PL 2026-067: Variance Request for Required 300ft Lot Width (Walter Family Trust)
Dissent: None
Moved by Commissioner Huber [0:13:20] · Seconded by Commissioner Holden [0:13:35]
Marty Schmidt presented staff's support for the variance and related rezoning, emphasizing compliance with the 2040 Comprehensive Plan by creating a larger, single 14.76-acre lot from cluster-style parcels. This action increases lot width from 150 ft to 216 ft, despite still being less than the 300 ft minimum for RR1, and offers more flexibility for home placement. Discussion clarified the applicant's intent to sell the property with more options for home locations, not to build immediately, and that the change would not negatively impact future development potential or access to Balsa Avenue. Cedar Lake Township made no recommendation, deferring to the county.
2026-066: Rezoning Request from Rural Residential Reserve Cluster (RR-1C) to Rural Residential Reserve (RR1-1) for Walter Family Trust
Dissent: None
Moved by Commissioner Watson [0:22:00] · Seconded by Commissioner Huber [0:22:05]
This item, related to the variance approved earlier by the Board of Adjustment, was presented on the Planning Advisory Commission's consent agenda. There was no separate discussion, only a clarification that it was the same property previously discussed.
2026-064: Rezoning 5 Acres from RR1 Rural Residential Reserve District to RR2 Rural Residential Single Family District (BB Miseri)
Dissent: None
Moved by Commissioner Watson [0:41:25] · Seconded by Commissioner Robbins [0:41:35]
Greg Wagner presented the request for BB Miseri to rezone the northern 5 acres of a 10-acre parcel to RR2, allowing a 2.5-acre minimum lot for a future home. The southern 5 acres will remain RR1 and be sold to a neighbor for horse pasture, continuing an existing lease arrangement. A resident to the west raised concerns about the proposed primary septic site being too close to their property line, potentially affecting berry bushes and tree tapping, and issues with flooding in the southern part of the field. Staff explained septic setback requirements (10 ft from property line), the engineering review process for soil borings, hydric soils, and topography, assuring proper design and inspection to prevent off-site impact. The township recommended approval.

By reszoning these properties from rural residential reserve cluster to rural residential reserve, we're actually making the properties more compliant with the 2040 comp plan. Um, the 2040 comp plan removed the ability to do cluster style developments like the Walters did back in 2009, preferring the township to develop with 10acre lots and larger rather than these cluster style developments.
I don't believe it's the applicant's intent to build a house. It is their intent to sell the property as a whole with more options for home locations, essentially increasing the value of the property.
Marty, uh the other thing is uh we're supportive of this variance because you're increasing from 150 to 216 ft. I know it's still not 300, but you're still increasing the width on that property.
The request before the commission tonight is to only reszone the northern five acres of the property, which is outlined in blue... following the reszoning, this section here would be sold to the neighbors and attached to their parcel.
My that's one of two concerns that I have is that if the septic is that close to the property line in that location, it may make it that I can no longer eat those berries or tap the trees from worry of anything coming from a drain field from the septic. The second part which might be a bigger concern at least to the owner is this whole field especially the the southern part of this which ... floods about every two to three years.
My understanding is the intent of a setback for a a septic system is to kind of do what you just said to confine that waste water into an area to have it infiltrate into the ground... the intent of a septic system is to treat that and have that waste water infiltrate down, not spill onto adjacent properties.
