Resolution Number 2026-225: Certifying Final Approved Appraise Values and Authorizing Acquisition by Eminent Domain Proceedings

Motion to amend carries; Amended resolution carries

Dissent: Commissioner Beer expressed continued reservations regarding the temporary frontage road, even after the amendment.

Moved by Commissioner Brekke [33:14] · Seconded by Commissioner [33:40]

The item pertains to property acquisitions for the County Highway 17 reconstruction and County Highway 12 at County Highway 17 roundabout project. Several citizens, including Julie Welch, Jim Larson, Luke Jenkins, Jeff Bolt, and Pam Christian Bolt, spoke against the eminent domain process, specifically the inclusion of a 'desired' connection/frontage road. Concerns raised included repeated land takings, safety for children due to a walking path between roadways, potential legal liabilities for the county, alleged misinformation from county staff, and the expenditure of funds on a non-essential road. Staff clarified the project timeline and eminent domain process, including property owner's right to reimbursement for appraisals. An amendment was proposed and passed to remove the specific parcels related to the contentious frontage road for further discussion, while the broader project proceeded.

it's for us. Um it will be a forth taking of our property by Scott County. Um my husband is not here with me today because um he just can't believe that the county is still coming to us to take more of our land.

And so from the perspective of just liability, um you know, I think it's really important to be thinking about what safety protocols are going to be happening, you know, is there going to be crosswalks in there? Is there going to be stop signs? Are there going to be putting a fence uh over by that area where there's that um big grassy field? because you know um if you've seen the billboards with that dude with the long whiskers um or you know the TSR time um we've become an increasingly latgious society.

My wife and I were told by Tony and Adam it's not required. It's a desired connection road northbound only. We have money to spend was that was told last year. Julie made the comment you can return it. You don't have to spend it. Why can't Scott County be part of the solution instead of the problem?

Um, and we do really work hard to try to negotiate with people, make modifications to designs. Um, sometimes that does include increasing our offer. We get an appraisal and I'm not an appraisal expert so whatever comps they use but we hire an expert to tell us what they feel like the taking is worth and we make that offer based on that and then we do negotiate to try to meet people in the middle.

It's uh I just feel like this particular area of land is sort of in flux to some extent. You know, maybe it's not 10 years, maybe it's not 20 years, but it could be. And so the need I just I'm still not fully understanding the need for that particular temporary piece. I know that sort of came out of some open houses, which I thought was great that we had these open houses and you were taking spears then. Um but you're standing there and like answering and I was there. We were all I think there um the reasons for some of these roundabouts like somebody, you know, we we want to be about safety. I do I do believe that we we want to be about safety. I think that was articulated for the folks that had heartfelt conversations today and we heard them at the open houses. So, I don't think anyone's debating that. Uh, it's just for me the temporary I think we've called a temporary frontage road um for maybe a future road through when development warrants um which like I'm I'm good with that. Uh it's just this temporary nature. I don't like spending money that's necessarily temporary.
