would take any help the City public works staff
would give them as well. A day or two by them would clear it pretty quick. Prime the

he Public Works Department reviewed the proposed plan and plans for the project noted above
and offer the following comments with regard to the project’s impact on City services and/or
infrastructure:
1.Site Plan
oThe proposed development did not require a traffic study per the City policy.
Additionally, the area has had prior traffic studies performed and review of those
studies confirmed that a study is not needed. A minor increase to traffic on Centre
Pointe and other nearby roads is expected but will not create any significant
issues.
oIf setbacks, easements, or lot sizes change, the changes will need additional
review.
oPublic Works appreciates that comments previously provided regarding driveway,
parking, and sidewalks have been addressed.
2.Utilities
oWater
Watermain is available for connections
MDH Water Permit may be required.
oSanitary
Sanitary sewer main is available for connections.
If the new buildings will have commercial kitchens, be aware that the City
has a FOG ordinance that requires a 1000 gallon grease interceptor.
oStorm Sewer
The development has to meet city, Rice Creek Watershed District, and
NPDES stormwater and erosion control standards.
Any onsite stormwater BMP will require an executed Operation &
Maintenance Agreement in favor of the City of Roseville that has been
recorded with Ramsey County. The template agreement can be found at
www.cityofroseville.com/privatebmp.
3.Ramsey County

o A County review of construction plans and a County Right-of-Way (ROW) permit
may be required.
o The existing Cleveland ROW meets or exceeds the County’s requirements noted
in the 2019 Approved Major Street Plan.
4. General
o Final construction plans will be approved by the City prior to issuing permits.

Councilmember Strahan recognized the Parks Department and all the great work

## Consider Approval of Aldine ROW Vacation
Public Works Director Jesse Freihammer briefly highlighted this item as detailed
in the Request for Council Action and related attachments dated July 21, 2025.
Mr. Freihammer submitted the petition to vacate part of Aldine Street's right-of
way. Residents initiated the petition due to the low priority given to the pathway
and the associated environmental and financial costs of building an ADA
accessible path. He explained the history of the right-of-way, the survey results,
and the potential costs of constrncting a city path.
He mentioned that the council
was asked to either approve the vacation or to retain the right-of-way and designate
it as a public pathway.
City Attorney Tierney submitted a memo on the legal issues of designating
dedicated right-of-way as parkland without a specific transportation connection.
Mayor Roe thanked Mr. Freihammer for the presentation. He also expressed
appreciation to Attorney Tierney for the memo, as he believed that after the last

## Consider Approval of Aldine ROW Vacation
Public Works Director Jesse Freihammer briefly highlighted this item as detailed
in the Request For Council Action and related attachments dated June 16, 2025.
Mr. Freihammer provided background on the Aldine right-of-way vacation, noting
that the city owns only the eastern 30 feet of the right-of-way. He explained that
the feasibility report indicated constructing a pathway would impact numerous trees
and cost between $84,000 and $177,000.
Councilmember Groff asked whether city staff had been going through Roseville
to identify pieces ofland that have not been used or connected, and that the Council
has been initiating some of those.
Mr. Freihammer explained that back in 2022, the staff submitted a list to the council
of properties the city wanted to vacate, and this right-of-way was included on that
list. This marked the fifth phase of right-of-way vacations brought back for review.
Councilmember Groff explained that when this item was first presented, the city
was unaware of the pathway.
